Initially I will state that the information provided for in this letter will at times be vague as there are pending legal disputes with various contractors who have provided services to the building. Since there are pending legal disputes, specifics about what has happened and what is ongoing cannot be revealed in this announcement to the Association. The Board’s goal is to reach agreements with all parties so that litigation can be avoided. Hurricane Protection of Building As you know, most of the shutters that were previously on the building have been removed and to the Board’s understanding have been destroyed. The removal of the shutters from the building and eventually off of the property is the responsibility of certain parties that we are seeking remedies against. It is the Board’s position that the removal of the shutters was against not only the contractual obligations of certain parties but also in violation of the applicable building code and pending permits. The Association, through Miami Curtain Wall Consultants, has prepared a hurricane protection plan which in general has been accepted by the building department. Window Replacement Project Through the advice of John Medina at Miami Curtain Wall Consultants (“MCWC”), Mr. Medina’s office is in the process of preparing certain amendments to the construction plans regarding the installation of the windows. This process will take at least two or three more weeks prior to submission to the building inspectors. Steps are being taken to ensure that permits do not expire. The previous window contractor, as you know, did not perform and in fact has caused damage to the building and its members. The surety has been working with us on seeking a remedy. The initial plan is to have a new General Contractor oversee the project as there are elements of concrete restoration personnel prior to reinstallation of any new window. The prior window contractor did not have the expertise to perform such functions, even though such work was contemplated in window installation contract. The obvious result was the deficient work performed on those windows installed to date. The window project will not be finished any time soon. The Board has explained to me that they have received complaints from certain persons that a previous contract was almost entered into by the previous Board and that but for actions of this new Board, the window replacement project would be moving along. Based on the advice we have received from our consultant, if indeed the project was continued as was previously contemplated, similar as well as more severe problems would have been encountered, which should have placed the association in a position more problematic than in which it finds itself today. Based on the information received by the board by Mr. Medina, the recommendations received from certain contractors which were previously assisting the association were incorrect and were merely providing temporary solutions that should not have adequately protected the association. This Board did not want to continue down this path and therefore are making sure the project is done correctly. Once a finalized contract is entered into with the new contractors, we will inform the members of the timeline as to when the project will continue and its anticipated finalization date.
