The results of the primary election determine the candidates who will run in the general election in November. The types of primary elections are: Presidential (Party-Nominated/Partisan Office) • Office on the ballot: U.S. President • Who can vote: Only voters who registered with the same political party as the candidate (the Democratic, American Independent, and Libertarian parties allow voters who registered with no party preference to vote in their primary). • Result: The candidate who moves on to the general election is the candidate nominated by their national political party and may not be the candidate that was elected by popular vote in the California primary election. California Open Primary (Voter-Nominated Offices) • Offices on the ballot: U.S. Senate, U.S. House of Representatives, statewide offices, and state legislative offices • Who can vote: Any voter may vote for any one candidate in each contest, regardless of party preference. • Result: The top-two candidates, regardless of party preference, who receive the most votes in each primary contest move on to the general election. After a top-two primary, a general election must be held even if one candidate receives a majority of the vote (at least 50 percent +1) and even if there is only one candidate in the primary election. California's open primary system does not apply to candidates running for U.S. President, County Central Committee, or local offices. Non-partisan offices (such as judges, county supervisors, city council members, and school board members) remain open to all eligible voters. Get out of line on Election Day! This Sample Ballot and Voter Information Pamphlet provides ballot marking instructions, polling place location, candidate information, and other important election details that you should review before you vote. You may mark your selections on your Sample Ballot and take it with you to the polls for easy reference. You have several options for voting: Vote-by-Mail – Voting by mail is convenient and easy. You will find an application to receive a Vote-by-Mail ballot on the back cover of this pamphlet. The deadline to request a Vote-by-Mail ballot is May 31. You have several options for returning your ballot: Mail your ballot in time to reach the Registrar of Voters Office by 8:00 p.m. on Election Day, or be postmarked on or before Election Day and received no later than three days after Election Day to be counted. Return your ballot in person to the Registrar of Voters Office during regular business hours and until close of polls on Election Day. For your convenience the Registrar’s office has a secure locked drop box at its entry for ballot drop off 24 hours a day. Deposit your ballot in one of the secure drop-off boxes available at designated City Clerks’ Offices from May 9 through June 6. Please visit our website to view a map of ballot drop-off locations. Take your ballot to any Polling Place (before 8:00 p.m.) in Riverside County on Election Day. You may confirm that the Registrar of Voters Office has received your returned Vote-by-Mail ballot on our website at www.voteinfo.net. Vote First, Count First! Vote-by-Mail ballots received before Election Day are counted first. Return your ballot as soon as possible to ensure that it is included in the first Election Night results! Early Voting – Vote at the Registrar of Voters Office beginning May 9 through June 6 (excluding Holidays), Monday through Friday, from 8:00 a.m. to 5:00 p.m.; Saturday, May 28 and June 4, from 9:00 a.m. to 4:00 p.m.; and Election Day, June 7, from 7:00 a.m. to 8:00 p.m. Early voting will also be available at participating malls in Riverside County on May 27 through May 29. Previously known as partisan offices, voter-nominated offices are state legislative offices, U.S. congressional offices, and state constitutional offices. In both the open primary and general elections, you can vote for any candidate regardless of what party preference you indicated on your voter registration form. In the primary election, the two candidates receiving the most votes — regardless of party preference — move on to the general election. If a candidate receives a majority of the vote (50 percent + 1), a general election still must be held. Even if there are only two candidates for an office in the open primary, a general election for that office is still required. California's open primary system does not apply to candidates running for U.S. President, County Central Committee, or local offices. California law requires that the following information be printed in this pamphlet Party-Nominated/Partisan Offices Political parties may formally nominate candidates for party-nominated/partisan offices at the primary election. A nominated candidate will represent that party as its official candidate for the specific office at the general election and the ballot will reflect an official designation. The top vote-getter for each party at the primary election moves on to the general election. Parties also elect officers of county central committees at the primary election. A voter can only vote in the primary election of the political party he or she has disclosed a preference for upon registering to vote. However, a political party may allow a person who has declined to disclose a party preference to vote in that party's primary election. Voter-Nominated Offices Political parties are not entitled to formally nominate candidates for voter-nominated offices at the primary election. A candidate nominated for a voter-nominated office at the primary election is the nominee of the people and not the official nominee of any party at the general election. A candidate for nomination to a voter-nominated office shall have his or her party preference, or lack of party preference, stated on the ballot, but the party preference designation is selected solely by the candidate and is shown for the information of the voters only. It does not mean the candidate is nominated or endorsed by the party designated, or that there is an affiliation between the party and candidate, and no candidate nominated by the voters shall be deemed to be the officially nominated candidate of any political party. In this sample ballot booklet, parties may list the candidates for voter-nominated offices who have received the party's official endorsement. Any voter may vote for any candidate for a voter-nominated office, if they meet the other qualifications required to vote for that office. The top two vote-getters at the primary election move on to the general election for the voternominated office even if both candidates have specified the same party preference designation. No party is entitled to have a candidate with its party preference designation move on to the general election, unless the candidate is one of the two highest vote-getters at the primary election. Nonpartisan State Offices Political parties are not entitled to nominate candidates for nonpartisan offices at the primary election, and a candidate at the primary election is not the official nominee of any party for the specific office at the general election. A candidate for nomination to a nonpartisan office may NOT designate his or her party preference, or lack of party preference, on the ballot. The top two vote-getters at the primary election move on to the general election for the nonpartisan office. 33-SOS RV 018-002 HO W TO USE THIS SAMPLE BALLOT 1. POLITICAL PARTY PREFERENCE: If you are not sure about your political party preference, look at the front of this booklet or at the address label on the back cover. You may also check your political party preference on our website at www.voteinfo.net or by calling (951) 486-7200. If you chose a political party preference when registering to vote you will be issued an official ballot which will include that political party’s U.S. Presidential and central committee candidates. Voter-Nominated and Nonpartisan contests will also be included. 2. NO PARTY PREFERENCE AND NONPARTISAN: If you did not indicate a political party preference or you registered with an unqualified political party, then you will be issued the No Party Preference / Nonpartisan ballot. Your ballot will include congressional, state legislative, and nonpartisan contests, not U.S. Presidential Candidates. However, for this election, three parties are allowing cross over voting for their Presidential Candidates. You may request one of the following ballots: Democratic Party American Independent Party Libertarian Party 3. PARTISAN OFFICES in the SAMPLE BALLOT Look at the sample ballot pages that follow. Find the sample ballot pages for the appropriate political party, in order to review your official ballot choices for partisan offices. If you are a no party preference voter and you choose to vote the nonpartisan ballot, you will not find any of the presidential candidates on your ballot. 4. VOTER-NOMINATED AND NONPARTISAN SAMPLE BALLOT PAGES All voters are eligible to vote on the voter-nominated and nonpartisan portion of the ballot. Following the party sample ballot pages are the voter-nominated and nonpartisan offices, and state and local propositions and measures. The exact issues and offices on your ballot correspond to the location of your residence address, according to what jurisdictions have seats to fill and/or questions to ask. Connect the head and tail of the arrow that points to your choice, like the example provided. Check both front and back of ballot for voting contests. Use a black ball point pen. Do not use felt tip, red or gel TO MARK YOUR VOTE DRAW A LINE ink. One line connecting the arrow is preferred. Vote for no more than the number of votes allowed in each contest (e.g. vote for one, vote for no more than two, etc.). VOTE!!! This amendment would grant the City Attorney authority to act as City Prosecutor charged with the duty of prosecuting misdemeanor offenses arising out of violations of state law occurring within the City of Riverside. The City of Riverside is a Charter City, meaning that it follows the laws set forth in the state’s constitution along with its own adopted City Charter. In a charter city, the charter may designate the city attorney as the “city prosecutor,” having the primary duty to prosecute all state misdemeanors committed within the city. Standard California misdemeanors are offenses that are punishable by a county jail sentence of less than one year and a maximum $1,000 fine. These include but are not limited to petty theft, trespassing, vandalism and graffiti, prostitution, and lewd conduct. A “yes” vote is a vote in favor of establishing the Office of City Prosecutor to prosecute misdemeanor offenses arising out of violations of state law. A “no” vote will reject the proposed amendment such that misdemeanor offenses arising out of violations of state law would not be prosecuted by the City Attorney and instead continue to be prosecuted by the County District Attorney’s Office. This measure, which will amend our City’s constitution, has not been allowed public vetting, nor has it been evaluated by any Council Committee. Therefore, no one can be certain of the ramifications of this ambitious prosecutorial program. Important questions remain unanswered: ●● How will the proposed costs of $2.5 million a year affect an already overdrawn budget? ●● Why does the City list ‘police’ as a supporter when their rank and file is on record as opposing? ●● Is it worth the redundant cost for a new City department when the County District Attorney’s Office appears to be productive? ●● Is it wise to place prosecution power in the hands of a City Council appointee versus an elected official? ●● What safeguards are in place to prevent undue influence by the City Council? A Charter Review Committee would compel testimony from City officials, weigh public comments, publicly deliberate the issue, and recommend for or against its placement on the ballot. This public process could be undertaken and, if supported, an amendment could be placed on the November 2016 ballot. Instead, voters should question this ‘fast track’ to the June ballot. Public safety depends on public awareness. Without a thorough examination of this amendment’s merits, one that includes vigorous community involvement, League of Women Voters Riverside must recommend a NO vote on Measure “A”. Given this cost, why would Riverside create a new bureaucracy that duplicates services now provided by the county? In fact, Councilmembers Burnard, Davis and Melendrez all voted against bringing this to voters. First year City Attorney says local control would increase the prosecution of misdemeanors in Riverside. But the Riverside County DA’s office already has a 90% misdemeanor prosecution rate in the City of Riverside. Prosecution by the DA is done with well-trained professional prosecutors at no cost to the City. A new, expensive apparatus is not needed. It doesn’t matter if a small fraction of other California cities let City Attorneys handle misdemeanor prosecutions. Those cities, including Los Angeles, are not islands of low crime rates. Riverside needs to mind its own store and avoid excess spending — particularly at a time of multimillion-dollar deficits that the City must address. The Mayor and some Councilmen seem to think a new City Prosecutor’s Office will directly address citizen complaints. The fact remains that the Police enforce the law; a City Prosecutor won’t reduce crime in Riverside. Unlike the appointed City Attorney, our elected District Attorney answers to the people. Coordination between the DA and local law enforcement has worked well for many years. Continued cooperation would save taxpayers $12.5-$25 million or more over the next 5 years by preventing creation of a new bureaucracy and trying to substitute for the currently effective DA’s prosecutors. With the rising price of pensions and other costs, Riverside needs to eliminate duplication and cut needless spending. Measure “A” would bloat spending instead, and is nothing more than an Expensive Local Boondoggle. A new bureaucracy will do nothing to cut crime in Riverside. Don’t be misled about the faulty claims by those who want to keep the status quo! Traditional public safety efforts are not working – we need to use every tool available to us. Neighborhood livability and the public’s safety are the number one priority of your City government. All Councilmembers, the Mayor, our Police Chief and City Executive Management are tasked with this goal. Many cities use local neighborhood prosecutors to proactively address crimes that affect us all. All have reported huge success - many for decades. These crimes include: aggressive panhandling, vandalism, theft, lewd conduct, and prostitution. These crimes have increased over the last three years, and are crimes your City Prosecutor would tackle. Neighborhood prosecution focuses strictly on livability issues and involves a long-term problem solving approach between law enforcement, the City Prosecutor, homeowner associations, neighborhood and business groups. Our District Attorney’s office does not do this! The cost for this plan is about 2% of our entire police department budget and just 0.2% of the City’s overall budget. We strongly believe this is a necessary investment for the enhanced safety and livability of our community. Neighborhood prosecution works toward stopping crime before it happens, rather than reacting to a crime after it happens. This plan reaches your neighborhood. This plan saves taxpayers dollars. The Mayor and members of the City Council shall receive compensation for their services as such, and in addition, when on official duty, shall receive reimbursement for their necessary expenses on order of the City Council. In January of every odd-numbered year, the City Council shall review the compensation including salary and benefits, of the Mayor and members of the City Council, and shall establish any increase in compensation of the Mayor and/or the members of the City Council. Beginning January 2017, the City Council member salary shall be eighty percent (80%) of the Mayor’s salary. Thereafter, any increase in salary shall not exceed five percent (5%) of the elected’s then-existing salary. Compensation shall be fixed by ordinance, adopted by not fewer than five affirmative votes of the City Council, after a noticed, public hearing, notice of which has been given by publication at least fourteen days prior to such hearing. Once a level of compensation for City Council members and the Mayor is established, such level will not be permitted to change automatically by linking such compensation to internal or external factors. 33-9006-M5 RV 018-025 impartial analysis of measure “B” ARGUMENT IN FAVOR of measure “B” A proposed Amendment to Section 403 of the Charter of the City of Riverside, California, Increasing the Compensation of City Council Members The Charter of the City of Riverside, Section 403, establishes that the Mayor and members of the City Council shall receive compensation for their services. The voters last amended Section 403 in 2004. Existing Section 403 provides that compensation for members of the City Council shall be fixed by ordinance adopted by no fewer than five affirmative votes of the City Council during odd-numbered years. Existing Section 403 further provides that there shall be no increase in the salary of members of the City Council greater than five percent (5%) of their then-existing salary. The current monthly salary of members of the City Council is approximately $3448 plus the cost of salary related benefits, while the current monthly salary for the Mayor is approximately $6897 plus the cost of salary related benefits. Serving as a Councilmember demands more than 40 hours a week, and being your representative is the primary, if not only, job your Councilmembers hold. Under our City Charter, Councilmembers are paid half of what the Mayor is paid, currently about $41,300 a year. This means the only people who can afford to serve as your representative are independently wealthy, employed in a position that allows them to work part time and set their own hours, or are retired. The majority of Riverside’s adult population cannot afford to serve as a Councilmember. Young people building a career, parents with young children, even people with kids in college can’t serve on the City Council because it does not pay enough to support their family. If approved by the voters, this measure would amend Section 403 to add a baseline salary for Council Members to be fixed at eighty percent (80%) of the salary of the Mayor. Based upon the current salary of the Mayor, the monthly salary for City Council members would be increased to approximately $5518 plus salary related benefits. Thereafter, any increases in salary for members of the City Council shall follow the same procedures as currently established by existing Section 403. The proposed charter amendment would go into effect on January 1, 2017. Riverside is a Billion Dollar Municipal Corporation. It provides police and fire, parks, libraries, streets, utilities and sewer services. Riverside manages an investment portfolio of $500 Million and has $4 Billion in assets. It needs engaged, strong, committed, and qualified leadership. You deserve representatives who can devote sufficient time to the job to do it well. That means we have to pay enough to attract qualified people of all ages to serve. If approved by the voters, the annual fiscal impact of this measure would be approximately $173,880 plus salary related benefits. Approximately thirty-five percent (35%) of this increase would be paid out of the general fund, while the remaining sixty-five percent (65%) would be paid out of other funds, predominately the various utility funds such as water, electric, sewer and refuse. This Measure was placed on the ballot by the City Council of the City of Riverside, California. This measure would increase the salary for a City Councilmember to 80% of the Mayor’s salary, or to about $66,200 a year. This is enough for a person to live and raise a family on, yet not so much it attracts people to the City Council job for the money. We urge a “YES” vote on Measure “B”.
