UHAB Member News Winter 2016| Issue 59 Para español vuelta a la página 9 THANK YOU! This year is off to a productive start for UHAB, on the heels of a particularly eventful 2015. Thanks to dedicated building residents, generous funders, and tireless UHAB staff, last year we assisted, trained, and insured more HDFCs than ever, as we helped preserve these co-ops and keep them affordable. We also educated many members of tenant associations on battling displacement and fighting for their housing rights in their changing neighborhoods. And, in our nationwide exploration designed to help expand best practices, we identified and mapped more than 200,000 affordable apartments in some 3,000 sharedequity co-ops. In New York City, we helped residents transform their distressed rentals into seven new HDFC co-op developments, while two more projects prepared to begin renovations. For people interested in becoming homeowners, we conducted frequent Introduction to Limited-Equity Co-ops workshops, creating a rich pool of qualified applicants for vacant affordable apartments. Our TIL/HDFC/ANCP team continued to provide management guidance and technical assistance to hundreds of buildings in Manhattan, the Bronx, and Brooklyn. Co-op Preservation staff expanded their services to HDFCs and prevented the foreclosures of five struggling co-ops by helping them secure millions of dollars in lowinterest loans to cover overdue property taxes and water/sewer charges. Hundreds of affordable co-ops kept their operating costs in check by enrolling in UHAB’s Fire and Liability Insurance Plan and receiving free heating fuel. We look forward to continuing, strengthening, and expanding our partnerships with residents and other affordable housing advocates throughout the city and across the country. ∆ JOIN UHAB’S SHAREHOLDERS FORUM MANHATTAN: Wednesday, February 17, 2016 UHAB Harlem Office 2023 Lexington Avenue 6:30-8:00 pm ∆∆ BROOKLYN: Wednesday, February 24, 2016 Brooklyn Law School 1 Boerum Place 6:30-8:00 pm UHAB Member News - Winter 2016 HDFCS ARE HERE TO STAY On December 8th, HDFC shareholders and affordable housing advocates packed the meeting room at the Adam Clayton Powell State Office Building in Harlem for a special briefing on converting limited-equity co-op buildings to market-rate housing. Erica F. Buckley, Bureau Chief of the Real Estate Finance Bureau of the Office of the New York State Attorney General, explained that “HDFCs’ sole corporate purpose is to develop a housing project for persons of low-income,” according to the Private Housing Finance Laws passed more than 40 years ago. Contrary to popular belief, HDFCs cannot be sold to private developers or otherwise converted to market-rate housing. The proceeds of any sale, like all other assets of the HDFC, must be used exclusively for the HDFC, not for the benefit or profit of any private individual, firm, corporation, or association. This is good news for HDFC shareholders, because this law ensures the permanent existence of HDFCs. Shareholders are not allowed to sell their HDFC buildings and thereby dissolve these valuable sources of affordable housing. Just as your HDFC was there when you needed it, future low- and moderateincome households will have the same opportunity to live in an increasingly expensive city. But why, then, some audience members asked, had some Mitchell-Lama buildings been converted from affordable co-ops to market-rate housing? Buckley highlighted the difference between an HDFC and a Mitchell-Lama housing company: Mitchell-Lamas were created by private companies, and therefore can be converted to free-market housing. HDFCs, on the other hand, fall under Article XI, which does not allow amendments to p. 2 | www.uhab.org the HDFC certificate of incorporation to change the HDFC into another type of entity. Because of Article XI, once a building is established as an HDFC, it will remain an HDFC—its status will not change or expire. The only way to convert an HDFC to market-rate ownership requires complex legal action, the permission of HPD (which the city says they will not grant), and numerous statutory hurdles. After Buckley’s presentation, Manhattan Borough President Gale Brewer also vowed to fight for shareholders who are struggling in their HDFCs and to help preserve this affordable co-op housing model. HPD and the Attorney General’s office have moved HDFCs to the top of their agenda for 2016 and will be expanding their enforcement of the law, in order to stop any illegal sales of buildings. RESIDENT SPOTLIGHT: JOANNA PAULINO, FROM TENANT LEADER TO UHAB ORGANIZER Joanna Paulino has occupied her fourth-floor Bronx apartment in Hunts Point with her six children for more than seven years. During her time there, the building has racked up 142 housing code violations in its 35 units. Tenants have had problems ranging from electrical fires and inconsistent heat to rat infestations and contaminated water that made people sick when it wasn’t boiled. Paulino learned about the Urban Homesteading Assistance Board when UHAB Tenant Organizer Elise Goldin came to the building in 2012 to form a tenant association. UHAB worked with the tenants to try to force the landlord to make repairs, but Stabilis Capital, the private equity group that owned the building, was more interested in selling the building to a new owner for profit than making repairs. In 2014, a real estate company headed by Joel Shafran became the new owners of the building. Horrific conditions in the building still persist and the landlord uses vacant apartments as scatter shelter sites for homeless people under a city program that gives high rent payouts. The conditions have driven most tenants away, leaving only 10 units occupied. Continued on page 5 UHAB Member News - Winter 2016 IS ILLEGAL SUBLETTING HAPPENING IN YOUR BUILDING? Your HDFC should have a sublet policy outlining how and when shareholders can sublet their apartments, but sometimes this policy can be misunderstood or misused —or missing. Having a clear policy in place for your building ensures that no shareholders break the law and that available units of affordable housing aren’t being used inappropriately and kept off the market. The board of each HDFC co-op has the power to set this policy while operating within the law and governing documents of the corporation. To know if shareholders have the option to sublet their apartments, you must educate yourself and examine your HDFC’s proprietary lease. If subletting is permitted in your building, make sure that the policy is being implemented correctly. It should take into account the board approval process, the maximum number of apartments that shareholders can sublease at one time, your building’s income caps (which must be verified for both new shareholders and those subletting), any surcharge paid to the co-op, the maximum percentage above maintenance that can be charged for the sublet, a primary residency clause, the maximum length of a sublet, and any other restrictions. The HDFC should uphold the purpose of providing longterm affordable housing to people with lower incomes. This means that your HDFC cannot be used as a bed and breakfast with companies such as Airbnb, since each short-term renter would have to verify low enough annual income. If you suspect that there might be unlawful subletting in your building, arm yourself with clauses from WE CAN WORK IT OUT! THE GREEN WORKER COOPERATIVES’ CO-OP ACADEMY As shareholders in HDFCs, when we hear the word co-op we usually think about housing. The cooperative model, however, is present in other areas of our lives as well. The Green Worker Cooperatives’ Co-op Academy, for example, brings cooperation into our communities through business. The Co-op Academy offers a unique, free of charge, 19-week cooperative business boot camp that teaches entrepreneurs how to share ownership of a business with all of its workers. Participants receive business coaching by experienced entrepreneurs as well as coursework in your governing documents and any subletting policy. If there are violations and nothing is being done about them, the most important thing for your board to do is establish a paper trail: written correspondence with the violator explaining what your Certificate of Incorporation and Proprietary Lease state, outlining evidence of the specific breaches of the governing documents, and noting the consequences of not complying, such as lease termination. If you are unable to resolve the situation through board correspondence or with a coalition of concerned shareholders, you may need to initiate a lawsuit. FREE SMOKE AND CARBON MONOXIDE DETECTORS Are residents of your HDFC co-op building interested in participating in a life-saving initiative to install brand new, state-of-the-art smoke and carbon monoxide detectors? Did we mention that it’s FREE? In the wake of recent fatal fires in New York City, FDNY and the American Red Cross have launched a program to educate NYC residents about fire safety and prevention and install up to 100,000 smoke and carbon monoxide detectors for free in the five boroughs over the next two years. UHAB is currently enrolling interested HDFCs with the Red Cross to outfit each apartment with a detector, in every sleeping area and common area. FDNY and the Red Cross know from experience that simply handing out alarms to residents does not guarantee that the alarms will be installed. In order to ensure that the detectors are installed immediately, UHAB is asking that your co-op board and your building’s super (if your HDFC has one) work with us to install these free alarms. If you or your super are unable to install alarms yourself, the Red Cross will work with you to provide volunteers for installation and education. All buildings will also receive educational materials for each resident regarding fire safety and emergency preparedness. Signing up for this important program is easy. First, discuss the initiative with your board and fellow shareholders. If the building decides to participate, elect a primary contact person who will handle communication with UHAB and the Red Cross. This person should contact Member Services Director Emily Ng (212 4793318 or [email protected]), or Kyla Alterman (212 479-3337 or [email protected]) and provide his or her full name, building address, cell phone number, email, and the number of units in the building. Indicate whether or not you have a super and select one or more available timeslot: weekend morning (9am-1pm), weekend afternoon (1pm-5pm), weekday morning (9am-1pm), weekday afternoon (1pm-4pm), weekday evening (4pm8pm). Once you contact Emily or Kyla with this information, UHAB will submit an application on behalf of your HDFC to the Red Cross. Shortly following the submission of your application, a Red Cross representative will call your primary contact and work out the logistics of when and how alarms will be installed throughout your HDFC. ∆ WANT TO LEARN MORE ABOUT CONNECTED BOOKS? RESIDENT SPOTLIGHT: JOANNA PAULINO Continued from page 2: Now Paulino is not just working as a tenant advocate in her building but as an employee of UHAB’s Organizing & Policy department. Her decision to leave her job at a senior center for people with Alzheimer’s to come work for UHAB was based on her experiences with UHAB as a tenant. “Tenants that need help want to work with people they can trust and rely on. I wanted to be part of that,” Paulino said. “Being active in my building was a great experience, but I knew there were other buildings out there dealing with the same if not worse issues than my building. I’ve noticed how much I enjoy helping tenants and supporting them when they are being harassed by the landlord.” Paulino has her work cut out for her in her own building. She is determined to form a strong tenant association so that residents can effectively join forces. Her main concern is that the landlord is offering tenants money to move out of the building. She speculates that, as in many other buildings, this landlord wants more vacant units to use as lucrative homeless shelters. Those tenants who have not accepted a buyout from the landlord have been suffering terribly, as repairs aren’t made and living conditions continue to decline. The situation is especially troubling for the sick and disabled seniors in the building. During future tenant association meetings, Paulino plans to discuss with her fellow tenants ways they can fight their landlord, such as 311 complaints, a group Housing Parts Action to force the landlord to make repairs, and to go through Article 7A Proceedings in New York City Housing Court and ask HPD to take over the building from the landlord. Durante su tiempo allí, el edificio tenía más que 142 violaciones de la ciudad en los 35 departamentos. Inquilinos han tenido problemas como fuegos de electricidad, calefacción inconsistente y agua contaminada que puede enfermar a los que lo beben sin hervir. requiere acciones legales, el permiso de HPD (cual la ciudad dice que nunca lo concedería), y numerosos obstáculos de estatutos. Estas condiciones ya han empujado mucho de los inquilinos a salir del edificio, dejando solo 10 departamentos ocupados. Su edificio tiene que tener un póliza de Alguiler para y cuando un Accionista pueda rentar su apartamento, pero a veces la póliza puede ser mal interpretada o mal usada, o perdida. Teniendo una póliza clara en su edificio asegura que ningún Accionista rompa las leyes y que los apartamentos sigan a precios módicos y no a precios de mercado. La Directiva que esta gobernando cada HDFC tiene el poder de adactar una ley a los documentos de la Corporación. Para saber si el Accionista tiene la opción de rentar sus apartamentos, usted tiene que ser educado y examinar sus contractos de HDFC de Propiedad. Si el rentamiento es permitido en sus edificios, este seguro que la ley este implementada correctamente. Tiene que tomar en cuenta la provatoria de la Directiva y el máximos de apartamentos que los Accionista pueden rentar al mismo tiempo, más la restricción de ingresos (en cual los nuevos Accionistas y los rentadores tienen que ser verificado), además algún extras pago a la Corporación, el máximos porcentaje arriba del mantenimiento que dé debe ser cargado por renta su apartamento, una clausula residencial, el máximo tiempo de rentamiento y de cualquier otras restricciones. Los HDFC tienen el propósitos de ofrecer un largo-tiempo de hogar accesible para la personas con bajos ingresos. Estos significa que los HDFC no pueden ser usado como “Cama y desayuno” con compañía como Airbnb, por poco tiempo rentamiento que debe ser verificado como ingreso anual. RECIBA SU ALARMA ¡ GRATIS DETECTORES DE HUMOS Y MONÓXIDOS DE CARBÓN Leer sobre cómo se puede con seguir detectores de humo y monóxido de carbón de último modelo GRATIS para sus HDFC. Después de recientes incendios fatales, el Departamento de Bomberos de la Ciudad de Nueva York (FDNY) junto con la Cruz Roja Americana lanzo una iniciativa que salva vidas en Nueva York para instalar hasta 100,000 detectores de humo y monóxido de carbón gratis en los cinco distritos durante los próximos dos años. La FDNY y la Cruz Roja saben por experiencia que no es suficiente distribuir detectores a residentes sino que hay que asegurar que los detectores están instalados en el apartamento. Por eso, en esta colaboración se le pide la ayuda de su súper de su HDFC que trabaje con UHAB para instalar los detectores gratis, y simplemente documentar la colocación de los detectores en las unidades con formularios proveídos por la Cruz Roja. Si usted o su súper no estén disponibles a instalar los detectores, es posible que la Cruz Roja puede proveer voluntarios para la instalación y educación. Como parte de este programa la Cruz Roja proveerá residentes en su HDFC con doble detectores de humo y monóxido de carbón gratis que dura 10 años (precio de venta de $49). La instalación de detectores en cada apartamento incluirá uno por cada cuarto de dormir y uno en la área común. Todos los edificios también recibirán materiales educativos para la prevención de incendios y la preparación de emergencia para cada residente. Su decisión de dejar su trabajo en un centro para personas mayores con Alzheimer para trabajar con UHAB fue basado en sus experiencias con UHAB como un inquilino. “Inquilinos que necesitan ayuda quieren trabajar con personas con quien ellos pueden confiar y respetar. Yo quería ser parte de eso,” dijo Paulino. “Organizar a mi edificio fue una experiencia buena para mí, pero yo sé que hay otros edificios que están viviendo con los mismos (o peores) problemas que el mío. Su preocupación mayor es que el dueño está ofreciendo dinero a inquilinos para salir del edificio. Ella cree que él quiere tener más unidades vacantes para poder rentarlos a la ciudad en donde se puede ganar más dinero. Los inquilinos que no han aceptado este “soborno” están sufriendo, sin reparaciones y viviendo en condiciones que continúen empeorar. El situación es especialmente alarmante a los personas mayores y los con discapacidades en el edificio. Durante reuniones del asociación de inquilinos en el futuro, Paulino planea discutir manaras para que todos pueden pelear con el propietario, como llamar a 311 para quejar de los condiciones, ir a la corte para forzar que el dueño hace los reparaciones, y para tratar a empezar el Artículo 7A procedimiento en el NYC Housing Court para que HPD se encargue del edificio. Los accionistas tienen mucho que hacer. Además de presupuestos ajustados, tienen que estar al tanto del mantenimiento y las reparaciones. Tienen que ahorrar dinero para renovaciones capitales. Tienen que seguir las reglas y regulaciones sobre las reuniones y las elecciones que mantengan su HDFC elegible para los reducciones de impuestos y otros subvenciones estatales que ayudan a asegurar que sus hogares sigan siendo asequibles. Por décadas, los residentes de cientos de cooperativas HDFC se han beneficiado del apoyo y orientación del equipo de Co-op Preservation en UHAB. Sea ayudando a los líderes en edificios con la preparación de presupuestos, solicitudes para préstamos, o con la supervisión de elecciones, UHAB ha ayudado a HDFCs en toda la ciudad a reforzar sus cooperativas o mantenerlas fuertes.
