I. Las ecciones y om•s•ones del transportista de hecho y de sus dependientes,
cuando btos actuen en el ejercicio de
sus funciones. se considerarlm tambi~n.
en relaci6n con el transporte realizado por
el transportista· de hecho, como acciones
y omisiones del transportista contractual.

2. Por lo que se reficre al transporte
realizado por el transportista de hecho,
las acciones y omisiones del transportis·
ta contractual y de sus dependientes,
cuando estos actuen en el ejercicio de sus
funciones, se consideranin tambien como
del transportista de hecho. Sin embargo,
tales acciones y omisiones no someteran
a) transportista de hecho a una responsabilidad que exceda de los limites previstas en e) Articulo 22 del Convenio de
Varsovia. Ningun acuerdo especial por
el cual ·el transportista contractual asuma obligaciones no impuestas por el Con•
venio ·de Varsovia, ninguna renuncia de
· derechos establecidos por dicho· Conve'nio y ninguna declaraci6n especial de valor prevista en el Articulo 22 de d:cho
