VOTER IDENTIFICATION AT THE POLLS
The purpose of this publicity pamphlet is to provide qualified electors of the
City information on Propositions 440 and 441 which will be on the August 28,
2012 Primary/Special Election Ballot. This pamphlet includes the full text of
the ballot, the text of each proposition as it will appear on the ballot and
supporting and opposing arguments filed for any of the propositions.
Every voter is required to show proof of identity at the polling place before
receiving a ballot.
ACCEPTABLE IDENTIFICATION
Following are the types of identification that are acceptable and that can be
used when voting at a polling place on Election Day. All identification must
match the voter’s name and address shown on the Maricopa County
Elections Signature Roster.
In compliance with the Federal Voting Rights Act, this publicity pamphlet is
printed in English and Spanish. To be fully prepared to exercise your right
to vote, thoroughly read all the material in this pamphlet.

EARLY VOTING INFORMATION
Individuals may cast an early ballot at the Avondale City Hall, 11465 W Civic
Center Drive, Arizona, as follows:
August 2 through August 23, 2012
Monday - Thursday, 7:00 a.m. - 6:00 p.m.
For additional early voting locations check the Maricopa County Recorder's
website (recorder.maricopa.gov). Other early voting locations are open
Monday - Friday, 8:00 a.m. - 5:00 p.m.
PROVISIONAL BALLOT
If the voter does not have acceptable identification at the polling place,
a Provisional Ballot may be voted. Acceptable identification must then
be presented to the City Clerk or the Maricopa County Recorder by 5:00
p.m. on Friday, August 31, 2012.
To request a mail ballot contact the City Clerk’s Office at 623-333-1200 or
Maricopa County Elections (602) 506-1511. A mail ballot may be requested
via the Internet at the Maricopa County Recorder’s website
(recorder.maricopa.gov). The last day to request an early ballot by
telephone, mail, or via the Internet is August 17, 2012.

Early ballots must be received by 7:00 p.m. on August 28, 2012.
In order for your ballot to be valid and counted, your voted early ballot and
affidavit must be received by the City Clerk or the Maricopa County Recorder
by 7:00 p.m. on Election Day, Tuesday, August 28, 2012. You may also
deposit your ballot and affidavit at any polling place designated for this
election from 6:00 a.m. to 7:00 p.m. on Election Day.

ALTERNATIVE EXPENDITURE LIMITATION
(Home Rule Option)
SUMMARY ANALYSIS
A RESOLUTION OF THE COUNCIL OF THE CITY OF
AVONDALE, ARIZONA, PROPOSING AN EXTENSION OF
THE ALTERNATIVE EXPENDITURE LIMITATION.
The voters of the City Avondale in 2009 adopted an alternative expenditure
limitation (Home Rule Option). The purpose of this election is for the
continued use of the Home Rule Option.
WHEREAS, Article IX, Section 20, Subsection 9 of the Arizona State
Constitution permits the Council of the City of Avondale (the “City Council”)
to submit to the voters an alternative expenditure limitation; and
Pursuant to the Arizona State Constitution, the City Avondale seeks voter
approval to adopt a Home Rule Option to apply to the City for the next four
years beginning in 2013-2014. Under a Home Rule Option if approved by
the voters, the city estimates it will be allowed to expend approximately
$153,097,680 in 2013-2014, $143,465,320 in 2014-2015, $149,043,080 in
2015-2016 and $133,888,710 in 2016-2017.
WHEREAS, in 1981 the voters of Avondale first adopted the
alternative expenditure limitation commonly referred to as “Home Rule;” and
WHEREAS, the Avondale voters approved extension of Home Rule
in 1985, 1989, 1993, 1997, 2000, 2005 and 2009; and
WHEREAS, the City Council, after two public hearings held on
February 21, 2012 and March 5, 2012, has determined that a further
extension of the Home Rule alternative expenditure limitation is necessary.
With approval of the Home Rule Option, the City will utilize the expenditure
authority for all local budgetary purposes including general government,
public safety, economic and community development, culture and recreation,
health and welfare, grants/intergovernmental, debt service, general capital
improvements, street maintenance & improvements, water & sewer system
operations & improvements, sanitation and internal service.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF AVONDALE as follows:

SECTION 2.
The Home Rule alternative expenditure limitation
extension shall be submitted to the voters of the City as follows:
Shall the following be adopted by the City of Avondale as an
alternative expenditure limitation:
“The Mayor and Council of the City of Avondale shall annually,
as part of the annual budget adoption process, adopt an
alternative expenditure limitation equal to the total amount of
budgeted expenditures/expenses as it appears on the annual
budget as adopted by the City Council to apply to the City of
Avondale for each of the four fiscal years immediately following
such adoption. The alternative expenditure limitation shall be
adopted each year after a public hearing at which the citizens of
the City of Avondale may comment on the proposed alternative
expenditure limitation. No expenditures may be made in
violation of such alternative expenditure limitation, nor may any
proposed expenditures be in excess of estimated available
revenues, except that the Mayor and the Council may by threefourths vote, declare an emergency and suspend the alternative
expenditure limitation. The suspension of the alternative
The amount of revenue estimated to be available to fund the operation of
your city government is $153,097,680 in 2013-2014, $143,465,320 in 20142015, $149,043,080 in 2015-2016 and $133,888,710 in 2016-2017. These
revenue estimates are the same under the Home Rule Option or the stateimposed expenditure limitation. The city property tax shall be limited to the
amount prescribed in the Arizona State Constitution.
Any and all dollar figures presented in this summary are estimates only and
are based upon information available at the time of preparation of this
analysis. The budget and actual expenditures in any of the four years may
be more or less than the expenditures noted above depending on available
revenue.
If no alternative expenditure limitation is approved, the state-imposed
expenditure limitation will apply to the City.

FULL TEXT OF PROPOSITION 440
Proposition 440 — Also known as “Home Rule”, Alternative Expenditure
Limitation is important to support by the citizens of Avondale. We are asked
to vote on Home Rule every four years by the Arizona State Constitution
imposed expenditure limitations on all cities and towns. The City of Avondale
has been very prudent in developing the budget addressing projections of
services and capital projects, which are essential to the public safety, water
and sewer infrastructure, street improvements, and waste services of our
community and neighborhoods. Please join me in voting YES for Prop 440.
PROPOSITION 440
A PROPOSAL REFERRED TO THE PEOPLE BY THE COUNCIL OF
THE CITY OF AVONDALE RELATING TO AN EXTENSION OF THE
ALTERNATIVE LOCAL EXPENDITURE LIMITATION
OFFICIAL TITLE: Ratification of Resolution 3031-312; A resolution
proposing an extension of the alternative local expenditure limitation for the
City of Avondale.

DESCRIPTIVE TITLE: This proposal continues local control over the City of
Avondale budget by establishing the expenditure limitation for the next four
years. Annually, the Council of the City of Avondale will determine the
maximum expenditures for the fiscal year after at least one public hearing.
This alternative expenditure limitation replaces the state-imposed
expenditure limitation.

On the August 28, 2012 primary election ballot, Avondale voters will
have a chance to decide whether the City may continue the Home Rule
option of setting its budget, allowing the City and its elected Council to
control local spending rather than using an inadequate state-mandated
formula. A “yes” vote on Home Rule will not raise taxes.
A “YES” vote shall continue local control over the City of Avondale budget
by establishing the alternative expenditure limitation for the City of Avondale
for the next four years.

The Home Rule measure will appear as on the ballot as Proposition
Avondale has been a Home Rule city for many years, but Arizona law
requires that voters re-authorize it every four years. If Home Rule is not
approved, our City Council will lose the ability to set the City’s budget based
on current needs and revenues and would be required to operate under a
state-imposed expenditure limitation formula based upon 1980 spending
levels. In essence, Home Rule permits Avondale residents and the City
Council the flexibility to control the City’s financial destiny based on our
unique needs and opportunities.
A “NO” vote shall have the effect of (i) not allowing the City of Avondale to
continue local control of its expenditure limitation beyond the 2013-2014
fiscal year, (ii) causing the state-imposed expenditure formula to govern the
City of Avondale budget and (iii) reducing the City’s annual budget capacity
by approximately 31%.

ARGUMENTS FOR PROPOSITION 440
Please join me in voting “yes” on Proposition 440, which extends your local
control of city spending (“Home Rule”). State law requires us to weigh in at
the ballot box on this policy every four years. Together you answered the
call; approving Home Rule every time it appeared on the ballot, from 1981
through 2009. The result is today’s safe, secure family-friendly community.
Support Home Rule and General Plan
I am in support of Home Rule and Avondale’s General Plan and will vote for
it on August 28th, 2012.
I am not a member of the Planning Commission or the General Plan
Advisory Committee. I have been a resident of Avondale for over 10 years.
I serve on committees with the city and graduated from its Citizen
Leadership Academy class (CLA). In this class I witnessed how this city
provides our community with vision, growth, and development.
Home Rule controls spending through well-publicized annual hearings
followed by City Council’s vote to adopt a balanced budget. Their decision
is based on needs identified by our families, neighborhoods, and local
businesses. Unfortunately, when a community votes against Home Rule it
places its faith in an arbitrary statewide formula created at the end of the
1970's.
This plan encourages the idea of economic sustainability as a determining
concept for a successful community. Avondale is one of the first cities in the
valley to update its General Plan to promote health and the built
environment.
That outdated formula presumes that you as an Avondale resident should
be satisfied with the same local spending per person for police, fire, libraries,
and other services as your predecessors received in 1978-1979, adjusted
only for inflation. Taxes are not part of the formula, and therefore unaffected
by it. Instead, the ability to spend money already collected is impacted. The
city can collect revenue but then be forbidden by the formula to spend it on
services that your family needs.
I have also read the pros and cons of Home Rule and the arguments in favor
of Home Rule make sense. Home Rule is in accordance with American
tradition, since historically American’s have strongly believed, and still
believe in the idea of local self government.
An impartial analysis projects that if we do not approve Home Rule then the
city’s budget must be reduced by approximately 35 percent in 2013-2014,
resulting in significant cutbacks in programs, services and construction
projects. As a community do we really want antiquated 1978-1979 levels of
public safety that were barely acceptable for a small town with no college or
shopping centers?
Avondale is being proactive and responsible and Home Rule will provide the
city of Avondale with more flexibility to maintain services, which will maintain
the quality of life for all residents.

WHEREAS, the City Planning Commission (i) held two public hearings
on the proposed 2030 Plan on February 23, 2012 at the City Municipal
Operations Service Center and on March 15, 2012 at the City Council
Chambers and (ii) provided notice of such hearings by publication in the
West Valley View at least 15 calendar days and not more than 30 calendar
days prior to each hearing, by posting on the City’s website and by posting
at City Hall, Sam Garcia Library, Fire Station 172 and Estrella Mountain

WHEREAS, the City has consulted with, advised and provided
opportunity for official public comment by public officials and agencies,
Maricopa County, appropriate school districts, associations of government,
public land management agencies, other appropriate governmental
jurisdictions, public utility companies, civic, educational, professional and
other organizations, together with property owners and citizens and has
indicated sites for public purposes on the proposed update to the General
Plan referred to as the Avondale General Plan 2030 (the “2030 Plan”); and
WHEREAS, the City Council finds and determines that (i) proper
notice has been given in a manner required by Ariz. Rev. Stat. 9-461 et seq.
of the proposal of the City to adopt the 2030 Plan and that each of the
required publications have been made in the West Valley View, a newspaper
of a general circulation in the City and (ii) the 2030 Plan consists of all such

Ariz. Rev. Stat. 9-461. Nothing herein shall preclude the City Council from
adopting a new General Plan hereto in the manner provided by law.
SECTION 4. The 2030 Plan as adopted by the Council shall be
submitted to the qualified electors of the City for ratification at the City
election to be held August 28, 2012.
SECTION 5. Arguments in favor or in opposition to the General Plan
may be submitted to the City Clerk in the manner provided by law.
SECTION 6. The City Clerk is hereby directed to include a general
description of the General Plan and each of its elements in the publicity
pamphlet that will be published for the election to be held on August 28,
2012 and such information as with other election information shall be
translated into Spanish in accordance with the Voting Rights Act of 1965 as
amended.
SECTION 7. The City Clerk shall cause to be placed for public
inspection copies of the General Plan in each of the following locations and
shall post notice of such placement in the manner as agendas for meetings
of public bodies in the City: (i) Development Services Department, 11465
West Civic Center Drive, Suite 110; (ii) City Hall, 11465 West Civic Center
Drive, Suite 110; (iii) Avondale Civic Center Library, 11350 West Civic
Center Drive; and (iv) Sam Garcia Western Avenue Library, 495 East
Western Avenue.
SECTION 8. The Mayor, the City Manager, the City Clerk and the City

What is the Avondale General Plan?
Statutorily-Required Elements Included: (i) Open Space and (ii) Recreational
The Avondale General Plan (“Plan”) is a policy document setting forth the
community’s long-term objectives, principles, and expectations for future
growth and development. It is a plan defined and created through extensive
community participation and community outreach among citizens, business
owners, property owners, community leaders, technical staff, and advisors.
The Plan is based upon the community’s needs, existing development
patterns, and a desired vision for future growth. The Plan seeks to ensure
an orderly, balanced mix of employment, residential, and commercial uses.
The Avondale General Plan does not affect existing zoning.
Community Mobility Theme
Promotes safe, efficient, and accessible choices for the movement of people
and goods. Encourages safe bicycle routes and bicycle facilities, and
designates current and future routes. Identifies opportunities for residential
or commercial areas to be designated with access to transit.

Community Facilities
The 2012 version of the Avondale General Plan is a comprehensive
amendment of the 2002 plan, which was ratified by the Avondale voters on
September 10, 2002. The 2012 Plan was developed to set the vision for
future growth and development, and is required to be updated every ten
years. The 2012 Plan is divided into eight Themes: land use, economic
vitality, neighborhoods, sustainable development, open space, community
mobility, community facilities, and quality of life. Each theme contains the
goals and policies reflecting issues identified by the community. In several
cases, the Themes group the individual elements required by state law; the
Themes are summarized below:
Includes policies for public service, such as safety, water resources, human
services, and the facilities necessary to provide them with a focus on
development’s role. Identifies goals and polices to protect the community
from natural and man-made disasters. Provides goals and policies for the
currently available surface water, groundwater, and reclaimed water
supplies, and projects future growth and need.

Applies the principles of walkability, connectivity, and traditional

defines land-use categories. Incorporates balanced living with residential
and commercial areas to accommodate a mix of attractive and functional
development.

Identifies opportunities to increase the job-to-population ratio within
Avondale; promotes economic prosperity through diversification, selfreliance, and job growth; and expands upon and strengthens the job markets
in Avondale. It also outlines measures to ensure development pays its share
toward the increased demand on public services.
Why do we need to update the General Plan?
Arizona law (Arizona Revised Statutes Section 9-461.05 – commonly
referred to as “Growing Smarter”) requires that each municipality adopt a
comprehensive long-range General Plan to guide the development of the
municipality. The existing General Plan (2002) was last ratified by the voters
in September of 2002. State Law currently requires the City to adopt a new
General Plan (or readopt its current General Plan) and send it to the voters
for ratification, typically every ten years. As required by law, Avondale voters
must ratify (approve) this 2012 Plan before it can become effective.

On April 2, 2012, the Avondale City Council adopted the 2012 Plan for the
City. The 2012 Plan is entitled “Avondale General Plan 2030” as it is
intended to set the policy foundation for growth into the next two decades.
That foundation, if approved by the voters, creates general goals and
policies for elected officials regarding land use, neighborhood protection and
revitalization, economic vitality, open space, parks and recreation,
transportation, sustainable development, community facilities, and quality of
life.
Includes policies to improve the quality, variety, and affordability of housing.
Focuses on the importance of infill development, redevelopment, and
preserving Avondale’s older neighborhoods and provides a policy for
neighborhood housing assistance programs that promote home ownership.
Also includes goals and policies to improve the appearance of
neighborhoods, promotes maintenance of both commercial and residential
buildings, and identifies city programs that provide for the safety and security
of neighborhoods.

How is the Plan used?
General Plan Advisory Committee, I know that city staff members, elected
officials, and community leaders have worked extensively to create a plan
that reflects a vision for Avondale that is both distinctive and vibrant. The city
has also actively sought, and received, input from Avondale residents and
stakeholders to ensure the General Plan truly reflects the goals of our entire
community.

The Planning Commission and City Council use the General Plan to
evaluate policy changes and to make budget decisions. It is used by the City
to evaluate building and development proposals and prepare
recommendations on development projects. It is also the basis of the City’s
development regulations and its Capital Improvement Plan. Citizens,
developers, property owners, business owners, and neighborhood groups
use the General Plan to understand the City’s long-range plans, desired land
uses, and vision.

This plan encourages the idea of economic sustainability as a determining
concept for a successful community. Avondale is one of the first cities in the
valley to update its General Plan to promote health and the built
environment.
A PROPOSAL REFERRED TO THE PEOPLE BY THE COUNCIL OF
THE CITY OF AVONDALE RELATING TO ADOPTION OF A REVISED
GENERAL PLAN (2012) IN ACCORDANCE WITH STATE LAW
OFFICIAL TITLE: Ratification of Resolution No. 3036-412; A Resolution
adopting the Revised City of Avondale 2012 General Plan in compliance with
State Law, as approved by the Avondale City Council.
I have also read the pros and cons of Home Rule and the arguments in favor
of Home Rule make sense. Home Rule is in accordance with American
tradition, since historically American’s have strongly believed, and still
believe in the idea of local self government.

Proposition 441 — Avondale has developed the General Plan 2030 through
community involvement to give long-term goals and expectations of the
future growth of our community. An Arizona law requires the task of updating
the plan every ten (10) years and we are asked to vote to approve those
long-term development goals of the General Plan. Some of the areas the
general plan addresses are transportation, recreation, residential,
commercial, water and sewer needs. I believe it is essential for the current
planning commission, city council and the community is involved on how
Avondale is developed today and in the future. Voting YES provides those
guidelines for a productive future of Avondale.
If approved, when would the plan take effect?

The 2012 General Plan cannot be effective unless approved by the voters.
If voters do not approve the 2012 Plan, the existing 2002 General Plan
remains in effect until the voters approve a new General Plan. The City will
continue to be subject to the goals, objectives, and policies, land use plan,
and all elements of the 2002 General Plan. Additionally, the City is required
to resubmit the 2012 General Plan, or an amended form of it, to the voters
for approval at the next regularly-scheduled City election (or at a sooner
special election).

correo se puede pedir por medio del sitio en Internet de la Registradora del
Condado Maricopa (recorder.maricopa.gov). El último día para pedir una boleta
de votación temprana por teléfono, correo o en internet es el 17 de agosto de
2012.
Las boletas de votación temprana se tienen que recibir antes de las 7:00 p.m. el
28 de agosto de 2012.
Para que su boleta sea válida y contada, la Secretaria Municipal o la
Registradora del Condado Maricopa tiene que recibir su boleta de votación
temprana y el afidávit antes de las 7:00m p.m. el Día de la Elección, martes, 28
de agosto de 2012. Usted también puede depositar su boleta y el afidávit en
cualquier centro electoral en el Condado de Maricopa designado para esta

a la Ciudad de Avondale para cada uno de los cuatro años fiscales
inmediatamente después de dicha adopción. La limitación de gastos
alternativa deberá ser adoptada cada año después de una
audiencia pública en la cual los ciudadanos de la Ciudad de
Avondale puedan comentar sobre la propuesta limitación de gastos
alternativa. No se permitirán ningunos gastos en violación de dicha

RESUMEN DEL ANÁLISIS
VISTO QUE, en 1985, 1989, 1993, 1997, 2000, 2005 y 2009 los votantes
de Avondale aprobaron la extensión de la Opción de Autonomía; y
VISTO QUE, después de dos audiencias públicas celebradas, el 21 de
febrero de 2012 y el 5 de marzo de 2012, el Concejo Municipal ha determinado
que una extensión adicional de la Opción de Autonomía limitación de gastos
alternativa es necesaria.
AHORA, POR CONSIGUIENTE, RESUELVE EL CONCEJO DE LA
CIUDAD DE AVONDALE como lo que sigue:

SECCION 2. La extensión de la Opción de Autonomia limitación de
gastos alternativa se les deberá presentar a los votantes de la Ciudad como lo

Deberá la Ciudad de Avondale adoptar lo que sigue como una limitación de
gastos alternativa:
“Cada año el Alcalde y el Concejo de la Ciudad de Avondale, como
parte del proceso anual de adoptar el presupuesto, deberán adoptar
una limitación de gastos alternativa igual a la cantidad total de los
gastos/costos presupuestados como aparecen en el presupuesto
anual como adoptado por el Concejo Municipal que se le aplicará
En 2009 los votantes de la Ciudad de Avondale adoptaron una limitación de
gastos alternativa (Opción de Autonomía). El propósito de esta elección es para
el continuo uso de la Opción de Autonomía.
De acuerdo con la Constitución del Estado de Arizona, la Ciudad de Avondale
busca la aprobación de los votantes para adoptar una Opción de Autonomía que
se le aplicará a la Ciudad por los siguientes cuatro años comenzando en 20132014. Bajo una Opción de Autonomía si es aprobada por los votantes, la ciudad
calcula que se le permitirá gastar aproximadamente $153,097,680 en 2013-2014,
$143,465,320 en 2014-2015, $149,043,080 en 2015-2016, y $133,888,710 en
2016-2017.
Con aprobación de la Opción de Autonomía, la Ciudad usará la autorización de
gastos para todos los propósitos presupuestarios locales incluyendo gobierno
general, seguridad pública, desarrollo económico y de la comunidad, cultura y
recreo, salud y bienestar, concesiones/intergubernamentales, servicio de deuda,
mejoramientos generales de capital, mantenimiento y mejoras de calles,
operación y mejoras del sistema de agua y alcantarillado, servicios de sanidad
e internos.
Bajo la limitación de gastos ordenada por el estado, la ciudad calcula que se le
permitirá gastar aproximadamente $106,187,665 en 2013-2014, $92,556,735 en
2014-2015, $94,396,110 en 2015-2016, y $74,665,294 en 2016-2017 para la
operación de su gobierno local. Estos cálculos de gastos incluyen gastos de
ingresos excluidos por la constitución.

La cantidad de ingresos calculados a estar disponibles para pagar por la
operación del gobierno de su ciudad es $153,097,680 en 2013-2014,
$143,465,320 en 2014-2015, $149,043,080 en 2015-2016, y $133,888,710 en
2016-2017. Estos cálculos de ingresos son iguales bajo la Opción de Autonomía
o la limitación de gastos ordenada por el estado. El impuesto sobre la propiedad
de la ciudad será limitado a la cantidad prescrita por la Constitución del Estado
de Arizona.
Cualesquier y todas cifras que se presentan en este análisis son solo cifras
calculadas y se basan en información disponible al momento en que se preparó
este análisis. El presupuesto y los gastos actuales de cualesquier de los cuatro
años pueden ser más o menos que los gastos indicados arriba dependiendo de
los ingresos disponibles.
Si no se aprueba una limitación de gastos alternativa, la limitación de gastos
ordenada por el estado se le aplicará a la Ciudad.
TEXTO COMPLETO DE LA PROPOSICIÓN 440
Esa fórmula anticuada supone que usted como residente de Avondale debe de
estar satisfecho con los mismos gastos locales por persona para servicios de
policía, bomberos, bibliotecas, y otros servicios como sus predecesores
recibieron en 1978-1979, modificados solamente para la inflación. Los impuestos
no son parte de la fórmula, y por consiguiente no afectados por la misma. En
vez, se impacta la habilidad de gastar el dinero ya recaudado. La ciudad puede
recaudar ingresos pero luego se le prohíbe por la fórmula gastarlo en servicios
que su familia necesita.
Un análisis imparcial proyecta que si no aprobamos la autonomía entonces el
presupuesto de la ciudad se tiene que reducir por aproximadamente el 35 por
ciento en 2013-2014, resultando en reducciones significantes de programas,
servicios y proyectos de construcción. ¿Como una comunidad es que
verdaderamente deseamos niveles anticuados de 1978-1979 de seguridad
pública que apenas eran aceptables para un pueblo pequeño sin un colegio o
centros de compras?
Coloque su fe en la gente local a quienes usted eligió para servirle, en lugar de
una fórmula del estado de tres décadas de vieja. Vote “si” por la Proposición

PROPUESTA ENVIADA A LOS CIUDADANOS POR EL CONCEJO DE LA
CIUDAD DE AVONDALE REFERENTE A UNA EXTENSIÓN DEL LÍMITE
ALTERNATIVO DE GASTOS LOCALES.
TÍTULO OFICIAL: Ratificación de la Resolución Núm. 3031-312; Una
Resolución proponiendo una extensión del límite alternativo de gastos locales
para la Ciudad de Avondale.
TÍTULO DESCRIPTIVO: Esta propuesta continúa el control local sobre el
presupuesto de la Ciudad de Avondale estableciendo el límite de gastos para los
próximos cuatro años. Anualmente, el Concejo de la Ciudad de Avondale
determinará la cantidad máxima de gastos para el año fiscal después de por lo
menos una audiencia pública. Este límite de gastos alternativo reemplaza el
límite de gastos impuesto por el estado.

Proposición 440 – Conocida también como la “Opción de Autonomía”, Limitación
de Gastos Alternativa es importante en apoyar a los ciudadanos de Avondale.
Debido a la limitación de gastos impuesta por la Constitución del Estado de
Arizona sobre todas las ciudades y pueblos, cada cuatro años se nos pide que
votemos por la Opción de Autonomía. La Ciudad de Avondale ha sido muy
prudente al desarrollar el presupuesto basado en pronosticaciones de servicios
y proyectos de capital, que son esenciales para la seguridad pública, agua e
infraestructura de alcantarillado, mejoramientos de las calles, y servicios de
desperdicios de nuestra comunidad y vecindades. Por favor únase conmigo en
votar SI por la Proposición 440.
Un voto de "SÍ” tendrá el efecto de continuar el control local sobre el
presupuesto de la Ciudad de Avondale estableciendo un límite de gastos
alternativo para la Ciudad de Avondale para los próximos cuatro años.

En la boleta electoral del 28 de agosto de 2012, los votantes de Avondale
tendrán la oportunidad de decidir si la Ciudad pueda continuar la opción de
Autonomía de fijar su presupuesto, que le permite a la Ciudad y a su Concejo
elegido controlar los gastos locales en lugar de usar una fórmula inadecuada
ordenada por el estado. Un voto de “si” por la Autonomía no aumentará los
impuestos.

ARGUMENTOS A FAVOR DE LA PROPOSICIÓN 440
Por favor únase conmigo en votar “si” por la Proposición 440, cual extiende su
control local de los gastos de la ciudad (“Opción de Autonomía”). La ley del
Estado nos ordena considerar esta práctica en las urnas cada cuatro años.
Ustedes han respondido a este llamado; aprobando la opción de Autonomía
cada vez que apareció en la boleta, desde 1981 hasta 2009. El resultado es una
comunidad segura, protegida inocua a la familia.

La medida de Autonomía aparecerá en la boleta como la Proposición 400.
Por muchos años Avondale ha sido una ciudad de Autonomía, pero la ley
de Arizona ordena que los votantes la autoricen de nuevo cada cuatro años. Si
la Opción de Autonomía no se aprueba, nuestro Concejo Municipal perderá su
habilidad de fijar el presupuesto de la Ciudad basado en necesidades e ingresos
actuales y se le ordenaría operar bajo una fórmula de limitación de gastos
gravada por el estado basada en los niveles de gastos de 1980. En esencia, la
autonomía les permite a los residentes de Avondale y al concejo Municipal la
flexibilidad de controlar el destino financiero de la Ciudad basado en nuestras
necesidades y oportunidades únicas.
Yo les urjo a mis co-Ciudadanos votar “si” por la Proposición 440.
La opción de autonomía controla los gastos a través de audiencias anuales bien
publicadas seguidas por el voto del Concejo Municipal para adoptar un
presupuesto balanceado. Su decisión se basa en las necesidades identificadas
por nuestras familias, vecindades, y negocios locales. Desafortunadamente,
cuando una comunidad vota en contra a la Opción de Autonomía coloca su fe
en una fórmula arbitraría para todo el estado establecida al fin de los 1970s.

VISTO QUE, el Concejo Municipal (i) celebró una audiencia pública
tocante el Plan General propuesto el 2 de abril de 2012 en la Sala del Concejo
Municipal y (ii) ofreció aviso de dicha audiencia por publicación en el periódico
West Valley View a lo menos de 15 días de calendario y no más de 30 días de
calendario antes de cada audiencia; y
VISTO QUE, el Concejo Municipal encuentra y determina que (i) se
ofreción aviso propio de una manera ordenada por los Estatutos Revisados de

Arizona 9-461 et seq. de la propuesta de la Ciudad de adoptar el Plan 2030 y
que cada una de las publicaciones ordenadas se hicieron en el periódico West
Valley View, un periódico de circulación general en la Ciudad y (ii) el Plan 2030
consiste de dichos elementos como ordenado por los Estatutos Revisados de
Arizona 9-461.05.
APROBADA EN FORMA:
AHORA, POR CONSIGUIENTE, RESUELVE EL CONCEJO MUNICIPAL
DE LA CIUDAD DE AVONDALE, como lo sigue:

Por la presente se incorporan los preámbulos de arriba

Por la presente se adopta el Plan 2030, en la forma

El Plan 2030 se considera adoptado a partir de la fecha

de esta Resolución y será válido por un término como se estipula en los
Estatutos Revisados de Arizona 9-461. Nada en esto deberá impedir al Concejo
Municipal adoptar un Plan General nuevo en la manera estipulada por ley.

28 de agosto de 2012 y dicha información así como otra información electoral se
deberá traducir al Español de acuerdo con la Ley de Derecho al Voto de 1965
como ha sido enmendada.
La Secretaria Municipal causará que se coloquen

copias del Plan General en cada uno de los siguientes sitios para la revisión del
público y deberá fijar aviso de dicha colocación en la misma manera como
agendas de las reuniones de cuerpos públicos de la Ciudad: (i) Departamento
de Servicios de Desarrollo, 11465 West Civic Center Drive, Sala 110; (ii)
Ayuntamiento, 11465 West Civic Center Drive, Sala 110; (iii) Biblioteca del
Centro Cívico de Avondale, 11350 West Civic Center Drive; y (iv) Biblioteca Sam
Garcia Western Avenue, 495 East Western Avenue.
SECCIÓN 8.
Por la presente se le autoriza y se le ordena al
Alcalde, al Administrador de la Ciudad, a la Secretaria Municipal y al
Abogado de la Ciudad tomar todos los pasos necesarios para realizar el
propósito y sentido de esta Resolución.

El Plan General de Avondale (el “Plan”) es un documento de práctica que
expone las previsiones, metas y principios del crecimiento y desarrollo a largo
plazo. Es un plan definido y desarrollado a través de participación extensa de la
comunidad y comunicación entre los ciudadanos, dueños de negocios,
propietarios, líderes de la comunidad, personal técnico, y concejeros. El Plan se
basa en necesidades de la comunidad, pautas de desarrollo existentes y la
visión se desea para el crecimiento en el futuro. El Plan procura asegurar una
mezcla metódica y balanceada de empleo, residencial, y comercial. El Plan
General de Avondale no afecta las zonas existentes.
La versión 2012 del Plan General de Avondale es una enmienda completa del
plan de 2002, que fue ratificado por los votantes de Avondale el 10 de
septiembre de 2002. El Plan de 2012 se desarrolló para fijar la visión para el
crecimiento y desarrollo en el futuro, y se le requiere ser actualizado cada diez
años. El Plan de 2012 divide se ocho Temas: usos de terreno, vitalidad
económica, vecindades, desarrollo sostenible, espacio abierto, movilidad de la
comunidad, instalaciones de la comunidad, y calidad de vida. Cada tema
contiene las metas y prácticas que reflejan cuestiones identificadas por la
comunidad. En varios casos, los Temas agrupan los elementos individuales
requeridos por la ley del estado; los Temas se resumen abajo:
Tema de Usos de Terreno
Designa la distribución general, localización, e intensidad de los usos de terreno,
y define las categorías de usos de terreno. Incorpora una vida balanceada con
áreas residenciales y comerciales para satisfacer una mezcla de desarrollo
atractivo y útil.

Tema de Vitalidad Económica
Identifica las oportunidades para aumentar la proporción de trabajo-contrapoblación dentro de Avondale; fomenta la prosperidad económica a través de

los mercados de trabajos de Avondale. También ofrece un resumen de medidas
para asegurar que el desarrollo contribuya su parte hacia el aumento en
demanda los servicios públicos.

Tema de Vecindades
Incluye prácticas para mejorar la calidad, variedad, y asequibilidad de las
viviendas. Se enfoca en la importancia del desarrollo de relleno, reurbanización,
y conservación de las vecindades más viejas de Avondale y proporciona una
práctica de programas de ayuda para viviendas que fomentan la adquisición de
casas para familias. También incluye metas y prácticas para mejorar la
apariencia de las vecindades, fomenta el buen mantenimiento de edificios
comerciales y residenciales, e identifica los programas de la ciudad que ayudan
a mantener los vecindarios seguros y protegidos.

Tema de Desarrollo Sostenible
Proporciona principios para conservar recursos naturales y extiende el uso de
recursos renovables. Incorpora prácticas para preservar y proteger el ambiente
y recursos naturales que contribuyen a la calidad de vida de la comunidad.
Los Elementos Ordenados por Ley que se incluyen: (i) Energía, (II) Planificación
Ambiental y (iii) Conservación
Tema de Espacio Abierto
Un inventario completo de espacio abierto, análisis de necesidades
pronosticadas, y prácticas para fomentar espacio abierto y actividades de recreo.
Metas y prácticas para conservar espacio abierto para las generaciones futuras
y fomentar la salud de la comunidad al proporcionar espacio para recreo al aire
libre.

Fomenta opciones seguras, eficaces, y accesibles para el movimiento de gente

residenciales y comerciales que serán designadas con acceso al tránsito.

concentradas en el papel del desarrollo. Identifica metas y prácticas para
proteger la comunidad contra desastres naturales y artificiales. Proporciona
metas y prácticas para el suministro de agua superficial, agua subterránea y
reclamada que está disponible actualmente y proyecta las necesidades futuras.

Tema de Calidad de Agua
Aplica los principios de transitabilidad, conectividad, y estructura de vecindades
tradicionales. Describe los recursos culturales de la comunidad y como se
fomentaran y conservaran estos bienes. Fomenta y anima la participación de los
ciudadanos como un parte vital del proceso público.

¿Por qué es necesario actualizar el Plan General?
La ley de Arizona (Sección 9-461.05 de los Estatutos Revisados – comúnmente
referida a como “Growing Smarter”) requiere que cada municipalidad adopte
Plan General completo de largo plazo para guiar el desarrollo de la
municipalidad. El Plan General (2002) actual fue ratificado por los votantes en
septiembre de 2002. La Ley del Estado actualmente ordena que la Ciudad
adopte un Plan General nuevo (o adopte de nuevo su Plan General actual) y se
los presente a lo votantes para ser ratificado, típicamente cada diez años. Como
ordena la Ley, los votantes de Avondale tienen que ratificar (aprobar) este Plan
2012 antes de que se ponga en vigor.
El 2 de abril de 2012, el Concejo Municipal de Avondale adoptó el Plan 2012 de
la Ciudad. El Plan 2012 se titula “Plan General 2030 de Avondale” siendo que la
intención es de fijar la base de práctica del crecimiento para las próximas dos
décadas. Esa base, si aprobada por los votantes, establece metas y prácticas
generales para los oficiales electos en relación con el uso de terreno, protección
de las vecindades y revitalización, vitalidad económica, espacio abierto, parques
y recreo, transportación, desarrollo sostenible, instalaciones de la comunidad ,
y calidad de vida.
¿Cómo se usa el Plan?
La Comisión de Planificación y el Concejo Municipal usan el Plan General para
evaluar los cambios de práctica y para tomar decisiones presupuestarias. La
Ciudad lo usa para evaluar propuestas de construcción y de desarrollo y para
preparar recomendaciones sobre proyectos de desarrollo. También es la base
de los reglamentos de desarrollo de la Ciudad y su Plan de Mejoramientos
Capitales. Los ciudadanos, promotores, propietarios, dueños de negocios, y
grupos de vecindades usan el Plan General para entender los planes de largo
plazo de la Ciudad, usos de terreno deseado, y su visión.
¿Causará costos adicionales a los contribuyentes de impuestos la
actualización del plan?
No. No se anticipa que la implementación del Plan General va a causar
cualesquier costos directos a los contribuyentes de impuestos. Si se aprueba,
la medida de la boleta le permitirá a la Ciudad continuar con sus esfuerzos de
planear correctamente para el desarrollo en el futuro y administrar el crecimiento
para mantener una comunidad sana, y sostenible.
¿Qué pasará si el Plan no se aprueba?
El Plan General 2012 no puede estar en vigor a menos que se apruebe por los
votantes. Si los votantes no aprueban el Plan General 2012, el Plan General
2002 existente permanecerá en vigor hasta que los votantes aprueben un Plan
General nuevo. La Ciudad continuará a estar sujeta a las metas, objetivos
prácticas, plan de uso de terreno, y todos los elementos del Plan General 2002.
Adicionalmente, se le requerirá a la Ciudad que presente nuevamente el Plan
General de 2012, ó una forma enmendada del mismo, a los votantes para su
aprobación en la siguiente elección de la Ciudad programada regularmente (o
en una elección especial más temprana).
¿Si es aprobado, cuándo entrará el plan en vigor?
Si es aprobado por los votantes, el plan entrará en vigor después de la adopción
del escrutinio de los votos oficial de la elección especial.
¿En dónde puedo recibir información adicional tocante el propuesto Plan
General 2030?
Copias del Plan General 2030 están disponibles en el mostrador del
Departamento de Servicios de Desarrollo, el mostrador al frente del
Ayuntamiento de Avondale, Biblioteca Sam Garcia, y la Biblioteca Civic Center.
El Plan también se puede obtener en el sitio web del Departamento de Servicios
de Desarrollo de Avondale en www.avondale.org/generalplan o por
comunicándose con el Departamento de Servicios de Desarrollo/División de

LA CIUDAD DE AVONDALE REFERENTE A LA ADOPCIÓN DE UN
PLAN GENERAL REVISADO (2012) DE CONFORMIDAD
CON LA LEY DEL ESTADO
TÍTULO OFICIAL: Ratificación de la Resolución Núm. 3036-412; Una
resolución adoptando el Plan General Revisado de la Ciudad de Avondale
de 2012 de conformidad con la Ley del Estado, de acuerdo a lo aprobado
por el Concejo de la Ciudad.
TÍTULO DESCRIPTIVO: Esta propuesta busca la ratificación de los votantes
al Plan General revisado de la Ciudad de Avondale (2012), que se actualizó
según lo requerido por la Ley del Estado y aprobado por el Concejo de la
Ciudad de Avondale.
Un voto de "SÍ” tendrá el efecto de ratificar y adoptar el Plan General de la
Ciudad de Avondale (2012) según lo aprobado por el Concejo de la Ciudad
de Avondale.
Un voto de “NO” tendrá el efecto de rechazar el Plan General de la Ciudad

Yo les urjo a los votantes de Avondale votar a favor de ratificar el Plan General
2030 de Avondale. Como miembro de ambos comités la Comisión de
Planificación y el Comité Asesor del Plan General, yo sé que los miembros del
personal de la ciudad, los oficialeselectos, y los líderes de la comunidad han
obrado extensamente para desarrollar un plan que refleja una visión para
Avondale que es distinta y vibrante. La ciudad también procuró activamente, y
recibió, información de los residentes y accionistas para asegurar que el Plan
General verdaderamente refleje las metas de la comunidad completa.
Conforme termine la recesión y el desarrollo comience nuevamente, este plan
ofrece exactamente la dirección correcta, al tiempo oportuno exacto, para
proteger contra la expansión urbana. La ratificación del Plan General va a
proporcionar el necesario marco para asegurar que nuestra comunidad tenga

Yo apoyo la Autonomía y el Plan General de Avondale y votaré a favor el 28 de

Yo no soy miembro de la Comisión de Planificación o del Comité Asesor del Plan
General. Yo he sido residente de Avondale por más de 10 años. Yo sirvo en
comités de la ciudad y me recibí de su clase de la Academia de Liderazgo de
Ciudadanos(CLA). En esta clase yo testifique como la ciudad le proporciona a
nuestra comunidad una visión, crecimiento y desarrollo.
Este plan fomenta la idea de economía sostenible como un concepto condicional
para una comunidad triunfante. Avondale es una de las primeras ciudades del
valle en actualizar su Plan General para fomentar la salud y el ambiente
establecido.
También he leído los pros y contras de la Autonomía y los argumentos a favor
de la Autonomía tienen sentido. La Autonomía es de acuerdo con la tradición
Americana, siendo que históricamente los Americanos han creído firmemente,
y aun siempre creen en la idea de autogobierno local.
Avondale es pro-activo y responsable y la Autonomía le proporcionará a la
ciudad de Avondale más flexibilidad en mantener servicios, que mantendrán la
calidad de vida para todos sus residentes.

Proposición 441 – Avondale ha desarrollado el Plan General 2030 a través de
la participación de la comunidad para ofrecer metas a largo plazo y expectativas
del futuro crecimiento de nuestra comunidad. Una ley de Arizona ordena la
actualización del plan cada diez (10) años y se nos solicita votar para aprobar
aquellas metas a largo plazo del Plan General. Algunas partes que el plan
considera son la transportación, recreo, residencial, comercial, necesidades de
agua y alcantarillado. Yo creo que es esencial que la comisión de planificación
actual, el concejo municipal y la comunidad participen en como Avondale se
