TO THE HONORABLE SUSAN E. GOODSON, ADMINISTRATIVE LAW JUDGE:
COMES NOW Ambit Energy LLC, and files this Response to Order No. 1, and
would respectfully show the following:
RESPONSE TO ORDER NO. I
The customer Nawaid Isa (Isa Cricket Club) enrolled with Ambit Energy on August, 3,
2013. and service began on August 30, 2013. Upon enrollment, the customer selected a
fixed contract for a period of 12- months at a rate of 5.78 kWh. Invoice activity covering
the billing period from 8/30/2013 -12/30/2013 was billed based on actual read data from
Centerpoint Energy.
Ambit's Terms of Service (TOS), informed the customer that the price on the EFL does
not include: non-recurring fees charged by the TDU; Ambit Energy non-recurring fees
noted in the Agreement; ERCOT charges; fees imposed by any government entity and
taxes - all of which appear as separate line items on their bill. Upon acceptance of
Ambit's TOS, the customer agrees to pay all charges unless the agreement is cancelled
or rescinded. Centerpoint's records show that the demand usage for the premise was
recorded at 111 on 10/22/13. For this reason, the customer's account was billed by
Ambit according to Centerpoint's tariff for Secondary Service Greater Than 10 kVa.
Ambit received a drop request on December 23, 2013 The final read transactions were
received from Centerpoint on December 28, 2013, and a final invoice was generated by
Ambit for $2,184.56. This invoice included current and past due charges which remain
outstanding.

Effective September 1, 2013, the TDUs received approval from the
Public Utility Commission of Texas ("PUCT") to increase selected
delivery charges for all residential customers in their service
territories. The PUCT ruled the increases were reasonable and
necessary due to increased energy distribution costs. The change
in delivery charges will result in a per kWh increase based on the
rates listed below. Any back-billed charges will appear with the
description "Delivery Rate Increase" and will be identified by service
period. The PUCT allows the increase on variable and fixed rate
products under rule 25.475(d)(2)(a)(b) and is not considered a
material change to your terms of service with Ambit Energy. AEP

Evacuation Planning: When a hurricane threatens, listen for
instructions from local officials. When they call for an evacuation in
your area, get going without delay.* Discuss evacuation plans with
your family BEFORE hurricane season June 1 -Nov. 30. Make a
checklist of what you need to do before you leave town and review
it.•Monitor NOAA weather radio and local TV and radio broadcasts
during storm season. *Prepare an emergency supply kit including:
radio, flashlight, extra batteries, extra eyeglasses, bottled water,
non-perishable food, dry clothes, bedding, insurance information,
important documents, medications, copies of prescriptions and
special products for babies, the elderly and medically fragile family
members.* Learn evacuation routes before storm season. When
there is a hurricane in the Gulf, keep your gas tank as full as
possible. Expect traffic delays in an evacuation.* Dial 2-1-1 to

Commission of Texas Financing Order to provide annual notification
to customers regarding transition rate charges. These charges are
either included in your rate per kWh, or you may see the charge as
an invoice line item named `Transition Charge." Charges shall not
exceed amounts required to recover qualified costs for the use or
availability of electric services. Notice is hereby given that this
transition rate is owned by a Special Purpose Entity and neither by

Effective October 15th, 2013, Centerpoint received approval from
the Public Utility Commission of Texas ("PUCT") to increase the
Hurricane Ike Restoration Charge and the Hurricane Ike ADFIT
credit for customers in their territory. Charge rate per kWh:
$0.001646. ADFIT Credit rate per kWh: ($0.000420).

EFFECTIVE: SEPTEMBER 15, 2011
The following is your Terms of Service Agreement ("Agreement") with Ambit
Texas, LLC d/b/a Ambit Energy ("Ambit Energy;""we," "our") for the purchase of
electricity service for the plan you selected, as specified in the Electricity Facts
Label ("EFL") and hereby made an integral part of this Agreement along with the
Your Rights As A Customer ("YRAC") document. By enrolling for service with
Ambit Energy, you agree to be bound by this Agreement and the EFL and pay
for the electric service Ambit Energy provides to you under this Agreement and
the EFL. Please retain this Agreement, the YRAC, and the EFL for your records.
Ambit Energy is certified as a Retail Electric Provider ("REP") by the Public
Utility Commission of Texas ("PUCT"), PUCT Certificate #10117. This Agreement
applies only to non-residential customers that have a peak demand of less than
50 kilowatts during any 12-month period, unless the customer's load is part of an
aggregation program whose peak demand is in excess of 50 kilowatts during the
same 12-month period.

PRICING: Your price per kWh for electricity service is listed under the
Electricity Price Section of the EFL. The price on the EFL does not include nonrecurring fees charged by the TDU, Ambit Energy non-recurring fees noted in
this Agreement, ERCOT charges, fees imposed by any government entity, and
taxes, all of which you agree to pay and that will appear as separate line items
on your bill. You are responsible for all federal, state and local taxes and charges.
Non-recurring TDU charges may include, but are not limited to out-of-cycle
meter reads and self-selected switches, disconnection and reconnection fees,
move-in fees, meter tests, meter tampering costs, and broken meter seal repairs.
TDU Surcharge(s) may apply dependent upon your TDU area.

Hours of Operation
SERVICE TERM: Depending on which plan you ("customer") have selected,
your service under this Agreement is provided under either a fixed rate ("term")
product or a variable price ("month to month") product, as specified in the
EFL. The minimum term, if any, for the product you elected to enroll under is
stated in the EFL. If you are a new customer, your term will become effective on
the day your service begins with Ambit Energy, which coincides with the date
your meter is read by your TDU. Because this date is determined by your TDU,
Ambit Energy is not able to commit to a specific date for the commencement
of service. If you are currently an Ambit Energy customer and are switching to
another product, your term will become effective within 24 hours of the request
switch to the new plan.
CONTRACT RENEWAL: For customers on a fixed rate product, upon the
expiration of your term, your service will automatically continue on a monthto-month basis under one of Ambit Energy's variable price products unless
either you or Ambit Energy cancels this Agreement, as specified below in the
Cancellation Rights Section of this Agreement. A contract expiration notice will
be sent to you at least fourteen days prior to the end of your initial contract
term. If you fail to take action to ensure the continued receipt of retail electric
service upon the contract's expiration, you will automatically continue to be
served by Ambit Energy pursuant to a default renewal variable price product on

Customers who have enrolled in a variable price product (month to month
product) are subject to rate adjustments throughout this agreement, but not more
than once per billing cycle. Customers that choose a fixed rate product have a
fixed rate for the term.
NON-RECURRING AMBIT ENERGY FEES. You may also be charged nonrecurring fees for services Ambit Energy provides, which will only be incurred in
limited cases as described below. These charges will be listed as a separate line
item on your bill. The non-recurring Ambit Energy fees listed below do not include
TDU non-recurring charges, which will also appear as separate line items on your
bill. Service Orders. For service activation, standard and expedited move-in
orders are available upon request, Ambit Energy will pass through the move-in
fee charged by your TDU. This fee will appear on your first invoice. Insufficient
Funds. For each transaction not processed due to insufficient funds, including (a)
returned checks, (b) returned electronic fund transfers, and/or (c) rejectedcredit
card transaction, a $25.00 Returned Check or a $25.00 Non-Sufficient Funds
Charge will apply. Processing and Transaction Fees: For payments processed
by an Ambit Energy Customer Care Representative, a $5.00 Payment Processing
Fee may apply. Payments made with credit or debit card may incur a$2,50
transaction fee. Payment Plan Processing Fee. To establish a payment
arrangement, a $20.00 Payment Plan Fee will apply.
RIGHT To RESCIND: If you are switching to Ambit Energy from another retail
electric provider, you may rescind this Agreement without fee or penalty of
any kind within three federal business days after receiving the Terms of Service
document by notifying Ambit Energy by phone toll-free at 1(877) 282-6248 or by
fax at (214) 969-5928. If rescinding by fax, please write the name on the account,
address, phone number, ESI ID, sign, and specify that you are rescinding this
Agreement within three federal business days of receiving Ambit Energy's Terms
of Service.
CANCELLATION RIGHTS: To cancel this Agreement, you may call or fax us
at the contact information provided above. Cancellation is permitted for any
reason. However, if you enrolled under a fixed rate product, you agree to remain
a customer of Ambit Energy until the term expires or be subject to an early
termination fee, as specified in the EFL. You may cancel your Agreement with
Ambit Energy without penalty if p) Ambit Energy notifies you of a material
change to the Terms of Service and you elect to opt out of the Agreement due
to the material change (see the Material Change provision of this Agreement
for more information) or (2) you move to another premise and provide evidence
that you are moving along with a forwarding address. Ambit Energy reserves the
right to terminate this Agreement for non-pay, fraud, believable threats or harm
made by the customer to Ambit Energy's owners, employees, or contractors, or
for insufficient payments past the due date. Regardless of the method or reason
for cancellation of the Agreement, you are responsible for all outstanding charges
incurred through the date on which the cancellation is effected by the TDU.

not received by Ambit Energy at the close of business on the day the bill is due.
Late payments, delinquent or past due balances may result in a Late Payment
Penalty equal to 5% of the invoiced past- due amount.
VOLUNTARY BILL-PAYMENT ASSISTANCE PROGRAM: Ambit
Energy's bill assistance program is funded by voluntary donations made by our
customers. The proceeds fund bill payment assistance for residential electric
customers. To provide a voluntary donation to our program, please designate
the amount you would like to donate on your remittance slip, which is located
on each monthly invoice.
PAYMENT PLANARRANGEMENTS FOR SINGLE ELECTRIC
SERVICEIDENTIFIER (ESI ID) CUSTOMERS: If you are unable to pay your
bill on time, please call Customer Care immediately. Ambit Energy may allow
you to pay the outstanding bill after its Due Date but before the Due Date of the
next bill. Or you may quality for a deferred payment plan that allows you to pay
an outstanding balance over a period of time.
DEFERRED-PAYMENT PLANS: A customer is eligible to enter into a
deferred payment plan unless the customer has been issued more than two
termination or disconnection notices during the preceding 12 months; or
has received service from Ambit Energy for less than three months, and the
customer lacks sufficient credit or a satisfactory history of payment for electric
service from a previous REP (or its predecessor electric utility). A deferred
payment plan requires an initial payment of 25% of the outstanding balance,
and the remaining balance to be paid over three billing cycles. Your service may
still be terminated and disconnected if you do not meet the requirements of a
deferred payment plan,
AVERAGE BILLING FOR SINGLE ELECTRIC SERVICE IDENTIFIER
(ESI ID) CUSTOMERS: Ambit Energy's average billing program provides
you the convenience of budgeting your electricity expense by calculating your
current monthly bill based upon a rolling 365 day historical average usage. If
there is no previous billing in your name at the service address, we will take the
historical usage at that service address and apply your current price to calculate
your average monthly amount. This program is not offered to customers with a
delinquent balance. An account reconciliation or true-up will occur at the end of
every twelve (12) months that you are on Average Billing, or if: (1) your service
is disconnected for non-payment (2) you transfer your electric service to a new
residence (3) you cancel your service or (4) you switch to conventional billing.
PAYMENTS: You will receive a monthly bill; however, Ambit Energy may not
send you a bill if your balance is equal to or less than $5.00. All bills rendered
are due and payable 16 days after issuance ("Due Date"), which is defined as

DISCONNECTION: WITHOUT NOTICE: Ambit Energy may disconnect service
immediately for the following reasons: (1) a known dangerous condition exists,
in which event; prior notice will be given, if possible (notice will be provided by
phone or posted on the door of your service location as soon as practicable after
service is disconnected); (2) service was connected by a person without authority
and without an Agreement; (3) service is reconnected without authority after
being disconnected for failure to pay;(4) there is evidence of tampering with
equipment of the transmission or Local Distribution utility, municipally owned
utility or electric cooperative; or (5) there is evidence of theft of service. If service
was disconnected due to a dangerous situation, customer must correct the
situation and notify Ambit Energy before service will be reconnected.
DISCONNECTION: WITH NOTICE: Ambit Energy may order disconnect
of service for non-payment if amounts due remain unpaid ten (10) days after a
Disconnection Notice has been sent. Fraud and nonpayment shall be considered
breaches of this Agreement. To re-instate service with Ambit Energy after a
disconnection, you will be required to cure the reason for the disconnection and
may be assessed a deposit and a reconnection fee by the TDU, which will appear
as a line item on your bill. Disconnection of service will not excuse you from
paying any outstanding amounts owed to Ambit Energy. Ambit Energy reserves
the right to assess a deposit in the event Ambit Energy issues a disconnect order
to your TDU for non-payment. If service is not reconnected within ten days of
disconnection for non-payment, Ambit Energy reserves the right to cancel this
Agreement and require a new deposit and move-in fee for service initiation.
COLLECTIONS: In the event you default in the prompt payment of amounts
due under this Agreement, Ambit Energy reserves the right to charge you for any
and all fees or charges reasonable and necessary in order to collect or attempt to
collect delinquent balances. Ambit Energy may use the services of debt collection
agencies, consumer reporting agencies and other remedies as allowed by law to
collect any unpaid balances on your account.
CREDIT: This Agreement is conditioned upon you demonstrating to us your
creditworthiness throughout the Term of your Agreement. You agree to cooperate
with Ambit Energy in establishing your creditworthiness.
DEPOSITS: Ambit Energy will not deny service based on your creditworthiness;
however, you may be required to provide an initial deposit if you do not have a
satisfactory credit rating, you are a move-in customer, or you cannot demonstrate
satisfactory credit as defined in 25.478 of the PUCT rules (http://www.puc.state.
tx.us/rules/subrules/electric/25.478/25.478.pdf). If a deposit is required, the total
amount of your deposit will not exceed an amount equivalent to the greater of
either (1) the sum of the next two months estimated billings or (2) one-fifth of
the estimated annual billing. A separate deposit may be required for each service
location enrolled under this Agreement.

accrue only on deposits retained for longer than 30 days at the rate approved by
the PUCT. The interest shall accrue from the date the deposit is received. Your

24 consecutive months of service if (1) you have had no late payments for 24
consecutive months, (2) your service was not disconnected for non-payment and
(3) you are not delinquent in the payment of your current bill.
PAPERLESS BILLING: Enrollment in Ambit Energy's electronic Paperless Billing
program requires your consent to send you important information electronically,
Upon enrollment, you may receive your paper statement for one more billing cycle
through the mail at your billing address. Thereafter, you will receive a monthly
billing statement at the e-mail address you provided.
You agree to provide and keep your e-mail address current with Ambit Energy.
If any electronic communication (collectively, "electronic communication"),
including Paperless Billing statements are returned to Ambit Energy as
undeliverable, you remain responsible for ensuring timely payment. Paperless bills
and all other communication are always available through your online account at
www.ambitenergy.com. Should your e-mail be deemed undeliverable by Ambit
Energy, we will attempt to contact you by phone or other means determined by
Ambit Energy.
You understand and agree that Ambit Energy may provide you with all disclosures,
notices and other communication (collectively, "communication") regarding your
Ambit Energy account in electronic form. This communication includes, but is
not limited to, monthly billing statements, disconnect notices, payment reminder
notices and change in terms of service notifications. You may withdraw your
consent to receive electronic communication or update your e-mail address by
one of the following methods: Through your MyAmbit Account: Login at www.
ambitenergy.com. Go to the "My Bill" section and click the Edit/Cancel button
to change back to paper billing and postal mail communication. Go to the "My
Profile" section to edit your email address. Ph ne: You can call Ambit Energy
at (877) 282-6248 to withdraw your consent to Paperless Billing and electronic
communication. To ensure that our monthly billing statements and other
electronic communication are not treated as junk mail by your e-mail account
provider, please add the following e-mail address to your e-mail address book:

AUTOMATIC PAYMENT (AUTOPAY): If you enroll in Ambit Energy's
AutoPay program, you understand and agree that Ambit Energy will directly debit
your amount due as follows: Checking or savings account - 5 days prior to the
invoice due date. Credit Card -1 day prior to the invoice due date. You agree to

keep your registered bank account active and its information current with Ambit
Energy. If an AutoPay transaction fails due to insufficient funds, you may be
charged a $25.00 returned-transaction fee.
REFUSAL OF SERVICE: Ambit Energy may refuse to provide electric service
to a customer for one or more of the reasons specified in Section 25.477 of
the PUCTrules and regulations (http://www.puc.state.tx.us/rules/subrules/
electric/25.477/25.477.pdf).
DISCRIMINATION: Ambit Energy will not discriminate, deny service, or require
prepayment or deposit for service based on race, creed, color, national origin,
ancestry, sex, marital status, lawful source of income, level of income, disability,
familial status, location in an economically distressed geographic area, or
qualification for low income or energy efficiency services.
MATERIAL CHANGE: Ambit Energy will provide you with at least fourteen
calendar days advance written notice of any change in the Terms of Service, either
in your bill or in a separate mailing to your billing address. The change(s) will
become effective on the date stated in the notice. In the event of an unfavorable
change to this Agreement, you will have the option to cancel this Agreement
without penalty or fee for fourteen days from the date of notice. Your option
to cancel will not be provided if the change favors you or is mandated by any
applicable law or by any applicable rule or regulation of a regulatory agency
or body, including the PUCT. Pricing changes made due to a change in law or
regulation may be made without granting any right to cancel this Agreement
without penalty. No notice will be sent of contractual changes that benefit the
customer.
CUSTOMER INFORMATION: By entering into this Agreement, you authorize
your TDU to release to Ambit Energy certain information that we need to provide
you with service, including your address, phone number, account numbers and
historical usage information.
Agreement to any person or entity succeeding to all or substantially all of the
assets of Ambit Energy; and/or (d) transfer or assign this Agreement to a certified
REP. In the case of (b), (c) or (d), any such assignee shall agree in writing to be
bound by the terms and conditions hereof. Upon any such assignment, customer
agrees that Ambit Energy shall have no further obligations hereunder.
LIMITATIONS OF LIABILITY: LIABILITIES NOT EXCUSED BY REASON
OF FORCE AJEURE OR OTHERWISE SHALL BE LIMITED TO DIRECT
ACTUAL DAMAGES. NEITHER PARTY WILL BE LIABLE TO THE OTHER FOR
CONSEQUENTIAL, INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY OR INDIRECT
DAMAGES. LOST PROFITS OR PENALTIES OF ANY NATURE ARE HEREBY
WAIVED; THESE LIMITATIONS APPLY WITHOUT REGARD TO THE CAUSE OF
ANY LIABILITY OR DAMAGE, INCLUDING THE NEGLIGENCE OF AMBIT ENERGY.
THERE ARE NO THIRD PARTY BENEFICIARIES TO THIS AGREEMENT.
REPRESENTATIONS AND WARRANTIES: THE ELECTRICITY SOLD UNDER
THIS AGREEMENT WILL MEET THE APPLICABLE TDU'S STANDARDS AND MAY
BE SUPPLIED FROM A VARIETY OF SOURCES. AMBIT ENERGY MAKES NO
REPRESENTATIONS OR WARRANTIES OTHER THAN THOSE EXPRESSLY SET
FORTH IN THIS AGREEMENT, AND AMBIT ENERGY EXPRESSLY DISCLAIMS ALL
OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
GOVERNING LAw: This Agreement shall be governed by and construed,
enforced and performed in accordance with the laws of the State of Texas and
venue shall be in Dallas County, Texas. The provisions of the Uniform Commercial
Code ("UCC") shall apply to this Agreement, and electricity shall be a "good" for
purposes of the UCC ( http://www.statutes.legis.state.tx.us).
FORCE MAJEURE: We will endeavor in a commercially reasonable manner
to provide service, but we do not guarantee a continuous supply of electrical
energy. Events that are out of our control ("force majeure" events) may result
in interruptions in service. We will not be liable for any such interruptions. We
do not generate your electricity nor do we transmit or deliver electricity to you.
Therefore, you agree that we are not liable for damages caused by events of force
majeure, including acts of God, acts of any governmental authority, including
the Public Utility Commission of Texas, accidents, strikes, labor trouble, required
maintenance work, inability to access the TDU system, non-performance of
the TDU, changes in laws, rules, regulations, practices or procedures of any
governmental authority or the Electric Reliability Council of Texas, or any cause
beyond our control.
ASSIGNMENT: You may not assign this Agreement, in whole or in part, or
any of its rights or obligations hereunder without the prior written consent of
Ambit Energy. Ambit Energy may, without your consent (a) transfer, sell, pledge,
encumber or assign this Agreement or the accounts, revenues or proceeds hereof
in connection with any financing or other financial agreement; (b) transfer or
assign this Agreement to an affiliate of Ambit Energy; (c) transfer or assign this

As a retail energy customer in the state of Texas, you are entitled to the following
Customer Protection Rights pursuant to the Rules of the Public Utility Commission of
Texas ("PUCT"). These rights apply to all residential and small commercial customers
served by Ambit Texas, LLC d/b/a Ambit Energy ("Ambit Energy"), a certified Retail

to your electric distribution lines or meters should be directed to your TDU listed

CANCELLATION OF SERVICE: You may cancel your service at any time with no
an early termination fee if you are under a variable price product. If you are under a
fixed-rate product, you may have an early termination fee. Please see your Terms of
Service Agreement and Electricity Facts Label ("EFL") for full details.
UNAUTHORIZED CHANGE OF SERVICE PROVIDER OR "SLAMMING": A
REP must obtain your verifiable authorization before switching your electric service.
If you believe your electric service has been switched without your authoriza-
tion, you should request that the unauthorized REP provide you with proof of your
authorization and verification. The REP must provide proof to you within 5 business
days of your request. If you are not satisfied with this response, you may also file a
complaint with the PUCT at the address provided below. Upon receipt of a complaint
filed with the PUCT, the REP must respond within 21 days and provide all documentation relied upon by the REP related to the authorization to switch, and any
corrective actions taken to date.
If a REP is serving your account without proper authorization, they must take all actions necessary to return you to your original REP as quickly as possible. Your original
REP has the right to bill you at the price disclosed in your Terms of Service and EFL
from either: (1) the date you are returned to your original REP, or (2) any prior date
chosen by your original REP for which they had the authorization to service your
electric service location. In addition, the unauthorized REP is responsible for paying
all charges associated with returning your service to your REP of choice.
Billing Issues
UNAUTHORIZED CHARGES OR "CRAMMING°: Before any new charges
are included on your electric bill, Ambit Energy must inform you of the product or
service, all associated charges, how these charges will be billed, and obtain your
consent for the product or service. If you believe your bill includes unauthorized
charges, you may contact Ambit Energy to dispute such charges and you may file a
complaint with the PUCT. Ambit Energy will neither seek to terminate your electric
service for nonpayment of an unauthorized charge nor file an unfavorable credit
report against you for disputed unpaid charges that are alleged to be unauthorized
unless the dispute is ultimately resolved against you. If the charges are determined
to be unauthorized, Ambit Energy will cease charging you for the unauthorized
service or product, remove the unauthorized charge from your bill, and refund or
credit all money you paid for any unauthorized charge within 45 days. If charges are
not refunded or credited within three billing cycles, interests on the amount of any
unauthorized charge shall be paid to you at an annual rate established by the PUCT
within 15 days after the date the unauthorized charge is removed from your bill.
Ambit Energy will not re-bill you for any charges determined to be unauthorized. See
the Pricing Section of the Terms of Service for more information.
BILLING QUESTIONS OR DISPUTES: Please contact Ambit Energy toll-free
at (877) 282-6248 if you have specific comments, questions or complaints. Our
trained customer care specialists will do everything they can to ensure your problem
is resolved. If you are not satisfied with the resolution, you may file a complaint
with Ambit Energy. We make a commitment that we will promptly investigate your
concern and respond back to you with our findings within 21 days of your complaint.
If we fail to resolve your dispute, it is your right to file a complaint with the PUCT
Public Utility Commission of Texas, Customer Protection Division, P.O. Box 13326,

METER READING AND TESTING: Please contact Ambit Energy for instructions
on how to read your meter. If you feel your meter reading is not correct, please contact Ambit Energy to request a meter re-read. If you feel your meter is not operating
correctly, please contact Ambit Energy to request a meter test. You have the right to
request a meter test once every four years at no cost. If your meter is tested more
than once in a four-year period and the meter is determined to be functioning cor-

rectly, then you may be charged a fee. If you request a meter re-read and the reading
is accurate, you will be assessed a meter re-read charge, as disclosed in the Terms of
Service. Ambit Energy will gladly make a request to the TDU on your behalf for either
a meter re-read or meter test.
BILL PAYMENT ASSISTANCE: If you are a low income residential customer,
you may be eligible for financial aid from assistance programs, such as the Texas
LITE-UP Program or non-profit organizations in your area by calling 2-1-1. Feel free
to contact (877) 282-6248 or (866) 454-8387 to learn more. You can also visit the
web address https://www.liteuptexas.org/NewForm/ to submit an online application
or download and print a copy of the LITE-UP self-enrollment form.
DEFERRED PAYMENT PLANS AND OTHER PAYMENT PLANS: If you
cannot pay your bill, please call Ambit Energy immediately. Ambit Energy may offer
you a short term payment plan that allows you to pay your bill after your due date,
but before your next bill is due. In addition, you may qualify for a deferred payment
plan. A deferred payment plan allows you to pay an outstanding bill in installments
beyond the due date of the next bill. Ambit Energy may require an initial payment
to initiate the agreement. Ambit Energy is required to offer you a deferred payment
plan unless: (1) you have been disconnected during the preceding 12 months; (2) you
have submitted more than 2 payments during the preceding 12 months that were
found to have insufficient funds available; or (3) you have been the REP's customer
for less than 3 months, and do not have sufficient credit or a satisfactory history of
payment with a previous REP. All REPs must offer customers deferred payment plans
for bills that are due during an extreme weather emergency and to customers who
have been under-billed in the amount of $50.00 or more.
Disconnection and Termination
TERMINATION: Ambit Energy may terminate your electric service for reasons
other than non-payment as specified in your Terms of Service Agreement. You
may terminate your agreement with Ambit Energy without penalty upon providing
reasonable proof, including but not limited to forwarding address. You may also
terminate your agreement without penalty if Ambit Energy notifies you of a material
change in the terms and conditions of services, as stipulated in the Terms of Service
Agreement. Ambit Energy may also terminate this Agreement if fraud has been committed. See your Terms of Service Agreement for other details regarding terminating
your contract.
DISCONNECTION OF SERVICE: The PUCT has determined that under certain
dangerous circumstances (such as unsafe electric line situations) Ambit Energy may
authorize your TDU to disconnect your electric service without prior notice to you.
Additionally, Ambit Energy may seek to have your electric service disconnected for:
(1) failure to pay a bill owed by the date of disconnection; (2) failure to comply with
the terms of a deferred payment agreement made with Ambit Energy; (3) using the
service in a manner that interferes with the service of others or using non-standard
equipment; (4) failure to pay a deposit required by Ambit Energy; or (5) failure of a
guarantor to pay the amount guaranteed when Ambit Energy has a written agreement, signed by the guarantor, which allows for the disconnection of your service.
Ambit Energy may disconnect service for non-payment if amounts due remain un-
paid 10 days after a Disconnection Notice has been sent. This notice must be mailed
to you separately no earlier than the first day after the date your bill is due.
Ambit Energy will not initiate service disconnection for the following reasons: (1)
delinquency of payment by a previous occupant, (2) failure to pay charges unrelated
to electric service, (3) failure to pay for a different class of electric service, (4) failure
to pay an under-billing, other than for theft of service, more than 6 months old, (5)
failure to pay for a disputed charge until a determination as to the accuracy is made,
(6) failure to pay an under-billing due to faulty metering, unless there has been
meter tampering, or (7) on a holiday or weekend, or the day immediately preceding
a holiday or weekend, unless the REP's personnel are available on those days to
take payments, make payment arrangements with you, and request reconnection of
service, (8) failure to pay an estimated bill other than a bill rendered pursuant to an
approved meter-reading plan, unless the bill is based on an estimated meter read by
the TDU, (9) Ambit Energy receives a pledge or other notification that an energy assistance provider is forwarding sufficient payment to continue service provided that
such pledge or other notification is received by the due date stated on the disconnection notice, and the customer, by the due date on the disconnection notice, either
pays or makes payment arrangements to pay any outstanding debt not covered by
the energy assistance provider, or (10) customer establishes that disconnection of
service will cause someone residing at that residence to become seriously ill or more
seriously ill.
To avoid disconnection due to serious illness, you must enter into a deferred
payment plan with Ambit Energy, have the ill person's attending physician call or
contact Ambit Energy by the stated date of disconnection, and have the ill person's
attending physician submit a written statement attesting to the necessity of electric
service to support life. This exemption from disconnection due to illness or disability
shall be in effect for 63 days and may be applied for again after the 63 days has
expired and the deferred payment plan has been fulfilled.
RESTORATION OF SERVICE: If your service has been disconnected by Ambit
Energy, your service will be reconnected upon satisfactory correction of the reasons
for disconnection. If your service was disconnected due to a dangerous situation,
your service will be reconnected once you notify Ambit Energy that you have corrected and satisfactorily resolved the dangerous situation.
Other Protections
CRITICAL CARE: If interruption or suspension of electric service will create a
dangerous or life-threatening condition, you may qualify as a "Critical Care Residential Customer" or "Chronic Condition Residential Customer." Upon your request for
critical care status, Ambit Energy will provide the PUC-approved application form to
be completed by you and your physician. The form must be submitted electronically
to the TDU by your physician. Critical care requests will be evaluated and approved
or declined by the TDU; however, you may appeal the eligibility determination
to the TDU. If you are not satisfied with the results of this appeal, you may file a
complaint with the PUCT. If approved, the TDU will send you a renewal application
prior to the expiration of your critical care status. Qualification as a critical care
residential customer does not relieve you of the obligation to pay Ambit Energy for
services rendered. However, a critical care residential customer who needs payment
assistance is encouraged to contact Ambit Energy immediately regarding possible
deferred payment options or other assistance that may be offered.

without discrimination as to a customer's race, creed, color, national origin, ancestry,
sex, marital status, lawful source of income, level of income, disability, family status,
location in an economically distressed geographic area, or qualification for low
income or energy efficiency services.
PRIVACY R16MTs: Ambit Energy will not release proprietary customer information except as authorized under the law. The PUCT has authorized release of
proprietary customer information to law enforcement agencies, energy assistance
agencies, collection and reporting agencies, utilities and the PUCT.

prohibits any telemarketing solicitation* to residential and wireless customers, and

"SLAMMING":

electrico. Si usted cree que su servicio el6ctrico ha sido cambiado sin su autorizaci6n, le debe de pedir al REP no autorizado una copia de su autorizaci6n y
verificaci6n. El REP debe de entregarle tal prueba a mas tardar a los 5 dfas habiles
a partir de la fecha solicitada. Si usted no esta satisfecho con su respuesta, puede
someter una queja al PUCT a la direcci6n posteriormente indicada. Al recibir una
queja sometida al PUCT, el REP tiene 20 dias para responder y proveer toda la

PLANES DE PAGOS DEFERIDOS Y OTROS PLANES DE PAGOS
Si usted no puede pagar su factura, por favor Ilame a Ambit Energy inmediatamente. Ambit Energy le puede ofrecer un plan de pago a corto plazo que le
permita pagar su factura despues de la fecha de vencimiento pero antes de que

Energy puede autorizar a que su TDU desconecte su servicio electrico sin previa
notificaci6n a usted. Adicionalmente, Ambit Energy puede solicitar la desconexi6n
de su servicio por: (1) falta de pagar una factura no mas tardar de la fecha de
desconexi6n; (2) falta de cumplir con los terminos de un plan de pago diferido con
Ambit Energy; (3) usar el servicio de una manera que interfiere con el servicio de
otros o el uso de equipo no estandar; (4) falta de pagar un dep6sito requerido por
Ambit Energy; (5) falta de pago por un fiador por la cantidad garantizada cuando
Ambit Energy tiene un acuerdo por escrito, firmado por el fiador, el cual permite la
desconexidn de su servicio.
Ambit Energy puede desconectar su servicio por falta de pago si las cantidades
por pagar no se pagan durante un periodo de diez dias a partir de la fecha de
envfo del Aviso de Desconexi6n. Este aviso debe de ser enviado aparte y antes del
primer dfa desputss de la fecha de vencimiento de su factura actual.
Ambit Energy no iniciara un procedimiento para desconectar su servicio por
ninguna de las siguientes razones:
(1) Falta de pago por servicio electrico de un previo ocupante; (2) Falta de pagar
cualquier cargo no relacionado con servicio electrico; (3) Falta de pagar por un tipo
o clase de servicio electrico diferente (4) Falta de pagar por una cuenta facturada
por menos cantidad de lo debido (excepto por robo de servicio) que ocurri6 hace
mas de 6 meses; (5) Falta de pagar cualquier cargo bajo disputa hasta que se haga
una determinaci6n con respecto a su exactitud; (6) Falta de pagar cargos por menos cantidad que ocurrieron por un medidor defectuoso (excepto si el medidor fue
alterado), o(7) en un fin de semana o dia feriado, unicamente que representantes
del REP esten disponible durante esos dias para aceptar pagos, arreglos de pagos
y solicitar la reconexi6n de servicio;(8) Falta de pagar una factura estimada a no
ser que la factura estimada sea parte de un programa de leer medidores aprobado,
Gnicamente que la factura este basada en figuras estimadas por el TDU; (9) Ambit
recibe una promesa u otro tipo de aviso de que un proveedor de asistencia de
energfa esta remitiendo un pago de tal cantidad suficiente para continuar el servicio con la condici6n de que tal promesa se reciba a lo mas tardar en la fecha de
vencimiento mencionada en el aviso de desconexi6n y el cliente, a lo mas tardar
en la fecha de vencimiento, pague o haga arreglos para pagar cualquier cantidad
por pagar no cubierta por el proveedor de asistencia de energfa, o(10) el cliente
establezca que la desconexi6n de servicio causard que un residente se enferme
gravemente o que su enfermedad se agrave.
Para evitar una desconexi6n por razones de enfermedades graves usted debe
de comprometerse a un plan de pagos diferidos con Ambit Energy; lograr que el
m6dico del enfermo se comunique con Ambit antes de la fecha de desconexi6n; y
lograr que tal medico someta una declaraci6n por escrita atestiguando a la necesidad de servicio electrico por razones de vida o muerte. Esta exencidn debida a

TERMINACI6N: Ambit Energy puede cancelar su servicio electrico por
causas no relacionadas con la falta de pago como especificado en los T6rminos de
Servicio de su Acuerdo. Usted puede cancelar su acuerdo con Ambit Energy sin
penalizaci6n al proporcionar una prueba razonable, incluyendo pero no limitado a

DERECHOS DE PRIVACIDAD: Ambit Energy no divulgara informaci6n
propietaria del cliente excepto como autorizado por ley. El PUCT ha autorizado la
divulgaci6n de tal informaci6n a las agencias policiales, agencias de asistencia de
energia, agencias de colecci6n y de reporte, agencias de servicio plJblico y al PUCT.

RESTAURAC16N DE SERVICIO: Si Ambit Energy desconecta su servicio,

reconectado al notificarle a Ambit Energy que usted ha corregido y satisfactoriamente resuelto la situaci6n peligrosa.
Otras Protecciones
CUIDADO CRITICO: Si la interrupci6n o suspensi6n de un servicio electrico
puede crear una condici6n peligrosa o potencialmente mortal, usted podria
calificar como un "Cliente Residencial de Cuidado Crftico" o "Cliente Residencial
con Condici6n Cr6nica". Al recibir su solicitud de estado de cuidado critico, Ambit
Energy proveera la planilla de aplicaci6n aprobada por la PUC para ser completada
por su medico. La planilla debe ser enviada electr6nicamente a la TDU por su
medico. Las solicitudes de cuidado critico seran evaluadas y aprobadas o declinadas por la TDU; sin embargo, usted puede apelar la determinaci6n de elegibilidad
a la TDU. Si no esta satisfecho con los resultados de esta apelaci6n, usted puede
presentar una queja con la PUCT. Si es aprobada, la TDU le enviara una aplicaci6n
de renovaci6n antes de la expiraci6n de su estado de cuidado crlTico. El calificar
como cliente residencial de cuidado critico no le alivia de la obligaci6n de pagar a
Ambit Energy por sus servicios prestados. No obstante, un cliente residencial de
cuidado critico que necesite asistencia de pagos debe de contactar a Ambit Energy
inmediatamente para repasar las opciones de pagos diferidos u otra asistencia que
se le pueda ofrecer.

electrico sin discriminaci6n a raza, credo, color, origen nacional, ascendencia, sexo,
