SAN JUAN COUNTY
RESOLUTION NO. 14-15-12
DECLARING ALL CONDITIONS HAVE BEEN MET FOR CONDUCTING AN ELECTION JANUARY 6, 2015,
ON THE QUESTION OF INCORPORATION OF THE
TOWN OF KIRTLAND, NEW MEXICO
WHEREAS, on September 2, 2014, the San Juan County Commission received petition(s) for
incorporation of the town of Kirtland, New Mexico; and
WHEREAS, the petition(s) requested the Board of County Commissioners of San Juan County to hold an election on
the question of incorporation of a town of Kirtland, New Mexico, on January 6, 2015; and
WHEREAS, the Board of County Commissioners did, on September 2, 2014, conduct a public hearing
on the validity of the petition(s) for incorporation of the town of Kirtland, New Mexico, and did hear testimony and
statements, and did receive, discuss, and consider documentation with respect to the validity of the petition; and
WHEREAS, the Board of County Commissioners, after considering all documents, testimony, and public
presentations, did make findings of fact as follows:

Find that there are 337 acres of land in the proposed town;
Find that the petition(s) contain valid signatures of the owners of
60%+ (at least 203 acres of land) in the proposed town;
Find that there is a population of more than 337 residents in the proposed town.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of San Juan County, New Mexico,
that:
1.
The petitions are sufficient to call for an election January 6, 2015, on the question of proposed incorporation
of the town of Kirtland, New Mexico, and the County Clerk is directed to take such actions and engage in such
proceedings as to conduct such election and certify the results thereof.
2.
The County Executive Officer is directed to refer the Municipal Services and Revenue Plan to the Local
Government Division of the State Department of Finance and Administration for its consideration and report back to
the Board of County Commissioners the results of that review.
PASSED, APPROVED AND ADOPTED this 2nd day of September, 2014.

DECLARACIÓN DE TODAS LAS CONDICIONES QUE HAN LLENADO LOS
REQUISITOS PARA LLEVAR A CABO UNA ELECCIÓN EL 6 DE ENERO DE 2015
SOBRE LA INCORPORACIÓN DEL PUEBLO DE KIRTLAND, NUEVO MÉXICO
CONSIDERANDO QUE, el 2 de septiembre, la Junta de Comisionados del Condado de
San Juan recibió una(s) petición(es) sobre la incorparación del pueblo de Kirtland, Nuevo México; y
CONSIDERANDO QUE, la(s) petición(es) pedían que la Junta de Comisionados del Condado de San Juan lleve a
cabo una elección sobre la incorporación del pueblo de Kirtland, Nuevo México, el 6 de enero de 2015; y
CONSIDERANDO QUE, la Junta de Comisionados del Condado, el 2 de septiembre de 2014, llevó a
cabo una audiencia pública para la validación de la(s) petición(es) de la incorporación del pueblo de Kirtland,
Nuevo México, y escuchó testimonios y declaraciones, y recibió, discutió y consideró la documentación con
respecto a la validación de la petición;
CONSIDERANDO QUE, la Junta de Comisionados del Condado, después de considerar todos los
documentos, testimonios y presetaciones públicas, formuló las siguientes constataciones del hecho:
A.
Hay 337 acres de tierra en el pueblo propuesto;
B.
La(s) petición(es) contiene(n) firmas validas del 60% + de los propietarios (por lo menos 203 acres de tierra)
en el pueblo propuesto;
C.
Hay una población de más de 337 residentes en el pueblo propuesto.
AHORA, POR LO TANTO, SE HA RESUELTO por la Junta de Comisionados del Condado de San Juan,
Nuevo México, que:
1.
La petición ha sido suficiente para llamar a elección el 6 de enero de 2015, sobre la cuestión de proponer la
incorporación del pueblo de Kirtland, Nuevo México, y el escribano del condado debe tomar dicha acción y organizar
los procedimientos para conducir dicha votación y certificar por lo tanto los resultados.
2.
Los Oficiales Ejecutivos del Condado deben de referirse a el Plan de Servicios e Ingresos Municipales del
Gobierno Local del Departamento del Estado de Administración y Finanzas para su consideración y reportar a la
Junta de Comisionados del Condado los resultados de dicha revisión.
