A. REFERENCE FRAMEWORK
The realities of the internationalisation of higher education are becoming increasingly
consolidated while at the same time it takes on numerous forms, from programmes aimed at
attracting foreign students, joint degree programmes, academic mobility programmes and
franchising. The development of measures for the quality assurance of this internationalisation
is becoming an important issue, not just for safeguarding the rights of the different users, but
also for developing new structures that make best use of its potentialities.
Transnational degree programmes1 represent one of the variants in which the
internationalisation of higher education is apparent, and it is one of the areas in which AQU
Catalunya, in its capacity as a university quality assurance agency, is actively involved. In
accordance with the Catalan Universities Act (LUC), education institutions wishing to offer a
programme leading to a degree awarded by a foreign institution that has no equivalent to a
recognised degree in Catalonia, must be evaluated by AQU prior to authorisation by the Catalan
Government.
The proposed methodology set out below, which incorporates the standards and guidelines for
quality assurance (ESG2) established in the European Higher Education Area, has been
designed to be applied in cases of this type.
It also takes into consideration the UNESCO and Council of Europe Code of Good practice in
the Provision of Transnational Education3 adopted by the Lisbon Recognition Convention
Committee in 2001.
As a point of fact, from the perspective of the functions of review, certification and accreditation
granted to it by the legal framework, one of the missions of AQU Catalunya is to play an
instrumental role in the correct implementation of the ESG standards and the principles
stemming from the abovementioned code by university institutions and programmes established
in Catalonia.
In addition to these international requirements, the methodology also embodies the conditions
laid down by prevailing legislation: Royal Decree 557/1991 of 12 April, concerning the setting
up and recognition of universities and other higher education institutions, in conformity with the
provisions of the Spanish Universities Act (LOU); and the provisions set out in article 19 of
Royal Decree 557/1991, which were implemented through an Order, dated 26 May 1993, by
the Spanish Ministry of Education and Science for application as secondary (delegated)

legislation in Catalonia, in accordance with article 149.3 of the Spanish Constitution, insofar as
Catalonia has yet to set these implementing regulations in place.
Methodological procedures
The methodology proposed by AQU Catalunya envisages two instruments:


A protocol for gathering evidence that, together with a site visit, should make it possible to
determine the potential of the institution established in Catalonia to properly run the study
programme. This protocol pays special attention to: public information on the study
programme, the management of academic activity, the resources and the quality assurance
system.
A questionnaire for analysing the position of the foreign institution awarding the degree. The
aim of the questionnaire is to gather evidence on its academic potential in the discipline and
its internal and external quality assurance systems.
These two instruments, together with a site visit to the institution giving the programme, will
provide the necessary information for the AQU report, which is necessary in order for the
providing institution running the programme in Catalonia to receive authorisation, to be drawn
up.
In order for the site visit to the providing institution to proceed correctly, the replies to the two
instruments need to be sent and received by AQU Catalunya no more than one month after you
receive this guide.
The external review visit will be carried out by a panel appointed by AQU Catalunya consisting
of one academic representative with experience in institutional management, who will act as
moderator, one student and one QA expert.
The visit will be arranged beforehand and it will last one day (although it may be longer, if the
panel deems it necessary).
Within a period of no longer than four weeks, the panel moderator must submit the
corresponding report to AQU Catalunya for ratification by the Quality Assessment Commission.
Once it has been ratified, the result will then be communicated to the corresponding
government department with jurisdiction over the universities for its decision regarding
authorisation of the institution to run the degree programme.

B.
PROTOCOL
FOR
EVALUATING
AN
EDUCATION
INSTITUTION OFFERING A FOREIGN DEGREE PROGRAMME IN
CATALONIA
The questionnaire for the education institution that intends to give a foreign degree programme
in Catalonia firstly takes into account as evidence the agreement or covenant signed with the
foreign awarding institution, which, once legalised through diplomatic channels or by way of The
Hague apostille and accompanied by the corresponding certified translation, is enclosed with
the application that is submitted to the Directorate General for Universities.
The questionnaire covers a series of dimensions, of which detailed and structured information
on the following is necessary in order for the evaluation to proceed:
1. Public information for the users
2. Running of the study programme in Catalonia
3. Resources for running the programme in Catalonia
4. The quality assurance system
In the document of evidence, the following basic information on the study programme
must be provided:
- Programme identification
- Name of the programme
- Institution awarding the degree
- Institution delivering the degree
1. Public information on the study programme
“Institutions should regularly publish up to date, impartial and objective information, both
quantitative and qualitative, about the programmes and awards they are offering”. ESG 1.7
Give details of the content of the information aimed at your users that refers to the curriculum
(this information should be printed out and, where applicable, details given of the website where
the information can be found). Take into account the following items:

The degree that the student is awarded on completion of his/her studies and its recognition
in the countries of the European Union and internationally.

Curriculum structure: compulsory credits, credits from elective courses, curriculum
pathway, free-choice subjects, credit transfers, and course prerequisites, where applicable.

Competences/learning outcomes of the programme.

Job opportunities.

Places offered.

Admission criteria.

What are the various ways of gaining access to the degree course (entrance exams,
COU/final year of secondary studies, etc.)? Are they the same as in the awarding
institution?

Continuance criteria (for ongoing student status):

What continuance criteria are laid down in the programme? Are they the same as those
of the awarding institution? Compulsory stay requirements at the awarding institution,
where applicable.

Continuance criteria (for ongoing student status) at the awarding institution. Requirements
for doing work experience/placement abroad.

Registration fee for the student:

State the registration fee for each course, together with the registration fee of a stay at
the awarding institution, where applicable, with details of all expenses that are both
included (teaching, accommodation, etc.) and not included.

In the case of grant programmes and/or student exchange programmes, state clearly the
eligibility requirements.

Languages in which classes will be given at the teaching institution and at the awarding
institution.

Stipulated language knowledge requirements for students at the time of registration.

What are the formal mechanisms for establishing the students’ level of language
knowledge (recognised examinations, etc.)?

2. Running of the study programme in Catalonia
2.1 Study activities

Distribution of teaching activity: State the class hours and the distribution of the subjects in
the timetable. Duration of the teaching periods.

Practical dimension of the curriculum: Specifications of work experience/placement and the
final year project/dissertation, where applicable, stating:

Regarding the final year project/dissertation, and where applicable, describe the policy for
decision making, in terms of both its nature and the academic discipline.
2.2 Student assessment
“Students should be assessed using published criteria, regulations and procedures which are
applied consistently”. ESG 1.3
Describe the following aspects:

The types of exams that will be used (test, oral, etc.).

The mechanisms for correcting exams (with the participation of the awarding institution),
the criteria for assessment and the schedule for assessment (final exams, mid-term exams,
continuous assessment, etc.).

Criteria to average out term or yearly grades in different courses.

How and when the students are informed about the results of mid-term and final exams.

Regulations regarding exam review.

Where applicable, the mechanisms for analysing the results and finding irregular trends.

Supervisory mechanisms used by the awarding institution for student assessment.
3. Resources
“Institutions should have ways of satisfying themselves that staff involved with the teaching of
students are qualified and competent to do so. They should be available to those undertaking
external reviews, and commented upon in reports.” ESG 1.4
“Institutions should ensure that the resources available for the support of student learning are
adequate and appropriate for each programme offered” ESG 1.5
3.1 Overall viability of the project

State the institution’s overall objectives regarding the running of the programme.

Reasons justifying the programme’s introduction in Catalonia.

Anticipated demand for places on the programme.

Provide the required evidence for the necessary financial resources that will ensure the
project’s viability and give details of the providing institution’s income and expenditure as
precisely as possible and on an annual basis from the start of the activities to when the
programme is fully running.

In addition, specify the resources and provide evidence of the financial agreements to
endorse funding (asset backing, mortgage guarantees, etc.).
3.2 Quality of the teaching staff

State the anticipated teacher/student ratio.

Report on the working time assignment of the teaching staff on the degree programme.

For each course, state the staff in charge of teaching.
3.3 Administrative and service staff

Report on the administrative and service staff associated with the degree programme:
name, category and times that the administrative (secretary’s) office is open.
3.4 Facilities (physical space and equipment)
During the site visit, an assessment is made of the institution’s facilities, and in particular those
that will be used for the degree programme requesting authorisation. This will mainly cover:

The classrooms with their audio-visual equipment.

Specific rooms, such as laboratories where practicals will be held.

The library: capacity, number of places, physical conditions and functionality, technical
equipment, organisation of the collection, access to other sources (number of journal
subscriptions, number of specific monographs), reference and access systems, and
opening hours.

ICT (information and communications technologies): specific ICT spaces, access.

Complementary services: restaurants, cafeterias, printing services, sports services, cultural
services.

An assessment will also be made of compliance with the regulations regarding
handicapped persons.
3.5 Specific collaborations in teaching and research
Documentation must be submitted that attests to the points referring to:

The mobility of teaching staff (co-teaching, visiting lecturers, etc.)

Collaboration in research projects and activities (please specify projects, researchers,
funding body, etc.).

4. Quality assurance system
“Institutions should have a policy and associated procedures for the assurance of the quality
and standards of their programmes and awards. They should also commit themselves explicitly
to the development of a culture which recognises the importance of quality, and quality
assurance, in their work. To achieve this, institutions should develop and implement a strategy
for the continuous enhancement of quality. The strategy, policy and procedures should have a
formal status and be publicly available. They should also include a role for students and other
stakeholders.” ESG 1.1
“Institutions should have formal mechanisms for the approval, periodic review and monitoring
of their programmes and awards.” ESG 1.2
“Institutions should ensure that they collect, analyse and use relevant information for the
effective management of their programmes of study and other activities.” ESG 1.6
Bearing in mind that the programme design and its quality assurance, which is paramount with
regard to general objectives and content, are done by the awarding institution, the providing
institution in Catalonia will need to provide information on:

The existence of an institutional quality plan.

The level at which the different stakeholders in the degree programme are involved in
defining the objectives for enhancement .

Procedures to be used to establish the level of achievement of the learning outcomes.

In the case where the running of the programme is brought to an end or if the providing
institution were to close, the providing institution’s mechanisms to ensure the safe-keeping
of the student transcripts.

The structure of the report sent by the providing institution to the awarding institution.

The indicators to be used for the monitoring of programme quality.

Procedures at the providing institution for receiving information from the awarding
institution so that the programme content and assessment activities can be updated and
reference indicators be provided on the delivery of the programme at the awarding
institution’s campus.

The system for receiving and dealing with complaints and suggestions made by the
students.

C. THE EXTERNAL QUALITY REVIEW OF HIGHER EDUCATION
INSTITUTIONS DELIVERING FOREIGN STUDY PROGRAMMES
IN CATALONIA
Informative requirements for degree-awarding HE institutions
1. Introduction
According to article 113 of the Catalan Universities Act (LUC) 1/2003, the Government of
Catalonia is the administration responsible for the authorisation of the provision of foreign study
programmes by all higher education institutions established in Catalonia.
Article 113 also states that AQU Catalunya is the corresponding QA agency that carries out the
quality assurance of this provision. Such quality assurance is not for the purpose of official
recognition of a degree in Spain, but to safeguard the rights of students and to protect them
against courses being offered that are either fraudulent or of low quality.
In the process of authorisation laid down by the Government of Catalonia, two important
documents are required:
a) A diplomatic certification, in which the corresponding national recognition authority
guarantees: a) the legal status of the degree-awarding HE institution (in country A) and
b) recognition of the degree (to be delivered in Catalonia) in country A.
b) A copy of the agreement between the degree-awarding HE institution (in country A) and
the providing institution (in Catalonia providing the educational services) is required by
the Government of Catalonia. This is required in all cases in which both institutions
(awarding and providing) are independent.
Together with this documentation and prior to an external review of the quality of the
educational services, the short questionnaire below is to be completed by the awarding HE
institution. Short, specific answers would be appreciated.
The questionnaire should be signed by:
a) The highest-level academic coordinator/manager at the degree-awarding HE institution.
b) The academic coordinator/manager at the degree-awarding HE who will monitor the
quality of the study programme being delivered in Catalonia.

them and the programme delivered in Catalonia by your institution. Give information on

1.3 Networking within the scope of the programme
a) Have any agreements to deliver the same or similar programmes been signed between
your institution and other foreign universities? If so, please give details and answer
questions b and c; if not, go on to part 2.
b) To what extent do students who are registered in programmes awarded by your
institution but delivered by other institutions have access to student services at your
institution? (e.g. remote access to the library, graduates’ register, alumni associations,
etc.)
c) Do the general admission requirements at your institution also apply to foreign
students? If not, what are the admission requirements for foreign students?
Part 2: Internal quality assurance
a) Student admission requirements: Mechanisms to ensure that student requirements and
procedures at the home campus and at the new site of the providing institution in
Catalonia are the same.

APPENDIX I. LEGAL FRAMEWORK [ca]
Des d’un punt de vista legal, segons l’article 86.1 de la Llei orgànica 6/2001, de 21 de
desembre, d’universitats (LOU) sobre els centres que imparteixen ensenyaments d’acord
amb els sistemes educatius estrangers:
1. El Gobierno, previo informe del Consejo de Coordinación Universitaria, regulará el
marco general en el que habrán de impartirse en España enseñanzas conducentes a la
obtención de títulos extranjeros de educación superior universitaria, así como las
condiciones que habrán de reunir los centros que pretendan impartir tales enseñanzas.
El establecimiento en España de centros que, bajo cualquier modalidad, impartan las
enseñanzas a que se refiere el párrafo anterior, requerirá la autorización del órgano
competente de la Comunidad Autónoma en cuyo territorio se pretenda el establecimiento,
previo informe del Consejo de Coordinación Universitaria.
Segons l’article 113 de la Llei 1/2003, de 19 de febrer, d’universitats de Catalunya (LUC)
sobre centres docents que expedeixen títols estrangers:
1. Correspon al departament competent en matèria d’universitats autoritzar els centres
docents que es vulguin establir a Catalunya per a impartir, sota qualsevol modalitat,
ensenyaments conduents a l’obtenció de títols d’educació superior universitària no
homologats als títols universitaris oficials, i també revocar-ne l’autorització.
2. L’autorització a què es refereix l’apartat 1 requereix l’informe previ favorable de
l’Agència per a la Qualitat del Sistema Universitari de Catalunya (AQU Catalunya),
d’acord amb els estàndards de qualitat que l’Agència hagi elaborat per a aquests tipus de
centres.
Article 114. Funcions inspectores i comprovació dels requisits
El departament competent en matèria d’universitats ha d’exercir la funció inspectora per a
garantir que les universitats i els centres universitaris compleixen els requisits establerts
per la normativa vigent en relació amb les actuacions regulades per aquest capítol i, si
escau, els compromisos adquirits pels titulars de les universitats i els centres universitaris
privats.
Article 140. Objectiu i funcions
1. L’Agència per a la Qualitat del Sistema Universitari de Catalunya té com a objectiu
l’avaluació, l’acreditació i la certificació de la qualitat en l’àmbit de les universitats i dels
centres d’ensenyament superior de Catalunya.

2. Corresponen a l’Agència les funcions següents:
d) L’avaluació dels centres docents establerts a Catalunya que imparteixen
ensenyaments conduents a l’obtenció de títols estrangers d’educació superior
universitària.
La guia proposada per AQU Catalunya pren en consideració els aspectes vigents del marc
legal del Reial decret 557/1991, de 12 d’abril, i de l’Ordre del MEC de 26 de maig de 1993:

Artículo 19
1. El establecimiento en España de centros extranjeros para impartir enseñanzas de nivel
universitario, sea cual fuere su modalidad de enseñanza, conforme a sistemas educativos
vigentes en otros países, no conducentes a la obtención de títulos homologables a los
españoles, se ajustará a lo que disponga la Administración competente al autorizarlos. En
todo caso, será precisa la acreditación a que se refiere la letra b del apartado uno del
artículo 18, así como el expediente previsto en el apartado dos de dicho artículo. Dicha
autorización podrá ser revocada en caso de incumplimiento de las condiciones generales,
imputables al titular del centro.
2. La autorización no conlleva, por sí misma, el derecho a la homologación automática en
España de los estudios que se impartan en dichos centros. Para la homologación, en su
caso, de las titulaciones correspondientes se estará a lo dispuesto en la normativa
general sobre homologación de títulos extranjeros de educación superior.
Artículo 18
1. b) Acreditar que están debidamente constituidos con arreglo a la legislación del país
conforme a cuyo sistema educativo pretenda impartir las enseñanzas, que los títulos y
planes de estudios necesarios para obtenerlos están debidamente reconocidos, que las
enseñanzas tendrán plena validez en el referido país y que el centro quedará sometido,
por lo que a su sistema educativo se refiere, a la inspección de los correspondientes
poderes públicos, sin perjuicio de lo establecido en el convenio de adscripción. La
acreditación de estos requisitos se hará con certificación expedida al efecto por la
representación acreditada en España del país conforme a cuyo sistema educativo se
haya de impartir la enseñanza.
2. El expediente de autorización requerirá el informe del Ministerio de Educación y
Ciencia, así como del de Asuntos Exteriores, sobre la conveniencia de la misma basada
en la existencia de tratados o convenios internacionales suscritos por España y, en su
defecto, en el principio de reciprocidad.

Autorización de centros universitarios extranjeros no adscritos a universidades públicas
Octavo. Expediente de autorización
Uno. Sin perjuicio de las previsiones contenidas en los tratados o convenios suscritos por
España y, en su defecto, del principio de reciprocidad, el expediente de autorización para
la apertura y funcionamiento en España de centros extranjeros, no radicados en
comunidades autónomas con competencias en materia de enseñanza superior, que
impartan enseñanzas de nivel universitario conforme a sistemas educativos vigentes en
otros países, sea cual fuere su modalidad y no conducentes a títulos homologables a los
españoles, se iniciará mediante solicitud dirigida al ministro de Educación y Ciencia, que
se presentará en el registro general del Ministerio de Educación y Ciencia o por
cualquiera de los medios previstos en el artículo 38.4 de la Ley 30/1992, de 26 de
noviembre, de régimen jurídico de las administraciones publicas y procedimiento
administrativo común.
Dos. La solicitud a que hace referencia el apartado anterior deberá contener los
siguientes extremos:
a) Los datos de identificación de la persona física o jurídica promotora del centro.
b) La denominación específica de éste.
c) El municipio, la entidad de población y el domicilio exacto en donde esté situado o haya
de ubicarse el centro.
d) Las enseñanzas a impartir.
Tres. Dicha solicitud deberá ir acompañada de los siguientes documentos y
justificaciones:
a) Personalidad de los promotores. Acreditada en la forma señalada en la letra c del
apartado dos de la disposición segunda.
b) Enseñanzas a impartir. Justificación de las enseñanzas que pretendan impartirse, con
indicación del curso académico en que, de autorizarse el centro, darán comienzo sus
actividades y el calendario para la implantación completa de las distintas enseñanzas,
con expresión del número total de puestos escolares que pretenden cubrirse, curso a
curso, hasta alcanzar el pleno rendimiento, requisitos para su acceso y nacionalidad de
los alumnos.
c) Profesorado. Justificación de la plantilla de profesorado con que contará el centro
cuando alcance el pleno rendimiento, indicando el número de los que dispondrá en cada
curso, desde el comienzo de sus actividades, su dedicación y titulaciones de los mismos.
d) Personal de administración y servicios. Justificada en la forma señalada en la letra g
del apartado dos de la disposición segunda.

e) Edificios e instalaciones. Memoria justificativa de los edificios e instalaciones
centro, existentes y proyectados, con indicación en este último caso del plazo
ejecución. En todo caso, se especificará la localidad y el domicilio donde haya
ubicarse, sus espacios y superficies, y se justificará la titularidad jurídica sobre
mismos.

f) Tiempo de funcionamiento. Compromiso de mantener en funcionamiento el centro al
menos durante el tiempo que permita finalizar sus estudios a los alumnos que lo hayan
iniciado en el mismo.
g) Estudio económico. Se aportarán los estudios económicos básicos que aseguren la
viabilidad del proyecto, evaluando con la máxima aproximación los ingresos y gastos del
centro, detallándolo por anualidades desde el comienzo de las actividades hasta su pleno
rendimiento.
h) Financiación. Se especificarán los recursos y se aportarán las garantías financieras a
que se refiere la letra i del apartado dos de la disposición segunda.
i) Planes de estudios. Se precisarán los cursos o créditos a impartir y, en el caso de
enseñanzas regladas, se adjuntarán sus planes de estudios con indicación de la carga
lectiva de los mismos.
j) Convenio de colaboración. En el supuesto de que se haya suscrito con universidades o
centros universitarios españoles.
Cuatro. A la documentación enumerada en el apartado anterior se unirá la certificación a
que se refiere el párrafo segundo del apartado tres de la disposición segunda de la
presente orden.
Cinco. Los documentos antes citados deberán presentarse en la forma indicada en el
apartado cuatro de la citada disposición segunda.

APPENDIX II. QUALITY ASSESSMENT COMMISSION
The AQU Quality Assessment Commission (CAQ) is a standing review body set up under by
way of article 144 of Law 1/2003 of 19 February on Universities in Catalonia (LUC/Catalan
Universities Act). The commission’s composition and functions are specified in Decree
93/2003 of 1 April, whereby the Statutes of the Agència per a la Qualitat del Sistema
Universitari de Catalunya (Catalan University Quality Assurance Agency/AQU Catalunya)
were endorsed.
Approval for the Guide to the review of institutions offering foreign degrees in Catalonia was
given by the Quality Assessment Commission on 8 April 2011. The commission’s
