La Clinica Workers United for a Voice on the Job Union Update Labor Board rejects management appeal The National Labor Relations Board has rejected La Clínica’s appeal of the ruling throwing out the petition to decertify our Union. In a one-sentence ruling, the Labor Board found that management’s appeal raised “no substantial issues warranting review.” Management has wasted thousands of dollars on lawyers to try to break our Union. Every effort failed. Most recently, there was a petition to get rid of our Union days before management finally signed our contract. The Labor Board’s regional office threw the petition out, because La Clínica management violated the law so many times in so many ways that we needed some time to repair the damage they’d caused. But management appealed the decision. Now management needs to accept the Labor Board’s decision – and our decision. We decided years ago that we needed a change, that we needed a voice at work – that we needed our Union. We stuck with our decision when they refused to negotiate, when they went back on agreements we’d reached, and when they stalled on signing the contract that we negotiated. And each time, management paid their lawyers to give them bad advice. It’s time for management to respect our decision. It’s time for management to start spending money on the needs of our community and the needs of La Clínica employees, not on lawyers. And maybe it’s time for management to find new lawyers. Union action protects classification, wages As a shop steward, I find that it is not always enough for our co-workers to come to us with their concerns. If we see something in our departments or observe things which we know are in violation of our contract, we need to step up to the plate and let our supervisors and management know about the situation through the grievance procedure. A co-worker in my department was hired as a phlebotomist, but was, in fact, being trained and working as a lab technician from the first day of her employment. The pay difference is quite significant. I confronted my supervisor, and said that if she was going to work as a lab technician instead of a phlebotomist, she needed to be paid accordingly. He asked Diane Kummer about it, and said that I'd told him that I needed something in writing within 10 days. I received in writing from Diane that she would be a lab technician. I informed our Union Rep, and gave him the written answer. Now we’ll make sure that her job description is for a lab technician, and that her wages are being paid for that position also. She should also receive back pay. ALWAYS go to your shop stewards with your concerns! If we are not able to help, we will find out from our Union rep how to handle a situation. Should I get paid? Yes – and if you work full time, you should be paid overtime (time-and-a-half). Section 9.7 of the contract guarantees a meal break at least three hours after you start work, and at least three hours before the end of your shift, unless you agree to a different time. It also says you get paid for working your meal break. If that puts you over 8 hours for the day or 40 hours for the week, you should be paid overtime. If your supervisor doesn’t pay you for working through lunch, you should see your Union Steward. My supervisor had me come to a meeting before work, so she told me to go home early so that I wouldn’t get overtime pay. Is that right? No. Section 9.4(b) of the contract says you should be paid for work before and after your shift in 15 minute increments. Section 9.3 provides that your schedule can’t be changed unless there’s an emergency or you agree to it. If a supervisor tries to take away hours because you went to a meeting outside your regular shift, you should politely say you don’t want to do that, and then go talk with your Union Steward. Si un supervisor trata de reducir sus horas porque asistió a un mitin fuera de las horas del turno, debe responder con cortesía que Ud. no quiere hacerlo, y hablar con se delegado sindical (“Union Steward”). TSS & Managed Care At the end of May TSS and Managed Care were merged. We were supposed to get raises, but it didn’t happen. We brought this to management through the Union. Alan Leverett has now offered a proposal for retroactive pay starting September 1, 2007. We are still trying to get the pay going back to May 25th, when the jobs were merged.
