It is my pleasure to write to you in relation to your letter mentioned above, in which you requested the
following:
1. Total number of Land Bond holders who have initiated proceedings for administrative restatement
of the debt in accordance with the provisions of Supreme Decree No. 017-2014-EF and Supreme
Decree No. 019-2014-EF. In the event that this information does not exist, please send express
confirmation that, as of the date of this request, no holder has initiated such proceedings.
2. Total number of Land Bond holders that, as of the date of this request, have been registered or
have initiated the procedure for registration as legitimate holders of Land Bonds.
3. Memorandum No. 028-2000-EF/75.01 whereby the Department of Public Credit, among other
things, indicates that by virtue of Decree Law No. 17716, the equivalent of S/ 13,285,000.000
(Thirteen Million, Two Hundred Eighty-Five and 0/100 Soles de Oro) in bonds were placed.
4. A list of pending Court Cases involving Land Bond holders, in which the Ministry of Economy
and Finance is a party or has been informed through its counsel.
In this regard, please find attached a copy of Memorandum No. 522-2014-EF/52.04 in which the
General Debt and Public Treasury Office sent Report No. 260-2014-EF/52.04 issued by the Credit
Department of the Debt and Public Treasury Directorate which, in relation to the request made, states
the following:
With respect to numbers 1), 2) and 4), it states that it is sending the requested information, to which
end a total of thirteen (13) pages has been attached, which have been made available to you.
In relation to number 3), it reads: “(...) The document issued in 2000 has not been located[;]
therefore, this point of the request cannot be dealt with because [we] do not currently have this
document (...)”
In relation to this point, since your request falls in part under the provisions of Article 13 “Denial of
Access” from the Amended and Restated Law of Law No. 27806 - “Law on

I am writing to you in reference to the document mentioned above in which the Office of Document Management and
User Service of the Ministry of Economy and Finance (MEF) informed the DGETP that Ms. María Claudia Polo
Gastulo had submitted a new request for access to public information in order to be provided with the following:

in accordance with the provisions of Supreme Decree No. 017-2014-EF and Supreme Decree No. 019-2014-EF.
Total number of Land Bond holders who, as of the date of this request, have been registered or have initiated the
procedure for registration as legitimate holders of Land Bonds
Memorandum No. 028-2000-EF/75.01.
List or summary of pending court cases involving Land Bond holders in which the Ministry of Economy and
Finance is a party or has been informed through its counsel.
The legal period for dealing with requests for access to public information is 7 (seven) business days. Therefore, since
this request was received at the Ministry of Economy and Finance on November 21, 2014, the deadline for responding
to the interested party, including the extension, 1 expires on December 10, 2014.
In this regard, please be informed of the following:
1. Pursuant to the provisions of Article 3 of the Amended and Restated Law (TUO) of the Law on Transparency and
Access to Public Information, approved by Supreme Decree No. 043-2003-PCM, the information held by Public
Sector entities is presumed public, unless such information is classified as secret, reserved or confidential. 2
2. In addition, the third paragraph of Article 13 of the TUO states that a request for information does not entail an
obligation on the part of Public Administration bodies to create or produce information it does not have or is not
obligated to have at the time that the request is made nor to conduct evaluations or analyses of the information
they hold.
3. In the case of the MEF, also applicable in addition to the general rules for dealing with request for access to public
information, is Directive No. 003-2013-EF/41.02 titled “Guidelines for dealing with requests for access to public
information in the Ministry of Economy and Finance,” approved by Ministerial

Regulation No. 358-2013-EF/41.02 of December 13, 2013. This Directive states that bodies holding information
must make it available in a timely fashion to the government employee responsible for delivering it to the user. It
is important to indicate that the DGETP is not the holder of the information related to court cases involving Land
Bond holders; therefore, it was necessary to issue Official Letter No. 023-2014-EF/52.01 of November 26, 2014
to ask the Office of the Public Prosecutor for this information.
4. In relation to the request made by Ms. Polo Gastulo, I must state the following:

Total number of Land Bond holders who have initiated proceedings for administrative restatement of the
debt in accordance with the provisions of Supreme Decree No. 017-2014-EF and Supreme Decree No. 0192014-EF:
Supreme Decree No. 017-2014-EF, as expanded by Supreme Decree No. 019-2014-EF, approved the
“Regulation of Proceedings leading to the registration, restatement and payment, through administrative
channels, of the debt derived from Land Bonds issued within the framework of Decree Law No. 17716, Land
Reform Law pursuant to the Resolutions issued by the Constitutional Court,” which describes three
interrelated and consecutive administrative proceedings. For this reason, since the proceedings initiated to
register legitimate holders of land bonds have not yet concluded, to date, no citizen has initiated the
proceeding for the administrative restatement of the debt.
Consequently, there is no information regarding this aspect of the request for access to public information.
•
Total number of Land Bond holders who, as of the date of this request, have been registered or have initiated
the procedure for registration as legitimate holders of Land Bonds:
Bearing in mind that the requested [information] does not fall within any situation classifying it as secret,
reserved or confidential information, please be informed that according to DGETP’s records as of November
24, 2014, there are one hundred and sixty-eight (168) applications for authentications that have been received
for processing as part of the proceeding to register legitimate holders of Land Bonds, filed by one hundred and
fifty-nine (159) individuals.
•
Memorandum No. 028-2000-EF/75.01:
The document issued in 2000 has not been located. Consequently, this aspect of the request cannot be dealt
with because [we] do not currently have this document.
