El Paso Electric Company (EPE) submits this supplement to its proof of notice that it
filed on September 24, 2009.
In its initial proof of notice filing, EPE provided proof that it had published notice of this
proceeding in the El Paso Times. In addition to publication in the El Paso Times, EPE also
published notice in the West Texas County Courier and the Hudspeth County Herald. Copies of
the publisher's affidavits for those two publications are attached.
Also attached is a corrected affidavit for the publication of the notice in Spanish in the
El Paso Times. The original publishers affidavit was stamped, but not signed, by the notary
public.

NOTICE OF APPLICATION TO IMPLEMENT
AN INTERIM FUEL REFUND AND SURCHARGE
On September 1, 2009, El Paso Electric Company (EPE or Company) filed an Application with the Pdb1
Utility Comrpission of Texas (PUC or Commission) to implement an interim refund of a net over-reco
ery of fuel costs billed under its'fuel factors through July 2009. The docket number assigned to this pr
ceeding is PUC Docket No 37433. This filing was made under P.U.C. SUBST. R. 25.237(a)(3)(B). 11
filing impacts only the fuel portion of the rates charged by EPE for electricity in Texas and has no effe
on EPE's non-fuel base rates. This application, if granted, will affect all Texas retail customers who.tal
service under a tariff that has fixed fuel factors.
The total amount of the net over-recovery balance to be refunded through the proposed refund
$12,172,750, exclusive of,interest, through July 31, 2009; The effect of the refund on customers' bil
will vary depending on,the rate schedule under which they take service. Some non-residential custome
will receive a surcharge.
EPE proposes a refund period of one month and requests that the proposed refund be effective with t1
first billing cycle for the October 2009 billing month. For those customers receiving a surcharge, El
proposes to spread the surcharge over a three month period, beginning with the first billing-cycle for t1
October 2009 billing month. These changes will be subject to final review by the Commission in EPE
next reconciliation.

Esta solicitud se irealiz6 en base a P.U.C. SUBST. R. 25.237(a)(3)(B). Esta solicitud,afecta solamente
