El pasado 28 de septiembre de 2012, mediante Decreto
publicado en el Diario Oficial de la Federación, se publicó
el Reglamento de la Ley de Migración (en lo sucesivo el
“Reglamento”), entrando en vigor a partir del pasado 12
de noviembre, el cual reglamenta la Ley de Migración
expedida en Mayo de 2011 (en lo sucesivo “Ley”).

documento migratorio pueda ser tramitado por primera
ocasión en las oficinas ahora denominadas Delegaciones
Federales del INM, el solicitante deberá situarse bajo ciertos
supuestos (como la preservación de la unidad familiar o
de oferta de empleo, entre otros) para los demás casos,
primeramente se debe tramitar en la oficina consular
respectiva (en el extranjero) una visa que permitirá la
internación del extranjero a México, y una vez autorizado
su ingreso, deberá solicitar el canje del documento que
expidió la oficina consular, por el documento migratorio
correspondiente ante el INM, dentro del término otorgado
por la autoridad.
One of the more transcendent changes is that, previously,
the first application for the migratory document
(commonly known as FM2 and FM3), indistinctly of the
person´s status, was processed in the Regional Delegations
of the National Institute of Migration (hereinafter the
“INM” for its Spanish acronym), and now, in order to
apply for a migratory document for the first time in the
offices now denominated as Federal Delegations of the INM,
the applicant shall fall under certain assumptions (such as
the preservation of the family unit or job offers, among
others). For the other cases, one must first apply in the
respective consulate office (home country) for a visa that
will allow your admission into Mexico from a foreign
country, and once authorized to enter, shall solicit to
exchange the document issued by the consulate office for
the migratory document corresponding to the INM, within
the term given by the authority.

Federal Official Gazette, the Rules and Regulations of the
Immigration
Law
was
published
(hereinafter
the
“Regulation”), entering into force last November 12,
which regulates the Immigration Law issued on May of
2011 (hereinafter the “Law”).

Los Visitantes (turistas), no podrán cambiar de condición
de estancia una vez que hayan ingresado a México
(cambiar su situación de visitante/turista a residente), ya
que deberán sujetarse a lo que establece el párrafo anterior
y tendrán que salir del país al concluir el periodo de
permanencia autorizado, con algunas excepciones que
establece el Reglamento como son las razones
humanitarias, por citar un ejemplo.
The Visitors (tourists), will not be able to change their
status once having entered Mexico (change one´s status
from visitor/tourist to resident), since they will have to
follow the process established in the previous paragraph
and will have to leave the country once the authorized
staying period has concluded, with some exceptions that
the Regulation establishes such as for humanitarian
reasons.
Con la entrada en vigor de este Reglamento desaparece el
término de las calidades migratorias de No Inmigrante
(FM3) y de Inmigrante (FM2), para ahora ser clasificadas
como condiciones de estancia. De igual manera, en
cuestiones de términos el expediente básico con su
respectivo certificado de empresa, es ahora denominado
constancia de inscripción del empleador.
With this Regulation coming into effect, the term NonImmigrant (FM3) and Immigrant (FM2) of the Immigrant
Status no longer appear, instead are now classified as
conditions of your stay. In a similar fashion, regarding the
term for employers basic file with its respective business
certificate is now denominated proof of employer
registration.
Las ahora condiciones
de estancia simplifican las
calidades y características migratorias que establecía
anteriormente La Ley General de Población (en adelante
“LRLGP”), y su Reglamento (en adelante “RLGP”) de No
Inmigrante, Inmigrante e Inmigrado, ya que ahora el
documento migratorio que emite el INM estará expedido
bajo las condiciones de Visitante o Residente (dentro de
las cuales quedarán comprendidas los documentos
anteriormente denominados FM2 y FM3) , a continuación
se señalan las nuevas denominaciones que el Reglamento
establece:
The now conditions of your stay simplify the Immigrant
Statuses and characteristics of Non-Immigrant, Immigrant
and Immigrado that the General Law on Population
(hereinafter “LRLGP” for its Spanish acronym), and its
Regulation (hereinafter “RLGP” for its Spanish acronym)
previously had established. Since now the migratory
document issued by the INM will be given under
conditions of Visitor or Resident (of which will be
comprised in the documents previously denominated FM2
and FM3). The following points out the new
denominations established by the Regulation:
VISITANTES
VISITORS
 El Visitante sin permiso para realizar actividades
remuneradas se equipara a: la anteriormente
denominada calidad de No Inmigrante (FM3), el cual a
su vez se clasificaba en las características de turista,
transmigrante, visitante distinguido, visitante provisional,
ministro de culto, corresponsal, visitante en la modalidad
persona de negocios, o visitante en todas las demás
modalidades migratorias que no impliquen una actividad
lucrativa cuando la persona extranjera se haya
documentado con FMM con una temporalidad de
hasta 180 días.

Visitor without permission to carry out
remunerated activities it´s the equivalent to: the
previously denominated status of Non-Immigrant
(FM3), which in turn was also classified as a tourist,
transmigrate, distinguished visitor, provisional visitor,
religious minister, correspondent, visitor in the modality of a
businessman, or visitor in any other migratory modalities
that do not imply a lucrative activity when the foreign
person was documented with FMM on a temporary
basis of up to 180 days.
 El Visitante con permiso para realizar
actividades remuneradas será aquel que lleve a cabo
actividades que impliquen una actividad lucrativa
anteriormente No Inmigrante – Actividades lucrativas
(FM3). Esta condición autoriza al extranjero
a
permanecer en territorio nacional por un tiempo
ininterrumpido no mayor a 180 días, contados a partir

activities will be the one that carries out activities which
imply a profitable activity, previously Non-Immigrant –
Profitable Activities (FM3). This condition authorizes
the foreigner to remain in the national territory for an
uninterrupted period of time of no more than 180 days,
starting from the date of entry.

 Visitante regional. Autoriza al extranjero nacional
o residente de los países vecinos para ingresar a las
regiones fronterizas, no incluye permiso para recibir
remuneración en el país.

Regional Visitor. Authorizes a foreign citizen or
resident of the neighboring countries to enter the border
regions, it does not include permission to receive wages
in the country.
 Visitante trabajador fronterizo. Autoriza al
extranjero que sea nacional de los países con los cuales
México comparte límites territoriales y contará con
permiso para trabajar a cambio de una remuneración
en el país.

Guest worker Visitor. Authorizes a foreigner, as
long as he is a citizen of a country that shares Mexico´s
territorial limits, and grants permission to work for
wages in the country.



Visitor for humanitarian purposes.

Visitor for adoption purposes.
Visitante por razones humanitarias.
Visitante con fines de adopción.
RESIDENTES
RESIDENTS

Residente Temporal, serán aquellas personas
extranjeras documentadas con forma migratoria de
No inmigrante (FM3) e Inmigrante (FM2) dentro de
las características que incluía el RLGP de rentista,
inversionista, profesional, cargo de confianza, científico,
técnico, familiar, artista y deportista o asimilado.
Esta condición de estancia autoriza al extranjero para
permanecer en el país por un tiempo no mayor a cuatro
años, mientras que el RLGP permitía que el extranjero
con calidad de No Inmigrante renovara en múltiples
ocasiones su documento migratorio.
Este Reglamento dispone que por el hecho de ser
propietario de bienes raíces o tener una inversión en
México (con valores que se publiquen en el DOF) son
razones suficientes para que el extranjero obtenga un
documento migratorio, así como también podrá ser
autorizado bajo la condición de estancia de Residente
Temporal la persona que tenga vínculo con mexicano o
persona extranjera residente temporal o permanente; tener
oferta de empleo; tener comprobante de Registro Federal
de Contribuyentes (RFC), entre otros supuestos
contemplados por el Reglamento
El documento migratorio (tarjeta) que acredite la
condición de estancia de Residente Temporal podrá tener
una vigencia de uno, dos, tres o cuatro años, contados a
partir de que la persona extranjera obtuvo la autorización
de la condición de estancia, anteriormente la vigencia del
documento migratorio era solo por un año.
MÉXICO CANCÚN

Temporary Resident, will be those documented
foreigners with migratory form Non-Immigrant (FM3)
and Immigrant (FM2) under the characteristics that
included the RLGP of retired, investor, professional,
executive employee, scientists, technician, family member,
artist and athlete or similar.
This condition of stay authorizes a foreigner to remain in
the country for a time period of no more than four years,
while the RLGP allowed foreigners with a NonImmigrant status to renew on multiple occasions their
migratory document.
This Regulation stipulates that if a person is a proprietor
of real estate or has an investment in Mexico (with values
that are published in the Federal Official Gazette), these
are sufficient reasons so that the foreigner may obtain a
migratory document, and may also be authorized under
Temporary Resident staying status any person that has
links to any Mexican or foreign person with temporary or
permanent residency; having a job offer; having a tax ID
(RFC), and among other assumptions considered by the
Regulation.
The migratory document (card) that proves the condition
of your stay as a Temporary Resident will be valid for
one, two, three or four years, starting from the moment
the foreigner obtained the condition of his stay authorized,
previously the term for the migratory document was for
one year only.

Student temporary resident.

Residente permanente, serán aquellas personas
con residencia definitiva (se equipara a la calidad de
Inmigrado).

Permanent resident, will be those persons with a
definitive residency (Inmigrado status will be
acquired).
Esta condición estará sujeta a diferentes supuestos
como tener reconocimiento de la condición de refugiado,
tener vínculo con mexicano o persona extranjera residente
permanente, tener situación regular migratoria por cuatro
años consecutivos (tanto FM3 como FM2), tener situación
migratoria regular por dos años consecutivos como
residente temporal (FM2 o FM3) cuando el extranjero
tenga una relación conyugal o de concubinato con
mexicano o residente permanente, o por tener parentesco
hasta el segundo grado con mexicano de nacimiento, entre
otros supuestos.
This condition will be subject to different assumptions
such as having refugee status recognized, having ties with
a Mexican or a foreign permanent resident, having a
steady migratory situation for four consecutive years
(either as FM3 or FM2), having a steady migratory
situation for two consecutive years as a temporary
resident (FM2 or FM3) when the foreigner has a conjugal
or concubinage relationship with a Mexican or a
permanent resident, or by having kinship in and up to the
second degree with a Mexican by birth, among other
assumptions.
Lo anterior, previo cumplimiento de los requisitos
establecidos en las disposiciones administrativas de
carácter general que emita la Secretaría de Gobernación y
que serán publicadas en el Diario Oficial de la Federación.
The aforementioned, provided its compliance with the
requirements established in the administrative rulings of
general observance issued by the Secretariat of the Interior
and will be published in the Federal Official Gazette.
Otros datos importantes…
Cómputo de Ausencias: Otra ventaja para los extranjeros
derivada de este Reglamento es que, anteriormente el
RLGP fijaba una limitación para aquellos extranjeros que
eran titulares de la calidad de Inmigrante (FM2), estos no
podían ausentarse por más de 18 meses fuera del territorio
nacional, ya sea consecutivos o interrumpidos, durante un
periodo de 5 años, y que en caso de permanecer más del
periodo permitido en el extranjero, el Inmigrante perdía su
calidad migratoria, además de que uno de los requisitos
para poder solicitar la calidad de Inmigrado era cumplir
con el cómputo de ausencias menor a 18 meses. El nuevo
Reglamento de la Ley de Migración suprime esta
limitación y no se realiza un cómputo de ausencias para
obtener la condición de Residente Permanente, es decir,
tanto los Residentes Temporales como los Permanentes
tienen derecho a salidas múltiples.
Other important data…
Absentee computation: Another advantage for foreigners
arising from this Regulation is that, previously the RLGP
would set a limitation for those foreigners that had
Immigrant status (FM2), those would not be able to be
absent for more than 18 months abroad, whether
consecutive or interrupted, during a period of 5 years and
in the event that one stayed longer than that allowed in a
foreign territory, the Immigrant would lose his migratory
status, in addition, one of the requirements for applying to
an Inmigrado status was to fulfill the required absentee
computation of less than 18 months. The new Regulation
for the Immigration Law suppresses this limitation and
an absentee computation is no longer carried out in order
to obtain the Permanent Resident status, in other words,
either the Temporary Residents or the Permanent ones
have the right to exit the country on multiple occasions.

Residente temporal estudiante.
Uno de los cambios más radicales que prevé este
Reglamento, es que los menores de edad o personas bajo
tutela jurídica que viajen con un tercero mayor o viajen
solos, deberán contar con la autorización para salir del
país de las personas que ejercen sobre ellos la patria
potestad o la tutela, otorgada ante fedatario público o
autoridad competente, con las formalidades que exige la

Regulation, is that minors or persons with legal guardians
traveling with other person different from his/her parents
or legal guardians or traveling by themselves shall be
granted authorization to exit the country by their parental
or legal guardians, granted before a notary public or the

En otro orden de ideas, previo a la expedición de este
Reglamento, el extranjero que se encontrare fuera del país
al momento del vencimiento de su documento migratorio
se hacía acreedor de la sanción que contemplaba el
reglamento anterior, ahora la persona extranjera que se
encuentre fuera del territorio nacional al vencimiento del
documento que acredita su condición de estancia no será
sancionado si no rebasa el término que establece el
Reglamento. En caso de que no se respete dicho término
no se permitirá el ingreso al territorio nacional de las
personas extranjeras.
Moreover, prior to the issuance of such Regulation, the
foreigner that would find himself outside the country at
the moment of expiration of the migratory document was
subjected to a fine that adhered to the previous regulation,
now the foreign person that finds himself away from the
national territory at the moment of expiration of the
document that establishes his condition of stay will not be
sanctioned if he doesn’t exceed the term that is established
by the Regulation. In the case that the term is not obeyed,
the reentry of said foreign persons will not be permitted.

Nota: La vigencia de los documentos migratorios, los
términos otorgados por la autoridad, los supuestos de
otorgamiento de condiciones de estancia, etcétera; aquí
establecidos son las reglas generales aplicables, sin
embargo el Reglamento estipula excepciones y
particularidades conforme a la edad del solicitante o
situación específica del extranjero, por lo que cada caso
debe estar sujeto a previa revisión.
