APPLICATION FOR RENEWAL OF EXEMPTION
FILED BY AEROPYCSA, S.A. de C.V.
Pursuant to 49 U.S.C. §40109 and Subpart D of the Department's Procedural
Regulations, Aeropycsa, S.A. de C.V., a Mexican operator of executive aircraft, requests a
renewal of its exemption from 49 U.S.C. §41301, which exemption authorizes Aeropycsa
to engage in the foreign transportation of persons and their accompanying baggage in a
small aircraft between Mexico and the United States. Aeropycsa also requests renewal of its
stopover privileges and renewal of its relief from the requirement to obtain advance
approval for each Mexico-U.S. flight, based on the belief that considerations of comity and
reciprocity favor such relief. The Department granted the above authority on December 2,
1996. Aeropycsa requests that this authority, which is scheduled to expire on September
26**. 2009, be renewed for a period of at least one year.
Aeropycsa invokes the automatic extension provisions of the Administrative
Procedure Act, 5 U.S.C. §558(c), as implemented by 14 C.F.R. §377, to maintain its

exemption authority in effect pending a final Department determination on this
renewal applications.
Aeropycsa continues to be fit, willing and able to provide the services for which it
requests renewed authority. The relevant circumstances under which Aeropycsa received its
initial grant of exemption remain unchanged, and, in support of this application, all
necessary information required by the U.S. Department of Transportation in renewing
Aeropycsa's exemption is provided below.

Identical Performance of Services.
Aeropycsa, S.A. de C.V. seeks renewal of authority to transport corporate officials
of its parent corporation to and from the continental United States, in order to hold business
meetings with other company representatives and partners. These services are substantially
identical to those it performed during the past year.
Under current authority, Aeropycsa currently operates a single twelve passenger
Canadair Challenger CL-6002B16, which is registered in Mexico. Aeropycsa has no
immediate plans to acquire additional aircraft. The aircraft is fully navigation-equipped
with functioning mode C (altitude reporting) transponder(s) which will be in use in flight.

The aircraft is owned by Aeropycsa, S.A. de C.V. and is not leased or wet-leased.
All flights will be made in accordance with instrument flight rules and will be made
at altitudes above 12,500 feet mean sea level, unless otherwise instructed by Federal
Aviation Administration instructors.
As under the current authorization, Aeropycsa anticipates approximately 30 flights
to the United States per year, which would be undertaken regardless of seasonal variations.
They would be primarily non-stop/multi-stop passenger flights. The usual or anticipated
cargo or baggage on these flights would be limited to the personal luggage of the
passengers and/or spare parts to be repaired/overhauled.

Aeropycsa is responsible for the maintenance and operation of private aircraft used
by Grupo KUO S.A.B. de C.V. FKA DESC, S.A. de C.V. and its subsidiaries to transport
company officers and personnel between operating divisions and manufacturing sites
within Mexico, as well as for the transportation of company officials from Mexico to the
United States - in particular, to U.S. airports in Tucson and Phoenix, AZ; Los Angeles and
San Francisco, CA; Eagle and Denver CO; Miami and Fort Lauderdale, FL; Boston, MA;
St. Louis, MO; Chicago, IL; Teterboro and Newark,NJ; Dallas, TX; Toledo, OH.

Aeropycsa's Mexican authority to engage in these services remains in full force and
effect. (See Appendix 1.)
4.
Operations Specifications.
On November 11, 1996, pursuant to its FAA Part 129 Operations Specifications, the
Federal Aviation Administration issued operations specifications for these Aeropycsa
services, which remain in effect.
5.
Treaty.
These operations are encompassed by a bilateral aviation agreement between the
United States and Mexico titled, the U.S.-Mexico Air Transport Services Agreement of
August 15, 1960, as amended and extended. Under that agreement, the Government of
Mexico provides reciprocal treatment and authorizes U.S. carriers to conduct these types of
operations to and from Mexico.
6.
Accident Liability Insurance Coverage.
Aeropycsa's accident liability coverage meets or exceeds the liability limits o 14
C.F.R. part 205. A copy of the OST Form 6411 certifying Aeropycsa's insurance coverage
is attached at Appendix 2. The name of its insurance carrier is:

7. Other
Maintenance. Aeropycsa maintains its aircraft pursuant to an airworthiness program

approved by the Mexican D.G.A.C. in compliance with ICAO annexes 1, 6 (Part 1)
and 7. Aeropycsa performs routine maintenance on its aircraft and uses the

Aeropycsa has an established and well-qualified management team with many years
of experience providing domestic and international air taxi services.
Agreements With Other Carriers. Aeropycsa has no agreements or cooperative
working arrangements {e.g., block-space wet lease), either oral or written, entered
with and between Aeropycsa and any U.S. or foreign air carrier, or aeronautical
enterprise affecting the proposed services to the United States.

Aeropycsa, S.A. de C.V. receives and expects no financial assistance from the
Government of Mexico.

Since the authority requested is covered by a bilateral agreement with Mexico,
under that agreement, Aeropycsa need not be specifically designed by name by the
Government of Mexico in a diplomatic note.
•
Mexico grants traffic rights to U.S. carriers and described in the bilateral agreement
described previously.
•
Aeropycsa has not been involved in any safety of traffic violations or any fatal
accidents for the past five years.
Therefore, Aeropycsa respectfully requests renewal of its exemption authority to
engage in charter foreign air transportation of persons and their accompanying baggage
with small aircraft as set forth herein, and such other relief as may be in the public interest.
