Statement of Facts. Explain the facts of your case. (Your answer must be provided in the space
allowed.)
This is an action riddled with issues and errors. The Appellant was the Husband, and
Respondent was the wife. The parties were both natives of El Salvador, and were married in El
Salvador. El Salvador law states in its Family Law Code, Article 10, regarding Exterritorial
Rights: "The national in spite of his residence or address in a foreign country, shall remain
sub'ect to this code in relation to the erson obli • ations and ri 'hIs that are formed via the

relationship of forming_a family." See Exhibit "1". The parties were aware that El Salvador
does not recognize a Nevada divorce of its citizens. Due to the discord in the relationship over
the years, the parties agreed to separate assets and debts between themselves, and that Appellant
would obtain the proper El Salvadorian Decree of Divorce by paying for the process of divorce in
El Salvador. They agreed to a division of property and debts. and ultimately separated. The
evidence of the agreed of the pro_perty settlement is evidenced by the fact that Appellant herein
a • reed to award Res • ondent the • arties' most si • nificant asset: the communit residence.
Exhibit "2" is the Quitclaim Deed where the residence was transferred from the parties to
Res ondent on 10/2/09. Appellant kept personal propertyhis ossession . and Respondent •
ke tpersonal property in her possession. In fact, Appellant paid all community debts at that
time. There was one remaining minor child at the time of the divorce, and the parties had
worked out custody between themselves. Then A mellant went to El Salvador and be an the
process for a proper El Salvadorian divorce.
The parties' lived under the process of a divorce until Respondent desired to refinance the
former communi residence and take out some mone . To do so Res • ondent needed not onl
the Iuitclaim Deed but also a Decree of Divorce. Kee in mind both sarties are from El
Salvador and the do not know the lan ua e well nor the laws in the United States let alone
Nevada. When Respondent informed Plaintiff she needed a divorce in Nevada for Respondent's
benefit, the parties agreed Appellant would file for divorce in Nevada, although it was not valid
in El Salvador, as it would allow her to refinance the residence. To actually accomplish this was
a tragedy of errors, both procedurally and legally.

First although the parties had an ongoing divorce action nearly complete, in El Salvador
Plaintiff prepared a Nevada COMPLAINT FOR DIVORCE form, in proper person, simply
seeking a status divorce. He indicated there were no children, property or debts to be divided,as
these property and debts were address in El Salvador. The truth is, he had no idea how to fill out
the form. He filed it on 2/7/12, and served it on 2/25/12. He submitted a Decree of Divorce
which was filed 4/17/12, without having filed a DEFAULT. Clearly, that in itself was court
error, because the proper document [default] were not even filed. A DE ellant does not know wh
but thereafter, Respondent obtained an attorney and filed a motion to set aside the Decree of
Divorce, alleging Appellant's family members said Appellant bragged he got a divorce and all
the

sto throu hout the action. It is CLEAR that Res sondent • ot the marital residence refinanced it
and took out money. This demonstrates KNOWLEDGE of the parties' agreement to divide
ro e - but the court made the findin that there is not evidence of an a reement: If not
Appellant is entitled to 1/2 the value of the residence to offset the financial damage created by this
finding. The money would pay his alimony obligation. Appellant had no real property in
Nevada, except the former residence. He got two vehicles - both of which were in El Salvador,
and therefore not subject to division by this court - and Respondent got two vehicles. And each
party received their personal property. At the time, the parties agreed to this. However u o n
obtainin an attome in Nevada Res • ondent was convinced she would financiall benefit from
_ignoring the parties' a reel /lent as to the divorce of property and debts . and ignoring the proper
jurisdiction of the El Salvador divorce.

The court set the Nevada Decree if Divorce filed 4/17/12 aside, and allowed the parties to
litigate the matter in Nevada. Appellant was confused and also sought counsel to represent his
interest. The court alwa s had a translator resent for the • arties. His first attorne had to ar ue
that he was not seeking to commit fraud for not disclosingthe parties have a child, as the Decree
of Divorce in Nevada was solely to address the real property being placed in Respondents' name,
to assure A Duellant had no marital interest in the

after executing a Quitclaim deed..
Thus, the issue of the El Salvadorean Divorce action was never brought up in the court at that
time.
Appellant was informed by counsel that this court would take jurisdiction over child
custody and child support issues because the child was in Nevada for the requisite six months
under the UCCJEA. And the issues of custod visitation and su ort - to 'ether with attorne
fees - continued to be litigated.
There was no mention of the El Salvador divorce in the record until 3/14/13, when
Appellant filed the translated Divorce Decree from El Salvador. See Exhibit "3"
On 4/2/13, Appellant filed a Motion to Dismiss Action Due to Lack of Jurisdiction. This
motion addressed the existence of the El Salvador Divorce Decree, and requested the court give
full faith and credit to the El Salvador divorce. At a minimum, this prima facea evidence should
have iiven necessi to an evidentia hearin to determine which court had *urisdiction - and as
to what. Appellant's position was that the El Salvador had jurisdiction over the issue of the
divorce action any alimony award,and property and debts leaving Nevada with only subject
matter jurisdiction over the minor child, and to address custody, visitation and child sujiort. In

showing publication in the El Salvadorean newspaper - as required under El Salvadorean Law if
the other party is unable to be located, or resides outside the Country of El Salvador. Exhibit'
The matter was administratively reassigned from Dept D. To Dept C during this action.,
on or about 4/15/13. This complicated the matter further, as Dept C has no sitting judge at this
time due to the criminal proceedings and suspension of Judge Stephen Jones. Instead, there are
several rotating visiting Senior Judges, givingiis action a completec of consistency.
When Appellant's motion to dismiss due to lack of jurisdiction went before the court on
5/6/13 the minutes reflect Judicial Officer Steven E. Jones; however, it was actually heard by
Judge Gerald Hardcastle. The minutes state, "Court stated it has read the motion and finds there
was an opposition filed this morning. Court also finds that the foreign judgment has not been
authenticated. Should the court recognize that decree as having resolved those issues, the
doctrine of "comity" requires that that decree be taken with the same decree of fairness and
respect that this country requires from foreign decrees. Therefore, COURT ORDERED it will
not DENY the Motion this date, however, will continue it to the time of trial." Appellant was to
provide evidence of authentication - which he did, by providing supplemental records. See
Exhibit "5", minutes. NOTE: It appears an ORDER was never prepared by either attorney from
these minutes althou h the court ORDERED Res ondent's attorne to re sare this Order - and
this is the heart of Appellant's case.
The matter went to trial on 6/18/13. The trial was heard by Visiting Judge Ames making it the third judge to hear this matter. The court made a determination that it has
'urisdiction over the • allies sub - ect matter of the iro ert and debts and over the divorce itself.
The court made orders that fl in the face of the existin • El Salvador divorce which El Salvador
required to be made in El Salvador if parties were married in El Salvador. This court failed to
hold an evidentiary hearing c
lith of
El Salvador divorce althoughh
evidence clearly demonstrated the existence of an El Salvador divorce. There cannot be TWO
divorces: There can be only ONE. The El Salvador divorce action was initiated first. It was
completed first. And it is required to be from El Salvador by El Salvadorian law. The fact that
another divorce action was initiated first would require under UCCJEA that AT A MINIMUM
the two jurisdictions communicate. If a divorce action was initiated in California; and then in
Nevada the Nevada court would defer urisdiction because of the erior existence of the
California divorce. This is no different. It is another jurisdiction that has not only been filed
first, it has been completed first. This court sim I ignored its existence, and proceeded with
another divorce • rantm DIFFERENT terms to the earties. Which Decree of Divorce shall
prevail? We cannot simply ignore the El Salvador Divorce. We must, at a minimum, address
issues in the El Salvador divorce. When did El Salvador acquire jurisdiction? What does it have
jurisdiction over? An evidentiary

RES UIRED - Oust as an evidentia hearin • to determine sub'ect matter urisdiction over a
divorce between states or custod of children when 'urisdiction is in dis sute. While Jude
Hardcastle indicates COMITY requires the El Salvador be taken with the same decree of fairness
and respect that this country requires from foreign decrees, Judge Ames COMPLETELY
IGNORES the existence of the El Salvador Decree.
For this courts' edification, if an evidentiary hearing were granted on this matter, the
court would learn that if a party is not found in the country of El Salvador, their law requires
publication in an El Salvador newspaper. The trial court would have also learned that Appellant,
in fact corn shed with that re uirement and • ublished. Proof has been filed with this court.
A Duellant would reiterate, Respondent KNEW of the El Salvador divorce; however, since
the parties made an agreeable settlement as to Drop ertv and debts, there was no reason to contest
it. The El Salvador Divorce was proper, and should be given full faith and credit by this court.
Further, the trial court does not have never did have and cannot have subject matter
jurisdiction over the real property in El Salvador in Appellant's family name. This is his
separate prope
,
and it only ro erl
in the count or state where it lies. The trial
court has no jurisdiction over real property in El Salvador; however, the trial court awarded
Respondent one of two parcels of land in El Salvador, and Appellant two vehicles that are in El
Salvador. This was the basis for awardin Res ondent two vehicles in Nevada. This is clearl
not within the jurisdiction of the court.
Finally, this court failed to recognize th e
as to division of property and
debts - when the S uitclaim Deed Res s ondent executed for the ro e BEFORE the filin of the
Nevada divorce action which indicates that the property was transferred to "ELBA RIVAS, an
Unmarried Woman." If this is not evidence of an agreement for divorce and division of
MIT erty, what would this court accept as proof? Appellant requests the court remand this matter
to the trial court with instructions to either communicate with the El Salvador court, or hold an
evidentiary hearing to determine the significant issues of jurisdiction presented in this matter.

1. The court erred by failing to immediately determine facts about the filing of the El
Salvadorean Divorce action, such as: when was it filed? Filing alone divests this court of
jurisdiction pending determination due to the existence of a previously filed action.

2. The court erred by awarding real property in the country of El Salvador in any divorce action
in Nevada includin real as Nevada has no sub'ect matter 'urisdiction over such real or ersonal
property.
3. The court erred by awarding s osual support , perso nal
.n.d/or debt to the parties ,
which was properly under the jurisdiction of the El Salvadorean divorce action to address.
4. The court erred by failing to acknowledge the Doctrine of Comity, as set forth herein. Once
the Decree of Divorce was awarded in El Salvador, it should have been given full faith and
credit.
5. That the court failed to acknowledge the parties had made an agreement, in spite of the
evidence, including an executed QUITCLAIM DEED for the Nevada real property.

Segun el artfculo 10 del cOdigo de familia todo nacional sin importar su
residencia dentro del pals o fuera del pals, esta sujeto, en lo relativo al estado
de las personas y a las obligaciones y derechos que nacen de las relaciones de
familia, a la dispuesto en las leyes de el salvador.
Por lo que un tribunal de otro pals no tiene jurisdicciOn ni competencia para
decretar nulidades o anular resoluciones dictadas con forme a las leyes de este
pals, ya que el salvador siendo un estado soberano puede regular la forma y
los procesos para regir la convivencia y actuaciones de los actos que surte
efecto dentro del territorio.
Y en la ley de familia, claramente se establece las causales y procedimiento
para disolver el vfnculo matrimonial, y en caso de no estar conforme con la
resoluciOn dictada por el tribunal competente establece los recursos especificos
para expresar su inconformidad de acuerdo a las leyes del pals.

Attorney Oliver Melgar appearing in an unbundled
capacity this date representing the Plaintiff, Rutilio Rivas.
Court interpreter, Consuelo Cisneros, present with the
Defendant. Witnesses sworn and testified per attached
worksheet. Exhibits offered and admitted per attached
worksheet. Counsel stipulated to all exhibits being
admitted with the exception of Defendant's K and J, SO
ORDERED. Closing arguments by counsel. Matter being
submitted, the court finds that it does have jurisdiction
over the parties, property and the subject matter of the
divorce itself. The court finds that the parties are
incompatible, therefore, COURT ORDERED, absolute
DECREE of DIVORCE is GRANTED restoring both '
parties to the status of single unmarried persons with the
following terms and conditions. Parties awarded JOINT
LEGAL CUSTODY with PRIMARY PHYSICAL CUSTODY
to the Defendant. Plaintiff will have visitation from Friday
night to Sunday with the exchanges taking place at 5:00
p.m. Receiving party to provide transportation. The court
finds that the Plaintiff makes sufficient money, he maxes
out at the new amount, therefore, CHILD SUPPORT will
be set at $794.00 per month, with one half of the payment
due on the 5th of each and every month and the other half
due on the 20th of each and every month, with the first
payment due 9/5/13. Parties are to provide health
insurance for the minor child if available through their
employer. Any unreimbursed medical expenses are to be
shared equally between the parties with the 30/30 day
rule in place. The court finds that the Defendant was not '
servedwith the documents either the El Salvador divorce
of the divorce from the Eight Judicial District, which has
already been set aside: Furthermore, the case law
requires this court to assume that the taw in El Salvador is
the same as here unless it is specifically shown other
wise, therefore, the court is not going to recognize the
divorce in El Salvador. Furthermore, the court does not
believe and doesn't find the parties to have entered into a
full agreement of the division of the property, therefore,

that belongs to the Defendant is to be divided pursuant to
the Fondi formula. Defendant will be awarded the
Mercedes and the Nissan, Plaintiff will be awarded the
Ford Explorer, the two BMWs and the Jaguar. Defendant
will be awarded the marital residence located on
Summertime Drive along with any encumbrance and is to
hold the Plaintiff therefrom. The real property in El
Salvador, the court finds that both properties are valued at
$40,000.00 each. Plaintiff is to deed the property in
Coultepeke to the Defendant and Plaintiff will be awarded.

to them as their sole separate property. Any debts that the
parties respective names will be their sole and separate
responsibility and are to hold each other harmless
therefrom. As to ALIMONY, the court believes it is proper

is awarded alimony in the amount of $500.00 per month
for a period of 12 years. The court finds that the Plaintiff
was not credible, therefore, attorney fees in the amount of
$2,500.00 is hereby awarded to the Defendant. Attorney
Acuna is to prepare the Decree of Divorce and submit to
opposing counsel for approval and signature.

The above entitled cause coming on regularly this date; Plaintiff present and represented by
17 Oliver Melgar, Esq., on an unbundled basis; Defendant represented by Enrique Acuna, Esq.; Court

1. The court finds that Defendant was not served with the documents either the El Salvador
22 divorce or the divorce from the Eighth Judicial District, which has already been set aside.

. 2. The case law requires this court to assume that the law in El Salvador is the same as here
24 unless it is specifically shown otherwise, therefore, the court is not going to recognize the divorce
25 in El Salvador.

This Court has complete jurisdiction in the premises, both as to the subject matter thereof as
2 well as the parties thereto; that Plaintiff now is, and has been an actual and bona fide resident of the
3
County of Clark, State of Nevada, and has been actually domiciled therein for more than six weeks
4
immediately preceding the commencement of this action; all allegations contained in the Complaint
5
are true as therein alleged and the parties are entitled to a Decree of Divorce on the ground as set
6 forth herein; and the parties have waived findings of Fact, Conclusions of Law ind written Notice
of Entry of Judgment in said cause:

NOW, THEREFORE, IT IS HEREBY ORDERED, ADJUDGED AND DECREED, the
9 bonds of matrimony now and heretofore existing between Plaintiff and Defendant are dissolved, set
10 aside and forever held for naught, and that the parties hereto, and each of them, be restored to their
11 unmarried states.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that, over the objection of
Plaintiff, the court finds this is not solely a custody action, with the division of real property in the
14 State of Nevada, but that this is a divorce action, and the court finds it does have jurisdiction over
15
the parties, property and subject matter of the divorce itself.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the parties are awarded
17
joint legal custody of the minor child, to wit: JOANN RIVAS (DOB: 6/1/2004) with Defendant
18
having primary physical custody. Plaintiff shall have visitation from Friday night to Sunday, with
19 child exchanges taking place at 5 p.m. The receiving party shall provide transportation of the child.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the Plaintiff makes
21
sufficient money, he mues out the new amount, therefore, CHILD SUPPORT will be set at $794
22
per month, with one half of the payment due on the 5" of each and every month and the other half
23
due on the 20th of each and every month, with the first payment due 915/13. Parties are to provide
24 health insurance for the minor child if available through their employer. Any unreimbursed medical
25 expenses are to be shared equally between the parties with the 30/30 rule in place.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the court finds that the
27 culinary pension of Defendant is to be divided pursuant to the Fondi Formula.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the Mercedes and the
1 Nissan shall be awarded to Defendant, and the Ford Explorer, the two BMWs and the Jaguar will

2 be awarded to the Plaintiff. Defendant will be awarded the marital residence located on Summertim
3
Drive along with any encumbrance thereon, and is to hold Plaintiff harmless therefrom. The real
4 property in El Salvador, the court finds that both properties are valued at $40,000 each. Plaintiff is
6
to deed the property in Coultepeke to the Defendant and Plaintiff will be awarded the property in San
Salvador. Any other property of the parties currently have in their possession will be awarded to
7
them as their sole and separate property. Any debts that the parties respective names will be their
5
8 sole and separate responsibility and are to hold each other harmless therefrom.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED, as to ALIMONY, the court
10 believes it is proper in this case, which was a 24 year marriage, that alimony is to be awarded in the
11 sum of $500 per month for a period of 12 years. The court finds that the Plaintiff was not credible,
12 therefore, attorney fees in the amount of $2,500 is hereby awarded to the Defendant.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the parties agree to waive
the NOTICE OF ENTRY in this matter.

Pursuant to NRS 125.510(6), the parties are hereby put on notice of the following:

PENALTY FOR VIOLATION OF ORDER: THE ABDUCTION, CONCEALMENT OR
DETENTION OF A CHILD IN VIOLATION OF THIS ORDER IS PUNISHABLE AS A
CATEGORY D FELONY AS PROVIDED IN NRS 193.130. NRS 200.359 provides that
every person having a right of custody to the child who willfully detains, conceals or removes
the child from a parent, guardian or other person having lawful custody or a right of
visitation of the child in violation of an order of this court, or removes the child from the
jurisdiction of the court without the consent of either the court or all persons who have the
right to custody or visitation is subject to being punished for a category D felony as provided
in NRS 193.130.
