Pursuant to 49 U.S.C. § 40109 and Subpart C of the Department's Rules
of Practice, Ra Jet Aeroservicios, S.A. de C.V. ("Ra Jet"), a Mexican air taxi
operator of small executive jet aircraft, requests an exemption from 49 U.S.C.
§ 41301 to authorize it to engage in charter foreign air transportation of
passengers between Mexico and the United States and to engage in other
passenger charter operations in accordance with 14 CFR Part 212, using small
aircraft. Ra Jet also requests stopover privileges and relief from the
Department's requirement to provide prior notice of each flight, or series of
flights, between Mexico and the United States.

Ra Jet seeks the requested exemption from the Department for a period
of at least two years. In support of this application, and pursuant to the
Department's Procedural Regulations, Ra Jet states as follows:

Mr. Luis Alfredo Rayet Diaz, Ra Jet's President and CEO, established Ra
Jet in 2000 within the State of Coahuila, Mexico. Ra Jet is a privately held

Ra Jet is operationally and financially qualified to perform the air
transportation services for which it requests authorization in this application. As
evidence thereof -

(a) In 2009 the DGAC issued Ra Jet a license to provide worldwide nonscheduled ("no regular") passenger air taxi service. A copy of Ra Jet's
international license from the DGAC (the "Transporte Aereo Internacional") is
attached as Exhibit A. A copy of Ra Jet's Air Operator's Certificate (the
"Certificado de Explotador de Servicios Aereos") is attached as Exhibit B.
(b) Ra Jet maintains its corporate offices and base of flight operations at
Aeropuerto Internacional Plan de Guadalupe, in Ramos Arizpe, Coahuila,
Mexico, located approximately 50 miles west of Monterrey, Mexico.
Ra Jet's corporate function is to provide domestic and international air
transportation services to passengers using executive jet aircraft. These
passengers travel to the U.S. for various purposes, including business matters
and personal travel.
Ra Jet estimates that it will operate approximately 40 round trips monthly
between Mexico and the United States with an average load of two to three
passengers per flight. Almost all of this traffic will originate in Mexico. gl
(c) Ra Jet owns and commercially operates eight executive jet aircraft (7
Learjets and 1 Hawker 800A). Each aircraft is configured for eight passenger
seats. Ra Jet has acquired several additional corporate aircraft, but these
aircraft are not yet listed on the company's operations specifications
Y Although Ra Jet's forecast operations do not include specific flights between third
countries and the United States, Ra Jet anticipates the need to operate Fifth Freedom charter
service from time to time and is seeking such authority subject to the prior approval pursuant to
Part 212 of the Department's regulations.

("especificaciones de operacion") from the Mexican DGAC. Ra Jet intends to
expand its commercial flight operations in line with market demands. Any such
additional aircraft would be similar in size and capability to its present aircraft.
(d) Ra Jet maintains its aircraft in accordance with an airworthiness
program approved by the Mexican DGAC in compliance with ICAO Annexes 1, 6
(Part I) and 7 .~J At the Plan de Guadalupe International Airport, Ra Jet uses
Honeywell Aerospace for routine maintenance services. For minor aircraft
inspections the company sends the aircraft to an FAA authorized repair facility in
Monterrey, Mexico. For major aircraft maintenance and engine servicing, Ra Jet
sends its aircraft to an authorized Honeywell facility in the United States.
(e) Ra Jet has an established and well qualified management team with
extensive experience in providing domestic and international air taxi services. A
composite of Ra Jet's key personnel is shown in Exhibit C. Included with Exhibit
C is a brief overview of the qualifications of each key personnel member. All of
these individuals are Mexican citizens who reside in Mexico.
(f) Financial statements for Ra Jet for 2009 and through October 2010
are provided in Exhibit D. As shown therein, Ra Jet is making a significant profit
from its operations. As such, Ra Jet will have access to the necessary financial
resources to sustain its proposed services.

(g) Ra Jet's insures its aircraft with AON Corporation and maintains
combined single limit of liability coverage on its aircraft that exceeds the
requirements of 14 C.F.R. Part 205. AON's insurance broker in Mexico is
preparing OST Forms 6411 for Ra Jet's aircraft for submission to the Federal
Aviation Administration.
(h) Other than as described in this application, Ra Jet, Mr. Rayet, and the
company's key personnel hold no interest, directly or indirectly, in any other
aeronautical enterprise or common carrier.
(i) Ra Jet has not been involved in any safety violations, tariff violations,
or fatal accidents.

Other than as described in this application, Ra Jet does not have any
agreements or cooperative working agreements with any U.S. or foreign air
carrier affecting its proposed services to the United States.
(k) Ra Jet has executed OST Form 4523 (Waiver of Liability Limits under
the Warsaw Convention) for filing with the Department. A copy is appended as
Exhibit F.

Ra Jet's proposed U.S. services are consistent with the public interest for
the following reasons:
First, the Third and Fourth Freedom charter authority sought by Ra Jet is
authorized by Annex II to the U.S.-Mexico Air Transport Agreement of
September 15, 1960, as amended and extended, and therefore is presumptively
in the public interest.

Second, Ra Jet's operations will include carriage of passengers to the
U.S. on business, thereby fostering commerce between Mexico and the United
States consistent with the objectives of the North American Free Trade
Agreement (NAFTA).
Third, Ra Jet's request for extra-bilateral stopover privileges for passenger
flights results from the need to make occasional stops at two or more points in
the U.S. No regulatory purpose would be served by preventing Ra Jet from
meeting the stopover requirements of its corporate passengers.:!:! In addition, the
Department has routinely waived stopover restrictions for other Mexican air taxi
operators.§/
Fourth, although Ra Jet's request for relief from the requirement to notify
the Department of all Third and Fourth Freedom flights or series of flights is also
extra-bilateral, comity and reciprocity favor such relief.§.' For commercial
operations with small, business-type aircraft, the notice requirement serves no
regulatory purpose. It burdens both the Department, as the regulatory agency,

and Ra Jet, as the party being regulated. In addition, the Department has
routinely waived the notice requirement for other Mexican air taxi operators.I' On
information and belief, the Mexican DGAC does not require advance notice for
similar operations (i) by U.S. air taxis or (ii) by U.S. corporate operators carrying
passengers for compensation pursuant to Subpart F of Part 91 of the Federal
Aviation Regulations.
WHEREFORE, Ra Jet Aeroservicios, S.A. de C.V., respectfully requests
exemption authority for a term of at least two years to engage in charter foreign
air transportation of passengers between Mexico and the United States and to
engage in other passenger charter operations in accordance with 14 CFR Part
212, using small aircraft as set forth herein, and such other relief as may be in
the public interest.

En relaci6n a las gestiones que viene realizando, me permito informarle que con fundamento en
los artfculos 3°, fracci6n VI de la Ley de Vias Generales de Comunicacion, 6°, fracci6n 11, y II
fracci6n Ill, de la Ley de Aviaci6n· Civil, en relaci6n con el articulo 2 t , fracci6n VI del Reglamento

para el establecimiento y explotaci6n de un servicio publico de Transporte no Regular de Taxi
Aere~ Internacional de Pasajeros, desde su base de operaciones en Saltillo, Coah. y sub-bases
en Cancun,Q. Roo, Guadalajara, Jal. y Toluca, Edo. de Mex.
En tal virtud, y de conformidad con 10 dispuesto en los artkulos 3°, fracciones II, VIII, lXt XII Y

XI).- La Empresa queda obligada a presentar un informe estadlstico mensual a la Direcci6n
General de Aeronautica Civil (Direccionde Desarrollo Estrategico), en la forma DGAC-1857-1.
XII).- La Empresa debera contratar y mantener vigente un seguro que cubra las
responsabilidacies por los danos a pasajeros y equipaje, asi como danos a personas 0 casas que
se encuentren en la superficie de territorio mexicano en terminos de los Artfculos 70, 72 Y 74 de
la Ley de Aviaci6n Civil, 64, 65, 66, 67, 68, 69, 70 71 Y 72 de su Reglamento.

XIV) ... Previamente al inido de sus vuelos al extranjero deberan solicitar y recabar el permiso
correspondiente de cada una de las autoridades aeromluticas del (os) pais (es) citado (s) en la
presente autorizaci6n y, paralelamente, presentar en esta Dependencia copia (s) de dicho (5)
permiso (s) para acreditar que se cumpUo con este requisito.
XV).- La Empresa no podra ceder, hipotecar, gravar, transferir

XVIII) ... La Secretaria de Comunicaciones y Transportes podra dictar las modalidades y
caracteristicas conforme a las cuales se preste el servicio publico en las vias generales
comunicaci6n y medios de transporte.

Asimismo la Secretarfa tendril la facultad, en cualquier tiempO, de verificar el cumplimiento de
las Leyes de Vias Generales de Comunicaci6n y de Aviaci6n Civil. sus reglamentos y demas
disposiciones aplicables: Para tal efecto, la permisionaria estara obligada a permitir el acceso a los
verificadores a sus instalaciones, a transportarlos en sus equipos para que realicen· la verificaci6n
y, en general t a otorgarles todas las facilidades para estos fines, as! como a proporcionar a la
Secretarfa los informes con los datos que permitan conocer la operadon y explotaci6n de los
servicios de transporte aereo. '

XIX).- La navegaci6n en el espacio aereo sobre territorio nadonal se rige por 10 previsto en la
Ley de Aviaci6n Civil y por los tratados, y a falta de disposici6n expres3 se aplicarcin los
ordenamientos legales previstos en el articulo 4° de la propia Ley de Aviaci6n Civil y su
Reglamento l motivo por el cual la permisionaria debera cumplir can todas y cada una de las
disposiciones contenidas en dicha normatividad.

XXI) ... En la prestaci6n de los servicios de transporte aereo, la permisionaria por iniciativa propia °
a instancias de la Secretaria, debenl adoptar las medidas necesarias para garantizar las condiciones
maximas de la seguridad de la aeronave y de su operad6n, a fin de proteger la integridad ffsica de Jas
personas, equipaje y terceros.
XXII).- EI incumplimiento del permisionario, comandante 0 pilato a cualquiera de las obligaciones a
condiciones establecidas en la Ley de Aviaci6n Civil, en sus reglamentos y en este permiso, se
sancionara en terminos de los artfculos 86, 87, 88, 89 Y 90 del ordenamiento legal citado en primer
termino.
XXIII) ... El permisionario debera proceder al pago y, par consiguiente. acreditar ante esta Secretarfa
de Comunicaciones y Transportes, mediante redbo ofkial al entero de los derechos previstos en los
artfculos 159, fracci6n II, y 153, fracci6n II, de la Ley Federal de Derechos. las cantidades de
$12,530.00 M.N. y $667.00 M.N., por concepto del otorgamiento de este permiso e inscripci6n
en el Registro Aeronautico Mexicano, los cuales fueron cubiertos mediante recibo de pago de fecha
21 de octubre del 2009.
Por otra parte, el permisionario debera cubrir anualmente y acreditar mediante redbo ofi ci a! , el
pago de los derechos· correspondientes por cada uno de los afiosen que se encuentre vigente e.l
permiso, de conformidad con 10 dispuesto en los artfculos·84 de la Ley de Aviacion Civil, 193 de su
Reglamento y ISS. de la Ley· Federal de Derechos, vigente.
EI acreditamiento de pago de los derechos debera verificarse a mas tardar, dentro de los 25 dfas
naturales siguientes a la fecha de otorgamiento de este permiso y, en el caso de los anos
subsecuentes, el plazo para acreditar el pago se contara a partir de la fecha de la cual se haya
otorgado diC~ permiso.

Regarding arrangements you have been making, I hereby inform you that pursuant to
Article 3, Section VI of the General Communication Ways Law, 6, Section II, and 11, Section
III of the Civil Aviation Law, in relation to Article 18, Section VI of the By-Law of the
Ministry of Communication and Transport, this Civil Aeronautics Department grants the
company RA JET AEROSERVICIOS, S.A. DE C.V. PERMIT to establish and exploit non-regular
public international air taxi passenger transportation service, from its base of operation in
Saltillo, Coah. and sub-bases in Cancun, Q. Roo, Guadalajara, Jalisco, and Toluca, Edo.

In view of the above and in accordance with Article 3, Sections II, VIII, IX, XII AND XIII, 49,
51,129, and 121 of the General Communication Ways Law. 1 S t, 3 rd, 4 th, 5 th , Section I
paragraph a), 6 th , Sections I, II, XI and XII, 7th , 12, 14, 15, 17, 18, 23, 24, 32, 35, 42, 44, 47,
Section II, IV, and V, 61, 62, 70, 74, 76, 84, and other applicable provisions of the Civil
Aviation Law, l s t,2 nd , 10, 11, 25, 26, 28, 32, and 193 of its Bylaws, this permit shall be
subject to the following requirements and conditions
I). THE PERMIT IS GRANTED ON AN INDEFINITE BASIS, PURSUANT TO ARTICLE II OF
THE CIVIL AVIATION LAW, WHICH SHALL BE DEEMED TERMINATED WHEN THE
HOLDER OF THE PERMIT INCURS ANY OF THE CAUSES SET FORTH IN ARTICLES 14
AND 15 OF SUCH LAW.
11)- This permit is issued based on the operators permit of a non-regular public
international air taxi passenger transportation service, TAN-TN-667 granted by means of
official letter No. 0272 dated 29 January 2001.

III) - This permit shall be registered with the Mexican Aeronautic Register pursuant to
Article 47 of the Civil Aviation Law.
IV)-The aircraft shall be used only to provide non-regular international air taxi passenger
service.
V)- In the event the aforementioned aircraft is/are replaced or stop operating, this
Company shall notify the Civil Aeronautics Department, attaching a copy of the relevant
permit to National Air Taxi Transportation.
VI)-The aircraft crew shall have the competence certificate in force, issued by the Civil
Aeronautics Department.
VII) -Such aircraft shall leave national territory by any of the International Airports in
Mexico authorized by the Ministry of Communication and Transports, where it (they) will
meet the customs, migration and sanitary formalities and requirements.
VIII)-For the operation of authorized international flight(s), the company is bound to keep
in force its Air Operators Certificate, as well as the Limitations to such Certificate, issued by
this Civil Aeronautics Department, without which effectiveness or document evidencing the
same it will not be able to carry out operations hereunder, pursuant to the Mexican official
standard NOM-008-SCT3-2002
IX)- The Company shall follow airways previously established by the Ministry of
Communications and Transports.
X)- To obtain from this Ministry the approval and/or registration of rates and the relevant
rate components to be applied, as the case may be.
XI)-The Company is bound to file a monthly statistical report to the Civil Aeronautics
Department (programming and Statistics Department) in the form DGAC-1857-1
XII)- The Company shall contract and keep in force insurance that will cover passenger and
baggage liability, as well as damage to people of things located in Mexican Territory in
terms of Articles 70, 72 and 74 of the Civil Aviation Law, 64, 65, 66, 67, 68, 69, 70, 71 and
72 of its Bylaws.
XIII)- In accordance with Articles 62 and 74 of the Civil Aviation Law, the company shall
guarantee payment of the indemnification for damages that may be caused to passengers
and baggage outside Mexican territory, for the amounts set forth by the Warsaw
Convention, modified by the Hague Protocol or by any other regime in force in the country
or countries of destination of international flights for the period of time of this permit.
XIV)- Before starting flights abroad, you will have to request and obtain the relevant permit
from each of the aeronautic authorities of the aforementioned country or countries and,
simultaneously, file with this Agency a copy or copies of such permit to prove that the
requirement was met.

XV)-The Company may not assign, mortgage, pledge, transfer or alienate this permit or the
rights conferred by the permit to any government or state.
XVI)-The Company may not assign, mortgage, pledge, transfer or alienate this permit or the
rights conferred by the permit to any national or foreign individual without the Ministry's
authorization.
XVII)-The Company is bound to file this permit with the aeronautic authorities of the
international airports used for leaving and entering Mexican territory.
XVIII)-The Ministry Communications and Transports may set the modes and
characteristics upon which the public service will be provided in general communication
ways and means of transportation.
Additionally, The Ministry shall have the power, anytime, to verify compliance with the
General Communication Ways Law and the Civil Aviation Law, the regulations thereof and
any applicable provisions. For the purpose, the holder of the permit shall be bound to
allow verifiers access to its premises, carry them on its aircraft to carry out the verification
and, in general, grant them any facility thereof, as well as furnish the Ministry data about
the operation and exploitation of air transportation services.
XIX)- Air Navigation on national territory is abided by the Civil Aviation Law and by
treaties. If there is no express provision, legal ordinance provided for Article 4 of the Civil
Aviation Law and the Regulation thereof shall apply; consequently, the permit holder shall
comply with any and all provisions contained in such regulations.
XX)- Air transit, radio aids, meteorology, telecommunications and aeronautical information
services and any other air navigation assistance provided by the decentralized organization
named Servicios ala Navegacion en el Espacio Aereo Mexicano( Mexican Air Space
Navigation Services) shall be used for air navigation.
XXI)- The permit holder shall, on its own or at the request of the Ministry, take up the
necessary measures to guarantee maximum security conditions for the aircraft and the
operation thereof during the provision of air transportation services, in order to protect
the physical integrity of people, baggage and third parties.

XXII)-Failure by the permit holder, commander or pilot to comply with any of the
obligations or conditions set forth in the Civil Aviation Law, its regulations and this permit
shall be penalized in terms of Articles 86, 87, 88, 89 and 90 of the Civil Aviation Law.
XXIII)- The permit holder shall pay the fees provided for in Articles 159, Section II, and 153,
Section II of the Federal Fees Law, amounting to $12,530.00 Mexican Pesos and $ 604,00

Mexican pesos for the granting and the registration of this permit with the Mexican
Aeronautics Register, which had been covered by means of payment receipt dated October
21,2009.
Also, on a yearly basis, the permit holder shall pay and prove by means of an official receipt
the relevant fees for every year the permit is in force, in accordance with Articles 84 of the
Civil Aviation Law, 193 of its Regulation and 155 of the Federal Fees Law in force.
Fees payment shall be made within 25 calendar days following the date on which this
permit was granted, and for the following years, payment shall be made as of date on which
such permit was granted.

Captain Luis Alfredo Rayet Diaz is the President and C.E.O. of Ra
Jet Aeroservicios, S.A. de C.V. Captain Rayet was trained at the
Escuela Aeronautica Panamericana in Mexico, D.F. before
beginning his career in aviation in 1978. With more than 6,000
flight hours during 32 years of aviation experience, Captain Rayet
has held positions as Chief Pilot, General Manager, and Director
General at a host of Mexican air taxis before assuming the helm at
Ra Jet. These companies include Aerocisco, S.A. de C.V.,
Aeronaves T.S.M., S.A. de C.V., Aerorentas de Coahuila, S.A. de
C.V., and Jets Compartidos, S.A. de C.V. over the course of years
between 1978 and 2006. Captain Rayet founded Ra Jet in 2000,
and the company has grown into one of the larger air taxi
operations in Mexico.
Director of
Operations: Ra Jet's Director of Operations is Carlos Alberto Perez Villarreal.
He received a license in Official Operations from the Instituto
Mexicano de Aviation Civil. Captain Perez is a pilot with more than
17 years of aviation experience, having worked at Aeromexico
Connect in various positions as Operations Officer and later as
Operations Supervisor, Flight Controller, Chief of Dispatch and
Flight Control, and finally Chief of Operations. Captain Perez has
been Ra Jet's Chief of Operations since coming to work at the
company in 2010.
Chief Pilot:
Miguel Angel Magana Gonzalez is Ra Jet's Chief Pilot. Having
received his training at the Escuela Tecnica Aeronautica in
Monterrey, Nuevo Leon, Captain Magana currently has about 8,000
total flight hours. He holds a pilot's licence issued by the Mexican
DGAC and is qualified to operate Hawker 800 and 800XP aircraft,
Learjet 20s and 30s, in addition to other types of non-commercial
aircraft. He previously worked for other Mexican air taxi operations,
including Alcon Servicios Aereos, Aeronaves TSM, Aerotaxis
Dosmil, and Global Life Flight, before coming to work at Ra Jet in
2009.

Ra Jet's Maintenance Director is Miguel Angel Quevedo Montes.
Director:
Ing. Quevedo holds a license from the Escuela Superior de
Ingenerfa Mecanica y Electrica and has received specialized
training in helicopter maintenance from the Instituto Politecnico
Nacional. Before coming to Ra Jet in 2009, Ing. Quevedo was a
production control engineer at Aeroservicios Especializados, S.A.
de C.V. and later worked in a managerial position responsible for
aircraft maintenance, engineering, production control, purchasing
and invoicing at Scala Aviation, S.A. de C.V. in Mexico City. He
has taken numerous training courses relating specifically to Hawker
and Lear Jet aircraft, the primary types of aircraft RA Jet operates.

Director:
Ra Jet's financial director is Fernando Becerril Guerrero. Mr.
Becerril is a licensed public accountant (equivalent to the U.S.
C.P .A), and certified by the Board of Public Accountants of Jalisco.
C.P. Becerril has worked in the accounting industry since 1996 at
the accounting firm of Despacho de Ruiz Urquiza Y Cia., S.C.
before forming his own accounting firm (Becerril, Navarro Y Asoc.,

AGREEMENT
The undersigned carriers (hereinafter referred to as "the Carriers") hereby agree as follows:
1. Each of the Carriers shall, effective May 16, 1966, include the following in its conditions of carriage, including tariffs
embodying conditions of carriage filed by it with any government:
"The Carrier shall avail itself of the limitation of liability provided in the Convention for the Unification of Certain Rules
Relating to International Carriage by Air signed at Warsaw October 12th, 1929, or provided in the said Convention as amended
by the Protocol signed at The Hague September 28th, 1955. However, in accordance with Article 22(1) of said Convention, or
said Convention as amended by said Protocol, the Carrier agrees that, as to all international transportation by the Carrier as
defined in the said Convention or said Convention as amended by said Protocol, which, according to the contract of Carriage,
includes a point in the United States of America as a point of origin, point of destination, or agreed stopping place

The limit of liability for each passenger for death, wounding, or other bodily injury shall be the sum of US $75,000
inclusive of legal fees and costs, except that, in case of a claim brought in a State where provision is made for
separate award of legal fees and costs, the limit shall be the sum of US $58,000 exclusive of legal fees and costs.
(2)
The Carrier shall not, with respect to any claim arising out of the death, wounding, or other bodily injury of a
passenger, avail itself of any defense under Article 20(1) of said Convention or said Convention as amended by said
Protocol.
Nothing herein shall be deemed to affect the rights and liabilities of the Carrier with regard to any claim brought by, on
behalf of, or in respect of any person who has willfully caused damage which resulted in death, wounding, or other bodily injury
of a passenger."
2. Each Carrier shall, at the time of delivery of the ticket, furnish to each passenger whose transportation is governed by the
Convention, or the Convention as amended by the Hague Protocol, and by the special contract described in paragraph 1, the
following notice, which shall be printed in type at least as large as 10 point modern type and in ink contrasting with the stock on (i)
each ticket; (ii) a piece of paper either placed in the ticket envelope with the ticket or attached to the ticket; or (Hi) on the ticket
envelope:
"ADVICE TO INTERNATIONAL PASSENGER ON LIMITATION OF LIABILITY
Passengers on a journey involving an ultimate destination or a stop in a country other than the country of origin are advised
that the provisions of a treaty known as the Warsaw Convention may be applicable to the entire journey, including any portion
entirely within the country of origin or destination. For such passengers on a journey to, from,or with an agreed stopping place
in the United States of America, the Convention and special contracts of carriage embodied in applicable tariffs provide that the
liability of

[(name of carrier) and certain other] carriers parties to such special contracts for death of or personal injury to passengers is
limited in most cases to proven damages not to exceed US $75,000 per passenger, and that this liability up to such limit shall
not depend on negligence on the part of the carrier. For such passengers traveling by a carrier not a party to such special
contracts or on a journey not to, from, or having an agreed stopping place in the United States of America, liability of the carrier
for death or personal injury to passengers is limited in most cases to approximately US $10,000 or US $20,000.
The names of Carriers parties to such special contracts are available at all ticket offices of such carriers and may be
examined on request.
Additional protection can usually be obtained by purchasing insurance from a privre Crfnpan y . Such insurance is not
affected by any limitation of the carrier's liability under the Warsaw Convention lisUC speial contracts of carriage. For further
