Running for my 10th term in Congress, I have compiled a record of progressive leadership and accomplishment for the people of Marin and Sonoma Counties.
Having lived in the North Bay for more than 40 years, I have deep roots in our community. Your values are my values. As Co-Chair of the Congressional Progressive
Caucus, I fight for those values every day, even if it means going against the grain
or rocking the boat.
With your support as the wind at my back, I was the first Member to demand that we
bring our troops home from Iraq, a critical step in turning public opinion against the
war. With the same conviction, I am fighting for peace in Afghanistan and a smarter
national security policy.
I have no greater priority than making sure children, seniors and working families
have the support needed to lead prosperous lives in a peaceful world. That is why I
have led the charge for universal health care that includes a public option. That is
what drives me to ensure good schools, a clean environment and comfortable
retirement for my constituents.
I want to continue using my influence as a senior member of the majority to advance the interests of the Sixth District. But that is up to you. You are my employers.
My performance evaluation comes every two years in November; I ask you, my

family sacrifices associated with my second son-in-law’s deployment to Afghanistan as an active member of the U.S. armed forces. Being married to a diabetic and
having personally cared for a loved one dying of cancer, I feel and understand your
concerns about the costs of medical coverage. As a business owner for 27 years, I
comprehend balanced budgets and how government taxes and regulations must
be limited in order to sustain economic growth and job creation.
America needs to create new jobs for the 21st century with commitments of integrity
from both public and private sector leaders. To do this, the government must facilitate
creating an environment that revitalizes the entrepreneurial spirit by encouraging
new visions in energies, biotechnologies, engineering, and manufacturing.

are the champions of the Constitution and the Republic, as envisioned by the

an Army veteran, committed to bringing our troops home now, from Afghanistan
and Iraq, and to a policy of nonintervention in the future. I am dedicated to protecting individual freedoms, personal privacy, and to significantly reduce the size and
scope of government; along with lower taxes for Calfornians and all Americans.

results of the experiment are now in: Having promiscuously spent, taxed, and
overregulated, our leaders have brought us to the brink of ruin.
Every alert Californian knows the score: businesses fleeing the state in droves,
high unemployment, massive deficits, legislative gridlock, and the levers of government surrendered to powerful public employee unions.
My instincts tell me the public has finally had enough. Folks just want to be left
alone to follow their dreams. It is Californians themselves who will revive our state.
Drawing upon my experience as a businessman and activist, I have posted on my
website a number of proposals for eliminating deficits, creating jobs, and improving
education. Here is a sampling:
Limit government spending to a defined percentage of actual revenue. Shrink bureaucracies. Repeal spending mandates. Conform public employee salaries and benefits to the private sector. Prohibit government employee unions from engaging in
partisan political activity. Shorten the legislative session to six months.
Lower the business tax. Offer tax credits for research and development, new hires,
and fixed capital investments. Simplify workplace regulations. Shield businesses
from unnecessary litigation. Improve our energy, water, and transportation
infrastructure.
Encourage school choice and competition. Offer tax credits for educational savings
accounts. Get back to basics in our public schools. Emphasize vocational education. Make high school attendance voluntary. Leave political and sexual training to
parents.

As Chair for the Napa 2009 & 2010 Rotary 4th of July Parade, I organized hundreds
to march and thousands to watch. This year, I also formed the first all-city marching

As you know, these are extremely difficult times. With parents, teachers and staff,
we must continue to reduce costs in administration and operations but not at the
expense of the classrooms. We need to assure Santa Rosa students get the best
education possible.
Working together, we fought to retain small class sizes. We steadfastly resisted
more than 22 students in grades K-3 where developing the building blocks, especially reading, is critical. Other local districts have up to 36% more per class.
Working together, we have championed career technical programs for students
who choose work after graduation. Our programs are recognized as some of the
best and most relevant in the state. We fought to retain arts, music and sports, for
our students. Research has shown their value in the classroom and the impact on
personal growth.
There is more to do, like consolidating districts. Sonoma County averages one district
for every 1,776 students. What a waste of non-classroom resources. School districts
in surrounding counties are as much as ten times larger. I have been working on
potential district consolidations.
My efforts will continue to be focused on what is best for Santa Rosa students. I ask
for you continued support and vote.

language, coached, and was involved in a variety of cocurricular activities. I took
a six year break between Montgomery and Piner where I worked in business.
Throughout my life I have been actively involved in education policy.
I strongly believe that the survival and improvement of public education is dependent
on the need to provide public education with steady and adequate financing. We
must return control of our schools to our communities. We have to devise a way
to attract and retain the most highly skilled and professional educational workforce
that we can. And we must also set a goal of developing a powerful and engaging
curriculum that reflects the real world needs of our students and community.

School Board. I grew up in West Texas, attended BYU and in 1973 our family
moved to Northern California, living in Petaluma and working in San Francisco and
San Rafael prior to opening my own office in Santa Rosa. A few years ago I was
able to purchase a small ranch where I enjoy raising horses.
I have had 34 years of classroom teaching experience and an additional 7 years
of field experience auditing school districts. I have taught all levels of auditing, tax
and accounting including government and not-for-profit accounting.
My two children were successfully educated in the Santa Rosa City School District and 5 grandchildren presently are attending our local public schools. My wife
was the principal at Doyle Park Elementary School for 15 years previously having been a reading and curriculum specialist for the Santa Rosa Elementary
School District. My family and I continue our commitment to the Santa Rosa City
School District.
I strongly support the School Board’s current approach toward Academic and
Vocational Excellence. This year, of those students on track to graduate, our
high schools reached a 99.5% pass rate on the California Exit Exam. (The
statewide average was only 90.6%.) Vocational educational opportunities and
the introduction of campus environmental greening & carbon emission reduction
efforts are being expanded.
I have a vested interest in our public school system having sent my 4 children and
most of 9 grandchildren to school there. This has helped me relate to and know
how to assist them. I have a strong appreciation for the public school system and
understand the challenges that exist.
I feel strongly that I have the qualifications needed to help our schools become
the best that they can be. As a financial advisor for 42 years I know how to deal
with financial matters. My ability to listen and assist others is my greatest asset.
I speak Spanish fluently and am comfortable working with people of all walks of
life. As a self-employed business professional I am able to schedule my time to
meet my responsibilities effectively.
As your re-elected Board member I will continue to work to ensure that all dollars

Santa Rosa needs someone with proven experience to help lead an aggressive
economic revitalization effort. I know how to do just that. As Director of Economic
Development for San Rafael, I brought that city together and led its transformation
from blight to a vibrant destination.
During my 16-year career in San Rafael, sales tax revenues increased 197%, and
the value of taxpayer’s property skyrocketed 223%. Santa Rosa can be just as successful.
The environment was never sacrificed. In fact, my work was honored with Marin
Conservation League’s prestigious John M. MacPhail, Jr. Award.
Soon after moving to Santa Rosa in 2002, l was appointed to Santa Rosa’s Redevelopment Agency and Housing Authority Boards. It has given me a unique
view of Santa Rosa, both its challenges and its incredible unmet potential. I look
forward to working for the people of Santa Rosa. Working together, we can make
a difference.

PINER-OLIVET UNION SCHOOL DISTRICT
MEASURE L
An election will be held in the Piner-Olivet Union School District (the “District”)
on November 2, 2010, to authorize the sale of up to $20,000,000 in bonds of the
District to finance school facilities as described in the proposition. If the bonds are
approved, the District plans to sell the bonds in approximately four series over a
period of approximately twelve years. Principal and interest on the bonds will be
payable from the proceeds of tax levies made upon the taxable property in the
District. The information presented in numbered paragraphs 1-3 below is provided
in compliance with Sections 9400-9404 of the Elections Code of the State of California.
To provide funds to acquire, construct and improve
classrooms and facilities, expand student access to
computers and technology, and provide renewable
energy and related improvements to better maintain

COUNTY COUNSEL’S IMPARTIAL ANALYSIS OF MEASURE L
1. The best estimate of the tax which would be required to be levied to
fund this bond issue during the first fiscal year after the sale of the first
series of bonds, based on estimated assessed valuations available at the
time of filing of this statement, is 2.3 cents per $100 ($23.00 per $100,000) of
assessed valuation in fiscal year 2011-12.
The California Constitution allows school districts to borrow money by issuing
bonds to pay for repair, construction, and replacement of school classrooms and
facilities if 55 percent of the voters who vote on the measure approve the sale of the
bonds. The Piner-Olivet Union School District has called for an election on whether
to issue bonds in the amount of $20 million for such purposes.
2. The best estimate of the tax rate which would be required to be levied
to fund this bond issue during the first fiscal year after the sale of the last
series of bonds, based on estimated assessed valuations available at the
time of filing of this statement, is 2.3 cents per $100 ($23.00 per $100,000)
of assessed valuation in fiscal year 2022-23.
Money raised by the sale of the bonds can be used only for the purposes and projects stated in the Measure. The Bond Project List is set forth in the Measure, and
is published as part of the Measure in this ballot pamphlet. Examples of projects
listed include building new classrooms; providing new multipurpose rooms; modernizing and rehabilitating classrooms, schools, and student support facilities; replacing
relocatable classrooms with permanent buildings; installing renewable energy and
energy conservation improvements; improving student and vehicle safety by constructing improvements to playgrounds, student drop-off areas, parking, and roadways;
upgrading technology, and equipping computer labs and classrooms with new
computers and education technology equipment. As required by state law, the measure
prohibits using bond proceeds for school operating expenses or teacher and administrator salaries. The District’s Board will establish the priority and order in which the
projects will be completed.
3. The best estimate of the highest tax rate which would be required to be
levied to fund this bond issue, based on estimated assessed valuations
available at the time of filing of this statement, 2.3 cents per $100 ($23.00
per $100,000) of assessed valuation in fiscal years 2012-13, 2014-15,
2018-19, and 2023-24 through 2056-57.
If the measure is adopted, the District’s Board will conduct annual, independent
financial and performance audits to verify that expenditures are proper and projects
are being completed. In addition, an Independent Citizens’ Oversight Committee
will be established within sixty days of the report of election results to the Board.
The proceeds of the bonds will be maintained in a separate account in the County
Treasury, and the Superintendent of the District is required to report to the Board
annually on the status of projects undertaken and the amount of bond proceeds
received and expended in that year.
Within limits set by law, the District has the discretion to decide when to sell all or any
portion of the bonds. The bonds may be issued and sold in series, at different times,
as projects are undertaken. The bonds of any series must mature within 40 years of
the date they are issued. The funds to repay the bonds would be raised by an
increase in property taxes based upon the value of land and improvements in the
District. The interest rate on the bonds would depend on the market rate at the time
the bonds are sold. The rate cannot exceed the rate set by state law, currently 12 percent. The Tax Rate Statement prepared by the Superintendent of the District, which
estimates the property tax levies required to pay off the bonds, follows this analysis.
Approval of the ballot measure authorizes the issuance of bonds under certain
conditions, and is not approval of a specific tax rate or a specific bond issuance
plan. The tax rate estimates in this statement reflect the District’s current projection
of future assessed values and of future debt service payments, which are based on
certain assumptions. The actual tax rates and the years in which they will apply
may vary from those presently estimated, due to variations from these estimates in
the (i) timing of bond sales, (ii) the amount and repayment structure of bonds sold,
(iii) market interest rates at the time of each sale, and (iv) actual assessed valuations over the term of repayment of the bonds. The dates of sale of the bonds and
the amount and repayment structure of bonds sold at any given time will be determined by the District based on its need for construction funds, its intention to meet
the tax rate targets stated above, the legal limitations on bonds approved by a 55%
vote, and other factors. The actual interest rates at which the bonds are sold will
depend on the bond market at the time of each sale. Actual future assessed valuation will depend upon the amount and value of taxable property within the District
as determined by the County Assessor in the annual assessment and the
equalization process.
Voters should note that the estimated tax rates are based on the ASSESSED
VALUE of taxable property in the District as shown on the County’s official tax rolls,
not on the property’s market value. Property owners should consult their own property tax bills to determine their property’s assessed value and any applicable tax
exemptions.

In Piner-Olivet Union School District, we know that quality local schools are important. Good schools attract families, enhance local property values and add to our
local economy. Educational success benefits our community and needs to be
supported.
We suggest taxpayers start by asking why the Piner-Olivet School District needs to
borrow money and raise taxes to perform predictable maintenance and replacement of major building components. When a school district proposes a bond it’s
usually a sign of failure to plan adequately and to prudently manage the finances of
the District.
Measure “L” will improve our local schools to maintain the desirability of our community, provide our children with the modern facilities they need, and reduce energy
costs to put more money back in the classroom.
Modern technology is increasingly important for our children’s learning. Measure “L”
will improve student access to computers. Relocatable classrooms have been installed over the years to address temporary enrollment needs, but they are now old
and need to be replaced. Measure “L” will replace them with permanent classrooms.
Piner-Olivet Charter School outperforms many schools in Santa Rosa with higher
test scores and student performance. Measure “L” will expand existing charter
schools to allow more students to continue to benefit from this academic success.
Energy costs and repairs are increasing while State funding is decreasing. Measure “L” will provide renewable energy improvements to reduce annual operating
costs and put more money in the classroom. The District has done a good job
maintaining our schools, but as our schools age they require more repairs. Measure “L” will ensure an ongoing source of funding for major repairs and upgrades to
protect our investment in our schools.
Taxpayer safeguards are in place. Measure “L” requires annual performance and
financial audits and an independent citizens’ oversight committee to ensure funds
are spent only on voter approved improvements.
There is never a good time to wait to improve our schools. The time is now. Measure “L” will stimulate our local economy, provide needed school facilities, and promote the academic success of our children. Vote Yes on Measure “L”!

The fact that a roof and other major building components do not last forever should
surprise no one. Providing for a sound roof, functioning heating system and other
elements of the physical plant should be every bit as much a part of the annual budgeting as staff salaries and utility bills. Because roofs are not replaced every year,
a portion of the replacement cost should be placed in a dedicated replacement reserve fund each year so that funds will be available when the need does arise.
Without an adequately funded reserve only three things can happen, and they are
all bad; the District must defer maintenance, take funds from educational programs
for building maintenance or raise taxes (issue bonds).
The Sonoma County Taxpayers’ Association has been and continues to be a
strong supporter of public education. However, taxpayers have a right to expect
the officials who manage our public schools to be prudent managers of the taxpayer resources accorded them. A District that has not made adequate plans nor
maintained a replacement reserve fund, and has to resort to raising taxes has not
met this basic requirement for prudent management.
This bond proposal is a red flag suggesting the management practices at the
Piner-Olivet School District need to be modified to regain taxpayers’ confidence,
before they ask for more of our money. We recommend a No vote on Measure L.

REBUTTAL TO ARGUMENT IN FAVOR OF MEASURE L
The importance of education is not what’s at issue here. The Sonoma County Taxpayers’ Association supports public education, but we think taxpayers have a right
to expect school officials to use taxpayer provided resources prudently and efficiently. This bond measure does neither.
If bond proceeds fund energy efficiency installations that help reduce energy bills,
and those savings are not used to repay the bonds, those savings will be used to
create more money available for the school’s general funds. Since 80% of general
fund budgets typically pay for salaries, the bond proceeds will be used to support
higher salaries.
One of the stated uses of bond proceeds is technology upgrades and equipment.
With the rapid pace of technological development most technology equipment has
a short useful life before its out dated. Even being generous and assuming a five
year life, taxpayers will be paying for these improvements long after they have
been retired to the landfill.
Issuance of bonds usually is sign of failure of the district to provide a financial plan
to maintain and replace aging buildings. Prudent school officials will have set aside
funds in a reserve so that they will have the money to upgrade building systems
and replace things like roofs. Taxpayers should not reward those officials who
have allocated their entire budget to higher salaries, failing to set aside reserves for
predictable maintenance/replacement needs.
Our investment in our schools needs to be protected. Measure “L” will provide an
ongoing, local source of funding to cover needed repairs and critical upgrades. Our
schools, including our charters, are successful. Measure “L” will expand opportunities for the academic success of our children.
Relocatable facilities have served as temporary fixes to meet immediate enrollment needs, but now are costly and need to be replaced. Measure “L” will install the
modern classrooms our children deserve.
Computers and classroom technology are essential to providing our students with
a quality 21st Century education. Measure “L” will ensure our students have the
schools they need to have the best chance for academic success and be better
prepared for college and good-paying jobs.
An independent citizens’ oversight committee will ensure every penny of Measure “L” is
spent creating local jobs, stimulating our economy and improving Piner-Olivet schools.
It is never a good time to wait to improve our schools. Good schools attract families,
businesses and investment. To reduce operating costs and put more money into
the classroom, provide our children with the facilities they need, and improve our
schools and our community, vote Yes on Measure “L”!

FULL TEXT OF MEASURE L
BOND AUTHORIZATION
By approval of this proposition by at least 55% of the registered voters
voting on the proposition, the Piner-Olivet Union School District (the “District”) shall
be authorized to issue and sell bonds of up to $20,000,000 in aggregate principal
amount to provide financing for the specific school facilities projects listed in the
Bond Project List below, and in order to qualify to receive State matching grant
funds, subject to all of the accountability safeguards specified below.
ACCOUNTABILITY SAFEGUARDS
The provisions in this section are specifically included in this proposition
in order that the District’s voters and taxpayers may be assured that their money
will be spent wisely to address specific facilities needs of the District, all in compliance with the requirements of Article XIII A, Section 1(b)(3) of the State Constitution,
and the Strict Accountability in Local School Construction Bonds Act of 2000
(codified at Education Code Sections 15264 and following).
Evaluation of Needs. The Board of Trustees has evaluated the facilities
needs of the District at each campus and facility to determine which projects to
finance from a local bond at this time. The Board has certified that it has evaluated
safety, class size reduction and information technology needs in developing the
Bond Project List.
Limitation on Use of Bond Proceeds. The State Constitution allows proceeds from the sale of bonds authorized by this proposition to be used only for the
construction, reconstruction, rehabilitation, or replacement of school facilities listed
in this proposition, including the furnishing and equipping of school facilities, or
the acquisition or lease of real property for school facilities, and not for any other
purpose, including teacher and administrator salaries and other school operating
expenses. Proceeds of the bonds may be used to pay or reimburse the District for
the cost of District staff when performing work on or necessary and incidental to the
bond projects.
Independent Citizens’ Oversight Committee. The Board of Trustees shall
establish an independent Citizens’ Oversight Committee (pursuant to Education
Code Section 15278 and following), to ensure bond proceeds are spent only for the
school facilities projects listed in the Bond Project List. The committee shall be established within 60 days of the date on which the Board enters the election results
on its minutes.
Annual Performance Audits. The Board of Trustees shall conduct an annual, independent performance audit to ensure that the bond proceeds have been
expended only on the school facilities projects listed in the Bond Project List.
Annual Financial Audits. The Board of Trustees shall conduct an annual,
independent financial audit of the bond proceeds until all of those proceeds have
been spent for the school facilities projects listed in the Bond Project List.
Special Bond Proceeds Account; Annual Report to Board. Upon approval
of this proposition and the sale of any bonds approved, the Board of Trustees shall
take actions necessary pursuant to Government Code Section 53410 and following
to establish an account in which proceeds of the sale of bonds will be deposited. As
long as any proceeds of the bonds remain unexpended, the Superintendent or the
chief fiscal officer of the District shall cause a report to be filed with the Board no later
than December 31 of each year, commencing December 31, 2011, stating (1) the
amount of bond proceeds received and expended in that year, and (2) the status of
any project funded or to be funded from bond proceeds. The report may relate to the
calendar year, fiscal year, or other appropriate annual period as such officer shall
determine, and may be incorporated into the annual budget, audit, or other appropriate routine report to the Board.
Joint Use. The District may enter into agreements with the City of Santa
Rosa, the County of Sonoma, or any other public agencies or nonprofit organizations for joint use of school facilities financed with the proceeds of the bonds in
accordance with Education Code Section 17077.42 (or any successor provision).
The District may seek State grant funds for eligible joint-use projects as permitted
by law, and this proposition hereby specifies and acknowledges that bond funds
will or may be used to fund all or a portion of the local share for any eligible joint-use
projects identified in the Bond Project List or as otherwise permitted by California
State regulations, as the Board of Trustees shall determine.
Rate of Interest. The bonds shall bear interest at a rate per annum not exceeding the statutory maximum, payable at the time or times permitted by law.
Term of Bonds. The number of years the whole or any part of the bonds
are to run shall not exceed 40 years from the date of the bonds or the date of any
series thereof.
SPENDING AUTHORIZATION
The Bond Project List below describes the specific projects the District
proposes to finance with proceeds of the bonds. Inclusion of a project on the Bond
Project List is not a guarantee that the project will be funded or completed. Listed
projects will be completed as needed at a particular school site according to
Board-established priorities, and the order in which such projects appear on the
Bond Project List is not an indication of priority for funding or completion. The
Board of Trustees may make changes to the Bond Project List in the future consistent with the projects specified in the proposition.
Until all project costs and funding sources are known, the Board of Trustees cannot determine the amount of bond proceeds available to be spent on each
project, nor guarantee that the bonds will provide sufficient funds to allow completion of all listed projects. The final cost of each project will be determined as plans
are finalized, construction bids are awarded, and projects are completed. Certain
construction funds expected from non-bond sources have not yet been secured,
including State grant funds the District might reasonably expect to request for eligible projects, deferred maintenance funds, public agency or nonprofit partner contributions to joint-use projects, utility rebates, etc. Completion of some projects may
be subject to further government approvals by State officials and boards, to local
environmental review, and to input from the public.
Project costs include costs of the election and bond issuance and construction overhead and related costs, such as construction management, architectural, engineering, inspection and other planning and permitting costs, legal,
accounting and similar fees, independent annual financial and performance audits,
a customary construction contingency, and other costs incidental to and necessary
for completion of the listed projects (whether work is performed by the District or by
third parties).
Unless otherwise noted, the projects in the Bond Project List are authorized
to be completed at each or any of the District’s sites. District schools and locations

COUNTY COUNSEL’S IMPARTIAL ANALYSIS OF MEASURE N
The County of Sonoma has a civil service ordinance which was adopted in 1950 by
initiative. The ordinance provides for a Civil Service Commission, which establishes rules to implement the purposes of the ordinance. The civil service rules set
out procedures that must be followed in the event of employee discipline or layoffs
to protect employees in the classified service. Changes to the ordinance require
voter approval, unless the ordinance specifically permits such changes without
voter approval. For example, in 1994 the ordinance was amended by the voters to
allow the Board of Supervisors to change the status of appointed department
heads from classified (subject to civil service protection) to unclassified (not
subject to civil service protection).
As currently written, the ordinance provides that the director of personnel must
be appointed by the Civil Service Commission, and specifically provides that the
director of personnel shall be in the classified (protected) service. The amendment
would change the appointing authority from the Civil Service Commission to the
Board of Supervisors, and would change the position from classified to unclassified, consistent with the status of other county department heads. The amendment
would also change all references to the “director of personnel” to the “director of
human resources,” since the personnel department has been renamed the department of human resources.
If a majority of the voters voting on this measure vote “yes,” the measure will be
adopted. Otherwise, the measure will fail and the ordinance will remain
unchanged.
ARGUMENT IN FAVOR OF MEASURE N
Measure N updates the County Civil Ordinance adopted in 1950 to give the Board
of Supervisors the ability to directly appoint the Human Resources Director.
The Director of Human Resources is the only department head not appointed by
authority of the Board of Supervisors except for elected department heads. This
means the person with the responsibility for labor negotiations, employee benefits,
and training and development of the County’s more than 3,800 full time equivalent
employees is not directly accountable to the Board of Supervisors.
Measure N will align the County’s personnel system with a proven practice that is
already in use throughout the state. A practice where the Board of Supervisors
appoints and holds accountable the Human Resources Director.
In these difficult financial times, we all understand the need for efficient, effective,
and accountable government. Measure N improves accountability by ensuring a
key member of the management team is answerable to the Board. As your elected
representatives, this ability will bolster our management of the County organization
to deliver a wide variety of public services through a dedicated and talented
workforce.

AN ORDINANCE OF THE COUNTY OF SONOMA, STATE OF CALIFORNIA,
AMENDING ORDINANCE 305A AS SET FORTH IN CHAPTER 21 OF THE
SONOMA COUNTY CODE, TO REMOVE RESPONSIBILITY FOR THE
APPOINTMENT OF THE DIRECTOR OF PERSONNEL (NOW HUMAN
RESOURCES) FROM THE CIVIL SERVICE COMMISSION, AND ADD THE
POSITION OF DIRECTOR OF HUMAN RESOURCES TO THE UNCLASSIFIED
SERVICE

The People of the County of Sonoma, State of California, do ordain as follows:
SECTION I. Ordinance No. 305A, as amended from time to time and set forth in
Chapter 21 of the Sonoma County Code, shall be amended as follows.
Section 21-4 is amended to read:
Sec. 21-4. -Civil service commission—Chairman—Meetings—Director Responsibilities of director of personnel human resources. and other personnel employees.
Immediately upon appointment, the civil service commission shall elect one of its
members as chairman, who shall call meetings of such commission as often as
may be necessary, but at least once a month.
With the approval of the board of supervisors, the civil service commission shall
appoint a director of personnel from an employment list resulting from competitive
examinations. Such director of personnel shall be in the classified service. The civil
service commission shall appoint such other employees from appropriate employment lists as may be necessary to perform duties in the personnel department.
The director of personnel human resources shall act as executive secretary of the
civil service commission and shall perform and discharge under the direction and
control of such commission, the powers, duties, purposes, functions and jurisdiction vested in the civil service commission and delegated to him by it. The director
of personnel human resources shall be responsible to the civil service commission
for carrying out all procedures in the administration of the classified personnel in
conformity with the provisions of this article and the rules of such commission. The
director of personnel human resources shall keep an official record of all actions
taken by civil service commission and shall prepare, or cause to be prepared, an
annual report that shall be amended or approved by the civil service commission
and submitted to the board of supervisors.
Section 21-5 is amended by adding the director of human resources to the unclassified service, as follows:
(aa) The director of human resources.
SECTION II. All ordinances and parts of ordinances and all resolutions inconsistent herewith are hereby repealed.

Vote “Yes” on Measure O to renew our Urban Growth Boundary and help preserve
Santa Rosa’s quality of life. Measure O will protect the important farmland,
ranches, and water resources that surround our City.
Shall the voters of the City of Santa Rosa adopt an
ordinance amending section 17-28.010 of the Santa
Rosa City Code to extend Santa Rosa’s Urban Growth
Boundary ordinance until December 31, 2035?
Voters established Santa Rosa’s Urban Growth Boundary in 1996. The Urban
Growth Boundary is one of the best tools to limit urban sprawl and protect open
space. Measure O will re-authorize the boundary through 2035. Vote “Yes” on
Measure O to keep the current Urban Growth Boundary in place.
CITY ATTORNEY’S IMPARTIAL ANALYSIS OF MEASURE O
In 1996, the voters of Santa Rosa approved “Measure G-Santa Rosa Urban
Growth Boundaries” which approved an ordinance to restrict changes to the City’s
urban growth boundary, as depicted in the 1996 General Plan Specific Urban
Boundary Graphic, to twenty year intervals as part of a General Plan Update subject to certain limited exceptions which required a two-thirds vote of the council.
The twenty year period established under the ordinance would expire in 2016. The
ordinance further provided that it could not be amended or repealed except by a
vote of the electors of the City of Santa Rosa at a regularly scheduled general election or at a special election called for that purpose.
The Urban Growth Boundary limits the area which can be developed beyond the
current city limits.
On November 3, 2009, the City Council adopted the 2035 General Plan update
which incorporated the same Urban Growth Boundary as depicted in the 1996
General Plan Update. Measure O, if approved by a majority of the voters, would extend the term of the previously approved Urban Growth Boundary as depicted in
the 2035 General Plan Specific Urban Growth Boundary Graphic to 2035 in order
to be consistent with the term of the General Plan. The only proposed changes to
the Urban Boundary ordinance ( Section 17-28.010 of the Santa Rosa City Code)
are to extend the term and related text changes necessary to the ordinance as a
result of that change and as a result of expiration of the 2010 prohibition on the development of the 453 acre site in the southeast quadrant of Santa Rosa.
The ordinance retains the same exceptions to allow changes to the Urban Growth
Boundary by a two thirds vote of the council that were contained in the original ordinance approved in 1996.
In Santa Rosa, this policy has effectively preserved agricultural land, wildlife habitat, and fragile ecosystems that would otherwise be at risk for development. We
can’t afford to have costly sprawl pave over Santa Rosa’s landscapes and lose the
benefits these lands provide, including local food, clean drinking water and amazing views. Measure O protects these lands for the future.
Measure O saves the City of Santa Rosa money in several ways. It will ensure that
growth occurs inside the boundary line, where utilities and city services are most
economically maintained. It also saves the City from additional consulting fees by
making use of the recently approved General Plan studies.
Measure O is about stopping future sprawl. Santa Rosa doesn’t need to expand
outward; there is enough land within the Urban Boundary to accommodate our
growth through at least 2035. Measure O does not change Santa Rosa’s growth
management or its affordable housing policies. With Measure O, only the voters
can approve significant changes to the Urban Growth Boundary.
Measure O is about preserving open space and stopping future sprawl. We, the
voters, should decide how our City grows. Measure O gives us that power. Please
join us and vote “Yes” on Measure O.

Section 1.
Purpose.
The purposes of this ordinance are to provide for the health, safety, and
welfare of the residents of the City of Santa Rosa, to preserve agricultural uses
which are vital to the region’s economy, to discourage urban sprawl, and to implement the goals, objectives and policies of the Santa Rosa General Plan

(1) Protects agricultural uses outside the urban boundary;
(3) That the projected population and commercial/industrial land development estimates in the 2009 General Plan Update or subsequent General
Plan have been met or exceeded by the population and commercial/industrial land
development existing at the time the Council considers a General Plan
Amendment.
(2) Encourages residential, commercial, and industrial growth in areas
already served by urban services;
(4) That the adjustment to the urban boundary does not include land
designated as community separator in the Sonoma County General Plan.
(3) Improves the City’s ability to provide transportation, utilities, and other
City services;
(5) That the adjustment to the urban boundary does not include land
designated with the agricultural land use categories LEA, LIA, or DA by the
Sonoma County General Plan.
Section 2.
Findings.
The People of the City of Santa Rosa find that this ordinance:
(4) Protects open space surrounding the city;
(5) Discourages the provision of City services to sprawling developments in
outlying agricultural and open space lands which greatly increases the cost
of such services;
(6) Does not impose any numerical or percentage limit on the development
of housing units in the City of Santa Rosa; and
(7) Does not limit the supply of undeveloped land within the present urban
boundary of the City of Santa Rosa which is adequate to allow the City to
provide its fair share of the affordable and low cost housing needs of the
region.
Section 3.
to read as follows:
Section 17-28.010 of the Santa Rosa City Code is amended
(D) By affirmative vote of at least 2/3 of the total membership of the Council, the Council may act by General Plan Amendment to change the urban
boundary to provide an overriding public benefit to Santa Rosa that cannot
feasibly be accommodated within the existing urban boundary, in order to provide
a unique educational, cultural or economic opportunity for the City. This provision
shall not apply to residential or retail commercial projects. During each 20 year
period, adjustments allowed by this subsection may not exceed a total of 1%
(approximately 280 acres) of the area within the 1996 General Plan Update
urban boundary. The change in the urban boundary allowed by this subsection
shall be made only upon all of the following findings:
(1) That the proposed land use cannot feasibly be accommodated within the
existing urban boundary.
“17-28.010. Changes in Urban Boundary.
(2) That land designated as community separator in the Sonoma County
General Plan is not included within the proposed urban boundary amendment.
(A) Except as provided in subsections (B), (C) and (D) of this section, the
urban boundary of the City as depicted in the General Plan’s Parcel Specific Land
Use Diagram shall not be changed until December 31, 2035, and then only as part
of a General Plan update process.
(3) That land designated as agricultural land use category LEA, LIA, or DA
in the County General Plan is not included within the proposed urban boundary
amendment.”
(B) At any time the Council may act by General Plan amendment to change
the urban boundary as follows:
(1) To adjust the boundary to include or exclude ten acres or less for
the purpose of aligning the boundary with property lines as they existed on the date
the ordinance codified in this chapter was approved by the voters;
(2) To adjust the boundary for the purpose of protecting open space
or a natural resource;
(3) To add lands to be permanently maintained as public parks or open
space, to protect natural resources, or for sewage treatment or disposal uses;
(4) To add lands for the purpose of providing sewer or water to eliminate health hazards existing in improvements constructed prior to the date the
ordinance codified in this chapter was approved by the voters; provided that no
land designated as community separator or with agricultural land use categories
LEA, LIA or DA by the Sonoma County General Plan shall be included within the
urban boundary under subsections (B)(1), (2), (3) and (4).
(C) As part of a General Plan Update process, by the affirmative vote of at
least 2/3 of the total membership of the Council, the Council may act by General
Plan Amendment to change the urban boundary to replace land inside the urban
boundary established in the 2009 General Plan Update which has been designated for a particular land use and is subsequently determined to be unsuitable for
that land use due to unforeseeable environmental constraints, and only upon the
Council making all of the following findings:
Section 4.
No Taking. This ordinance is not intended, and shall not be
applied or construed, to authorize the City to exercise its powers in a manner which
will take private property for public use without the payment of just compensation
therefor, but shall be interpreted, applied and implemented so as to accomplish its
purposes to the maximum permissible extent, by all constitutional means. If application of this ordinance to a specific property of record as of the date of its adoption
would create a taking, then pursuant to this ordinance, the City Council may take
any action necessary to avoid a taking, to the greatest extent possible consistent
with the purposes of this ordinance.
Section 5.
Severability. If any section, subsection, sentence, clause,
phrase or word of this ordinance is for any reason held to be invalid and/or unconstitutional by a court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance.
Amendment and Repeal. No part of this ordinance may be

amended or repealed except by a vote of the electors of the City of Santa Rosa at a
regularly scheduled general election or at a special election called for that purpose.
Section 7.
Effective Date. This ordinance shall take effect ten days after
the vote is declared by the Council if a majority of the voters voting on the ordinance vote in favor of its adoption.
(1) That the evidence of unsuitability is provided by a public agency
other than the City of Santa Rosa or by court decision.
(2) That the Council has determined that there is insufficient remaining land designated within the then current urban boundary to meet the demand,
within the following five-year period, for the particular land use designation and that
it is infeasible to redesignate land within the urban boundary to meet the demand
for that land use.

CITY OF SANTA ROSA
MEASURE P
The City of Santa Rosa faces its most serious fiscal crisis due to the severe recession that has devastated our state and national economies. Since 2007/08, the
City’s general fund budget has been slashed by $21.9 million, or 16.8%. 174 positions, or 20% of the City’s employees, have been eliminated, including 14 police officer and 9 firefighter positions. Park maintenance staff has been reduced 70% and
street maintenance staff by 25%.
THE CITY OF SANTA ROSA VITAL CITY SERVICES
MEASURE. To help maintain essential City services
including police and fire protection; violent and gang-crime
prevention; pedestrian safety; property and nuisancerelated crime prevention; street paving and pothole repair; park
safety; and recreation and youth programs, shall the City of Santa
Rosa enact a one-quarter cent sales tax for eight years, with all
revenue staying in the City and subject to annual, independent
audits and public expenditure reports?

The reduction in city services has been dramatic. One fire station is closed each day.
One third of the City’s streetlights have been turned off. Our parks are turning brown,
and potholes go unfilled. Gang prevention has been reduced, recreation programs
decreased, homeless services cut back. But unfortunately, the worst is yet to come.
CITY ATTORNEY’S IMPARTIAL ANALYSIS OF MEASURE P
Measure P, if approved by a majority vote of the City’s voters would enact a one
quarter of one percent (0.25%) increase to the “Transaction and Use Tax” (commonly referred to as “sales tax”) on each dollar of taxable sales of goods within the
City of Santa Rosa and on storage, use or consumption in the City of Santa Rosa of
goods purchased from a retailer collected at the same time and in the same manner as other sales tax.
The tax is considered a general tax under state law. As a result, if approved, the
revenues from the tax would be placed in the City’s general fund and may be used
for general City operations and programs such as police and fire services, street
maintenance, park and recreational programs including gang prevention and any
other governmental functions and services.
The tax would continue for a period of eight (8) years from the date of commencement. Any extension to the duration of the proposed tax beyond eight (8) years
would require action by the City Council and a new vote of the public.
Expenditure of the funds would be subject to an annual independent financial audit.
City budget woes are expected to worsen by millions more, and Sacramento is
poised to take even more money from local governments. The grim reality is that
more cuts will be made to the most basic of City services — including brownouts of
up to 3 more fire stations and the elimination of up to 18 more police officers. Some
parks will be closed, and park user fees will be implemented. On the chopping
block may be the Ridgway and Finley Swim Centers, the Senior Center and our
Homeless Center.
By voting for a temporary 1/4 cent sales tax, the City of Santa Rosa can help to prevent these draconian cuts and restore badly needed services. For an additional tax
of just 25 cents on every $100 we spend in Santa Rosa for the next eight years,
Measure P will save our City’s most vital services. The funds will only be used for
the most important general fund services, and the politicians in Sacramento can’t
take it away. Please vote Yes on Measure P.

A “yes” vote on Measure P would increase the sales tax rate in the City of Santa
Rosa from the current nine and one quarter percent (9.25%) to nine and one-half
percent (9.50%).
The proposed tax is authorized by California Revenue and Taxation Code Section
7285.9 subject to approval by two-thirds of the City Council and a Majority of the
voters voting in an election on the tax. On July 27, 2010 the Council of the City of
Santa Rosa unanimously approved the proposed measure. A full copy of the text of
the ordinance is printed in these ballot materials.

REBUTTAL TO ARGUMENT IN FAVOR OF MEASURE P
Santa Rosa’s supporters of Measure P just don’t get it. This falls election is all
about the economy. It is about the rising pension costs that is a major factor in layoffs, service cuts, tax and fee increases. Unless this problem is addressed, the City
will be seeking additional taxes to pay for employee benefits.
The proponents of this tax increase are using scare tactics to convince you to vote
for more taxes and more government spending. They use phrases such as “the
worst is yet to come”, “the grim reality is that more cuts will be made to most basic
City services”.
All of us have been affected by this recession, but we don’t go to our bosses and
say we demand more money. We are fortunate to have our jobs. The taxpayers
have tighten their belts and government should do the same.
The City is saying this a temporary tax. When was the last time government really
instituted a temporary tax?
The City has turned away retail development that would have brought much
needed jobs and sales tax revenue to help with the City’s deficit. Instead, they want
the taxpayer to bail them out once again.
The City indicates the increased sales tax money will be used primarily for public
safety, but not long ago the voters approved Measure O a sales tax increase to
fund pubic safety.
When is enough, enough. Vote no on Measure P and force the City to live within its
means.

Until Santa Rosa resolves the looming issue of retiree pension costs they have not
earned the right to ask taxpayers for an increase in sales tax rate. The City has
made cuts in the budget to respond to the pressures that have resulted from our
current economic recession. We applaud them for doing that without asking the tax
payers for more money at a time when most taxpayers are also suffering from financial pressures.
Ideally we would hope that the City would find a way to live within its present budget
without pulling more from taxpayers’ pockets to fill City coffers. In any event, before
asking for a tax increase the City must seriously address and make substantial
progress toward resolving the biggest problem on the agenda, the exploding cost
of funding excessive promises to retired employees. Failure to address this as the
highest priority is equivalent to nibbling around the edges of the problem, but never
getting to the real issue.
Taxpayers must force the City to address the major problem of inflated pension
costs by keeping the pressure on. The greatest fear is that if a tax increase passes,
the City will continue to push the pension cost issue off into the future, only making
it worse.
To be sure there are many reasons to oppose the current sales tax increase. Including the fact in 2004 voters passed Measure O, a sales tax increase that was
supposed to solve their public safety problems. Now the City is asking for another
quarter cent primarily for public safety.
The City simply has not made the case for increasing the sales tax. We recommend you vote no on Measure P.

REBUTTAL TO ARGUMENT AGAINST MEASURE P
Contrary to the opponents’ argument, the City Council is seriously and aggressively addressing the costs of employee compensation and benefits.
The City has already realized more than $1,401,000 in savings from employee
concessions during fiscal years 2009 and 2010. As part of the current fiscal year,
additional employee concessions of approximately $2,512,000 are being negotiated with the various labor groups and management. These concessions will result
in a three-year savings to the City of more than $3,913,000, of which $2,771,000
applies to the General Fund.
In addition, the City Council is actively pursuing reduced retirement pension benefits by providing new non-public safety employees a lower pension benefit (establishing a “two-tier system”). State law forbids the reduction of retirement benefits
for its current employees and retirees.
Once fully implemented, the two-tier system will reduce the City’s future non-public
safety employee pension costs, but the savings will not be fully realized for several
years --- a prime reason why a short-term sales tax is necessary.
ORDINANCE NO. 3945
ORDINANCE OF THE COUNCIL OF THE CITY OF SANTA ROSA IMPOSING A
GENERAL TRANSACTION AND USE TAX TO BE ADMINISTERED BY THE
STATE BOARD OF EQUALIZATION
THE PEOPLE OF THE CITY OF SANTA ROSA DO ENACT AS FOLLOWS:
Section 1. The Council of the City of Santa Rosa in adopting this ordinance and
placing the general tax levied herein before the voters of the City, finds, determines, and states as follows:
1.
The City seeks to continue to provide excellent service to the residents
of Santa Rosa;
2.
To address current budget shortfalls, the City has made significant
budget cuts and continues to explore other possible reductions;
3.
The costs for repairs, upgrades and maintenance continue to exceed
available resources;
4.
Our community continues to suffer from crime. Santa Rosa needs
additional funding to maintain our police force and to support programs to keep our
neighborhoods, schools and parks safe;
5.
Due to a lack of funds, the City has not been able to maintain local
streets and roads at the necessary level and over 270 miles of local streets and
roads require repairs and safety improvements;
6.
Santa Rosa currently has 500 acres of city parks that require repairs
and renovations and 95 percent of the City’s current and planned recreation and
parks projects are unfunded;
7.
Santa Rosa’s population has and will grow. The City must develop
sustainable revenue sources in order to provide essential City services such as
police, fire, parks, recreation, and senior and youth services;
8.
The State of California faces a 20 billion dollar budget deficit, which
has and will result in state funding cuts to our city;
9.
Without additional money, our City will not be able to offer the kind of
services we need, deserve and count on, including local public safety services like
graffiti removal and proactive investigation of other nuisance crimes, or maintenance of recreation programs and facilities for seniors and youth;
10. The City of Santa Rosa needs a protected and reliable local revenue
source to help maintain essential local City services;
11. The general tax set forth in this ordinance and in its ballot measure is
subject to the City’s existing fiscal accountability measures such as the charter- required independent audit, review of City budget in a series of public hearings, and
year-end public expenditure reports on City expenditures; and
12.
The Council has evaluated Santa Rosa’s needs with input from the
public.
Without additional revenue for a limited time, additional budget reductions will have
to be initiated. The next round of budget cuts will reduce and/or eliminate vital basic
services provided by the City of Santa Rosa.
Section 2. Chapter 3-27 entitled “2010 Transaction and Use Tax” is added to
Title 3 of the Santa Rosa City Code to read as follows:
The question is: “Is it important to you to maintain core services? If so, is it worth 25
cents on every $100 you spend until the economy improves and pension reduction
plans take effect?” We believe it is.
“Section 3-27.010. TITLE. This ordinance shall be known as the City of Santa
Rosa 2010 Transaction and Use Tax Ordinance. The City of Santa Rosa hereinafter shall be called “City.” This ordinance shall be applicable in the incorporated
territory of the City.

FULL TEXT OF MEASURE P, CONT.
A. To impose a general retail transaction and use tax in accordance with the
provisions of Part 1.6 (commencing with Section 7251) of Division 2 of the Revenue
and Taxation Code and Section 7285.9 of Part 1.7 of Division 2 which authorizes
the City to adopt this tax ordinance which shall be operative if a majority of the electors voting on the measure vote to approve the imposition of the tax at an election
called for that purpose.
B. To adopt a general retail transaction and use tax ordinance that incorporates provisions identical to those of the Sales and Use Tax Law of the State of
California insofar as those provisions are not inconsistent with the requirements
and limitations contained in Part 1.6 of Division 2 of the Revenue and Taxation Code.
C. To adopt a general retail transaction and use tax ordinance that imposes a
tax and provides a measure therefor that can be administered and collected by the
State Board of Equalization in a manner that adapts itself as fully as practicable to,
and requires the least possible deviation from, the existing statutory and administrative procedures followed by the State Board of Equalization in administering and
collecting the California State Sales and Use Taxes.
D. To adopt a general retail transaction and use tax ordinance that can be administered in a manner that will be, to the greatest degree possible, consistent with
the provisions of Part 1.6 of Division 2 of the Revenue and Taxation Code, minimize the cost of collecting the sales and use taxes, and at the same time, minimize
the burden of record keeping upon persons subject to taxation under the provisions
of this ordinance.
Section 3-27.030. CONTRACT WITH STATE. Prior to the operative date, the
City shall contract with the State Board of Equalization to perform all functions incident to the administration and operation of this sales and use tax ordinance; provided, that if the City shall not have contracted with the State Board of Equalization
prior to the operative date, it shall nevertheless so contract and in such a case the
operative date shall be the first day of the first calendar quarter following the execution of such a contract.
Section 3-27.040. TRANSACTION TAX RATE. For the privilege of selling tangible personal property at retail, a general tax is hereby imposed upon all retailers
in the incorporated territory of the City at the rate of one quarter of one percent
(0.25%) of the gross receipts of any retailer from the sale of all tangible personal
property sold at retail in said territory on and after the operative date of this ordinance.
Section 3-27.050. PLACE OF SALE. For the purposes of this ordinance, all retail sales are consummated at the place of business of the retailer unless the tangible personal property sold is delivered by the retailer or his agent to an out-of-state
destination or to a common carrier for delivery to an out-of-state destination. The
gross receipts from such sales shall include delivery charges, when such charges
are subject to the state sales and use tax, regardless of the place to which delivery
is made. In the event a retailer has no permanent place of business in the State or
has more than one place of business, the place or places at which the retail sales
are consummated shall be determined under rules and regulations to be prescribed and adopted by the State Board of Equalization.
Section 3-27.050. USE TAX RATE. A general excise tax is hereby imposed on
the storage, use or other consumption in the City of tangible personal property purchased from any retailer on and after the operative date of this ordinance for storage, use or other consumption in said territory at the rate of one quarter of one
percent (0.25%) of the sales price of the property. The sales price shall include
delivery charges when such charges are subject to state sales or use tax regardless of the place to which delivery is made.
Section 3-27.050. ADOPTION OF PROVISIONS OF STATE LAW. Except as
otherwise provided in this ordinance and except insofar as they are inconsistent
with the provisions of Part 1.6 of Division 2 of the Revenue and Taxation Code, all
of the provisions of Part 1 (commencing with Section 6001) of Division 2 of the
Revenue and Taxation Code are hereby adopted and made a part of this ordinance
as though fully set forth herein.
Section 3-27.060. LIMITATIONS ON ADOPTION OF STATE LAW AND
COLLECTION OF USE TAXES. In adopting the provisions of Part 1 of Division 2
of the Revenue and Taxation Code:
A. Wherever the State of California is named or referred to as the taxing
agency, the name of this City shall be substituted therefor. However, the substitution shall not be made when:
1. The word “State” is used as a part of the title of the State Controller,
State Treasurer, State Board of Control, State Board of Equalization, State Treasury, or the Constitution of the State of California;
2. The result of that substitution would require action to be taken by or
against this City or any agency, officer, or employee thereof rather than by or
against the State Board of Equalization, in performing the functions incident to the
administration or operation of this Ordinance.
3. In those sections, including, but not necessarily limited to sections
referring to the exterior boundaries of the State of California, where the result of the
substitution would be to:
a. Provide an exemption from this tax with respect to certain sales,
storage, use or other consumption of tangible personal property which would not
otherwise be exempt from this tax while such sales, storage, use or other consumption remain subject to tax by the State under the provisions of Part 1 of Division
2 of the Revenue and Taxation Code, or;
b. Impose this tax with respect to certain sales, storage, use or
other consumption of tangible personal property which would not be subject to tax
by the state under the said provision of that code.
4. In Sections 6701, 6702 (except in the last sentence thereof), 6711,
6715, 6737, 6797 or 6828 of the Revenue and Taxation Code.
B. The word “City” shall be substituted for the word “State” in the phrase
“retailer engaged in business in this State” in Section 6203 and in the definition of
that phrase in Section 6203.
Section 3-27.070. PERMIT NOT REQUIRED. If a seller’s permit has been
issued to a retailer under Section 6067 of the Revenue and Taxation Code, an additional transactor’s permit shall not be required by this ordinance.
Section 3-27.080. EXEMPTIONS AND EXCLUSIONS.
A. There shall be excluded from the measure of the sales tax and the use
tax the amount of any sales tax or use tax imposed by the State of California or by
any city, city and county, or county pursuant to the Bradley-Burns Uniform Local
Sales and Use Tax Law or the amount of any state-administered sales or use tax.
B. There are exempted from the computation of the amount of sales tax
the gross receipts from:
1. Sales of tangible personal property, other than fuel or petroleum
products, to operators of aircraft to be used or consumed principally outside the
county in which the sale is made and directly and exclusively in the use of such aircraft as common carriers of persons or property under the authority of the laws of
this State, the United States, or any foreign government.
2. Sales of property to be used outside the City which is shipped to a
point outside the City, pursuant to the contract of sale, by delivery to such point by
the retailer or his agent, or by delivery by the retailer to a carrier for shipment to a
consignee at such point. For the purposes of this paragraph, delivery to a point outside the City shall be satisfied:
a. With respect to vehicles (other than commercial vehicles)
subject to registration pursuant to Chapter 1 (commencing with Section 4000) of
Division 3 of the Vehicle Code, aircraft licensed in compliance with Section 21411
of the Public Utilities Code, and undocumented vessels registered under Division
3.5 (commencing with Section 9840) of the Vehicle Code by registration to an
out-of-City address and by a declaration under penalty of perjury, signed by the

buyer, stating that such address is, in fact, his or her principal place of residence;
and
b. With respect to commercial vehicles, by registration to a place
of business out-of-City and declaration under penalty of perjury, signed by the
buyer, that the vehicle will be operated from that address.
3. The sale of tangible personal property if the seller is obligated to
furnish the property for a fixed price pursuant to a contract entered into prior to the
operative date of this ordinance.
4. A lease of tangible personal property which is a continuing sale of
such property, for any period of time for which the lessor is obligated to lease the
property for an amount fixed by the lease prior to the operative date of this
ordinance.
5. For the purposes of subparagraphs (3) and (4) of this section, the
sale or lease of tangible personal property shall be deemed not to be obligated pursuant to a contract or lease for any period of time for which any party to the contract
or lease has the unconditional right to terminate the contract or lease upon notice,
whether or not such right is exercised.
C. There are exempted from the use tax imposed by this ordinance, the
storage, use or other consumption in this City of tangible personal property:
1. The gross receipts from the sale of which have been subject to a
sales tax under any state-administered sales and use tax ordinance.
2. Other than fuel or petroleum products purchased by operators of
aircraft and used or consumed by such operators directly and exclusively in the
use of such aircraft as common carriers of persons or property for hire or compensation under a certificate of public convenience and necessity issued pursuant to
the laws of this State, the United States, or any foreign government. This exemption is in addition to the exemptions provided in Sections 6366 and 6366.1 of the
Revenue and Taxation Code of the State of California.
3. If the purchaser is obligated to purchase the property for a fixed
price pursuant to a contract entered into prior to the operative date of this
ordinance.
4. If the possession of, or the exercise of any right or power over, the
tangible personal property arises under a lease which is a continuing purchase of
such property for any period of time for which the lessee is obligated to lease the
property for an amount fixed by a lease prior to the operative date of this ordinance.
5. For the purposes of subparagraphs (3) and (4) of this section, storage, use, or other consumption, or possession of, or exercise of any right or power
over, tangible personal property shall be deemed not to be obligated pursuant to a
contract or lease for any period of time for which any party to the contract or lease
has the unconditional right to terminate the contract or lease upon notice, whether
or not such right is exercised.
6. Except as provided in subparagraph (7), a retailer engaged in
business in the City shall not be required to collect use tax from the purchaser of
tangible personal property, unless the retailer ships or delivers the property into
the City or participates within the City in making the sale of the property, including,
but not limited to, soliciting or receiving the order, either directly or indirectly, at a
place of business of the retailer in the City or through any representative, agent,
canvasser, solicitor, subsidiary, or person in the City under the authority of the retailer.
D. Any person subject to use tax under this ordinance may credit against
that tax any sales tax or reimbursement for sales tax paid to a district imposing, or
retailer liable for a sales tax pursuant to Part 1.6 of Division 2 of the Revenue and
Taxation Code with respect to the sale to the person of the property the storage,
use or other consumption of which is subject to the use tax.
Section 3-27.090. AMENDMENTS. All amendments subsequent to the effective date of this ordinance to Part 1 of Division 2 of the Revenue and Taxation
Code relating to sales and use taxes and which are not inconsistent with Part 1.6
and Part 1.7 of Division 2 of the Revenue and Taxation Code, and all amendments
to Part 1.6 and Part 1.7 of Division 2 of the Revenue and Taxation Code, shall
automatically become a part of this ordinance, provided however, that no such
amendment shall operate so as to affect the rate of tax imposed by this ordinance.
Section 3-27.100. ENJOINING COLLECTION FORBIDDEN. No injunction or
writ. of mandate or other legal or equitable process shall issue in any suit, action or
proceeding in any court against the State or the City, or against any officer of the
State or the City, to prevent or enjoin the collection under this ordinance, or Part 1.6
of Division 2 of the Revenue and Taxation Code, of any tax or any amount of tax required to be collected.
Section 3-27.110. SEVERABILITY. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, the remainder of the
ordinance and the application of such provision to other persons or circumstances
shall not be affected thereby.
Section 3-27.120. EFFECTIVE DATE. This ordinance, following its adoption by
at least 5 affirmative votes of the Council, and its publication in accordance with the
Government Code, shall become effective upon the approval of the tax imposed
hereunder by more than 50 percent of the voters of the City voting thereon at an
election called for that purpose. The “Operative Date” of the tax imposed hereunder shall be as provided in section 3-27.015.
Section 3-27.130. TERMINATION DATE. The authority to levy the tax imposed
by this ordinance shall extend only through March 31, 2019, or, if the Operative
Date is later than April 1, 2011, at the end of 8 years from the Operative Date, as
provided in section 3-27.015.”

7. “A retailer engaged in business in the City” shall also include any
retailer of any of the following: vehicles subject to registration pursuant to Chapter 1
(commencing with Section 4000) of Division 3 of the Vehicle Code, aircraft licensed
in compliance with Section 21411 of the Public Utilities Code, or undocumented
vessels registered under Division 3.5 (commencing with Section 9840) of the Vehicle
Code. That retailer shall be required to collect use tax from any purchaser who registers or licenses the vehicle, vessel, or aircraft at an address in the City.

MEASURE W
ARGUMENT IN FAVOR OF MEASURE W
Vote Yes on Measure W to relieve traffic congestion and create local jobs. Measure
W will provide funding to repair ailing roads and fill potholes in Sonoma County.
Sonoma County has some of the worst roads in the state and this local revenue will
stay in Sonoma County to fix our roads.
Sonoma County Transportation Improvement Measure:
In order to fill pot holes, build more bicycle and
pedestrian safety projects, create a countywide Safe
Routes to School program and sustain and improve local
bus service throughout Sonoma County, shall the Sonoma
County Transportation Authority establish a $10 annual vehicle
license fee?
W
Vote Yes on Measure W to fund transportation for senior citizens. Measure W will
help fund para-transit programs giving our elders the ability to live in the community
with dignity.
COUNTY COUNSEL’S IMPARTIAL ANALYSIS OF MEASURE W
Recently adopted state law authorizes local transportation planning agencies, with
voter approval, to impose a $10 annual vehicle registration fee to fund projects and
improvements for traffic congestion relief and air pollution mitigation. Sonoma
County Transportation Authority is proposing adoption of such a fee. The measure,
if approved, takes effect immediately, but the fee would not begin until six months
after approval by the voters. The fee would be collected by the Department of Motor
Vehicles at the time of registration of a vehicle, or with the annual registration
renewal, on all vehicles registered within the county limits, including cities.
Fees collected can be used only to pay for programs and projects to relieve congestion and air pollution that bear a relationship to or benefit the owners of motor vehicles
subject to the fee. The Measure describes impacts on vehicle owners, such as delay,
wasted time, wasted fuel, and public health impacts. The Transportation Authority
has approved an Expenditure Plan, included in the ballot pamphlet as part of the
Measure, describing categories of projects and setting priorities to mitigate these
impacts. The Plan proposes that 23 percent of revenue collected be spent on street
improvements, such as pothole repair, bikeway paving and maintenance, traffic
signal maintenance and upgrades, signing and striping of roadways, and sidewalk
installation and repair. Twelve percent of the revenue would support Safe Routes
to School programs. Sixty percent is targeted for transit service expansion and to
develop and encourage ride-sharing efforts. Administrative costs associated with implementing the Measure are limited to 5 percent of the revenue collected.
The Expenditure Plan can be amended from time to time, by two-thirds vote of the
Authority Board, after notice to all cities and the County. The Plan must be reviewed
and renewed or amended every ten years, at a publicly noticed hearing.
The Authority will provide public information including an annual budget, and an
annual report stating the revenues collected; the expenditures by programs, including
distribution of funds within each program and administrative costs; accomplishments
and benefits realized by the programs; and proposed projects for future funding.
If a majority of the voters voting on the Measure vote “Yes,” the Measure and the
fee will be approved.

Vote Yes on Measure W to provide Safe Routes to Schools. Measure W will fund
programs that help children travel safely to school. Our children go to school to
learn, but too many of them face dangerous and even sometimes deadly trips to
school. Measure W will help get children to school in a safer manner.
Vote Yes on Measure W to preserve and expand bus service in Sonoma County.
Measure W will provide needed funding to keep buses running and expand routes
including commuter service to help get cars off the road and relieve traffic during
some of the worst traffic time periods of the day.
We support Measure W because it will provide much needed local funding for critical projects, programs and it will help our local economy. The best part of Measure
W is the money can’t be taken away by Sacramento. Every dollar of Measure W
money that is dedicated to programs in Sonoma County will stay in Sonoma
County. Please Vote Yes on November 2nd to fix our roads and keep our county
moving.

REBUTTAL TO ARGUMENT IN FAVOR OF MEASURE W
Don’t be fooled by the misleading ballot argument in favor of Measure W. The list of
so called benefits is nothing less than typical political pandering. It promises additional spending for projects that you are already paying a sales tax for through the
passage of Measure M.
The proponents of Measure W don’t even bother to explain why they need more
money so soon after the voters approved Measure M just six years ago.
The provision to allocate funds for potholes only arose after a special interest group
did some poling that showed little interest by voters in the bike or bus projects.
Again, Measure M had sales tax money set aside for pothole repairs.
Buses are running at a fraction of their capacity and yet the County wants more
buses. Non governmental organizations are doing a great job of providing transportation services to seniors.
The proponents indicate the best part of this Measure W is the money can’t be
taken by Sacramento. What they don’t tell you is with the passage of State Proposition 22 this fall, Sacramento will not be able to take transportation funding away
from local governments.
It is particularly interesting to note that the Citizens Advisory Committee to the
Sonoma County Transportation Authority advised against this measure, but the
County went ahead with it anyway.
What is being proposed is a permanent new tax to deal with a temporary revenue
problem. Voters should see through this charade and vote no on Measure W.

ARGUMENT AGAINST MEASURE W

When is enough, enough? Voters passed Measure M, a quarter cent sales tax, to
increase funds for transportation as recently as 2004. Now, a mere 6 years later
they’re back asking for more, and in the midst of recession of historic proportions
that finds families and business across the county struggling with their own
budgets.
What’s being proposed here is a permanent new tax, to deal with a temporary problem.
True, revenues for transportation projects that flow from sales tax receipts and
from the State and Federal governments may be reduced now due to the recession, but that will pass when the economy recovers.
The Sonoma County Transportation Authority tries to justify this ill conceived tax by
earmarking most of the funds for bicycle and walking paths, bus transit and of late
pothole repairs. We would hardly argue that these transportation activities are not a
good thing, but the real question to ask ourselves, is this the time to further burden
motor vehicle owners with an additional tax that has no expiration date?
Here is a fact to think about. The Sonoma County Transportation Authority’s Citizen Advisory Committee voted not to place this Measure on the ballot. Apparently
the committee’s recommendation was ignored by the powers that be. The Sonoma
County Taxpayers’ Association recommends a no vote on Measure W.

I.
Title
This ordinance shall be known as the “Sonoma County Transportation Improvement Measure.”
II.
Purpose
Pursuant to California Government Code section 65089.20, the Authority hereby
authorizes the placement of a majority vote ballot measure before the voters of
Sonoma County to authorize a ten dollar ($10) increase in the fee for motor vehicle
registration. If approved, the fee would be imposed in perpetuity for transportationrelated projects and programs in Sonoma County that provide a benefit to or
otherwise have a relationship with the persons who will be paying the fee and that
are consistent with the regional transportation plan adopted pursuant to California
Government Code section 65080. The Board of the Authority hereby adopts a
Vehicle Registration Fee Expenditure Plan (“Expenditure Plan”) attached hereto
and incorporated herein, allocating the revenue from the fee to transportationrelated programs and projects that provide a benefit to or have a relationship with
the persons who pay the fee. The Expenditure Plan shall be attached to the
measure to be approved by the voters.
Expenditure Plan programs and projects include but are not limited to those that
have the following purposes:

Voting Yes on Measure W means investing locally in efficient, accessible, green
transportation solutions for all Sonoma County residents, whether you drive, ride
public transit, travel by bike, walk or use some combination.

Voting Yes on Measure W means not relying on the state to meet our most urgent
transportation needs. Our local Sonoma County Transportation Authority has a
proven record of success in using our transportation dollars wisely on the projects
that are most important to us and provide the greatest value.
III.
The previous measure approved by voters —Measure M in 2004— allowed us to
dramatically improve our quality of transportation. This measure widened and improved Highway 101, including upgrading interchanges up and down the County. It
improved and maintained local streets and roads, and supported transportation
programs for seniors and the disabled.

Each registered motor vehicle driven on the streets and highways of
Sonoma County contributes to congestion. Traffic congestion occurs when the
number of vehicles using a transportation facility exceeds the capacity of that facility. Individual drivers contribute to congestion in the following ways:
Based on the information presented to the Authority at a duly noticed public
hearing, the Authority makes the following findings:

The record is clear: Local funding has positively transformed how we get to work
and school, and how we visit family and friends. Measure W will continue our record of success — following a transparent process, revenue from Measure W will
stay in Sonoma County and be used for our local priorities.
Please join us and Vote Yes on Measure W to ensure we can continue to meet our
local transportation needs and priorities by reducing traffic congestion and getting
you where you need to go.

Public health impacts: increased stress and air quality related health
impacts.
Emergencies: congestion may interfere with the efficient and timely
deployment of emergency vehicles and services.
Spillover traffic from highways and main arterials to secondary roads
and side streets: can have local safety and quality of life impacts.

The programs, services and projects to be funded by the fee will partially
mitigate the effects of traffic congestion and congestion induced pollution, and
will produce a benefit to the vehicle owners subject to the fee by reducing commute
time, decreasing individual auto related expenses, and improving air quality
through reduced pollution. Studies indicate that reducing congested roadway
traffic volumes even 5% can reduce travel delay by 10-30%. Increased transit and
bicycle/pedestrian use take an estimate of 1 vehicle off the road for each bike

Contract with Department of Motor Vehicles
The Authority shall contract with the Department of Motor Vehicles to collect the
Fee imposed pursuant to California Government Code section 65089.20 upon the
registration or renewal of registration of a motor vehicle registered in the County,
except those vehicles that are expressly exempted under this code from the payment of registration fees, pursuant to California Vehicle Code section 9250.4 as
approved by the voters of Sonoma County.
VI.
Use of Proceeds
The proceeds of the Fee governed by this ordinance shall be used solely for
the programs and purposes set forth in the Expenditure Plan and for the administration thereof. The Authority will administer the proceeds of the Fee to carry out
the mission described in the Expenditure Plan. The Authority will attempt to maintain geographic equity in the allocation of funds over successive five year periods.
Pursuant to California Government Code Section 65089.20, not more than five
percent of the Fee shall be used for administrative costs associated with the programs and projects, including the amendment of the Expenditure Plan.
Reduced delay, and improved productivity and economic efficiency
Increased travel reliability
Reduced fuel consumption and vehicle maintenance costs
Improved air quality
Reduction in greenhouse gas emissions
Improved public health
Better provision of emergency services
Reduced impacts to local neighborhoods from spillover traffic
Pursuant to California Vehicle Code Section 9250.4, the initial setup and programming costs identified by the Department of Motor Vehicles (Department) to collect
the Fee upon registration or renewal of registration of a motor vehicle shall be paid
by the Authority from the Fee. Any direct contract payment with the Department by
the Authority shall be repaid, with no restriction on the funds, to the Authority as
part of the initial revenue available for distribution. The costs deducted pursuant to
this paragraph shall not be counted against the five percent administrative cost
limit specified in California Government Code Section 65089.20(d).

This program would also provide funding for improving, maintaining and
rehabilitating local roads. Fee payers benefit from having roadways safely maintained and operating efficiently. It is difficult for vehicles and bicycles to safely
negotiate poorly maintained roadways (i.e., low pavement quality, faded striping,
signal operation problems, debris on shoulders). Programs that improve local road
operations benefit the fee payer by identifying and mitigating recurring congestion
problems.
The costs of placing the measure authorizing imposition of the Fee on the ballot,
including payments to the County Registrar of Voters and payments for the printing
of the portions of the ballot pamphlet relating to the Fee, advanced by the Authority,
shall be paid from the proceeds of this Fee, and shall not be counted towards the
five percent limit on administrative costs. The costs of preparing the Expenditure
Plan, advanced by the Authority, shall be paid from the proceeds of the Fee subject
to the five percent limit on administrative costs. At the discretion of the Authority,
these costs may be amortized over a period of years.

The cost of the programs and projects listed in the Expenditure Plan equal or
exceed the anticipated revenue to be raised by the fee. The projects and programs
to be funded by the fee increase have a relationship or benefit to the persons who
will be paying the fee. Based on the facts set forth below, the congestion relief and
air quality improvement benefits to each motor vehicle owner are predicted to
equal or exceed the per vehicle annual fee.
The economic benefit of reduced congestion can be calculated using the following
methodologies:
DELAY: The U.S. Federal Highway’s Administration currently estimates that each
hour of delay (time spent traveling under congestion) costs us roughly $12.
Sonoma County currently experiences 53,226 hours of delay each day (estimated
financial cost $638,712/day or $233 million/year). A reduction of 1138 hours/day
(2% reduction) in daily delay would provide a congestion reduction benefit equal to
or exceeding the $10 per vehicle per year proposed fee.
TRIPS: Congestion reduction benefits per reduced automobile-mile are estimated to be worth roughly $0.25 per mile during urban peak hour conditions. The
average trip length in Sonoma County is 13.08 miles per trip, therefore each vehicle
trip reduced would save all county commuters roughly $3.27. A reduction of 4,176
trips from the 1,720,290 current Sonoma County daily vehicle trips (or a 0.24% reduction in daily vehicle trips) will provide a congestion reduction benefit equal to the
$10 per vehicle per year proposed fee. 200,798 daily trips are currently made using
transit or non-motorized modes. The additional 4,176 trips would represent a 2%
increase in transit or non-motorized trips.

The programs and projects to be funded by the fee are consistent with the
regional transportation plan adopted pursuant to Government Code section 65080.
IV.
Duration of the Fee
The Fee, if so approved, would be imposed annually unless repealed.
The proceeds of the Fee shall be spent only inside the limits of Sonoma County.
None of the proceeds, outside of the costs incurred by the Department of Motor
Vehicle to collect the fee, shall be taken by the State.
VII.
Implementing Agency
The Sonoma County Transportation Authority (“Authority”), pursuant to California
Government Code Section 65089.20, shall place a majority vote ballot measure
before the voters to authorize a $10 per year increase in the motor vehicle registration fee. If so approved, the Authority will collect and administer the Fee in
accordance with this Ordinance and the Expenditure Plan.
VIII. Amendments to the Expenditure Plan
It is expected that the Expenditure Plan will be amended from time to time. Amendment to the Expenditure Plan shall be approved by a two-thirds vote of the Authority.
All jurisdictions within the County will be given a minimum of 45 days notice and
opportunity to comment on any proposed Expenditure Plan amendment prior to its
adoption.
A required review and renewal of the Expenditure Plan will be performed every ten
years. Staff will prepare a draft Expenditure Plan, a public hearing will be held and
the Authority will adopt a new plan by a two-thirds vote. Unless and until a revised
Expenditure Plan receives support by two-thirds of the Authority the previous
Expenditure Plan will remain in effect.
IX.
Severability
If any provision of this Ordinance or the Expenditure Plan or the application
thereof to any person or circumstance is held invalid, the remainder of the Ordinance and the Expenditure Plan and the application of such provision to other
persons or circumstances shall not be affected. If any proposed expenditure

Senator Loni Hancock (Oakland). The Sonoma County Transportation Authority

Statutory Authorization and Requirements
The statute requires that the Fee collected be used only to pay for programs and
projects that bear a relationship or benefit to the owners of motor vehicles paying
the Fee and be consistent with a regional transportation plan. The Fee will be imposed on each annual motor-vehicle registration or renewal of registration in
Sonoma County occurring on or after six-months following the November 2, 2010
election, where the measure was approved by the voters, for an unlimited period,
unless otherwise terminated by the voters of Sonoma County. To implement this
Fee, the statute requires the governing board of the Authority to adopt an Expenditure Plan. The statute also requires the ballot measure resolution be approved by
majority vote of the Authority members at a noticed public hearing.

A.
Purpose of the Expenditure Plan
The Sonoma County Vehicle Registration Fee Expenditure Plan (Expenditure
Plan) will guide the annual expenditures of the funds generated by a $10 per year
vehicle registration fee (Fee), if approved by voters in the November 2010 election.
Sonoma County has very significant unfunded transportation needs, and this Fee
would provide funding to meet some of those needs. It is expected that this Fee will
generate approximately $5 million per year.
Programmatic Expenditures
The Expenditure Plan identifies three types of programs that will receive funds
generated by the Fee. Below are descriptions of each program and the percentage
in parentheses of the annual revenue that will be allocated to each program after
deducting for the Authority’s administrative costs. The Authority will program funds
to specific projects within the three categories every three years on a competitive
basis, countywide, unless stipulated otherwise in the Expenditure Plan. This effort
will seek geographic equity over successive five year cycles. The first programming process will begin upon approval of ballot measure and conclude by July 1,
2011.
The goal of this Expenditure Plan is to support transportation investments in a way
that sustains the County’s transportation network and reduces traffic congestion
and vehicle-related pollution. The Fee would be a key part of an overall strategy to

Pothole Repair, Complete Streets and New Technologies (23%)
This program would provide funding to improve, maintain and rehabilitate local
roads, bikeways and traffic signals. It also would incorporate the “complete streets”
practice that makes local roads safe for all modes, including bicyclists and pedestrians, and accommodates transit. This program would also improve the performance of road, transit, pedestrian and bicyclist technology applications, and would
accommodate emerging vehicle technologies such as electric and plug-in-hybrid

The Authority will provide annual financial projections for budgeting purposes and
will adopt an Annual Budget each fiscal year that will include projected Fee revenue,
other anticipated funds and planned expenditures for programs and administration.
The Authority will draft an Annual Report, which will be made available to the public
and will include the following:

Safe Routes to School Program (12%)
This program would seek to reduce congestion through bicycle and pedestrian
safety programs for teens and children; carpool programs at schools throughout
Sonoma County and other related programs or projects that reduce trips to schools
and promote transportation safety. Projects eligible could include:

Programs aimed at increasing the number of children walking and biking to school.
Provide classroom lessons to teach children the necessary skills to
navigate safely through busy streets and to persuade them to be active
participants in the program.
Establish an education and encouragement program that offers
events, contests and materials to encourage children (and parents) to
walk and bicycle.
Create programs and incentives for carpooling and transit.
Transit for Congestion Relief Program (60%)
This program would seek to make it easier for drivers to use public transportation,
make the existing transit system more efficient and effective, and aid in mobility for
critical populations such as students and seniors. The goal of this program is to
decrease automobile usage and thereby reduce both localized and area-wide
congestion and air pollution. Each Sonoma County based bus operator will receive
its population share of funding on an annual basis and can use those funds on eligible projects such as:
