GENERAL SALES CONDITIONS
1) The price indicated on the price-list are meant ex-works in Parma.
2) Shipments are made according to the availability in stock, and we guarantee the maximum promptness of the shipment
of the order. In case of a delayed shipment, the Customer is not entiled to stop the payments which are about to be
made.
3) All expenses of transport, packaging and Post are charged to the purchaser.
4) Goods are shipped at the purchaser’s risk. We hereby disclaim any responsibility for possible delays, breakages,
tamperings and thefts of the parcels. After eight days from the receiving of the goods no claim is admitted.
5) The return of the goods will not be accepted, without our previous consent. In any case the Customer is debited with
restoration, examination and storage expenses.
6) The payment if not otherwise agreed should be cash on delivery.
7) In case of a delayed payment, moratorium interests ex D.lgs. 231/2002 will be calculated after the expiration date. A
non-payment will imply the debit of all the expenses.
8) Our firm guarantees the excellent quality of the products and undertakes to replace only the material which should be
defective owing to production deficiencies. Compensation for any possible damage is however excluded.
9) The pictures and dimensions indicated in this catalogue are approximate. The models can be subjected to slight
changes or variations without obligation to give notice on our part.
10) For any possible disputes, Parma court is chosen as the place of jurisdiction.

CONDICIONES GENERALES DE VENTA
1) El precio indicado en el listado se entiende la mercancía franca en nuestro establecimiento.
2) Las expediciones serán servidas según las disponibilidades de almacén, garantizando la máxima prontitud en los
trámites de salida de los pedidos. En caso de retraso de la expedición el cliente no está autorizado a suspender los
pagos en cursos.
3) Todos los gastos de transporte, embalajes y postales son con cargo exclusivo del comitente.
4) La mercancía viaja a riesgo y peligro del comitente sin nuestra responsabilidad por eventuales retrasos, roturas o robo
del paquete. Transcurridos ocho dias del recibo de la mercancía no se aceptan reclamaciones.
5) No vendrá aceptada mercancía en sustitución sin previa conformidad de la Empresa. En cada caso los gastos de
restablecimiento, control y almacenaje son por cuenta del cliente al coste.
6) Los pagos salvo acuerdo pactado se entienden contra reembolso.
7) Por el retraso en los pagos en la fecha de vencimiento acordada serán aplicados a partir del día sucesivo a aquel en
que se debió efectuar el pago, intereses moratorios iguales ex D.lgs. 231/2002. La falta de pago supondrá además el
cargo de todos los gastos relativos soportados.
8) La Empresa garantiza la óptima calidad de los productos y se empeña en sustituir solo el material que resulta
defectuoso por carencia productiva. Esta expresamente excluido el resarcimiento de cualquier eventual daño.
9) Las ilustraciones y las medidas de nuestros productos se entienden aproximadas, pudiendo los modelos sufrir leves
modificaciones o variaciones sin obligación de preaviso por parte de la Empresa.
10) Para cualquier controversia Foro competente PARMA.

ALLGEMEINE VERKAUFSBEDINGUNGEN
1) Die Preise verstehen sich ab Werk in Parma.
2) Die lieferlungen abhängt von Verfügbarkeit des Warenlager, im fall der verzögerten Lieferung hat der Kunde nicht das
Recht laufende Zahlungen einzustellen.
3) Die Transportkosten, Verpackung und postlisch fallen zu Lasten des Auftraggebers.
4) Die Ware reist auf Gefahr des Auftraggebers. Wir lehnen jegliche Verantwortung für eventuelle Verspätungen der Post,
Schäden, Aufbrechen und Diebstähle der Pakete ab. Sind acht Tage nach dem Empfang der Ware vergangen, werden
keine Reklamationen mehr angenommen.
5) Keine Rückerstattung von Waren kann ohne die vorherige Genehmigung der Firma stattfinden. Auf jeden Fall gehen die
Lagerungs- und instandsetzungskosten, sowie die Kosten für die Kontrolle, zu Lasten des Kunden.
6) Die Bezahlungen per Nachnahme erfolgen werden, außer besondere Fallen.
7) Im Fall der verzögerten Zahlung, es wird einen Zinssatz wie den ex D.lgs. 231/2002 auferlegt. Im Fall der fehlenden
Zahlung die Kosten wird belastet.
8) Die Firma Caggiati versichert die ausgezeichnete Qualität der Produkte und verpflichtet sich die Ware, die auf Grund von
Herstellungsmangeln fehlerhaft hervorgeht, zu ersetzen. Schadenersatz für mögliche Schäden ist aber von vornherein
ausgeschlossen.
9) Sowohl die Bilder als auch die Grössen, die in den vorliegenden Katalogen enthalten sind, sind annähernd. Alle Modelle
unterliegen möglichen kleinen Änderungen. Die Firma ist aber keineswegs, den Kunden im voraus davon in Kenntnis zu
setzen.
10) Falls sich Streitigkeiten ergeben, wählen wir Parma als zuständigen Gerichtsstand.
