On 13 February 2012 this General Directorate received a letter from the General Technical
Secretariat in which we were asked information regarding the freeing of an orca that was brought
from Holland to the Theme Park Loro Parque's installations in Tenerife.
This letter was sent to the General Directorate of Quality, Environmental Evaluation and Natural
Areas as the competence in terms of the commerce of vvild species is that of the General Sub­
directorate of Natural Areas.
We received the follovving report on the 3 May of this present year and we are attaching it to this
letter, for your reference.

The decision to transfer a juvenile orca, founded stranded on the Dutch coast of the Wadden sea in
June 2012 to Loro Parque's installations was taken by the Dutch Ministry of Economy, Agriculture
and Innovation, based on a report compiled by a group of 7 international experts, which united some
of the world's top experts on orcas and who had participated in the few orca release attempts to
date.
In this case, the function of the CITES Scientific Authority in Spain, a competence of this General
Directorate, has only been to inform on whether the installations to house the Orcinus orca were
appropriately equipped to conserve and give her proper care, in accordance with article 9 of the
Council Regulation (Ee) No 338/97 dated 9 December 1996 on the protection of species of wild fauna
and flora by regulating trade therein.
The evaluation of Loro Parque's installations was based on a previous evaluation done in 2003 which
was required to house 4 specimens which were to come in from the United States.
Ever since the transfer to Loro Parque
, this organisation has promptly informed this General Directorate on her introduction into the
"orcario" . In the last report from 1 March 2012 it is agreed that the veterinary situation is normal
and that Morgan's introduction process into the group of 5 other orcas had been completed
satisfactorily.

Orcin us orca FROM HOLLAND
Orcinus orca is the orca (Family Delphinidae)
It lives practically in all the seas of the world although its presence is not uniform. It is one of the
most widely distributed mammals. This species is catalogued as "Data Deficient" by the IUCN
(2012) since more studies on the structure and abundance of different populations are
required in the majority of regions where it is found.
It is found in Annex A of the Council Regulation (EG) No 338197 dated 9 December 1996 on the
protection of species of wild fauna and flora by regulating trade therein, and in the Appendix II of
the CITES Convention.
Precedents: Evaluation of the Loro
specimens from the United States
Parque
installations
in
Tenerife
to
house 3-4
On the 19 November 2003, this General Subdirectorate issued a positive report on the Loro
Parque installations that would house 3-4 live specimens of orca imported from the United
States. It is important to bear in mind that of the 3-4 implicated specimens, only one was from
wild origin (code W), the other born in captivity, and belonging to code F.

This positive report was based on individual blueprints of the different installations (mainly pools),
together with measurements and detailed descriptions. There was also information on the different
products and materials that would be used, with fact sheets on every one of them as well as the
justification for their use in each case.
The soliciting party also presented the following information:
- An educational project based on the group of orcas,
Orcinus orca
Orcinus orca.
- A breeding programme for the orcas
- A research plan for the orcas

In the educational project, the soliciting party mainly presented the possibilities of conducting
educational activities in the installations (based on current and predicted visitors), educational
activities, infrastructure and the personnel, as well as basic guidelines on liIA1at an educational
programme based on a population of captive orcas could be like.
The presented breeding project revealed great knowledge and experience of the soliciting party
(or on behalf of their partner Sea World, Florida, USA, the most experienced centre in the world
regarding the breeding of this species in captivity). This programme was presented to us on very
detailed and well-discussed way. Breeding orcas in captivity as well as the handling that those
responsible must do in every step of the way was also presented in a detailed way.
The research projects involved twelve different fields of research. The generic interest in the
research project was the possibility of learning a notable amount of information about this species
thanks to keeping a captive population. The populations in captivity (mainly at Sea World, a partner
of Loro Parque for in this petition) have permitted scientists to study physiological, reproductive,
behavioural and feeding aspects that are impossible to study in wild populations. In addition there is
an interest in improving handling techniques in a captive species such as an orca, a large marine
predator.
Due to all this information the installations were deemed adequate for the housing of 3-4
specimens of Orcinus orca.
Orca Morgan's Rescue
On the 23 June 2010 the D utch coastal guard located a lone juvenile orca in calm waters off the
Ducth coast, on the Wadden Sea. No orca had been Sighted off the Dutch coast since 1963.
The Dutch coast guard asked for help from the Harderwijk rescue centre to rescue this animal
which was about 18-24 months old and 343 m in length. Whilst the animal was being treated to
recover her weight and strength, work began to determine the identity of her family group. As there
was little certainty as to liIA1at group the orca belonged to, there were many questions on her
survival in the wild, and the 7 international experts with 1iIA10m Harderwijk decided to consult,
some of the best experts and 1iIA10 has participated in release attempts of orcas: CJ
Camphuysen (Royal NIOZ, Netherlands), John KB Ford (Cetacean Research Program, Pacific
Biological Station, Canada), Christopher Guinet (Centre National de la Recherche Scientifique,
France, Makid Leopold (IMARES, Netherlands), Christina Lockyer (The North Atlantic Marine
Mammal Commission, Norway), James Mc Bain (DVM, USA) and Fernando Ugarte (Head of
Mammal and Bird Department of the Greenland Institute of Natural Resources. The group of
experts unanimously concluded that the rescued animal wasn't apt for reintroduction and that she
should remain captive in adequate installations.

Based on this report, the Dutch Ministry of Economy, Agriculture and Innovation established that
Morgan would remain captive under the following circumstances:
- she must be with other orcas
- must be in adequate installations for a predator of her size
- must have educational aspects
This decision was communicated in the 18th meeting of the Council Committee of ASCOBANS of
the Migratory Species Convention (CMS) held in Bonn from the 4 to 6 May 2011.
At the end of May 2011, Harderwijk dolphinarium technicians visited the Loro Parque installations in
Tenerife and identified it as the ideal place for Morgan to integrate into a social group of orca, with
the optimum care and treatment for her and with educational objectives that are in accordance with
those established by the Department of Biodiversity of the Dutch Government.
Evaluation of the Loro Parque installations in Tenerife to house orca Morgan
On the 31 May 2011, the Administrative CITES authority - Spain (General Subdirectorate of
Inspection, Certification and Technical ASSistance for International Trade - Ministry of Industry,
Tourism and Commerce) contacted this Scientific Authority who had received a request to transfer
an individual Orcinus orca from dolphinarium Harderwijk (Netherlands) to the installations at Loro
Parque in Tenerife.
Due to the fact that the Netherlands considered that she could not be returned to the sea and
that the dolphinarium which was housing Morgan was only habilitated to keep small cetaceans, her
transfer to Loro Parque was requested.
In accordance with what is established in article 9 of the Communitarian Regulation 338/97,
the Administrative Authority requested a report on whether the proposed housing for the
individual Orcinus orca was appropriately equipped to preserve her and provide her the necessary
care.
As stated above, this Scientific Authority already had all the details and characteristic of the
installations in Tenerife and had authorised the importation of fours specimens of the same species
in 2003.
In May 2011 there were 5 Orcinus orca specimens at Loro Parque, two males and two females, that
were imported in 2003 from the US and a male calf born in December 2010.
Because of this, on 3 June 201 1 we gave a positive report on the installations at Loro Parque in
Tenerife to house an orca specimen originating from the Netherlands.
Report on the introduction of a rescued specimen of Orcinus orca into the group of animals
at Orca Ocean in Loro Parque
Since Morgan's transfer to Loro Parque, this organisation has been p e r i o d i c a l l y informing our
Subdirectorate about the introduction process.
Said process had been planned and structured in
5 phases:

- De-sensitisation of Morgan with regards to the vocalisations of the other five orcas in Orca
Ocean. and viceversa
- Adaptation to her carers and trainers. carefully transitioning those of Hardetwijk for those at Loro
Parque
- Adaptation to the installations. Orca Ocean installations consist of four pools: one main pool.
two holding tanks and one medical pool
- Adaptation to the management systems: her repertoire of medical behaviours and the
introduction of further behaviours
- Integration into the social group: since her arrival into Orca Ocean there was an acoustic contact
with the other individuals and there were controlled events of more and more duration.
We received 4 reports on the progress of this introduction on these dates:
- 14 December 2011
- 10 January 2012
- 3 February 2012
- 1 March 2012
In the last report it is conduded that the veterinary situation is normal and that Morgan's
introduction into the group of orcas at Loro Parque has been completed satisfactorily. This does
not mean that in the natural evolution of the social group there may not appear conflicts of
hierarchy. but current circumstances allow us to ascertain that there are no risks of her not being
accepted. or her being exduded. from the social group at Loro Parque.

En relaci6n a su escrito, de fecha 15 de febrero de 2012, relativo al escrito de la Casa de
S.M. el Rey intercediendo sobre una orca tr(jida de· Holanda al orcario de Loro Parque,
en Tenerife, adjunto Ie remito un informe al respecto.
La decisi6n de trasladar un ejemplar juvenil de orca, que apareci6 varado en la costa
holandesa del mar de Wadden en junio de 2010, a las instalaciones de Loro Parque, fue
tomada por el Ministerio de Economfa, Agricultura e Innovaci6n del Gobierno Holandes,
en base al estudio realizado por un grupo de 7 cientfficos internacionales, que reune a
algunos de los mayores expertos mundiales en orcas y que habian participado en los
escasos intentos de reintroducci6n de orcas conocidos hasta el momento.
En este caso, el cometido de la Autoridad Cientifica CITES":' Espana, competencia que
recae en esta Direcci6n General, ha side unicamente informar si el alojamiento previsto
para el ejemplar de Orcinus orca esta equipado de manera adecuada para conservarlo .y
darle el debido cuidado, de acuerdo con el articulo 9 del Reglamento (CE) 338/97, de 9
de diciembre de 1996, relativo a la protecci6n de la fauna y flora silvestres mediante el
control de su comercio.
La valoraci6n' de las instalaciones de Loro Parque en Tenerife se ha basado en una
valoraci6n previa realizada en 2003, para alojar 4 especimenes procedentes de Estados
Unidos..
Desde el traslado a Loro Parque, esta organizaci6n ha venido informando puntualmente
a esta Direcci6n General del proceso de introducci6n en el orcario. En el ultimo informe,
de fecha 1 de marzo de 2012, se concluye que la situaci6n veterinaria es normal y que el
proceso de introducci6n de Morgan al grupo de cinco orcas de Loro Parque ha side
completado de manera satisfactoria.

INFORME sobre LAS INSTALACIONES DE LORO PARQUE, TENERIFE, PARA El
ALOJAMIENTO DE UN EJEMPLAR DE ORC/NUS ORCA PROCEDENTE DE
HOLANDA
Orcinus orca
es la orca (Familia Delphinidae).
Se distribuye por fa practica totalidad de los mares del mundo aunque su presencia en
ellos no es uniforme. Es uno de los mamiferos con mayor area de distribucion. Esta
especie esta catalogada por UICN (2012) en la categoria de "Datos insufiCientes" ya que
son necesarios mas estudios sobre la estructura de las sub poblaciones y abundancia en
la mayoria de las regiones donde se distribuye.
Se encuentra listada en el Anexo A del Reglamento (CE) 338/97 del Consejo, de 9 de
diciembre de 1996, relativo a la proteccion de especies de la fauna y flora silvestres
mediante el control de su comercio, y en el apemdice II del Convenio CITES.
Antecedentes:
Valoraci6n de las instalaciones de Loro Parque en Tenerife para
alojar 3 4 especimeries procedentes de Estados Unidos
-
EI19 de noviembre de 2003, esta Subdireccion General informo positivamente acerca de
las instalaciones previstas en Loro Parque para alojar 3 - 4 especimenes vivos de orca
procedentes de Estados Unidos. Es importante tener en cuenta que de los 3-4
especimenes implicados, solo uno era de origen silvestre (codigo W), siendo el resto de
cria en cautividad, adjudicandoseles en principio codigo de origen F.
Ese informe positiv� se base en que el solicitante aporto pianos individuales de las
diferentes instalaciones (piscinas principalmente), con medidas y descripciones
detalladas. Informo igualmente sobre productos y materiales a utilizar en las instalaciones,
con fichas tecnicas de los mismos y la justificacion de su usa en cada caso.
EI solicitante aporto ademas la siguiente informacion:
Proyecto educativ� para el grupo de orcas,
" Programa de cria para orcas Orcin us orca
- Plan de investigacion para orcas Orcinus orca.

En el proyecto educativ�, el solicitante exponia principalmente la gran posibilidad de
desarrollar actividades de educacion en sus instalaciones (que basa en las visitas
actuales· y previstas), su actividad educativa, las infraestructuras y personal con que

cuenta y las lineas maestras de 10 que podria ser un programa educativo basado en la
poblacion de orcas en cautividad.
EI proyecto de cria presentado revelaba el gran conocimiento y experiencia del solicitante
(0 de su socio Sea World, Florida, USA, centro con mas experiencia en el mundo en la
cria en cautividad de esta especie). Este programa exponia de forma ordenada, detallada,
bien argumentada y referenciada la cria en cautividad de las orcas y el manejo que los
responsables deben hacer de cada etapa 0 paso de la misma.
EI proyecto de investigacion comprendia doce lineas de investigacion. EI interes genericQ
del proyecto de investigacion era la posibilidad de obtener una cantidad notable de
conocimientos cientificos sobre esta especie a partir del mantenimiento de una poblacion

. en cautividad en las condiciones descritas. Esta posibilidad subyacia en multitud de
aspectos concretos en la exposicion de la informacion aportada, que revela como las
poblaciones mantenidas en cautividad (principalmente por Sea World, socio de Loro
Parque para esta solicitud) han permitido estudiar aspectbs fisiologicos, reproductivos, de'
comportamiento y alimentarios que no es posible abordar con especimenes 0 poblaciones
en el medio natural; adicionalmente esta el interes del,desarrollo de tecnicas de manejo
en cautividad para una especie como la orca, un predador marino de gran tamano.
Con dicha informacion, se considero que las instalaciones eran adecuadas para el
alojamiento de 3-4 especimenes de Orcin us orca.
Rescate de la orca Morgan
EI 23 de junio de 2010, el servicio de la guardia costera holandesa localiz6 un ejemplar
juvenil de. orca en una zona somera de la costa holandesa del Mar de Wadden. No se
habian avistado orcas en la costa holandesa desde 1963.
La guardia costera holandesa solicit6 la ayuda del centro de rescate del acuario de
Hardewijk para rescatar el animal, de unos 18- 24 meses de edad y 343 cm de longitud.
Allf, mientras se trataba de que el animal recuperara peso y fuerzas, se iniciaron los
trabajos para determinar la identidad del grupo familiar de la orca para intentar
reintegrarlo. Dado que la escasa certeza sobre el grupo familiar al que pertenecia la orca
rescatada generaba dudas sobre su posible supervivencia en la naturaleza, el grupo de
expertos del delfinario de Harderwijk decidi6 consultar a un grupo de 7 cientificos
internacionales que reline a algunos de los mayores ex ertos en orcas del mundo y que
habian participado e-n-Io escasos intentos de reintroduCcl6n de orcas conocidos: C.J.
Camphuysen (Royal NIOZ, Netherlands), John K. B. Ford (Cetacean Research Program,
Pacific Biological Station, Canada), Cristopher Guinet (Centre National de la Recherche
Scientifique, France), Makid Leopold (IMARES, Netherland), Christina Lockyer (The North
Atlantic Marine Mammal Commission, Norway), James Mc Bain (DVM, USA) Y Fernando
Ugarte (Head of Mammal and Bird Department of the Greenland Institute of Natural
Resources). EI grupo de expertos concluy6 de forma unanime que el animal rescatado no
era apto para una reintroducci6n y que debia ser mantenida en cautividad en unas
instalaciones adecuadas.

En base a dicho informe, el Ministerio de Economia, Agricultura e Innovacion del Gobierno
Holandes establecio que Morgan debia mantenerse en cautividad con una serie de
condiciones:
que estuviese con otras orcas,
en unas instalaciones adecuadas para un predador de su tamano,
en un lugar con objetivos educativos.
Esta decision fue comunicada en la 18 reunion del Comite Consultivo de ASCOBANS
(Acuerdo para la Conservacion de los Pequenos Cetaceos en el Mar Baltico y mar del
Norte) del Convenio de Especies Migratorias (CMS 0 Convenio de Bonn), celebrada en
Bonn del 4 al 6 de mayo de 2011.
A finales de mayo de 2011, tecnicos del delfinario de Harderwijk visitaron las instalaciones
de Loro Parque en Tenerife y las identificaran como un lugar idoneo para que Morgan
pueda integrarse en un grupo social de orcas, con un grado de manejo y cuidado optimos
para un ejemplar de esta y con unos objetivos de educacion y sensibilizacion en la linea
de los que establece el Departamento de Biodiversidad del Gobierno Holandes.
Valoracion de las instalaciones de Loro Parque para el alojamiento de la orca
Morgan
Con fecha 31 de mayo de 2011, la Autoridad Administrativa CITES - Espana
(Subdireccion General de Inspeccion, Certificacion y Asistencia Tecnica del Comercio
Exterior del Ministerio de Industria, Turismo y Comercio) comunico a esta Autoridad
Cientifica que habia recibido una solicitud de traslado de un ejemplar de la especie
Orcinus orca del delfinario de Harderwijk (Paises Bajos) a las instalaciones de Loro
Parque en Tenerife.
Dado que las autoridades de Paises Bajos consideraban que no podia ser devuelta al mar
y dado que el delfinario en el que se encontraba entonces, estaba habilitado solo para
mantener cetaceos pequenos, se solicito el traslado a las instalaciones de Lora Parque.
De acuerdo con 10 establecido en el articulo 9 del Reglamento comunitario 338/97, la
Autoridad Administrativa solicitaba que se informase sobre si el alojamiento previsto para
el ejemplar de Orcin us orca estaba equipado de manera adecuada para conservarlo y
darle el debido cuidado.
Como se ha explicado anteriormente, esta Autoridad Cientffica ya tenia todas las
caracteristicas de las instalaciones de Tenerife para las que autorizo la importacion de
cuatro especimenes de la misma especie en diciembre del ano 2003.
En Loro Parque habia en mayo de 2011 cinco ejemplare.s de Orcin us orca, dos hembras y
dos machos que se importaran de Estados Unidos en 2003 y una cria macho nacida en
diciembre de 2010.
Por ello, con fecha 3 de junio de 2011 se informo positivamente a sobre las instalaciones
del orcario de Loro Parque en Tenerife para albergar un ejemplar de orca pracedente de
Paises Bajos.

Informe sobre la , i ntroducci6n de un ejemplar rescatado de Orcin us orca en el grupo
de animales de Orca Ocean de Loro Parque
Desde el traslado de Morgan a Lora Parque, esta organizaci6n ha venido informando
puntualmente a esta Subdirecci6n General del proceso de introducci6n en el orcario,
Dicho proceso de introducci6n habia sido planificado y estaba estructurado en 5 fases:
de Morgan respecto a las vocalizaciones de los
cinco ejemplares de Orca Ocean, y viceversa,
Adaptacion a cuidadores y entrenadores, planificandose una transici6n gradual de
los cuidadores de Hardewijk a los de Loro Parque
Adaptacion a las instalaciones. Las instalaciones de Orca Ocean consisten en un
sistema de cuatro piscinas, una principal, dos de alojamiento y una piscina medica
Adaptacion al sistema de gestion: consolidaci6n del repertorio de comportamientos
medicos e introducci6n de comportamientos adicionales
Integracion en el grupo social: desde la lIegada de Morgan a las instalaciones de
Orca Ocean se inici6 el contacto acustico con el resto de los ejemplares y eventos
de introducci6n controlados de duraci6n cada vez mayor.

En el ultimo informe, se concluye que la situaci6n veterinaria del ejemplar es normal y que
el proceso de introducci6n de Morgan al grupo de orcas de Loro Parques ha sida
completado de manera satisfactoria. Esto no significa que -en la evoluci6n natural del
grupo social en el futuro no puedan aparecer conflictos de jerarquia, pero las
circunstancias actuales permiten afirmar que ya no hay riesgo de no aceptaci6n 0
exclusi6n de Morgan en el grupo social de orcas de Lora Parque,
