She comes to school everyday. She is super happy, caring, compassionate and completely optimistic,” said Julie Mahoney, physical education teacher at South Street Elementary, Castle Rock. Bianca Gamez is now too sick to go to school. In January 2005, Bianca had a relapse and the ten-yearold is dying of leukemia. Her only hope of recovery is to receive a bone marrow transplant “She’ll need a transplant to save her life, but her family is poor and doesn’t have insurance,” said Brenda Smith, founder and president of Compassion for Kids. “Without money, there will be no transplant.” It’s a lot of money, a seemingly insurmountable fortune of up to a million dollars. But that does not deter those who love and care for Bianca. Her parents are ranch hands and they have received many generous offers of help. Compassion for Kids and South Street Elementary School are organizing fundraising events including a sponsored Run for Bianca, which will take place on May 14. Money is one thing but the challenge is two fold. Firstly, Bianca needs a suitable donor and that search is not easy. Matching donors to a patient is like trying to win a lottery. “Without a bone marrow match, there is nothing doctors can do,” Smith said. Chances would be improved if more Hispanics were registered as possible donors and Smith encourages the local community to volunteer for a blood test to see if there is a suitable match. “She’s an incredible girl, she is sharp and intelligent. She loves computers and math,” said Smith. “Her eyes just shine.” Brenda Smith founded Compassion For Kids in 2002 after her five-year-old daughter Chelsea was diagnosed with leukemia. Suthers advised consumers who have used credit cards to make purchases at DSW Shoe Warehouse stores since October 2004 to contact their credit card issuers immediately. DSW’s parent company, Retail Ventures, Inc., announced yesterday that certain personal financial information of its customers has been compromised. DSW has six stores in Colorado (Littleton, Westminster, Cherry Creek, Broomfield, Lakewood, and Colorado Springs). Suthers also called on DSW to immediately contact each Colorado consumer that is affected, and to inform them of the breach and urge them to review their credit card accounts and credit reports for suspicious activity. “I am extremely concerned about the recent wave of security breaches that have affected consumers’ personal and financial information,” said Suthers. “I am encouraged that DSW has disclosed the unauthorized access to sensitive customer records, and I call on the company to notify every affected Coloradoan as soon as possible.” According to DSW, the company has identified consumers whose credit card and other purchase information has been accessed by unauthorized third parties, and has notified affected credit card companies and banks. DSW has advised customers to call DSW’s toll-free special assistance number, 1-800-3140224, for more information. In addition, consumers should review the information on the Attorney General web page (www.ago.state.co.us)for more information on preventing identity theft and what to do if their personal financial information is compromised. Delta Dental’s smile-a-bration offers free dental care Seven dental offices in Colorado Springs will provide one day of free dental care for uninsured children in Colorado on Saturday, April 30, 2005 as part of Delta Dental’s Smile-a-bration. The statewide program, sponsored by Delta Dental Plan of Colorado, Perfect Teeth and Kaiser Permanente, will offer dental exams, cleanings, fillings, X-rays, teeth sealants, crowns and extractions to any uninsured child up to the age of 18. The appointment line will be open from March 22 to April 1 or until all appointments are filled. “This is the third year Delta Dental has been able to provide free dental care to those children who might never otherwise have the opportunity to see a dentist,” said Kate Paul, president and CEO of Delta Dental Plan of Colorado. “Last year we treated more than 3, 300 children. Unfortunately we had to turn many away because there just wasn’t enough money to take care of all the children in Colorado who need dental care. We need to identify ways to expand this important program.” Delta Dental will reimburse the 150 dentists expected to participate in the program with the exception of 18 Perfect Teeth clinics. They have agreed to donate more than $60,000 of care to the program. For the second year, Kaiser Permanente will donate its services to make appointments. In addition, participating dentists can donate their reimbursement fee to this program or to other non-profit organizations that provide dental care to the needy. Since the inception of Smile-a-bration in 2002, 330 dentists have provided free dental care to 5,600 children statewide. Delta Dental has donated more than $1.25 million to the program and participating dentists have donated $24,000 of their fees to non-profit organizations providing additional dental care to the needy. Selena Paulina Rubio Fractura en la Iglesia si el Papa renuncia, revela estudio que Wojtyla pidió en secreto Juan Pablo II encargó a finales de la década de los noventa la realización de un estudio secreto sobre la hipótesis de dimisión del “romano pontífice”, el cual resolvió que no era conveniente la renuncia Karol Wojtyla pues ello abriría un cisma en la Iglesia, se reveló ayer en el diario La Reppublica. “No es oportuno que un romano pontífice dimita”, señalaba el reporte en sus conclusiones. El documento fue encargado por el Papa al hoy extinto cardenal Vincenzo Fagiolo, quien entonces era uno de los principales expertos de derecho canónico, asegura el vaticanista Marco Politi. En el artículo del periódico italiano Politi señala que la voluntad del Papa de no renunciar a su puesto se basa más en las conclusiones de ese estudio que en su temperamento místico, que le ha llevado a decir que no dimitirá pues “Cristo no bajó de la Cruz”. Según el columnista, el reporte fue presentado al Papa el 22 de septiembre de 2000, poco antes de la muerte de Fagiolo, al que le fue encargado el estudio cuando Juan Pablo II había superado los 75 años de edad y enfrentaba crecientes dificultades por el avance del Mal de Parkinson. “En ese momento por su debilitada salud el Papa decidió enfrentar la cuestión más espinosa para quien porta el título de Vicario de Cristo: examinar el fundamento jurídico y doctrinal a una renuncia papal”, afirmó el experto. Según La Repubblica, el Papa quiso indagar más a fondo sobre la cuestión, también debido a que su predecesor Paulo VI había meditado sobre la posibilidad de renunciar por sus problemas de salud, e incluso se había preparado un retiro en la abadía de Montecassino. Juan Pablo II también pidió a Fagiolo indagar sobre la conveniencia de imponer la renuncia de los obispos al alcanzar los 75 años de edad. Sobre ese aspecto la conclusión fue: “No, un romano pontífice no puede imponer la dimisión de un obispo solamente por la edad. La obligación no tiene fundamento doctrinal, aunque el Papa puede hacer una exhortación”. Respecto a la dimisión papal, el estudio estableció que es justificada solamente en caso de demencia. Lo cierto es que a partir de entonces, en el nuevo Código de Derecho Canónico, promulgado por Juan Pablo II el 25 de enero de 1983, la dimisión papal está prevista. Estos preparadores abusivos obtienen ganancia financiera desviando una porción del reembolso de sus clientes, cobrándoles cuotas excesivas por preparar sus declaraciones. Agencias de Asesoramiento de Crédito. Los contribuyentes deben tener mucho cuidado con agencias de Asesoramiento de Crédito que prometen mejorar el estado de su crédito, que promueven contratos de pagos o les cobran cuotas demasiado altas, o les hacen cargos mensuales o ‘donativos’ obligatorios que solo sirven en aumentar su deuda. La División de Organizaciones Exentas y Entidades Gubernamentales del IRS ha hecho de la auditoria de organizaciones asesoras de crédito una prioridad porque algunas de estas organizaciones que son exentas de impuestos y cuyo propósito es educar a clientes de bajos recursos con problemas de crédito están cobrando cantidades exorbitantes sin proveer el asesoramiento prometido. 5. Doctrina del “Derecho Al Reclamo”. Deducción de “No Ganancias”. Esta estafa es similar a la ‘Doctrina del Derecho Al Reclamo’ en la cual los contribuyentes pretenden tomar el total de ingresos como gastos misceláneos en el Anexo A del formulario 1040. El contribuyente anota su ingreso bruto ajustado (AGI) bajo la sección de “Otras Deducciones Misceláneas” del Anexo A y le agrega una nota a la declaración refiriéndose a ciertos documentos en las cortes e incluye la frase ‘Ganancia No Realizada”. 7. “Corporación Sole”. However, the number of SUVs available can sometimes make finding one with the right safety features seem confusing. This auto-safety overview may help you find the right SUV for you and your family. Four-Wheel Independent Suspension This feature allows each wheel to react individually to bumps in the road and increases the chances that all wheels will remain firmly planted on the ground. For instance, the Porsche Cayenne features independent suspension at all four corners. The set-up delivers handling similar to that of a sport sedan, with precise and responsive steering that could be vital during an evasive maneuver. Page 14 17 de marzo 2005 - 24 de marzo 2005 COMMUNITY NEWS IRS announces the 2005 dirty dozen The Internal Revenue Service today unveiled its annual listing of notorious tax scams, the “Dirty Dozen,” reminding taxpayers to be wary of schemes that promise to eliminate taxes or otherwise sound too good to be true. The “Dirty Dozen” for 2005 includes several new scams that either manipulate laws governing charitable groups, abuse credit counseling services or rely on refuted arguments to claim tax exemptions. The agency also sees the continuing spread of identity theft schemes preying on people through e-mail, the Internet or the phone, sometimes with con artists posing as representatives of the IRS. “The Dirty Dozen is a reminder that tax scams can take many forms,” IRS Commissioner Mark W. Everson said. “Don’t be fooled by false promises peddled by scam artists. They’ll take your money and leave you with a hefty tax bill.” Involvement with tax schemes can lead to imprisonment and fines. The IRS routinely pursues and shuts down promoters of these scams. But taxpayers should also remember that anyone pulled into these schemes can face repayment of taxes plus interest and penalties. Persons who suspect tax fraud can call the IRS at 1-800-8290433. The Dirty Dozen 1. Trust Misuse. Unscrupulous promoters for years have urged taxpayers to transfer assets into trusts. They promise reduction of income subject to tax, deductions for personal expenses and reduced estate or gift taxes. However, some trusts do not deliver the promised tax benefits, and the IRS is actively examining these arrangements. 2. Frivolous Arguments. Promoters have been known to make the following outlandish claims: that the Sixteenth Amendment concerning congressional power to lay and collect income taxes was never ratified; that wages are not income; that filing a return and paying taxes are merely voluntary; and that being required to file Form 1040 violates the Fifth Amendment right against selfincrimination or t h e F o u r t h Amendment right to privacy. Don’t believe these or other similar claims. Such arguments are false and have been thrown out of court. While taxpayers have the right to contest their tax liabilities in court, no one has the right to disobey the law. 3. Return Preparer Fraud. Dishonest return preparers can cause many headaches for taxpayers who fall victim to their ploys. Such preparers derive financial gain by skimming a portion of their clients’ refunds and charging inflated fees for return preparation services. They attract new clients by promising large refunds. Taxpayers should choose carefully when hiring a tax preparer. As the saying goes, if it sounds too good to be true, it probably is. No matter who prepares the return, the taxpayer is ultimately responsible for its accuracy. 4. Credit Counseling Agencies. Taxpayers should be careful with credit counseling organizations that claim they can fix credit ratings, push debt payment agreements or charge high fees, monthly service charges or mandatory “contributions” that may add to debt. The IRS Tax Exempt and Government Entities Division has made auditing credit counseling organizations a priority because some of these tax-exempt organizations, which are intended to provide education to lowincome customers with debt problems, are charging debtors large fees, while providing little or no counseling. 5. “Claim of Right” Doctrine. In this scheme, a taxpayer files a return and attempts to take a deduction equal to the entire amount of his or her wages. The promoter advises the taxpayer to label the deduction as “a necessary expense for the production of income” or “compensation for personal services actually rendered.” This so-called deduction is based on a misinterpretation of the Internal Revenue Code and has no basis in law. 6. “No Gain” Deduction. Similar to “Claim of Right,” filers attempt to eliminate their entire adjusted gross income (AGI) by deducting it on Schedule A. The filer lists his or her AGI under the Schedule A section labeled “Other Miscellaneous Deductions” and attaches a statement to the return, referring to court documents and including the words “No Gain Realized.” 7. Corporation Sole. Since September 2004, the Department of Justice has obtained six injunctions against promoters of this scheme and filed complaints against 11 others. Participants apply for incorporation under the pretext of being a “bishop” or “overseer” of a one-person, phony religious organization or society with the idea that this entitles the individual to exemption from federal income taxes as a nonprofit, religious organization. When used as intended, Corporation Sole statutes enable religious leaders to separate themselves legally from the control and ownership of church assets. But the rules have been twisted at seminars where taxpayers are charged fees of $1,000 or more and incorrectly told that Corporation Sole laws provide a “legal” way to escape paying federal income taxes, child support and other personal debts. 8. Identity Theft. It pays to be choosy when it comes to disclosing personal information. Identity thieves have used stolen personal data to access financial accounts, run up charges on credit cards and apply for new loans. The IRS is aware of several identity theft scams involving taxes. If taxpayers have any doubt whether a contact from the IRS is authentic, they can call 1-800-829-1040 to confirm it. 9. Abuse of Charitable Organizations and Deductions. The IRS has observed an increase in the use of tax-exempt organizations to improperly shield income or assets from taxation. This can occur, for example, when a taxpayer moves assets or income to a tax-exempt supporting organization or donor-advised fund but maintains control over the assets or income, thereby obtaining a tax deduction without transferring a commensurate benefit to charity. A “contribution” of a historic facade easement to a tax-exempt conservation organization is another example. In many cases, local historic preservation laws already prohibit alteration of the home’s facade, making the contributed easement superfluous. Even if the facade could be altered, the deduction claimed for the easement contribution may far exceed the easement’s impact on the value of the property. 10. Offshore Transactions. Despite a crackdown on the practice by the IRS and state tax agencies, individuals continue to try to avoid US taxes by illegally hiding income in offshore bank and brokerage accounts or using offshore credit cards, wire transfers, foreign trusts, employee leasing schemes, private annuities or life insurance to do so. The IRS, along with the tax agencies of US states and possessions, continues to aggressively pursue taxpayers and promoters involved in such abusive transactions. 11. Zero Return. Promoters instruct taxpayers to enter all zeros on their federal income tax filings. In a twist on this scheme, filers enter zero income, report their withholding and then write “nunc pro tunc”— Latin for “now for then”—on the return. 12. Employment Tax Evasion. The IRS has seen a number of illegal schemes that instruct employers not to withhold federal income tax or other employment taxes from wages paid to their employees. Such advice is based on an incorrect interpretation of Section 861 and other parts of the tax law and has been refuted in court. Recent cases have resulted in criminal convictions, and the courts have issued injunctions against more than a dozen persons ordering them to stop promoting the scheme. Employer participants can also be held responsible for back payments of employment taxes, plus penalties and interest. It is worth noting that employees who have nothing withheld from their wages are still responsible for payment of their personal taxes. The IRS removed four scams from the Dirty Dozen this year: slavery reparations, improper home-based businesses, the Americans with Disabilities Act and EITC dependent sharing. The agency has noticed declines in activity in some of these schemes. But taxpayers should remain wary because the IRS has seen old scams resurface or evolve. Moreover, the IRS reminds taxpayers to be vigilant about cons that may not be on the Dirty Dozen list. Each PTK All-Colorado Team member was offered two $10,000 scholarships to attend J&W for two years. “W e want to attract the best and brightest to the university,” explained Bette Matkowski, J&WDenver president. Matkowski was formerly president of Lamar Community College, and is familiar with the All-Colorado Academic Team. “We were thrilled by this generous offer,” said Nancy McCallin, CCCS president. “These scholarships to 27 students are well in excess of half a million dollars. I am speaking of Virginia Watson and I have added her letter of complaint about a racist college professor so you can read for yourself what she says happened in a Forensic Science class that she is enrolled in. I went to a number of colleges in my life. The first was Eastern New Mexico University in Portales, New Mexico where I acquired a B.S. degree and began a career in teaching. During those years, I too ran into racist professors. But I didn’t say anything. I thought that I had to take care of my family and I had to complete my degree and that I had better keep my mouth shut. Years later, after I had earned my PhD and had achieved success in my historical field, I ran into one of those racist professors. I was at the Santa Fe Trail Conference in Hutchinson, Kansas and I was a major speaker on the program. I saw Dr. Ira Ihde and I went up to him and I said, “Dr. Ihde, I want to thank you for being so bad, because you inspired me to get into my field.” Yeah I know, that wasn’t a nice thing to say to an old retired professor, but I remembered all of his racism and his distorted view of southwestern history that I took a personal satisfaction in doing it. But, if I would have had the courage of a Victoria Watson, I would have confronted him than and perhaps generations of students who followed me would not have been fed his nonsense. Watson and I am a current freshman this semester at CSU-Pueblo. The reason for this letter is to bring to your attention a very serious occurrence regarding a faculty member. On Thursday, March 2nd, I attended Forensic Anthropology taught by Dr. Dan Forsyth. At the last twenty minutes of class, he proceeded to end our lesson to discuss a rather racial and insulting matter. He completely lashed out about the American system giving sympathy to us lazy, bitter Mexicans who don’t deserve to be here. May I point out that he did not use “illegal” or “immigrant,” he said “Mexicans.” I would like to point out that he has also blatantly thrown around the word “nigger” in our lessons. I am a minority myself and am completely disgusted and appalled. Racial and political opinions have nothing to do with anthropology. I am furious knowing that my $2,000 tuition is paying for this man to ramble about how he thinks Mexicans should go back to Mexico and how we Mexicans have raped the American system. Most importantly, this man had no point. Had it have been some sort of healthy debate I would have humored him, but instead he completed insulted every minority in the class with his ignorance. Not only that but he was yelling and using excessive profanity. After listening to his senselessness for 10 minutes, I got up to leave the class, where he proceed to point at me in front of the class and yell “Hey Screw You!” I would like to let you know that I am the only Mexican in the class so to the other students, this incident really meant nothing. Now you and I [k]now that there are very well respected Hispanic alumni, staff, and partnerships here at CSU that would seriously disagree and be outraged by these statements. I pay a lot of money to attend this institution that I thought was a place of respect and learning. I feel that his actions should not go unpunished. I bring this to your attention now so that something can be done. I would like to express to you the resentment I feel. If no action is taken, I will take this matter further and/ or public.
