• Universal Declaration of Human Rights (12/10/1948),
Article 27:
(1) Everyone has the right freely to participate in the
cultural life of the community, to enjoy the arts and to
share in scientific advancement and its benefits. […]
• Convention on the Rights of Persons with Disabilities
(2006) - Article 30 - Participation in cultural life,
recreation, leisure and sport
(1) States Parties […] shall take all appropriate
measures to ensure that persons with disabilities: […]
c) […], as far as possible, enjoy access to monuments and sites of national cultural importance.

Council Resolution of 6 May 2003 on accessibility of
cultural infrastructure and cultural activities for people
with disabilities (05/06/2003):
•The Council of the European Union invites the member
states and the commission, within their respective
competencies, to: […]
iii) continue efforts to eliminate existing barriers and
examine further appropriate ways and means to facilitate
and improve the access of people with disabilities to
culture, including:
— evaluating and improving physical access,
without prejudice to Member States regulations
concerning protection of monuments, to places such
as archaeological sites, museums, monuments and
places of cultural activities […].

Legal framework - DE
In Germany legislation in reliance to monument
protection is based on the federal state level:
• 6 from 16 federal states have included in their
monument protection acts a part like “The monuments
protection authority is taking account of the needs of
people with disabilities” (2010)
•Laws on equal opportunities for people with disabilities
on federal state level

• Processes of weighing of interests between
monument protection and barrier-freedom
normally requires individual solutions
¾ Give-and-take is necessary
¾ Maybe not all parts of the monument can be
made accessible
• Target: Weighing of interests between accessibility to
the greatest extent possible and protection of the
cultural heritage
