Capítulo XI TLCAN

Artículo 1101: Ambito de aplicación.
•
1. Este cap ítu lo se ap lica a las m ed id as qu e ad op te o mantenga u na Parte relativas a:
•
•
(a) los inversionistas d e otra Parte;
(b) las inversiones d e inversionistas d e otra Parte realizad as en territorio d e la Parte; y
(c) en lo relativo a los Artícu los 1106 y 1114, tod as las inversiones en el territorio d e la Parte.
Artículo 1105. Nivel mínimo de trato
•

1. Cad a u na d e las Partes otorgará a las inversiones d e los inversionistas d e otra Parte, trato acord e
con el d erecho internacional, inclu id o trato ju sto y equ itativo, así com o p rotección y segu rid ad
p lenas.
Artículo 1110: Expropiación e indemnización
•
1. N ingu na d e las Partes p od rá nacionalizar ni exp rop iar, d irecta o ind irectam ente, u na inversión d e
u n inversionista d e otra Parte en su territorio, ni ad op tar ningu na m ed id a equ ivalente a la
exp rop iación o nacionalización d e esa inversión (exp rop iación), salvo qu e sea:
•
(a) p or cau sa d e utilid ad p ú blica;
(b) sobre bases no d iscrim inatorias;
(c) con ap ego al princip io d e legalid ad y al Artícu lo 1105(1); y
(d ) m ed iante ind em nización conform e a los párrafos 2 a 6.
Artículo 1114 TLCAN

•
1. N ad a d e lo d ispu esto en este capítu lo se interpretará com o im ped im ento
para qu e u na Parte ad opte, m antenga o ponga en ejecu ción cu alqu ier
m ed id a, por lo d em ás com patible con este capítu lo, qu e consid ere
apropiad a para asegu rar qu e las inversiones en su territorio se efectú en
tom and o en cu enta inqu ietu d es en m ateria am biental.

2. Las Partes reconocen qu e es inad ecu ad o alentar la inversión por m ed io d e
u n relajam iento d e las m ed id as internas aplicables a salu d o segu rid ad o
relativas a m ed io am biente. En consecu encia, ningu na Parte d ebería
renu nciar a aplicar o d e cu alqu ier otro m od o d erogar, u ofrecer renu nciar o
d erogar, d ichas m ed id ascom o m ed io para ind u cir el establecim iento, la
ad qu isición, la expansión o conservación d e la inversión d e u n inversionista
en su territorio. Si u na Parte estim a qu e otra Parte ha alentad o u na inversión
d e tal m anera, pod rá solicitar consu ltas con esa otra Parte y am bas
consu ltarán con el fin d e evitar incentivos d e esa índ ole.

2.1 Mem bers shall ensu re that in respect of technical regu lations, prod u cts im ported from the
territory of any Mem ber shall be accord ed treatm ent no less favou rable than that accord ed to like
prod u cts of national origin and to like prod u cts originating in any other cou ntry.
•
2.2 Mem bers shall ensu re that technical regu lations are not prepared , ad opted or applied w ith a
view to or w ith the effect of creating u nnecessary obstacles to international trad e. For this pu rpose,
technical regu lations shall not be m ore trad e-restrictive than necessary to fu lfil a legitim ate
objective taking accou nt of the risks non -fu lfilm ent w ou ld create. Su ch legitim ate objectives are,
inter alia: national secu rity requ irem ents; the prevention of d eceptive practices; protection of
hu m an health or safety, anim al or plant life or health, or the environm ent. In assessing su ch risks,
relevant elem ents of consid eration are, inter alia: available scientific and technical inform ation,
related processing technology or intend ed end -u ses of prod u cts.

2.3 Technical regu lations shall not be m aintained if the circu m stances or objectives giving rise to
their ad option no longer exist or if the changed circu m stances or objectives can be ad d ressed in
aless trad e-restrictive m anner.

2.4 Where technical regu lations are requ ired and relevant international stand ard s exist or their
com pletion is im m inent, Mem bers shall u se them , or the relevant parts of them , as a basis for their
technical regu lations except w hen su ch international stand ard s or relevant parts w ou ld be an
ineffective or inappropriate means for the fu lfilm ent of the legitim ate objectives pu rsu ed , for
instance becau se of fu nd am ental clim atic or geographical factors or fu nd am ental
