Los turistas de los Estados Unidos Canadá y Europa solo necesitan un pasaporte para estadías de hasta 90 días en Panamá. Si quieres quedarse mas tiempo puedes salir del país por tres días y regresar por otros 90 días o consultar el Ministro de Inmigración. Para todos los demás países es mejor contactar a su embajada o consulado sobre los requisitos. También hay una nueva ley no que no permite turistas en Panamá con pasaportes que tienen fecha de expiración en los próximos 3 meses. Revise su pasaporte bien o no podrás entrar a Panamá. La ley Panameña también requiere que siempre lleve algún tipo de identificación consigo en Panamá. Puede ser una licencia de conducir—necesita tener su foto en ella. Debido a que muchos latinoamericanos están intentando trasladarse a Panamá, la policía algunas veces piden identificación a los turistas. No necesita llevar su pasaporte, pero para evitar problemas es mejor tener consigo una fotocopia de su pasaporte, la página de su foto y la página donde esta marcada la fecha de su entrada. Si sus hijos están viajando con solo uno de los padres, se requiere una nota de permiso notariado del otro padre – ¿Necesito tener alguna vacuna? Que tal los mosquitos? No necesitas ninguna vacuna o inyecciones para visitar Panamá. Aunque no lo creas, es probable que no vayas a ver ni un mosquito en todo su viaje. Panamá es un país tropical, pero su control sobre los mosquitos es muy efectivo. A menos que estés en la selva durante la oscuridad o en áreas remotos, no necesitará preocuparse. ¿Como es el clima? Panamá tiene dos climas—las tierras bajas que incluye la Ciudad de Panamá, que son tropicales y húmedos, y las tierras altas que tienen temperaturas de primavera todo el año. En las tierras bajas las temperaturas durante el día usualmente están entre 80F-90F. Se hace mas fresco en las tardes que son muy agradables. En las tierras altas la temperatura está entre 50F-85F. Panamá también tiene dos temporadas—la temporada seca y la temporada de lluvia. La temporada seca toma plazo entre Diciembre hasta Mayo y la temporada de lluvia para el resto del año. La temporada seca significa que casi nunca llueve, mientras que la temporada de lluvia significa una lluvia casi todos los días en la media tarde. Casi nunca llueve todo el día, así que no arruinará su viaje. La excepción es Bocas del Toro y Boquete donde hay mucha lluvia. En Bocas del Toro puede llover todo el día y en Boquete entre Septiembre y Octubre hay mucha lluvia también. ¿El agua es potable? Hay algunas preocupaciones sanitarias? Comparado con otros países latinoamericanos, Panamá tiene condiciones sanitarias excelentes. Es el único país con agua potable (menos en las islas de Bocas del Toro). La “Venganza de Montezuma” que es tan común en otros países es muy rara en Panamá. La moneda oficial es el Balboa pero en Panamá se usa el dólar Estadounidense como moneda circulante gracias a un acuerdo internacional entre ambos países. Eso significa que el país tiene baja inflación y es mas estable que otros países con monedas que cambian de valor muy rápidamente. Cajeros automáticos y tarjetas de crédito info Usted puede obtener dinero en efectivo en su cuenta en un banco extranjero en los cajeros automáticos. Tarjetas de crédito son aceptadas en los hoteles, los mejores restaurantes y de las principales tiendas de la ciudad de Panamá. Fuera de la Ciudad de Panamá, usted necesitará dinero en efectivo. ¿Qué tipo de ropa y cosas debo traer conmigo? En general, para una clima tropical, evite colores oscuros. Use ropa de algodón livianos para estar cómodo y trate de vestirse bien, ya que los panameños aprecian a las personas bien vestidas. Las tierras altas pueden ser frías, así que traiga un sweater o chaqueta liviana. Si planeas hacer caminatas traiga pantalones largos, botas, un sombrero y repelente para mosquitos. Es un buena idea también traer bronceador, lentes de sol y binoculares. ¿Cuánto debo dar como propina en Panamá? 10% es normal y algunas veces se incluye en la cuenta, así que revísalo primero. No necesitas dar una propina a los taxistas, pero será muy apreciado si lo haces. ¿Es seguro conducir en Panamá? Puedo hacer una vacación de volar/conducir? Si, especialmente afuera de la Ciudad de Panamá. El tráfico en la Ciudad de Panamá es caótico y complicado—aquí recomendamos usar los taxis hasta que conozcas bien su camino en la ciudad. Hay muchos taxis en la ciudad, pero asegúrese solo tomar taxis amarillos con un número oficial. También puede haber tranques vehiculares en las mañanas y tardes. Pero afuera de la Ciudad de Panamá, Panamá tiene unas de la infraestructuras mejores en Latinoamérica. La Carretera Panamericana, la carretera principal que cruza todo Panamá, es 50% hecho de una carretera moderna de cuatro vías. Hay carreteras menores a todos los destinos principales desde este carretera. Las estaciones de gasolina de estilo americano y restaurantes de comida rápida están disponibles en todo la carretera. El aeropuerto doméstico de Panamá esta en Albrook, unos 15 minutos del centro de la ciudad, y 45 minutos del aeropuerto internacional de Tocumen. INFORMACIÓN DE VISITAS ¿Cuál es el numero de teléfono para información turística? Llama a 178, los operadores hablan inglés, español, francés y portugués. Ellos le asistirán si tienes algún problema, como un pasaporte perdido o un robo, pero también tienen información turística en general. ¿Es seguro Panama? Si, Panamá es uno de los países latinoamericanos mas seguros. Crímenes contra los turistas son algo muy raro. Sin embargo, como en cualquier ciudad grande, use el sentido común. No esté solo en áreas pobres en la noche. En la ciudad, solo use taxis amarillos con números oficiales o un taxi afiliado con su hotel. No tengas grandes cantidades de efectivo en su persona ni enseñes a todo el mundo su Rolex nuevo. La única excepción de seguridad es la Ciudad de Colón, donde es mejor ir con un guía a la Zona Libre solamente. También necesitas tener cuidado en la región de la provincia de Darién que es frontera con Colombia, no es ideal para turistas. Tiene la segunda economía mas libre en Latinoamérica (después de Chile), una infraestructura de carreteras y telecomunicaciones de primer mundo, el dólar americano como moneda principal, un centro bancario internacional impresionante, la Zona Libre más grande de las Américas, y una posición geográfica sin igual con varios centros de transportación logísticos. Si el aeropuerto internacional tiene vuelos directos a 56 ciudades en la región. Hay leyes que dan incentivos de impuestos y laborales a centros corporativos. El gobierno también ha creado una zona económica especial donde una nueva ciudad se esta construyendo—Panamá Pacifico, con incentivos de impuestos grandes para negocios y permisos gubernamentales rápidos. Caterpillar, Dell y 3M ya están aquí. La Ciudad de Panamá es unas de las ciudades mas seguras en Latinoamérica con una de las capitales mas modernas y atractivas para extranjeros. Varios inversionistas pequeños y grandes te pueden decir que ha sido un placer trabajar con la clase empresarial de Panamá, muchos que han sido educados en los Estados Unidos o trabajaron en la antigua zona del canal. ¿Cuál es el voltaje de la electricidad? No más de una empresa puede presentar en un solo espacio , sin el permiso escrito de Promociones Yachting , Inc. No hay bienes o productos que no sean los fabricados o vendidos en el curso normal de los negocios será ostentado tanto por expositor . 5 . VENTA DE MERCANCÍA Se permite que la venta de determinados productos para su entrega durante el Salón . Este programa se puede controlar con reglas estrictas , incluyendo el inventario mínimo y los controles periódicos de exposiciones por Promociones Yachting , Inc. Los barcos y otros objetos grandes no se incluirá en este programa. Los expositores que deseen participar están sujetos a las condiciones de la página . 6 . BOOTH EXPOSICIONES Estándar Cabina 10 x 10 Booth ( 3,00 x 3,00 metros ), 2,44 " de altura , blanca Faja con número de stand y nombre de la empresa hecha en negro corte de vinilo (tipo medio Helvetica, 10.5" de altura . Incluye 1 mesa rectangular con falda azul marino , negro 3 sillas de vinilo , 1 toma de corriente , 1 lámpara Slimeline , un cesto de basura y un pequeño refrigerador. Un paquete Stand 20 x 20 ( 6,00 x 6,00 metros ) incluye todos por encima de 10 x 10 , más una mesa rectangular adicional, 3 sillas adicionales, 1 de aluminio taburete alto y 1 mostrador con paneles blancos , con puertas y cerradura. 7 . TIERRA Y GRANEL EXPOSICIONES Los barcos y los remolques deberán estar dentro de los límites de su espacio. Barcos o motores que sean descargadas, deben ser colocados con el equipo apropiado para asegurar la seguridad del público y su empresa. Yachting Promotions , Inc. no tendrá ninguna responsabilidad con respecto a este procedimiento. EN-AGUA EXHIBE Servicio de electricidad está disponible para cada resbalón como se muestra a través de la Marina de Flamenco. 9. LUZ Y ENERGÍA Se proporcionará suficiente iluminación para la iluminación general de toda la zona de Show. 10. CUIDADO Y EL PERSONAL DE EXPOSICIONES Yachting Promotions, Inc. se encargará de la limpieza de tienda y área de exhibición general. INSTALACIÓN Y EXTRACCIÓN DE PRUEBAS DOCUMENTALES Todas las exposiciones deben ser eliminados de acuerdo con el calendario de avería. Cualquier exhibición o barco no se elimina en forma oportuna serán retirados y almacenados a cargo del expositor . La puesta a punto y la descomposición horarios que se señalan en este Manual del Expositor deben cumplirse estrictamente para la seguridad y comodidad de todos los expositores y la presentación oportuna de la Feria. Por favor, preste especial atención a la programación en lo que respecta a su exhibición . Montaje y desmontaje de las exposiciones se harán a expensas del Expositor . Servicio Forklift / Crane estará disponible a petición con antelación. Las solicitudes de servicios especiales se deben hacer por escrito al menos quince ( 15 ) días antes de la inauguración . Una mesa de servicio se establecerá durante el periodo de instalación para recibir los pedidos de los servicios especiales necesarios para coordinar las actividades de todo el personal de servicio. Un Set -up oficial estará a su disposición para ayudar a los expositores durante el periodo de instalación . 12. CREDENCIALES DE EXPOSITOR Las credenciales se emitirá trabajar exhibición personal previa solicitud por escrito por el representante de exhibir en los formularios. Hay un límite en el número de credenciales que permiten a un expositor. Las credenciales no se estrenará hasta han realizado todos los pagos de espacio. Las credenciales se quedarán en la oficina de credencial para recoger arriba. 13. EXHIBICIONES EN ÁREAS DE ESTACIONAMIENTO Embarcaciones, remolques y otras exhibiciones de producción no se permiten en las áreas de estacionamiento durante las horas de espectáculo. 14. CUMPLIMIENTO DE LA ORDENANZA Toda la ciudad, estado y Federal leyes y reglamentos todo eléctrico, fuego y Departamento de salud deberán ser observadas por todos los expositores. 15. HORAS DE EXPOSICIÓN ABSOLUTAMENTE DESMONTAJE DE CUALQUIER PARTE DE CUALQUIER EXPOSICIÓN NO SERÁ PERMITIDO ANTES DE 30 MINUTOS DESPUÉS DEL CIERRE DEL SHOW. Descarga ilegal de aguas residuales de los buques está sujeto a multas rígidas y repercusiones. Debe ser retirado del sitio por un transportador de residuos Anchique: Achique aguas residuales y aguas "grises" que no está contaminado con aceite, combustible, o otra regulada mediante la contención, puede descargarse en las aguas superficiales o en tierra. Regulaciones federales, estatales y locales prohíben la descarga de aguas residuales de la sentina y "gris" de agua contaminado por aceite, combustible o otro regulado de la contención. Propietarios de barcos será responsables de cumplir con estas regulaciones. Los recibos deben conservar para su inspección. Limpieza a presión: El uso de agua alta o baja presión, equipos de limpieza para el enjuague inicial de un buque arrastrado del agua es aceptable. Sin embargo, acumulada algas, ostras o percebe acumulación debe ser correctamente recogida y desecharse en la basura normal. El uso de este equipo para quitar la pintura inferior de cascos se limitará a un área con una superficie impermeable, donde las aguas residuales deberán ser contenida, recogidas y tratadas para quitar pintura sólidos para cumplir con los estándares de alcantarillado sanitario. Si no se cumplen las normas, más tratamiento será necesario antes de la descarga de las alcantarillas sanitarias. Lavado a mano por encima de la línea de flotación: Detergentes y limpieza compuestos usados en el lavado de embarcaciones deberán ser biodegradables. Las aguas residuales generadas por barcos de lavado a mano no se considerarán un "residuos industriales" o "otros residuos" como definido en el capítulo 24. Lijado de casco o Topsides con herramientas eléctricas: Instalaciones permitidas deberán establecer y hacer cumplir sus propias reglas con respecto a la utilización del poder lijar herramientas. Sin embargo, el polvo de lijado generado por esta actividad debe ser arrastrado y eliminado con el regular de basura y no puede ser descargada intencionalmente en un desagüe pluvial o en las aguas superficiales. Gasolina de residuos: Deben guardarse en un recipiente no-escaparse o resistentes superficial y cubierto para evitar que el agua de lluvia en el contenedor. El contenedor debe ser claramente etiquetado "gasolina de residuos" y la ubicación de almacenamiento debe cumplir con los códigos locales de fuego. Cada vez, posible residuo gasolina será filtrado y utilizado como combustible. Residuos gasolina no se ultimará en el suelo, vertederos, o a las aguas superficiales. Residuos gasolina debe ser retirado del sitio por un transportador de residuos permitido para manejar este producto de desecho y los recibos deben conservarse para su inspección. Residuos de Diésel, keroseno y alcoholes minerales: Estos debe ser almacenados en contenedores no-escaparse en una superficie impermeable y cubiertos para evitar que el agua de lluvia penetre en el contenedor. Cada envase debe ser claramente etiquetado con su contenido. Las ubicaciones de almacenamiento deben cumplir con los códigos locales de fuego. La eliminación de estos residuos debe ser por un transportador de residuos permitido para manejar esos desechos, y los recibos deben conservarse para su inspección. Productos residuales del petróleo no será la descarga a tierra, vertederos o a las aguas superficiales. Grasa: Habrán recogido y grasa derramada o residuos en el contenedor de residuos de aceite. Los residuos que quedan en el suelo pueden ser absorbidos con "derrame seco" o un producto similar y desecharse con la basura normal. We appreciate your cooperation in its implementation, disregard to same, shall cause possible reprimands, fines and depending on the seriousness of the events, may cause the expulsion from our premises and possibly the involvement of authorities, if deemed necessary, to safeguard the proper functioning and uninterrupted provision of our services, as well as to ensure the peace, security and well-being of our customers and visitors. REGULATION OF FLAMENCO MARINA DOCK SECURITY Our facilities are spacious, thus we require the collaboration of all our customers and visitors to report any anomaly in terms of security, to have discretion at the moment of entering the docks and allow the Security Team to carry out their work with due respect; Remember, that they are taking care of you, your family, guests and goods. We will appreciate not to mediate in disadvantages in the routine checks performed by the security team to your crew or contractors, reporting the authorizations that allow members of your crew or contractors to remove values or goods belonging to you from your yachts and, to the extent possible, be specific regarding said permission. 1. All boats shall operate under International Maritime laws. 2. The maximum speed permitted in the Marina will be 5 mph. 3. All boats must be: a. Properly tied, securely to your dock. b. In optimal conditions. The boat that is not working properly must be notified to the Marina Supervisor in charge. The Marina, at its discretion, may move it to any other dock, if deemed necessary. 4. Flamenco Marina has a zero tolerance policy towards pollution. The Panamanian Environmental Government Entities continuously monitor our Marina, by applying strict standards against pollution. All violations will be reported to the regulatory entities. 5. It is not allowed: a. To light any type of fire, fireworks, barbecues and grills on the docks, or on yachts within the facilities of the Marina or on the grounds of Isla Flamenco. b. To swim, dive or fish within the Marina. c. To download sewage in the Marina, or in the Bay of Panama. This will cause for sanctions of up to US$1,000. Before entering the Marina, retention tanks must be closed to avoid any accidental discharge. The boat, which has no retention tanks, shall notify this at the Marina’s Office. d. To perform the following works on the docks: Maintenance of outboard motors, corrective maintenance (overhaul) to generators and main engines, welding jobs, removal of propellers, change of anodes, sanding and painting, application of solvents, washing and cleaning of filters, or grinding works. e. To keep tanks or other recipients with fuel or lubricants on the docks. Refusal to remove them, or not notifying the Supervisor on duty of the disposal of these substances, will allow the Marina to report to the Office of the Captaincy of the Maritime Authority of Panama and the Authorities of the Panama Canal, on the imminent risk of pollution and neglect of this point, so that these authorities may take appropriate actions and implement its opinions and additional sanctions that Flamenco Marina disposes of (see the Waste section in this document). f. Trespass the doors towards the Docks without proper authorization. g. To neglect the calls of attention and requests for collaboration of the Security, Marina or Maintenance personnel on the compliance of the provisions of this Regulation. 6. Those who violate the above mentioned regulations would be subject to fines as pre-established in Annex-A. For your Security and control of the movement of your yacht, we have included in your monthly statement, a detail of the entries and exits of your yacht, to your Marina. attention to the provisions mentioned above, damages caused by exceeding the amperage, by failure to disconnect the connection prior to yacht’s exit, or due to collision, will beassumed by the owner of the yacht. If it is not possible to be repaired, you will have to assume the cost of replacing the pedestal, plus any additional cost for its installation. This cost will be reflected in the monthly billing and is not covered by the maintenance fee. WASTE Fuerte Amador Resort & Marina, maintains a policy of ZERO tolerance in terms of pollution, which must comply with the regulations and standards and are aware of the importance of caring for our surroundings and the environment. 1. All foreign garbage (waste) must remain on board until the authorities or the authorized company may dispose of them. Local waste should be deposited in the containers found on the docks. 2. To dispose of the used/burned oil, you must contact the Marina´s Supervisor to do so. The cost of the reception of these oil substances is A DOLLAR ($1) per gallon; the Marina reserves the right to change this fee, which would be notified. You will not be exempt from payment due to lack of knowledge of this notification, we urge you to seek advice prior to requesting this reception service. 3. The management and disposal of these products is the responsibility of the owner of the boat, indiscriminately the maintenance and handling of these substances is done by your crew or by any technical service hired to do so. 4. Similarly, the yacht’s crew must do the handling and disposal of used filters; it is forbidden to incorporate that waste with the garbage. 5. It is not allowed to keep tanks or other type of oil containers (new or used) on the docks. 6. The owner shall be responsible for all costs related to the removal and cleaning of any kind of spill (oil or diesel) that unduly occurs by your handling, or your crew, contractor, representative and/or visitors of your boat. The Marina will charge US$1,000 for the cleaning. If there is any authority involved such as AMP, ACP and OCP the Owner shall assume any expenses that those entities dictate, in addition to our charge. 7. The non-compliance of the above mentioned provisions is subject of fine by the environmental authorities and the Marina. 8. Should you have knowledge of any spill or pollution, you must notify same to the Marina´s Supervisor, the Marina’s Office or to the Control Tower. FUEL For your convenience and the good performance of your engines, Flamenco Marina only uses the best low-sulfur fuel available in Panama, a periodical cleaning to our tanks is carried out by our supplier, same is verified daily to detect if there is water in them and controls are kept during the processes of reception in the tanks. 1. All supplies of fuel must be carried out on the docks assigned by the Marina. It is strictly forbidden: a. The transfer of fuel from one yacht to another boat or container. b. Carry fuel out of the premises in containers. c. Smoke or ignite fire in the area near to the service pier and during the fuel provision process. 2. The Marina must authorize the cleaning of the fuel tanks. 3. The containers used for shipping fuel must be properly designed and certified for these effects. 4. The boat owners are responsible of their vessel´s fuel-loading operation. The Marina will not be liable for any spill, for overfilling fuel or oil in a boat, for whichever the reason. 5. The Marina will penalize any irregularities in the handling of fuels, with fines starting at US$1,000. 6. Boats must use their time efficiently in the Fuel Dock, in order to allow other boats to fuel up. 7. All engines must be turned off during the supply process. 8. During provision operations the following must be taken into account: a. Only the operator of the boat must remain on board. b. The owner or boat captain shall handle the fuel hose. c. All hatches, doors and others must be closed during the bunkering operation, to avoid fumes to enter the boat. d. Simple Green is the only biodegradable detergent, authorized by the authorities, to clean possible spills on deck. GENERAL RULES 1. All boats must: a. Be safe and in good condition in order to be admitted at the Marina. No boat will be allowed access without prior authorization and reservation. b. Go to the Marina Office and sign the "License Agreement" or Entry Contract, with the exception of boats that only come to stock up on fuel or other services, or to embark / disembark passengers. Any boat that has not signed a Contract will be charged double the visitor’s rate and may be removed, at the owner’s expense. c. Report your entry and exit on VHF Channel 10 to the Control Tower. d. Turn off the Radar equipment with in the Marina. 2. All boats intending to stay at the Marina must submit their registration documents and valid insurance policy. The insurance policy must include coverage for damage to third parties. 3. When a boat with permanent contract leaves Flamenco Marina facilities for more than 30 days, it must notify the Marina’s Office previously, in writing. During this period, the customer becomes inactive and the Marina will not debit any dock charges for a maximum of thirty (30) days; Right after this period, the boat will return to its active status, in our system. During said period of absence, the Marina will use your space. The maintenance fee is not subject to such considerations and will be charged from the initial date of the Contract. 4. In case of a fire, leakage, or any emergency, the Marina shall take all necessary measures, including boarding the boat to inspect same, with or without the Owner’s permission. The Marina may solve the problem right away, but all the expenses incurred, shall be borne by the owner of the boat involved. 5. Any changes to the docks are forbidden, or their extensions, except those authorized by the Marina. If an improvement is authorized, it cannot be removed. 6. No vessel may be used for business or advertising within the Marina, without the prior authorization from the Marina’s Administration. Advertising, posters, printed propaganda, etc., is not permitted on the docks, without permission from the Marina. 7. Trailers that are not under contract will not be allowed. Trailers abandoned for more than seven (7) days may be sold and shall remain under the Marina’s Administration. 8. All boats shall be subject to inspection by the Marina’s staff before occupying its assigned dock. 9. All boats must be properly insured and the Marina should be included in the insurance as "Additional Insured ". The Marina must have a copy of the valid insurance policy, and it is mandatory to comply with Fuerte Amador Resort & Marina’s terms and conditions in this regard. 10. It is not allowed: a. TO SUB-LET THE DOCKS. b. To fillet or flake fish on the Marina. This prohibition includes the docks or inside the yachts, on the grounds of the Marina. c. Store "dinghies" or any other equipment in the hallways. d. ONLY ONE BOX (DOCK BOX) IS ALLOWED per boat. 11. The boat owner must pre-pay their stay and comply with all regulations. 12. Any boat owner who has a claim must submit it in writing to the Marina Office. 13. When assigned to your dock the boat’s owner or captain is responsible for said space and if any failure or irregularity is found same must be notified in writing to the Marina’s Office. Maintenance will make all arrangements; if necessary, otherwise the Marina will not be responsible for any claim or damages caused. 14. All boats at the Marina are subject to inspection, at any given time, with prior permission of the boat’s owner or captain for: (a) health, navigable conditions and security; (b) be boarded for inspection in any emergency, either by government authorities and/or the General Manager of Fuerte Amador Resort & Marina, Manager of the Marina or the Marina Supervisor. 15. The commercial operation of boats or "Charters" both for permanent customers, as well as guests in transit are subject to regulations that includes: a. The prior written approval of the Marina’s Administration. b. Verification of the boat’s state. c. Compliance with the Marina’s operational safety measures. d. The registration of each passenger personal data. e. A charge for usage of the docks and fees per passenger are established, which must be canceled before commencing any activity. For information on these charges and current tariffs please contact the Marina’s Office. 16. Marina crew will give their support when there is bad weather or during any emergency, however it is the responsibility of the boat’s Captain or Owner to take charge of the boat’s security or remove any belongings, if necessary, as well as, to move to another location if the Marina’s crew so requests. RIGHT OF ADMISSION Dear clients and visitors, we hope you understand that this is a Private Marina, that the security of your boat, the belongings on same, your own wellbeing and that of your family and guests, depend on your collaboration in controlling who are allowed to access this, your Marina. Flamenco Marina reserves the right of admission. Similarly, we request your cooperation in enforcing the Regulations of this Marina, to maintain the cordiality and good behavior and paying particular attention to the following provisions: 1. Yacht owners are responsible for the behavior of their guests, children and pets. Pets should have their leash while within the grounds of the Marina and will be allowed only if they do not bother. Each owner must collect its pet’s waste. 2. The boat’s owners must provide the Marina’s Office with a list of its staff and those living onboard, as the crew and people allowed onboard whenever the owner is not on the boat. All crew or employee shall leave the docks no later than 6:00 pm. 3. Access to the docks for staff living onboard (overnight) the yachts shall be until the deadline, 12:00 am. 4. After 6:00 pm the entry of visitors that have not been previously notified by the boat’s owner to the Marina’s office, will be restricted. The owner or a member of the yacht’s crew must accompany these guests during their entry and exit from the facilities. 5. Persons and visitors at night must inform their details and provide their personal identification to the members of Fuerte Amador Security staff, for their proper registry in the logbook. 6. Noise should be controlled to a minimum and not disturb other guests. 7. Each owner is entitled to one (1) free parking per boat and will be given a coded card for this purpose. The Marina is not responsible for any valuables left in the vehicle. The Marina will issue one pass per boat. 8. All external service or hired personnel MUST REGISTER WITH THE MARINA’s OFFICE IN ORDER TO BE ABLE TO ACCESS THE DOCKS and must abide by the rules of the Marina. The boat owner must communicate in advance to the Marina’s Office, in writing, detailing the date, type of work and the name of the contractor authorized to access your boat; if possible ask your contractor the details of all people who will have access to your boat. The contractor must submit a copy of this communication to the Marina so that the corresponding day passes are issued. 9. For access to employees or contractors, day passes will be issued, and its issue personalized, which means that the person authorized in the communication must be present in person and the employee or contractor’s data will be verified against the identity documents submitted. 10. Work authorization will be exclusively for the boat applicant, if the staff is found on another yacht, it will be ordered to leave the premises immediately and a record of this anomaly will be made for future actions, where lockout could even be considered. 11. Any contractor working without carrying the corresponding provisional entry pass will be removed from the premises and a fine of $100 will be imposed. Imposed fines, which are not canceled immediately by the contractor personnel will be reflected in the monthly statement of the boat that required the services. 12. Cards or Magnetic Access Control Passes are assigned exclusively to the boat’s owner, authorized family members and his crew (Captain and Boat Crew), they must be requested at the Marina’s Office. The person registered as the boat owner is the only person authorized to apply for these access cards. These cards ARE NOT TRANSFERABLE, they are part of a control system that records the date and time of entry / exit of those registered in the database systems; Any irregularity detected by misuse of this device, (ie. lending it to an unauthorized person) will be penalized by the Marina’s Office with fines starting from $100. The card used irregularly may be seized, and even suspended indefinitely for the same reason. Should this measure be implemented due to security reasons, access shall be by way of day passes, which cost shall be covered by the user. 13. The following provision applies for the entry of contractors or workers: The Access Control Card is designed to facilitate the entry of the bearer; Groups are not allowed to enter using a single card. Obviously, this does not apply for owners’ guests. 14. Fuerte Amador Security staff will periodically check passes, both the Magnetic Access Control as well as day passes issued to contractors. 15. Paint jobs, major motors or generators repairs are not allowed on the docks. Only minor repairs in order to ensure the proper functioning of the boat are allowed. All owners or other persons working on the boat should perform its regular maintenance in such a manner not to cause damage, or contamination to the Marina’s facilities. Failure to comply with these regulations may be penalized by the General Manager or the Manager of the Marina in their sole discretion. 16. Noise should be controlled. The use of machines, generators, radio and television, by the owners, employees, visitors and staff should not disturb others. 17. The transient boats should prepay their stay or may not be allowed on the Marina. 18. The boat owner acknowledges that the Marina have developed a family atmosphere, and is therefore responsible that guests, captain, crew and contractors behaves always in a respectful manner. It is unacceptable to be intoxicated, or behave in a immoral, aggressive, threatening, or abusive manner within the premises of the Marina. All the staff at Fuerte Amador and Flamenco Marina, should be treated with respect and any instruction given by the Marina and security personnel should be complied with at all time. HELP US SERVE YOU BETTER At Flamenco Marina, we strive to provide the best service possible to our customers and their boats, training our staff in the operational area and treatment with due courtesy to you, your guests and contractors. We would appreciate your keeping this document on your boat, should you require another original; just ask for it, we will gladly provide you with another. By this way your crew will be instructed of our procedures. Likewise, we appreciate your keeping your accounts current and avoid incurring in charges for late payment, so that we may provide you with our uninterrupted services. Note that in our permanent leases (Prepaid or Monthly), default is defined as "the delay in the payment of their accounts in 90 days ", for the purpose of terminating the relationship. However, Fuerte Amador Resort & Marina, will carry out all administrative steps to suspend your benefits and services as from a 60-day delay in paying your bills. Administrative Actions: 1. Two months delinquency in the payment of any account: The 2 months delay in canceling any service account: electricity, maintenance fees or other, will lead to the deactivation of the magnetic access cards. We will not prevent your access, but your intended entry to the docks should be reported to the Marina’s Office, in order to purchase a day pass per person. This applies to owners, guests and crew alike. 2. Three months delinquency in the payment of any account: in addition to the above mentioned measures, the provision of fuel will be suspended, or sale of ice, deactivation of the SPOT satellite messages service assigned by the Marina and charge of the equipment. Likewise, we will alert the Captaincy of the Port of Panama of the Maritime Authority of this irregularity. 3. Delinquency for 4 months and more: the provisions agreed to in the TWELFTH clause of the Dock Lease Agreement will come into effect, with regard to the termination of the contract by the Lessor and if necessary any required legal action will be taken. MARINA POLICIES WITH REGARD TO THE MEASURE OF THE YACHT 1. Flamenco Marina uses as reference for defining the cost per footcharge, the maximum length of each yacht, this includes removable items from stem to stern, including those that do not affect the buoyancy of the boat. 2. It is the Marina's prerogative to take as valid the measures the ACP uses for the vessels crossing the Panama Canal. 3. The Marina’s Administration may, when it deems appropriate, confirm the size (LOA – Length Over All) of the boat, measuring from the end points from stem to stern, including the pulpit up to the platform, to determine the correct boat measurement and applicable to economic conditions for the rental of docks. The Supervisors’ Chief and the boat owner or captain shall sign a record of the data. ANNEX A 1. Fines related to the withdrawal of tanks or containers of pollutants left on the docks, cleanup of oil spill, or any waste caused by the owner, crew, mechanic, contractor, agent, visitor of your boat, will cost US$1,000. If the regulatory authority imposes any sanction to the boat, it shall bear all expenses incurred and that of any other entity which provide support in the removal of pollutants or cleaning up of spills. 2. Penalty for sewage discharge at the Marina and its surrounding, US$500. 3. Make sure the gate is closed when entering or leaving the docks, otherwise you will be fined US$50. 4. Speeding ticket, over 5 MPH, US$50. 5. Misuse of the Magnetic Access Card: a. The first time for US$100. b. The second time for US$500. c. The Marina Office may, at any time, seize the card and suspend its benefits, due to violation of the security measures and controls intentionally. 6. General Rules violation, Right of Admission # 18: a. For the first time US$50. b. The second time US$150. c. The third time, the boat will be expelled from the Marina and moneys paid in advance will not be refunded. OPERATION HOURS 1. The Marina OPERATES 24/7. The Marina is staffed seven days a week, 365 days a year. 2. Fuel service operates from 7:30 am to 6:00 pm, seven days a week. 3. The administrative schedule of the Marina is from Monday through Friday from 7:00 am to 6:00 pm and Saturday and Sunday from 7:00 am to 4:00 pm. 4. The term CUSTOMER refers to any party who contracts for services with SMCS. SMCS RESPONSIBILITIES SMCS shall be responsible only for those services which it directly provides, and hereby agrees to execute its contractual duties in good faith. SMCS assumes no responsibilities for any persons, parties, or other contracting firms not under SMCS’s direct supervision and control. SMCS shall not be responsible for loss, delay, or damage due to strikes, lockouts, work stoppages, natural elements, vandalism, acts of God, civil disturbances, power failures, acts of terrorism or war, or any other causes beyond SMCS's reasonable control, or ordinary wear and tear in the handling of materials. SMCS shall not be liable to any extent whatsoever for any actual, potential, or assumed loss of profits or revenues, or for any collateral costs which may result from any loss or damage to an exhibitor's material which may make it impossible or impractical to exhibit same. INSURANCE It should be clearly understood that SMCS is not an insurer. Each CUSTOMER should arrange complete risk coverage for the value of said freight/equipment through endorsements to existing policies, insuring the exhibit material from the time it leaves their facility until it is returned. It should be further understood and agreed that SMCS does not provide for full liability, should loss or damage occur. Should SMCS incur a liability, it shall be limited to the specific article which is lost or damaged, and in any event, the maximum liability shall be limited to $ .30 per pound per article with a maximum liability of $50.00 per item, or $250.00 per shipment, whichever is less. CLAIM(S) FOR LOSS CUSTOMER agrees that any and all claims for loss or damage shall be submitted to SMCS prior to the conclusion of the show when alleged loss or damage occurred prior to that time, and in all cases within 30 days of the conclusion of the show. For claim reporting purposes, the "conclusion" of the show shall be construed as the end of the day on which CUSTOMER must vacate the show site. All claims reported after the 30 day period will be rejected. PAYMENT FOR SERVICES MAY NOT BE WITHHELD In the event of any dispute between the CUSTOMER and SMCS relative to any loss or damage claim, the CUSTOMER shall not be entitled to, and shall not withhold payment for SMCS services as an offset against the amount of the alleged loss or damage. Any claim against SMCS shall be considered a separate transaction and shall be resolved on its own merit. INDEMNIFICATION CUSTOMER agrees to indemnify, forever hold harmless and defend SMCS and their employees, officers, and agents from and against any and all claims, causes of action, fines, penalties, damages, liabilities, judgments, and expenses on account of personal injury or death, damage to or loss of property or profits arising out of, or contributed to by any of the following: CUSTOMERS negligent supervision of any labor secured through SMCS or the negligent supervision of such labor by any of the CUSTOMER'S employees, agents, representatives invitees, and/or any CUSTOMER appointed contractor (EAC). CUSTOMER'S negligence, willful misconduct, or deliberate act, or such actions of CUSTOMER'S employees, agents invitees, representatives or EAC's at the show or exposition to which this contract relates, including but not limited to the misuse, improper use, unauthorized alteration, or negligent handling of SMCS equipment. SMCS shall not be responsible for concealed damage, damage to carpets in bags or damage to materials improperly packed. SMCS shall not be responsible for crates and packaging which are unsuitable for handling, including but limited to crates made from compressed particle board, partially assembled, or having prior damage. INBOUND SHIPMENTS Consistent with trade show industry practices, there may be a lapse in time between the delivery of shipment (s} to the booth and the arrival of the CUSTOMER or their representative. During such time, the materials will be left unattended. SMCS is not, and cannot be, responsible for loss; damage, theft, or disappearances of CUSTOMER'S materials after same have been delivered to the CUSTOMER'S booth at the show site. SMCS shall not be liable for shipments received without receipts, freight bills, or specified unit counts on receipts of freight bills, such as UPS, Fed Ex, Van Lines, etc. Such shipments will be delivered to booth without guarantee of piece count or condition. Further, the CUSTOMER agrees, in connection with the receipt, handling, temporary storage, and reloading of the freight, that SMCS and its affiliates will provide these services as CUSTOMER'S agent and not as bailee or shipper. Bills of lading or delivery slips indicating number of pieces, description of merchandise, material estimated value, and weight are required for all shipments. In the event no weight is indicated on delivery documents, SMCS will estimate the weight if no actual scale weight is provided prior to the close of the event. This estimated weight will be final and binding. OUTBOUND SHIPMENTS SMCS will have bills of lading and labels available at the Service Desk. NO SHIPMENT WILL BE LOADED WITHOUT A BILL OF LADING. Once materials have been labeled, packed, and ready to be shipped, completed bills of lading should be turned in to the Service Desk. Consistent with trade show industry practices, there may be a lapse of time between the completion of packing and the actual pick up of CUSTOMER'S materials from the booth for loading onto a carrier or container. During such time, the materials will be left unattended. SMCS shall not be responsible for loss, damage, or theft of materials loaded after the show. All materials will be checked at the booth at the time of loading using document(s) submitted to SMCS by the CUSTOMER. Notations of exceptions to conditions of materials, or piece counts will be on the form submitted by the CUSTOMER. Exhibitors selecting carriers other than SMCS will need to make their own arrangements for pick up. SMCS will not release any shipment to any carrier until the CUSTOMER has provided a completed bill of lading to the service desk. In the event a carrier arrives at show site with their own bill of lading, SMCS will not honor the paperwork unless and until the CUSTOMER has completed a standard bill of lading provided by SMCS or written instruction from the CUSTOMER indicating the pick-up is acceptable. SMCS assumes no responsibility for loss, damage, theft, or disappearance of CUSTOMER'S materials after the same have been delivered to CUSTOMER'S appointed carrier or agent for transportation after the show. SMCS loads materials onto the carrier's truck under the supervision of the carrier's driver who checks and assumes custody of materials; SMCS assumes no liability for any materials after carrier assumes custody of materials. If CUSTOMER'S designated carrier fails to show by the move-out deadline after a show, SMCS shall have the authority to route CUSTOMER'S shipment via return shipment to SMCS warehouse in Ft Lauderdale, Florida for disposition at CUSTOMER'S expense. Materials left behind without orders at the service desk will be classified as abandoned. SMCS shall not be responsible for same. SMCS is not responsible for any delay of rush shipments. While rush shipments will be expedited to the best of our ability, we will not assume any financial responsibility for shipments which do not arrive at their destination at a dated time. Materials returned to warehouse where no disposition is made by the CUSTOMER or for pick up by a chosen carrier, the CUSTOMER agrees to be responsible for a return freight charges when this service is necessary. Materials will be held in storage until payment is made.
