PARENTAL RIGHTS AND RESPONSIBILITIES
26.003. RIGHTS CONCERNING ACADEMIC PROGRAMS.
a) A parent is entitled to:
1) petition the board of trustees designating the school in the district that the parent’s child will attend, as provided
by Section 25.033;
2) reasonable access to the school principal, or to a designated administrator with the authority to reassign a
student, to request a change in the class or teacher to which the parent’s child has been assigned, if the reassignment or change would
not affect the assignment or reassignment of another student;
3) request, with the expectation that the request will not be unreasonably denied:
A) the addition of a specific academic class in the course of study of the parent’s child in keeping with
the required curriculum if sufficient interest is shown in the addition of the class to make it economically practical to offer the class;
B) that the parent’s child be permitted to attend a class for credit above the child’s grade level, whether
in the child’s school or another school, unless the board or its designated representative expects that the child cannot perform
satisfactorily in the class; or
C) that the parent’s child be permitted to graduate from high school earlier than the child would
normally graduate, if the child completes each course required for graduation; and
4) have a child who graduates early as provided by Subdivision (3)(C) participate in graduation ceremonies at
the time the child graduates.
b) The decision of the board of trustees concerning a request described by Subsection (a)(2) or (3) is final and may not be
appealed.

26.004. ACCESS TO STUDENT RECORDS. A parent is entitled to access all written records of a school district concerning the
parent’s child, including:
1) attendance records; 2) test scores; 3) grades; 4) disciplinary records; 5) counseling records; 6)
psychological records; 7) applications for admission; 8) health and immunization information; 9) teacher and counselor evaluations;
and 10) reports of behavioral patterns.

26.005. ACCESS TO STATE ASSESSMENTS. Except as provided by Section 39.023(e), a parent is entitled to access to a copy of
each state assessment instrument administered under Section 39.023 to the parent’s child.

26.006. ACCESS TO TEACHING MATERIALS.
a) a parent is entitled to:
1) review all teaching materials, textbooks, and other teaching aids used in the classroom of the parent’s child; and
2) review each test administered to the parent’s child after the test is
administered.
b) A school district shall make teaching materials and tests readily available for review by parents. The district may specify
reasonable hours for review.
c) A student’s parent is entitled to request that the school district or open-enrollment charter school the student attends allow
the student to take home any textbook used by the student. Subject to the availability of a textbook, the district or school shall honor
the request. A student who takes home a textbook must return the textbook to the school at the beginning of the next school day if
requested to do so by the student’s teacher. In this subsection, “textbook” has the meaning assigned by Section 31.002.

26.007. ACCESS TO BOARD MEETINGS.
a) A parent is entitled to complete access to any meeting of the board of trustees of the school district, other than a closed
meeting held in compliance with Subchapters D and E, Chapter 551, Government Code.
b) A board of trustees of a school district must hold each public meeting of the board within the boundaries of the district
except as required by law or except to hold a joint meeting with another district or with another government entity, as defined by
Section 2051.041, Government Code, if the boundaries of the governmental entity are in whole or in part within the boundaries of the
district. All public meetings must comply with Chapter 551, Government Code.

26.008. RIGHT TO FULL INFORMATION CONCERNING STUDENT.
a) A parent is entitled to full information regarding the school activities of a parent’s child except as provided by Section
38.004.
b) An attempt by any school district employee to encourage or coerce a child to withhold information from the child’s
parent is grounds for discipline under Section 21.104, 21.156, or 21.211, as applicable.

26.009. CONSENT REQUIRED FOR CERTAIN ACTIVITIES.
a) An employee of a school district must obtain the written consent of a child’s parent before the employee may:
1) conduct a psychological examination, test, or treatment, unless the examination, test or treatment is required
under Section 38.004 or state or federal law regarding requirements for special education; or
2) make or authorize the making of a videotape of a child or record or authorize the recording of a child’s voice.
b) An employee of a school district is not required to obtain the consent of a child’s parent before the employee may make a
videotape of a child or authorize the recording of a child’s voice if the videotape or voice recording is to be used only for: 1) purposes
of safety, including the maintenance of order and discipline in common areas of school or on school buses; 2) a purpose related to a
cocurricular or extracurricular activity; 3) a purpose related to regular classroom instruction; or 4) media coverage of the school.

26.010. EXEMPTION FROM INSTRUCTION.
a) A parent is entitled to remove the parent’s child temporarily from a class or other school activity that conflicts with the
parent’s religious or moral beliefs if the parent presents or delivers to the teacher of the parent’s child a written statement authorizing
the removal of the child from the class or other school activity. A parent is not entitled to remove the parent’s child from a class or
other school activity to avoid a test or to prevent the child from taking a subject for an entire semester.
b) This section does not exempt a child from satisfying grade level or graduation requirements in a manner acceptable to the
school district and the agency.

26.011. COMPLAINTS. The board of trustees of each school shall adopt a grievance procedure under which the board shall
address each complaint that the board receives concerning violation of a right guaranteed by this chapter.

Sec. 26.003. Derechos sobre Programs Academicos.
a) El padre tiene derecho a:
1) solicitar a la mesa directiva que designa la escuela en el distrito a la asistirá el/la hijo(a) del padre, según
la Sección 25.033;
2) acceso razonable al director de la escuela , o al administrador asignado con la autoridad de re-asignar al
alunmo, para solicitar un cambio de clase o de maestro a quién ha sido asignado su hijo(a), si esta re-asignación o cambio no
afecta a la asignación de otro alunmo;
3) solicitar, con la expectiva de que no se negará la petición irracionalmente:
a) la adición de una clase académica específica en el programa de studio de/la hijo(a) del padre
de acuerdo con el programa requerido si se manifesta suficiente interes para agregar y ofrecer la clase y hacerlo
económicamente prático.
b) que se le permita al/la hijo(a) del padre asistir a una clase de un nivel mas alto del cursado por
el hijo(a) para credito extra. Estas clases se
impartiran en la escuela propia del/la niño(a), o en otra escuela excepto si la
mesa directiva o sus representantes designados esperan que el/la niño(a) no pueda funcionar satisfactoriamente en esa clase.
c) que se le permita al/la hijo(a) del padre que se gradue de high school anted del tiempo normal, si
el alumno completa los requisitos para graduarse;
4) que un alumno que se gradua antes del tiempo normal, según se estipula en la Subdivisión (3) (c),
participe en las ceremonias de graduación cuando termine los requisitos de graduación.
b) La decision tomada por la mesa directiva sobre la petición descrita en la Subsección (a)(2) o (3) es final y no se
puede apelar.
Sec. 26.004. Acceso a Récords Estudiantiles.
El padre tiene derecho al acceso a todos los récords escritos del distrito escolar
relacionados a el/la hijo(a) del padre,
incluyendo: 1) récords de asistencia; 2) calificaciónes en los exámenes; 3) notas de calificación; 4) récords de disciplina; 5)
récords de asesoría; 6) récords psicológicos; 7) solicitudes de admisión; 8) datos de salud y vacunas; 9) evaluaciónes de
maestros y consejeros; 10) informes sobre patrones de comportamiento
26.005. Acceso a las Evaluaciones Estatles.
Excepto como se estipule en la Sección 39.023 (e), un padre tiene derecho al acceso a una copia de cada instrumento evaluative
que se le administre bajo Sección 39.023 al/la hijo(a) del padre.
26.006. Acceso a los Materiales de Enseñanza.
a) El padre tiene derecho a:
1)revisar todos los materiales de enseñanza, libros de texto, y otros materiales auxiliares de enseñanza
utilizados en el salon de clase de su hijo(a); y
2)revisar cada prueba que se le administre al/la hijo(a) del padre después de que se le administre
b) El distrito escolar hará fácilmente disponible los materiales de enseñanza para que los padres de familia los pueda
revisar. El distrito especificará loas horas razonables para esta revision.
c) Los padres del alumno tienen derecho a solicitar que el distrito escolar o la escuela alternativa de inscripciones abiertas a la que
asiste el alumno, preste al estudiante cualquier libro de texto que sea necesario. El distrito o la escuela cumplirá con la solicitud, según
la disponibilidad de libros. Un alumno que pida prestado algun libro tendrá que devolverlo a la escuela al inicio del siguiente día
escolar si el maestro del niño(a) así lo pide. En esta subsección, “libro de texto”: tiene el significado asignado en Sección 31.002.
Sec.26.007. Acceso a las Reuniones de la Mesa Directiva.
a) El padre tiene derecho a un completo aceso a cualquier reunion de la mesa directiva del distrito escolar, excepto cuando
es una reunion cerrada de acuerdo con lo estipulado en Subcapítulos D y E, Capítulo 551, Código Gubernamental.
b) La mesa directiva de un distrito escolar tiene que celebrar cada reunion pública de la mesa directiva dentro de los límites
del distrito, exepto cuando se requiera de otra manera por ley o para celebrar una reunión conjuntamente en otro distrito. Todas las
reuniones públicas tiene que ser de acuerdo al Capítulo 551 del Código Gubernamental.
Sec.26.008. Derecho a Información Completa Sobre el Alumno.
a) El padre de familia tiene derecho a toda la información sobre las actividades escolares del/la hijo(a) del padre, excepto
como es estipula en la Sección 38.004.
b) Cualquier intento de parte de algun empleado del distrito escolar de promover o obligar al niño(a) a que oculte
información a su padre es razón suficiente para acción disciplinaria bajo la Sección 21.104, 21.156, 21.211, según sea applicable.
Sec. 26.009. Consentimiento Requerido para Ciertas Actividades.
a) El empleado del distrito escolar tiene que obtener un consentimento por escrito del padre de un(a) niño(a) antes que el
empleado pueda:
1) hacerle un examen, una prueba o un tratamiento psicológico, excepto si este examen, prueba o tratamiento se
requiera bajo la Sección 38.004 o por ley estatal o federal relacionada a los requisitos para educación especial; o
2) hacer, o autorizar que se haga, una grabación en video del/la niño(a), o hacer o autorizar que se haga una audio
grabación de la voz del/la niño(a).
b) No se le requiere al empleado del distrito obtener el consentimiento del padre de un(a) niño(a), antes de que el empleado
pueda hacer una grabación de su voz se utilizará solamente para:
1) los propósitos de seguridad, incluyendo el mantenimiento de orden y disciplina en las áreas de uso común de la
escuela o en los autobuses escolares;
2) un propósito relacionado a actividades co-curriculares o extra-curriculares
3) un propósito relacionado a la instrucción regular en el salón de clase; o
4) la cobertura de la escuela por algun medio de comunicación
Sec. 26.010. Extención de Instrucción.
a) El padre tiene derecho a sacar temporalmente al/la hijo(a) de una clase o de alguna actividad escolar que represente un
conflicto con las creencias religiosas o morales, si el padre le presenta o le entrega al maestro una declaración por escrito autorizando la
separación del/la niño(a) de la clase o otra actividad escolar. El padre no tiene el derecho a sacar al/la hijo(a) de la clase o de alguna
actividad escolar para evitar un examen o para evitar que el/la niño(a) tome un curso durante el semestre entero.
b) Esta sección no exenta a un(a) niño(a) de tener que satisfacer los requisitos academicos del año escolar o los requisitos de
graduación de una manera acceptable para el distrito escolar y para la agencia de educación estatal.
Sec. 26.011. Quejas.
La mesa directiva de cada distrito escolar adoptará un procedimiento de quejas bajo el cual los directivos tratarán a cada
queja que reciben respecto a la violación de los derechos garantizados en este capítulo.

LFCISD IS A TITLE I DISTRICT
Title I of the No Child Left Behind Act of 2001 (formerly known as ECIA, ESEA or Chapter I)
is the largest federally funded educational program. This program, authorized by
Congress, provides supplemental funds to school districts to assist schools with the highest
student concentrations of poverty to meet school educational goals. Los Fresnos CISD
receives federal funding for this purpose.
Schools qualify based on demonstrating that the K-12, ages 5-17, membership has a
sufficiently high percentage of economically disadvantaged students. In this district, Title I
funds are school-wide since our district show that at least 40% of the enrolled students are
eligible to receive a free or reduced price meal on the 100th day of school. Los Fresnos CISD
is a Title I district.

TITULO I
La ley Titulo I del Acto de No Child Left Behind del 2001 (conocido antes como ECIA, ESEA o
el Capitulo I) es el programa educativo que mas recibe fondos federales suplementales .
Este programa, autorizado por el congreso, provee fondos a los distritos escolares para
que asistan a sus escuelas con un alto numero de estudiantes catalogados como “pobres”.
Los fondos recibidos se utilizan para ayudar a estos estudiantes a alcanzar las metas
educativas de la escuela. Los Fresnos CISD recibe fondos federales para esta meta.
Los distritos pueden calificar demonstrando que por lo menos el 40% o mas de los
estudiantes en sus escuelas que cursan los grados K-12, de 5-17 años de edad, son elegibles
para recibir comida gratis o a precio reducido al final del centesimo (100) dia de clase. En
Los Fresnos CISD, los fondos del Titulo I son distribuidos a todas las escuelas porque por lo
menos el 40% de todos los alumnos en nuestras escuelas reciben comida gratis o a precio
reducido. Los Fresnos CISD es un distrito bajo el programa Titulo I.
