PLAN CERTIFICATION STATEMENT

DE MATERIALES PELIGROSOS DE NEGOCIOS
The Oxnard Fire CUPA has made administrative changes that
will affect how businesses meet the annual Business Plan
reporting requirements of the California Health and Safety
Code, Chapter 6.95.
El programa CUPA del Departamento de Bomberos ha
hecho cambios administrativos que afectarán la manera en
que los negocios cumplirán los requisitos para reportar el
Plan de Negocios bajo el Código de Salud y Seguridad de
California, Capitulo 6.95.
In the past, CUPA sent out to each business in the program
a Business Plan Annual Reporting Requirement Certification
form. The reporting form, in accordance with the law, was to
be returned on or before March 1st of each year. The form
instructed the facility representative to sign the statement, if
there were no changes to your emergency contact information
and chemical inventory, or submit a new Business Plan if
changes had occurred.
Anteriormente, CUPA enviaba a los negocios participantes
en el programa, una forma para la Certificación del Plan de
Negocios para Materiales Peligrosos. Esta forma había que
entregarla, según la ley, para o antes del 1ro de Marzo de
ese año. Las instrucciones indicaban que la forma la podía
firmar el representante de las instalaciones, si es que no
había ningún cambio en la información de contactos o
el inventario de químicos, o presentar un nuevo Plan de
Negocios si había cambios.
This reporting year, the CUPA sent out a revised certification
form referred to as the Hazardous Materials Business Plan
Certification Statement.
Este año, CUPA envió una forma para certificación con revisiones que se llama Declaración de Certificación del Plan
de Negocios para Materiales Peligrosos.
This new Certification Statement listed the facility’s chemical
inventory and emergency contact information as reported on
your last Business Plan submittal and recorded on the Oxnard
Fire CUPA database. As before, the new form will require the
business owner, operator, or designated representative to
certify that the listed information is complete, accurate, and
that there have been no hazardous materials changes for the
reported maximum amount stored onsite. If any changes or
corrections are needed, then the Business Plan must be revised
and returned along with the signed certification statement
within the specified time frame.
Esta nueva Declaración de Certificación enumeraba el
inventario de químicos y la información de emergencia de
la misma forma que había sido reportada y registrada en
la base de datos de CUPA. Como se hizo anteriormente, la
nueva forma requiere que el dueño, agente o representante designado certifique que la información contenida en
la lista sea precisa, completa y que no haya ningún cambio
en las cantidades máximas de los materiales peligrosos
almacenados en el sitio. Si algún cambio o corrección es
requerido, el Plan de Negocios tendrá que ser revisado y
devuelto junto con la declaración de certificación firmada,
dentro del lapso de tiempo especificado.
Why is it important for you to submit your certification
statement?
¿Por qué es importante que presente su declaración de
certificación?
Además de que es importante cumplir con la ley estatal, la
cuota del permiso del CUPA del Departamento de Bomberos, en parte, se basa en el inventario de sustancias químicas almacenado en su instalación. Mantener una base de
datos precisa nos ayuda a asegurar que el cargo del permiso sea correcto. De igual importancia es que tengamos
la información al corriente sobre su instalación para poder
identificar los peligros asociados con las actividades de
respuestas de emergencia.
In addition to the importance of complying with the state law,
the annual Oxnard Fire CUPA permit fee, in part, is based on
your chemical inventory stored at your facility. Maintaining
an accurate database helps us to ensure that your permit
fee is correct, and just as importantly, that we have current
information for your facility to help identify hazards associated
with emergency response activities.
CUPA INSPECTION: WHAT TO EXPECT
As a business owner or operator you may want to
know what are the common
components of a typical
CUPA inspection? Your CUPA
inspector is actually conducting
a consolidated inspection of
several programs.
Note: Not all programs discussed
here may apply to your facility.
Site Inspection
The inspector will conduct a walk- through of the facility
observing equipment, storage and work areas.
Business Plan Review
The Hazardous Materials Business Plan will be reviewed
to ensure the reported information, including chemical
inventory, is correct and adequate.
Employee Training
The written employee training records will be reviewed
to determine that they meet the training standards and
procedures outlined in the Business Plan.
Hazardous Waste
Sites disposal records include a review of manifests, bills,
of lading and receipts documenting proper disposal of
hazardous waste generated at the facility.
Underground Storage Tank Monitoring
Records will be reviewed for maintenance, certifications
and testing equipment of the UST system. Also your
written monitoring plan, emergency response plan,
certification of your Financial Responsibility, operating
permit and designated operator certification will be
reviewed.
MOST COMMON VIOLATION
The most common violation that Oxnard Fire/CUPA inspectors
see during facility inspections is no labels (or incomplete labels)
on hazardous waste containers. Labels can be purchased from
almost any safety supply company or possibly from your
hazardous waste contractor.
A proper label contains the following information:
 The words “Hazardous Waste,”
 The name and address of the facility generating the
waste,
 The accumulation start date (this is the date hazardous
waste is first placed into the container),
 The composition and physical state of the waste (e.g., used
oil, liquid). Generally, the physical state can be indicated
by checking the appropriate box on the label, and
 The particular hazardous properties of the waste (e.g.,
flammable, reactivity, etc.). Again, this can generally be
accomplished by checking the appropriate box on the
label.
If the contents of the container are pumped out by the
hazardous waste contractor, the same label can be reused, but
remember to change the accumulation start date.
To satisfy the hazardous waste labeling requirements for
aboveground storage tanks, you need to have the words
“Hazardous Waste,” the contents and the accumulation start
date.
Open containers are another commonly found violation.
Keeping containers tightly closed helps to prevent spills from
occurring, particularly here in Southern California where we
are prone to earthquakes. Also, if your containers are stored
outside and sealed tight it will prevent rainwater from entering
the container, thereby preventing overfilling and discharges
to the ground.
VIOLACIONES MÁS COMUNES
Una de las violaciones más comunes observadas durante
inspecciones conducidas por el programa CUPA es la falta
de etiquetas(o etiquetas incompletas) en contenedores de
desperdicios peligrosos. Las etiquetas pueden ser compradas
en casi todas los compañias proveedoras de recursos para la
seguridad o posiblemente de su contratista.
Una etiqueta completa contiene la siguiente información:
Las palabras “Hazardous Waste” (Desperdicios Peligrosos)
El nombre y la dirección del negocio que genera el
desperdicio
La fecha en que empezó la acumulación (fecha en que fue
depositado por primera vez el desecho peligroso en el
contenedor)
La composición y estado físico del desperdicio (sólido o
liquido). Generalmente, el estado físico puede ser identificado
revisando la etiqueta de correspondiente.
Las propiedades particulares del desperdicio(inflamable,
radiactivo, etc.)
Si los contenidos del contenedor son vaciados por el contratista
de desechos peligrosos, la misma etiqueta puede ser reutilizada,
pero recuerde de cambiar la fecha de acumulación.
Para satisfacer los requerimientos de etiquetación de desechos
peligrosos es necesario que contenga las palabras ““Hazardous
Waste” (Desperdicios Peligrosos) y la fecha de acumulación.
Otra violación común, son contenedores abiertos. Mantener
los contenedores bien cerrados ayuda a prevenir derrames,
particularmente aquí en el sur de California en donde estamos
propensos a terremotos. Además, si sus contenedores se
encuentran a la intemperie pero tapados correctamente esto
prevendrá que la lluvia entre en los contenedores, de este
modo previniendo que se llenen y derramen los contenidos
en el suelo.
ES MI NEGOCIO UN “CESQG”?
Las siglas CESQG significan “ Generadores de Pequeñas
Cantidades Condicionalmente Exentos”. Algunos negocios
califican para esta categoría de permiso si cumplen con los
siguientes requisitos:
 Generan menos de 27
galones (220 libras) de
desperdicios peligrosos por
mes.
 Aseguran que desecho o
reciclaje de los desperdicios
peligrosos es hecho
en un lugar autorizado
o es recogido por un
transportador autorizado.
 Mantienen un expediente
sobre el desecho de
desperdicios peligrosos por
un mínimo de tres años.
IS MY BUSINESS A CESQG?
CESQG stands for “Conditionally Exempt Small Quantity
Generator”. A business falls into this permit category if
they meet the following requirements:
 Generate less than 27 gallons (220 pounds) of waste
per any calendar month.
 Ensure that the disposal or recycling of the hazardous
waste is done at an authorized facility or is collected
by a registered hauler.
 A record of hazardous waste disposal must be
maintained by the business for a minimum of 3
years.
If your business qualifies as a CESQG you are eligible to
use Business Only Hazardous Waste Round-Ups available
through the City of Oxnard. Qualifying businesses may
receive as much as $250 worth of free disposal. An
appointment time and location can be arranged by
calling the Waste Round-Up Event at 987-0717.

usted es elegible para utilizar los Servicios de Recolección de

CUPA PROGRAM STAFF
This is an ideal program that can be used to inexpensively
and routinely dispose of your hazardous waste. It
significantly reduces your disposal cost and keeps your
business in compliance with hazardous waste storage
and recordkeeping requirements.
It is important that the combined storage of hazardous
materials and hazardous waste be maintained below
50 gallons. Storing more than 50 gallons will place the
business in a higher and more costly permit fee range.
