As noted above, CONTINENTAL is seeking transborder charter
authority to engage in foreign air transportation of persons and
their belongings without the need for prior Department approval

each
flight,

flights.

Future operations, including its proposed U.S. service, are
likely

be
a
continuation
of
this
type
of

CONTINENTAL estimates that it will operate 150 round trip flights
annually between Mexico and the United States with an average
load of five passengers per flight; all of which will originate
in Mexico.
(c) CONTINENTAL owns and operates a single 12 passenger
Dassault Falcon 900EX Jet aircraft with Mexican
registration
XA-BEG.
(d) CONTINENTAL maintains its aircraft pursuant to a
maintenance
service
agreement
with
C.A.M.P.,
an FAA approved
maintenance system in the United States; at the Dassault Falcon
Jet
Center,
in Little
Rock,
Arkansas,

Center; and in accordance with an airworthiness program approved
by the Mexican DGAC in compliance with ICAO Annexes 1,6 (Part I)

He also holds the position of Chief Pilot in the company.
Capt. Luis Antonio Reyes has been with

since its inception in 1992 and serves as the company's Assistant
Manager. Capt. Reyes received his Pilot's License in 1981. He

En respuesta a su escrito del 18 de abril de 1996, me permito informarle que con fundamento en los
articulos 3"., fraccion VI de la Ley de Vias Generales de Comunicacion, 6°, fraccion II, y 11 fraccion
III, de la Ley de Aviacion Civil, en relacion con el articulo Q°, fraccion VIII del Reglamento Interior de
la Secretaria de Comunicaciones y Transportes, esta Subsecretaria de Transporte, otorga a la
Empresa SERVICIOS EJECUTIVOS CONTINENTAL, S. A. DE C.V., PERMISO para ei
establecimiento y explotacion de un servicio publico de Transporte no regular de taxi aereo
Intemacional de pasajeros, desde su base de operaciones en TAMPICO, TAMPS., HACI.A TODO EL
MUNDO.
En tal virtud, y de conformidad con lo dispuesto en los articulos 3". fracciones II, VIII, IX, XII y XIII, 49,
51 y 120 de la Ley de Vfas Generales de Comunicacion; 1"., 3"., 4°., 5°., fraccion I inciso a), 6°.,

- E l p^isente permiso debera ser inscrito en el Registro Aeronautico Mexicano, conforme ai
lo 47 de la Ley de Aviadon Civil.
(s) aeronave (s) sera (n) utilizada (s) solamente para prestar servicio de taxi aereo
ional no regular de pasajeros.

del permiso correspondiente a Transporte Aereo Nacional.

Dicha (s) aeronave (s) saldra <n) de territorio nacional, por cualquiera de los aeropuertos
ternadonales de la Republica Mexicana autorizados por la Secretaria de Comunicaciones y
Transportes, donde cumpliran las formalidades y requisites de aduana, migradon y sanidad.
);VHQ.- Para la operacion del (os) vuelo <s) intemacional (es) que se autoriza (n) esa Empresa queda
flbligada a cumplir los requisites establecidos en la Norma Oficial Mexicana Emergente NOM-EM-008
SCT-003, publicada en el Diario Oficial de la Federacion el 30 de Noviembre de 1994, aplicable en lo
que corresponde al servicio de taxi aereo nacional y/o intemacional, la cual se da por reprodudda en
este permiso y se considera parte integrante del mismo, por lo que la violadon y/o incumplimiento de
la referida norma, sera motive de revocadon.
IX).- La Empresa debera seguir las vias aereas previamente establecidas por la Secretaria de
Comunicaciones y Transportes.
X).- Aplicaran en estos vueles la cuota que previamente haya autorizado la Direccion General de
Tarifas, Transporte Ferroviario y Multimodal.
CI).- La Empresa queda obligada a presenter un informe estadistico mensuai a la Direcdon General
de Aeronautica Civil (Departamento de Programacion y Estadisticas),^ en la forma DGAC-1857-1,
XII).- La Empresa debera contratar y mantener vigente un seguro que cubra las responsabilidades
por los danos a pasajeros y equipaje, asi como danos a personas o cosas que se encuentren en la
superficie de territorio mexicano en terminos de los Articulos 62. 70. 72 y 74 de \a Ley de Aviacion
Civil.

III).- Con fundamento en lo dispuesto en los Articulos 24. 32 y 74 de la Ley de Aviadon Civil, esa
resa debe garantizar el page de la indemnizadon por danos que pudieran causar a pasajeros y

XVIfl).- La Secretaria de Comunicaciones y Transportes podra dictar las modalidades y
caracteristicas conforme a las cuales se preste el servido publico en la vias generales de
comunicacion y medios de transporte.
Asimismo, la Secretaria tendra la facultad, en cualquier tiempo, de verificar el cumplimiento de las
Leyes de Vias Generales de Comunicacion y de Aviacion Civil, sus reglamentos y demas
disposidones aplicables. Para tal efecto, la permisionaria estara obligada a permitir el acceso a los
verificadores a sus instaladones, a transportarios en sus equipos para que realicen la verificadon y,
en general, a etorgaries todas las fadlidades para estos fines, asi como a propordonar a la
Secretaria los informes con los dates que permitan conocer la operacion y explotacion de los
servidos de transporte aereo.
XIX).- La navegacion en el espacio aereo sebre territorio nacional se rige por lo previsto en la Ley de
Aviadon Civil y por los tratados, y a falta de disposidon expresa, se aplicaran los ordenamientes
legales previstos en el articulo 4° de la propia Ley de Aviacion Civil, motive por el cual la
permisionaria debera cumplir con todas y cada una de las disposidones contenidas en dicha
nermatividad.

Para la navegacion en el espacio aereo, sera obligaterio utilizer los servidos de transito aereo,
yudas, meteorologle, telecomunicadones e infermadon aeronauticas, asi como los demas
a la navegacion aeree que preste el Organe Desconcentrado denominado Servidos a la
ion en el Espacio Aereo Mexicano.
-n la prestadon de los servidos de transporte aereo, la permisionaria por inidativa propia o a
^ftMas de la Secretaria, debera adopter las medidas neceseries para garantizar las condidones
de la seguridad de la aeronave y de su operacion, a fin de proteger la integridad fisica de
!re}ronas, equipeje y terceros.

XSUl)^.- El incumplimiento del permisionerio, comendante o piloto a cualquiere de les obligadones o
condibiones establecidas en la Ley de Aviacion Civil, en sus reglamentos y en este permiso, se
sandenera en terminos de los articulos 86, 87, 88, 89 y 90 del ordenamiente legal citado en primer
termino.
;XXlil).j El permisionario debera presenter dentro de los quince (15) dias siguientes s la fecha de
inscg'pdon de este permiso una fianza a favor de la Tesoreria de la Federedon por un monto
i^quivaiente a tres mil dias de salario minimo a la fecha en que se contrate dicha fianza, para
garantizar el cumplimiento de las obligaciones que el mismo le impone, con base en el articulo 17 de
la Ley de Vies Generales de Comunicacion y 89 de la Ley de Aviacion Civil. Esta fianza debera
manteneria vigente mientras este en vigor el permiso.
XXIV).- El permisionario debera proceder al page y, por consiguiente, acreditar ante esta Secretarie
de Comunicaciones y Transportes, mediante recibo oficial al entero de los derechos previstos en los
articulos 159, fraccion II, y 153, fraccion II, de le Ley Federal de Derechos, las cantidades de
$5,000.00 M.N. y $ 1'000.00 M.N. por concepte del otorgamientd'de este permiso e inscripdon en el
Registro Aeroneutico Mexicano.
Por etra parte, el permisionario debera cubrir anuelmente y acreditar mediante recibo oficial, el page
de los derechos correspondientes por cede uno de los aiios en que se encuentre vigente el permiso,
de conformidad con lo dispuesto en el articulo 159, de la Ley Federal de Derechos, vigente.
