General approach to gambling

In the field of gambling (juego) and betting (apuesta), the Spanish legal system has remarkably changed in the last decades, going from a centralized system to a decentralized one.
Gambling was decriminalized in 1977, by the enactment of the Royal decree 16/1977. Such
decriminalization caused a proliferation of new types of gaming (such as casinos, bingo,
gaming machines), alongside the games allowed until then: the National lottery, the sport
betting and the National Blinds Organization ticket.
Historically, Spain installed a centralized system of gaming. However, the Autonomous
Regions (Comunidades Autónomas: «CCAA») have been progressively acquiring
competences, legislating and controlling the gaming activities held in their respective
territories. This process started in 1982, with the transfer of gambling competences to
Catalunia and the Basque regions, followed by the affording of competences on behalf of
Aldalucía, Galicia, Canarias, Valencia, Navarra, Aragón, La Rioja, Castilla y León, Madrid y
Murcia, Baleares, Extremadura, Castilla la Mancha, Asturias, Cantabria, and the cities of
Ceuta and Melilla.
Today, most CCAA benefit from exclusive competences with respect to gambling held
within their respective territories.
In this light, the role of the central State is limited to gaming and betting at the national
level, sport betting and national lotteries (this including the authorization and registry of
gaming enterprises acting at the national level as well as police competences), and to the
coordination with the different regional systems, including the preparation of statistic data. In
other fields, the existing central State's legislation withdraws when there is an Autonomic
norm regulating the same matter. In other words, the State's monopoly on gaming still exists,
but now the CCAA limit the monopoly in the framework of their territories759.
Since 1984, betting at the national level was under the responsibility of an entity named
Organismo Nacional de Loterías y Apuestas del Estado («ONLAE»). In light of the necessity
of making State lotteries more competitive in an evolving market, in 2000760 a more dynamic
entity - the entrepreneurial public entity of State lotteries and betting (Entidad pública
empresarial Loterías y Apuestas del Estado: «LAE») - substituted the ONLAE. The tasks of
the LAE are:

The management, operation and commercialization of lotteries and games of national
scope in their different modalities. This includes lotteries and gaming carried out in a
region larger than the territory one CCAA. It falls within the exclusive competence of the
LAE to authorize the organization and exploitation of drawings, lotteries, games of
random combinations and, in general, of any sport betting whose scope of development
or application exceeds the territorial limits of one CCAA, as well as the liquidation of the
corresponding rates.

From the standpoint of operators, private entrepreneurs exploit casinos, gaming
machines and bingos, whilst the public sector exploits lotteries: the national lottery and
the «primitiva» lottery, the bono-loto and the football betting (quiniela de fútbol) are exploited
by the LAE; whilst the pro-blind ticket (Cupón pro-ciegos) is exploited exclusively by a
association: the ONCE (National organization of Blinds).
Spain has a law against money laundering761. Articles 2.2. a) and 2.2. j) submit the persons
engaged in casino and lottery operations to the obligations imposed by the law.

«Primitive» Lottery consists in guessing, from a table of correlative numbers, a certain

Instant lottery is a game enabling to win a prize, invisible to the player until he proceeds

Gaming machines of type «B» are machines which, in exchange for the price of a
game, concede to the user a certain time for gambling and, eventually, according to the
gaming program, a prize in money. Are also machines «B» those including an element
of betting or chance and classified as such by the Ministry of Interior766.

a fixed prize, offer to the user an entertainment or the possibility of gaining a price in
money or in goods767.
«El juego activo «El Combo» Artículo 1.Objeto del Reglamento y características del juego.
1.1. El presente Reglamento tiene por objeto establecer las condiciones por las que se rige el
juego activo denominado «El Combo», sin que la participación en el juego suponga que se
concierte contrato alguno entre los concursantes ni entre éstos y la ONCE, quedando limitada
la actividad de los concursantes a pagar el precio y a entregar sus apuestas en la forma
establecida en el presente Reglamento. 1.2. El hecho de participar en cualquiera de los sorteos
de «El Combo» implica el conocimiento del presente Reglamento por parte de los concursantes
y su adhesión a las normas incluidas en el mismo, quedando sometidas todas las apuestas a
dichas normas. 1.3. El juego activo denominado «El Combo» está formado por siete bolas: seis
bolas agrupadas en tres filas (base, centro y vértice) colocadas en forma de triángulo y una
bola adicional. Dentro del triángulo la fila base tiene tres bolas, la fila centro tiene dos bolas y la
fila vértice una bola. 1.4. El juego consiste en asignar un número del 0 al 9 a cada una de las
seis bolas colocadas dentro del triángulo y otro número, del 1 al 11, a una bola adicional, para
optar, previo el oportuno sorteo, a los premios que correspondan, en la forma y en las
condiciones que se establecen en el presente Reglamento. 1.5. Cada combinación de seis
números para las bolas del triángulo y de un número para la bola adicional constituye una
apuesta. Pueden existir dos o más apuestas a la misma combinación y combinaciones que no

Betting is the activity in which an amount of money is staked on the results of a public
or sport event previously determined, that has an uncertain result and that is
independent from the intervening parties768. In Spain there are no fixed odds.
Sports betting
–
Sports betting are contests organized on the basis of the results of one or several sport
events769.
Bingo

Bingo is a game played on 90 numbers, from 1 to 90 inclusive, played on the basis of a
support made of a cartoon or an integrated card having each 15 different numbers and
distributed in three horizontal lines of five numbers each and in nine vertical columns, in
each of which there can be three, two or one number, but without having a column
without numbers. Prizes can be won when completing different combinations out of a
drawing770.

Raffle
A raffle is the drawing of a determined object, movable or immovable, but in any case not
money or something representing money. The drawing is realized between several persons
who have purchased tickets of a unique value. The total of the issued tickets should satisfy
the price of the prize771.
Tombola
A tombola is a simultaneous drawing of several movable objects done in such manner that
one and unique ticket gives the possibility of acquiring each one of the objects. The total of
the issued tickets should satisfy the price of all the objects772.
Aleatory combinations
Aleatory combinations are drawings that, with exclusive aims of publicity or promotion of a
product or a service, and having as unique consideration the consummation of the product or
the service without any increasing in its prize, some prizes in money, in goods or services
are offered773.
Sales Promotional gaming

«Sales with gifts» are sales in which the seller uses contests, drawings, gifts, bonds,
prizes or similar things, related to the offer, promotion or sale of some goods774.

The national lottery is exempted of operational taxes, so is the National Blinds Organization.
For other gaming, Spanish law imposes a tax on gaming (tasa fiscal sobre el juego).
Although this is a central State's tax, the cession of competences on behalf of the CCAA
(Law 14/1996 of 30 September 1996) caused that the management, liquidation, inspection,
collection and regulation falls within the powers of the later. Besides this tax, the operators
have to satisfy a tax for administrative services of gaming management. This tax variates
from one CCAA to the other. Besides these two taxes, operators are submitted to the tax on
companies (a direct tax of personal nature applied to gains). Finally, Spain applies a tax on
economic activities, which is a direct tax imposing economic activities carried out in Spain.
Casinos are exempted from TVA. Depending on the CCAA where the casino operates, the
tax may fluctuate between 20 - 61% on a progressive scale. For Bingos, depending on the
concerned CCAA, the tax on operators may fluctuate between between 10-31%. The tax
applicable to sales promotional gambling is of 10% of the value of the prizes.

1.
General
The CCAA, who have the exclusive competences to regulate gaming held within their
territories, enacted legislation regulating gambling and betting - including the establishment
and exploitation of casinos. With respect to this last sector, the multiplicity of regional
legislations may pose difficulties to operators wishing to act in more than one CCAA,
because the same entity may be submitted to different administrative requirements. In
this context, the role of the central State is limited to gaming and betting at the national level,
some sport betting and national lotteries (this including the authorization and registry of
gaming enterprises acting at the national level as well as police competences) and to the
coordination with the different regional systems, including the preparation of statistic data. In
other fields, the existing central State's legislation withdraws when there is an Autonomic
norm regulating the same matter.
From the standpoint of operators, private entrepreneurs exploit casinos, gaming machines
and bingos on the basis of specific concessions or authorizations, whilst national lotteries are
the competence of the central State.
2.
Lotteries
The public sector exploits, on an exclusive basis, the lotteries at the national level (the
national lottery and the «primitiva» lottery, the bono-loto and the football betting «quiniela de
fútbol» are exploited by the LAE).

As soon as in 1956 , Spain forbidded the selling of foreign lottery tickets and the
publication of their programs, publicity and announcements. In 1985, the Additional provision
n° 18 to the Law of the State Budget for 1986796, specifically forbidded the putting into
circulation, commerce, possession or production of tickets, tickets, stamps, cartoons, notes,
machines or any other element, including technical and computerized, serving as a support
for games of chance, drawings, lotteries, raffles, tombolas, random combinations and, in
general, any activity in which amounts of money or economically valuables objects are risked
in form of betting with respect to results. This prohibition exceptes the State lotteries and the
lotteries organized by the National Blinds Association. With the creation of the LAE, the
competence to exploit, handle and commercialise the different lotteries at the level of more
than the territory of one CCAA (including sport betting) were exclusively attributed to that
entity.797

Some special drawings, such as the pro-blind ticket (Cupón pro-ciegos) and the «Combo»798,
are exploited in exclusivity by a charity association: the ONCE (National organization of
Blinds). In effect, an order of 23.3.2000799, attributes, in Article 5, the exclusive right to exploit
a certain lottery as well as the possibility to increase the area of action to other gaming to the
National Blinds Association. Article 50 of the same order provides that the National Blinds
Association may receive subventions from the State.
On the 6 August 2005, the Ministry of Official Bulletin of the State published Order
EHA/2566/2005, of 20 of July800, allowing only the entrepreneurial public entity of State
lotteries and betting to comercialize its products by Internet and other interactive means.
Article Third 3° of this Order states that with the aim of avoiding transborder betting, the
mechanisms of validation of the bets must guarantee that the participation will only be
allowed within the Spanish territories.
At the regional level there exist certain local lotteries regulated by the laws of the CCAA. In
Cataluña, the exclusive right to operate local lottery belongs to the Catalonian Government,
throughout its Entity for gaming and bets801. The same principle exists in Canarias802.
3.
Casino Gaming
Today, the competence to regulate the operations of casinos belongs almost entirely to the
CCAA.
The operation of casinos is allowed by concession, after the opening of a public tender.
Along with the traditional requirements of solvency of the promoters, etc., some CCAA take
into consideration the touristic interest of the presented project803. It is not unusual that the
requirement of domicile in Spain or in the CCAA804 and, for corporations to adopt a

certain form should be included805. Another usual requirement is for the shares of operating
companies to be nominative806.
As to the nationality of the operators, some CCAA laws require Spanish nationality. Such
is the case of Valencia (art. 16 b) of Law 14/1988807). With this respect, such regional laws
may collide with a Law of the central State808, providing, in article 1, that gaming is one of the
sectors of foreign investment with specific regulation on the right of establishment in Spain.
However, article 2 to this Law states that «the former will not apply to the residents of a State
member of the EU, exception made of activities related to the production or trade of arms or
materials related to national security»809.
The number of casinos allowed is fixed by each CCAA. In Canarias, for example, the
number of authorizations available for casinos is limited to eleven (three in Teerife, four in
Gran Canaria, two in Lanzarote and two in Fuerteventura)810. Another example is
Cataluña811.

In Spain, gaming machines are classified in types «A», «B» and «C».
«A» Machines are those aimed at purely amusement games.
«B» Machines are those who, in exchange of the price of the match, they concede to the
user an additional gaming time and, eventually, a price in money.

«C» Machines are those who, according to their characteristics and within the limits
established by the law, concede to the user –in exchange of a bet – a certain time of use and
eventually a prize that depends entirely on chance. To this effect, «Chance» (azar) means
that the combination of each game does not depend on former combinations or results812.
Machines of the «A» type can be installed in bars, cafeterias, restaurants and hotels,
campings, boats, markets, gaming and Bingo saloons.
Machines of the «B» type may be installed, after authorization, in certain parts of cafeterias
and bars, in authorized Bingo rooms, in gaming locals where machines «C» are authorized
and in gaming locals calssified as «B». These machines may not be installed in train
stations, airports and malls, when the room where they are placed is not closed and isolated
from the large public. Neither may they be installed in temporary shops, beaches or other
recreational zones or public streets. Machines of the «C» type can only be installed in
casinos (arts 34 and 35 Real Decreto 2110/1998)
There is an Order issued by the Ministry of Interior on the 15.10. 1979813, that seems not to
have been modified, establishing a monopoly in favour of a State entity (the national institute
of industry) for the manufacturing of gaming machines of type «C».
At the regional level, some CCAA impose on operating entities the obligation to be
constituted as SRL or Sociedades anónimas and to have nominative shares814.
5.
Betting
Sports betting at the national level belong to the competence of the central State, but the
CCAA have also regulated on the subject.
On the 13 June 2003, a decision was issued by the Spanish Counsel of Ministers with
respect to the opening of the Zarzuela horse racing facility in Madrid815. Here, it was decided
to confere on a public entity (the Sociedad Estatal de Participaciones Industriales - SEPI816)
the exclusive right on the concession to run the installation, and to the LAE the right to
organize and exploit the horse betting (not only inside, but also outside the facility).
At the regional level, the País Vasco regulates betting in Law 4/1991817. Art. 3 .2 of this Law
defines betting (apuesta) as a gaming activity by which an amount of money is risked in
order to guess the results of a previously determined event. The result of the event must be

of uncertain and independent from the parties. Betting may be authorized in horse race
installations «or in other places where activities that could be the subject of betting are
carried out» (Art. 10 of Law 4/1991). In addition, external betting can be done in authorized
offices and places (art. 17 of Law 4/1991). Article 7.1 of Decree 68/2005818 and Article 8.1 of
decree 95/2005819, impose the obligation to be domiciled in the CCAA for obtaining a beeting
license. Art. 12 c) states that in order to be elected for obtaining a gaming license, the
candidate must have experience in the exploitation of allowed games in the CCAA.
Andalucía's Law n° 2/1986820 subjects the awarding of concessions for horse racing betting
to the «touristic interest … and the economic and social benefits that can be obtained in the
geographic zone where they will be installed». Art. 19 of this law requires that the
organization of gaming and bets should be done only by enterprises that are registered in the
public register, that are constituted in the form of commercial companies fulfilling the
conditions required by law (especially the condition to be sociedades anónimas having as
their exclusive objective the exploitation of gaming). The participation of any legal or physical
person is limited to a maximum of three companies exploiting casinos and eight of other
types of games. Finally, the law attributes preference to charity, sportive, cultural and
touristic entities having more than three years of uninterrupted legal existence (these entities
are not obliged to adopt the form of société anonyme). Although it is not specifically said,
from the wording of the article it would be reasonable to infer that this article refers to
Spanish entities.
The CCAA are also competent to regulate the number of horse racing facilities that can be
installed within their territorios. In this respect, Cataluña fixed the maximum number of
allowed installations in five821.
Madrid restricts the possibility of «external betting» in horse racings (i.e., betting carried
outside the hippodromes, for example, by interactive means) to the territory of the
Community.822

Bingo

A Ministerial Order of 9 January 1979823 established that only charity, sport or cultural
entities, as well as commercial companies fulfilling certain conditions may be
authorized to organize Bingos. Among the conditions, the entities must have no profit
aims, and the benefits of the Bingo must be devoted to the accomplishment of their statutory
objectives.
In the areas of Ceuta and Melilla, each operator may only run one Bingo. With respect to
Sociedades anónimas engaged in sport, they have to be constituted according to law
10/1990 of Sports and Royal decree 1251/1999. They must have more than three years of
existence, counted from the moment of their inscription in the Spanish official register. Other
commercial companies must have been constituted under any of the forms for commercial
companies admitted by the law (the law does not mention it, but there is at least a doubt that
the meaning is according to Spanish law). They must possess the minimum capital
requested by Spanish law for that type of companies, and the participation of foreigners
«must be in accordance to the laws in force with respect to foreign investments in Spain». No
person can hold parts in more than five companies running Bingo.
With the acquisition of competences in gaming by the CCAA, Bingos are today mainly
regulated by the legislation of the later.
Some CCAA establish a numerus clausus of licenses. Such is the case of Canarias824 and
Cataluña825.
In Navarra826, the law establishes that owners of Bingo may be charity, sportive, cultural and
touristic entities having more than three years of uninterrupted existence and functioning, as
well as commercial entities constituted as sociétés anonymes and cooperatives holding
Spanish nationality. Valencia827 requires Spanish nationality for Bingo operators and
gives preference to cultural and tourist charity and sport organizations having more than
three years of uninterrupted legal existence and operation.

It seems that TV, radio, newspaper and other media games offering non expensive prices to
the public, on a «just for fun» basis, do not fall within the laws regulating games of luck and
chance. This is also the case of contests in which the participants have to show some
knowledge. Thus, the possibility of gaining a prize by calling a television program to

answer to a question posed, is not considered as gaming. If a newspaper organizes a
competition among readers in which they have to answer to questions on history or
geo_graphy, it will not be gaming. However, if it raffles a car, the activity will be considered
as gaming and the organizers should obtain an authorization.828
Article 5 para 2 and 7 of the telecommunications law829 may be a barrier since they exclude
gaming from the regime of free circulation of services in the information society with respect
to suppliers established in one EU country.830

At the level of the central State, the LAE is the body empowered to authorize the operation of
promotional lotteries, such as national campaigns of commercial companies831.
At the Central State's level, Law 34/1987832 states, in Article 2, that it is a very severe fault to
practice leisure or chance gaims in public establishments, social circles or private clubs,
whenever the total amount of betting exceedes the minimum interprofessional monthly
salary. Article 3 to the same Law qualifies as severe faults the promotion of non authorized
selling by means of activities similar to the allowed gaming and the practice of amusement or
chance gaming in public establishments, social circles or private clubs.
At the level of the CCAA, Asturias833 forbids all promotions by means of gifts, presents, any
kind of consumptions, free or by a price inferior to the market price and in general all activity,
service and acts tending to promote the participation in gaming carried out by the owners of
bingo places or by a third person.
In Cataluña834, in in the absence of an express authorization by the General Directorate of
Games no promotional activity can be carried out in bingo rooms, nor any gift or invitations
can be distributed to the participants.
Madrid835 qualifies as gaming activities (therefore forbidden if not operated according to the
gaming law and its regulations) all acts consisting in the handling of goods or rendering
services for free or by a price inferior to the market price.

Charity entities filling certain conditions are eligible for operating bingos (see point 3).
Article 5 to the Statutes of the Nacional Blinds Association attributes the exclusive right to
exploit a lottery as well as the possibility to increase the area of action to other gaming to the
National Blinds Association, whilst Article 50 provides that the National Blinds Association
may receive subventions from the State. This may be a unilateral advantage in favour of this
organization.
A special authorization is afforded once a year on behalf of a raffle named «Sorteo de Oro»,
organized by the Spanish Red Cross.836
The Law of 16 July 1949 (Jefatura de Estado, B.O. 17) Normas para celebrar rifas, forbids
the organization of raffles. The law tolerates raffles organized for reasons of public utility
and charity (a tax of 10% of the total value of the tickets is imposed). Private persons may
also apply for an authorization, but the level of taxes required from them is higher: 25% of the
total value of the tickets (arts 1-2).
At the level of the CCAA, drawings, tómbolas and aleatory combinations, the benefits of
which will be entirely devoted to support certain areas of public necessity may be authorized.
Such is the case of Article 15 of the Extremadura Law 16/1998837, This article provides that
an authorization can be awarded to the organization of drawings, tómbolas and aleatory
combinations, the benefits of which will be entirely devoted to the organization of cultural and
artistic activities, as well as to support sport and tradition.

Taxes
The national lottery is exempted of operational taxes, so is the National Blinds Organization.
For other gaming, Spanish law imposes a tax on gaming (tasa fiscal sobre el juego).
Although this is a central State's tax, the cession of competences on behalf of the CCAA
(Law 14/1996 of 30 September 1996) caused that the management, liquidation, inspection,
collection and regulation falls within the powers of the later. Besides this tax, the operators
have to satisfy a tax for administrative services of gaming management. This tax variates
from one CCAA to the other. Besides these two taxes, operators are submitted to the tax on
companies (a direct tax of personal nature applied to gains). Finally, Spain applies a tax on
economic activities, which is a direct tax imposing economic activities carried out in Spain.
Casinos are exempted from TVA. Depending on the CCAA where the casino operates, the
tax may fluctuate between 20 - 61% on a progressive scale. For Bingos, depending on the
