Saying Goodbye to a Grocery Icon

Local 653 would like to express our deepest sympathy to the family of Jerry Paulsen, who passed away on
April 5. Jerry was a grocery icon in Minneapolis who started as a small store butcher at heart with “uptown”
sophisticated merchandising talents and abilities, building Jerry’s Enterprises, Inc. from a small hole-in-thewall meat business in Edina over 55 years ago. He started out as a neighborhood butcher at Grandview
Market, the kind who greeted his customers by name and cut their steaks and pork chops to order. Jerry was
a graduate of South High School in Minneapolis and the University of Minnesota. In 1983 he was recognized
as Edina’s businessman of the year by the Edina Chamber of Commerce for his extraordinary business
success and his outstanding contributions to the Edina community. Jerry was also recognized as the 2007
Minnesota Grocers Association outstanding grocer. Jerry has had quite an impact on the Twin Cities market,
with thirteen locations represented by Local 653 that have positively impacted his employees (trained “the
Jerry’s way”) and their families. With first-class customer service, product and cleanliness, Jerry’s has been
a top-notch organization and still is today.
Jerry, you will be deeply missed.

Grievance Procedure - A Bargaining Right

Every year Local 653 represents a number of full-time and part-time members under
the grievance procedure. A grievance is a dispute between the union member and
their employer. There can be a variety of reasons for filing a grievance, including
wrongful termination, suspensions, incorrect scheduling of hours for part-time,
improper pay rate, wages, and vacations, to name just a few.
Our most important job here at the local union is to represent and serve our
membership. Our staff of business agents takes pride in helping the membership in
any way we can in order to correct or solve a problem that a union member may have.
We are here to protect the rights of our members under the collective bargaining
agreement. Many of the grievances can be settled at store level when the Local 653
business agent contacts the store manager and presents the issues on the member’s
behalf. If this is not worked out to the member’s satisfaction, it is then with the
member’s direction that we file for a mediation. Mediation is when the employer,
the union, the union member and a mediator from the State of Minnesota meet to
resolve the grievance. In this step, a settlement that is satisfactory between both
parties (union and management) is reached a majority of the time. We have had a
few grievances that could not be settled in this format, and that is when we would
utilize the final step in the grievance procedure, which is called arbitration.
I believe the most important right that you—the union member—have is the
guaranteed right to representation. This is a right bargained for you in your collective
bargaining agreement. It is imperative that you know all the rights your contract
provides. Everyone should take the time to read their contract so they understand all
the benefits it provides. Please give the union office a call if you need a copy of the
current agreement. We will send one to you right away, or if you have any questions
we can help you with, remember we are here to serve you.

Cada año la Local 653 representa a un número de miembros empleados de tiempo

entre un miembro del sindicato o unión y su empleador. Pueden ser una variedad
de razones por entregar una queja, incluyendo el despido por equivocación,

salarios, y vacaciones, por mencionar algunas.
Nuestro trabajo más importante aquí en el sindicato es el representar y servir a nuestra
membresía. Nuestro personal de agentes de negocios se siente orgulloso de ayudar
a nuestra membresía de cualquier manera para corregir o resolver un problema que
un miembro del sindicato pueda tener. Nosotros estamos aquí para proteger los

My boyfriend and best friend for 12 years works at Cub
Food South in Coon Rapids. His name is Jose Flores-Sanchez. He won the Shrine Circus tickets, and we want to
thank you very much! Jose is a very dedicated and hard
working employee who absolutely loves his job. It was a
very special day for Jose. It’s been his-life long dream to
see the Shrine Circus. When Jose was 5 years old, living in
the war torn country of El Salvador, Central America, he accidently picked up a grenade, and Jose suffered 2nd degree
burns on his face, eyes, hands, chest, and feet. It was the
Shriners who helped Jose and made him well again. He was
just so ecstatic to see those clowns and elephants. Jose has
lived in the United States since 1981. As he was telling the
clown who came to greet us, “If it wasn’t for the Shriners
organization and this beautiful country (USA) I wouldn’t be
alive today. I love this country and I am proud to work here
and be a good citizen.” Jose’s final immigration hearing is
in October 2013, then he will obtain “Full Residency” after
being homeless since age 4, neglected, abondoned , tortured, and poor, Jose finally found his place in the world
- Cub Foods South, and he loves every employee and every
customer he greets and assists. Thank you for this wonderful opportunity!

Again this year Local 653 will be awarding ten $1,000 educational grants to
members and/or their dependents. The ten winners will be randomly drawn
from the applications submitted.

Cub Employees Take “The Polar Bear Plunge!”

This past winter, many employees of Cub Foods stores were participants in several
area Polar Bear Plunge events across the Twin Cities. Because Polar Bear Plunge
events benefit Minnesota Special Olympics athletes, each participant had to raise a
minimum of $75.00 to jump into the frigid waters. There were 16 events this winter
across the state, held between January and March. This was the 16th year for the
Polar Bear Plunge.
I had the privilege of attending (not jumping!) the Plunge at Crystal Beach in
Burnsville on February 23. The South Metro Cub stores had 56 jumpers from Apple
Valley, Rosemount, Lakeville North and South, Burnsville South, Burnsville Heart of
the City, Eagan East and West, Lyndale, Cottage Grove, Inver Grove Heights, Hastings,
and Northfield. They had a fun tailgating event for all the jumpers. It was great to
see so many of our members and management participating for such a great cause.
Altogether Cub had approximately 80 associates who participated, and they raised
over $15,000.00. South Metro Cub stores alone raised over $6,500.00!

eventos Polar Bear Plunge en diferentes áreas a
través de las Ciudades Gemelas. Dichos eventos
benefician a los Atletas de las Olimpiadas
Especiales de Minnesota, cada participante tenía
que colectar un mínimo de $75.00 para saltar en
las aguas congelantes. Hubo 16 eventos durante
el invierno a través del estado, que se llevaron
acabo entre enero y marzo. Este fue el evento
numero 16 del Polar Bear Plunge.
Tuve el privilegio de asistir (¡no a saltar!) al
evento de Crystal Beach en Burnsville el 23 de
febrero. La tienda de South Metro Cub tenia 56
saltadores de Apple Valley, Rosemount, Lakeville
del Norte y del Sur, Burnsville del Sur, Burnsville
Heart of the City, Eagan del Este y del Oeste,
Lyndale, Cottage Grove, Inver Grove Heights,
Hastings, y Northfield. El evento incluyó antojos
y bebidas en los estacionamientos para todos
los saltadores. Fue muy agradable el ver a tantos
de nuestros miembros y directores participando

Loser Contest
Local 653 will be hosting its “Biggest Loser” contest
again this year. Initial weigh-ins will be on Thursday
and Friday, May 16 and 17, and Monday, May 20,
2013, at our office in Maple Grove from 8:00 a.m.
until 4:00 p.m. each day. (You are welcome to join
after that date, but that will mean you will have a
shorter time to lose the weight.) The final weigh-in
will be on Sunday, October 6, during our 4th annual
Health Fair, held here at Hall 653.
Prizes will be awarded to the top five biggest losers:
1st Prize: $2,000.00
2nd Prize: $1,500.00
3rd Prize: $1,000.00
4th Prize: $500.00

All prizes will be a combination of half in a gift card

Don’t Let One Mistake Put Your Job in Jeopardy

I know that routine responsibilities can sometimes be forgotten
with so much going on in our lives. Mistakes are made—after all,
we’re only human. However, one work mistake can sometimes be
all it takes to find yourself out of a job. Not knowing what days and
hours you are scheduled to work and then perhaps not showing
up when scheduled because you forgot or thought you worked on
another day or at a different time is one such mistake you can’t
afford to make. When this happens, most employers consider
this as a “no show, no call” or job abandonment on the part of
the employee and it can be grounds for termination. If this is the
position the employer takes, it is a difficult hole to climb out of—for
you as well as your union representative.
When this occurs, the only option left other than to accept the
termination is for your union representative to file a grievance on
your behalf and hope we can prevail (with the help of a mediator
from the Minnesota State Bureau of Mediation Services) in
changing the decision of the employer to give you another chance.
As you can see, it’s a big roll of the dice and the odds are in the
employer’s favor. The reason many employers take a tough stand
on this is because it happens too often—it is a hardship and has a
negative impact on their business. A consequence of not showing
up for work is the added burden it creates for your coworkers
and the customers who shop your store and make all our jobs
possible. Being asked to work later to cover hours that were the
responsibility of another employee is rarely appreciated on such
short notice even by those willing to do so. Many times it’s just too
late to cover the shift.
Please don’t take chances with your job. Play it safe by knowing
and working your schedule as posted.

con tanto que esta ocurriendo en nuestras vidas. Se cometen errores,
después de todo, somos humanos. Sin embargo, un simple error podría
ser todo lo que se necesita para que uno pierda el trabajo. El no saber
que días o que horas usted tiene en su horario para trabajar o tal ves el
no presentarse cuando usted tiene que trabajar por que usted lo olvido,
o usted pensó que tenia que trabajar en un día diferente o en diferentes
horas es uno de los errores que usted no se puede permitir. Cuando
esto sucede, casi todos los empleadores consideran esto como un “no
presentarse, no llamar” o abandono del trabajo de parte del empleado
y podría ser razones para ser despedido.
Cuando esto sucede, la única opción además de aceptar su despido es
que su representante sindical entregue una queja en favor de usted y
que con suerte usted gane (con la ayuda de un mediador de Servicios
de la Oficina de Mediación del Estado de Minnesota) para cambiar la
decisión del empleador para que este le de otra oportunidad.
Como usted pude ver, esto es jugarse la suerte y la suerte está,
generalmente, del lado del empleador. La razón por la cual muchos
empleadores son muy firmes con este problema es porque sucede con

Attention All Members
Sweethearting
Many of you work at companies that have attendance policies, and
many now have electronic monitoring. What that means is that your
punches, either in or out, are being checked on a daily basis. Because
of this you need to be very diligent in following the posted schedule.
In most cases you are not allowed to leave early, even one minute,
without a manager’s permission. It is your responsibility to make sure
this is taken care of. Because points are given for such occurrences, it
might be several months before enough points accrue for the company
to take some type of action—either verbal or written.
It’s not February, but I thought I would talk a little about sweethearting—
not the sweethearting related to Valentine’s Day where you go out and
buy your loved one a dozen roses or a box of chocolates or take them
out for a nice dinner, or in some cases, all three! I’m talking about the
sweethearting that can go on in any of the stores where you work.
This sweethearting, as it was named years ago, is when an employee
gives some kind of deal to another employee or friend that no one
else would get. Examples of this include not ringing up all the items
going through the register, not charging the proper price at the register,
weighing something wrong knowing you are giving that person a special
deal, and using coupons for products not purchased. These are just
some examples, all of which are considered theft in the mind of your
employer. Almost all employers have zero tolerance for theft, which
means termination of employment. Most of these cases are not onetime occurrences; they are practices that have been going on for some
time. As I said, the companies consider this theft. The union does not
condone theft, though we look at each case individually and the member
still has the right to the grievance procedure.

The same applies if you switch shifts with a coworker. Both employees
need to get permission and have the switch signed off by a supervisor
or manager.
It is imperative that all employees follow their posted schedules. Do
not make any changes without approval. When in doubt, ask the
person in charge and keep a record for yourself. Communication is the
key. Do it on a daily basis.

Lunds Kitchen Commissary Ratifies
New Contract

On Monday, April 8, 2013, the employees of Lunds Kitchen Commissary
ratified their new contract. The unknown of the Affordable Care Act
and how it affects our Health and Welfare plan made it imperative
that we sign a one-year contract. We were able to get some nice
language changes and other perks, though, and there will be no
employee contributions to Health and Welfare and all employees will
get a Lunds gift card as a bonus.
I want to thank our new President Matt Utecht, long-time committee
member Jane Watts, and newcomer Brenda Balling for all of the work
they did on this new contract.

Ratificó un Nuevo Contrato.

El lunes, 18 de Abril del 2013, los empleados del Departamento de
Cocina de Lunds ratificaron un nuevo contrato. Lo desconocido del
Acta de Cuidado Accesible (Affordable Care Act) y del como afecta
nuestro plan de Salud y Bienestar lo convirtió en imperativo el
que firmáramos un contrato por un año. Tuvimos la oportunidad
de adherir un buen cambio en el lenguaje y otros beneficios, y no
existirán contribuciones de parte de los empleados para la Salud y
Bienestar y todos los empleados obtendrán una tarjeta de regalos
como bono.
Quiero darles las gracias a nuestro Presidente Matt Utecht, y a nuestra
miembro de comité de muchos años Jane Watts, y a la recién llegada
Brenda Balling por todo el trabajo que llevaron acabo con este nuevo
contrato.

Late Again? Watch the Time!

No matter the circumstances--not paying attention to your watch, clock,
alarm clock, cell phone, losing track of time, or just taking your job for
granted—it seems to me that for some employees lateness and no call/
no show seem to be very big issues. This worries your business agents
because you can put yourself in a predicament that could have serious
consequences. I don’t know all the reasons or excuses for being late, but
I do know that our union contract gives employees an advanced schedule
so they know when their scheduled hours of work are supposed to be!
If you’re late or don’t show up for work, the store is often forced to find
someone to cover your shift by asking them to stay late, come in early,
or call another employee in for a shift when they were scheduled to be
off. Many times if there is no one to cover a missed shift or tardiness,
the department or whole store can generate some ill will towards the
employee who is late or no call/no shows. These are not the shoes
you want to be in, in this day and age. This can even cause disharmony
among employees, and customers can sense this among employees
when frequenting the store.
If you know you’re going to be late for your shift, call the store as soon
as possible and talk to your supervisor. Let them know what is going on
ahead of time if you are ill or have some other proper excuse. Remember:
No Call/No Show may be regarded as a “Voluntary Quit.” This could
leave the member terminated and your business agent frustrated and
unable to help you.

While this late spring has presented us with some difficulty in chasing that little white ball around,
we’re looking ahead! The 4th Annual John Lego Memorial Golf Tournament will be held on Wednesday,
August 28, 2013. We will again be at Brookview Golf Course in Golden Valley. We will have lunch and
prizes in the upstairs room, where we’ll be reminiscing about “what could have been!”
