The Position of Civil Society Organisations before the ruling of Uruguay’s Administrative Court The ​
Administrative Court’s ruling​
restricts the implementation of Uruguay’s abortion law (​
law number 18.987​
) by revoking the articles within its ​
Regulatory Decree​
related to conscientious objection. The Administrative Court´s interpretation of the law is the most restrictive and conservative to date in relation to women’s rights. The Court’s decision only serves to increase the barriers impeding women’s access to abortion services. Where the law claims to protect the “conscience” of a few legislators over women’s right to choose, the Administrative Court opted to favour professionals who have turned their backs on the needs and rights of women in the midst of an unwanted pregnancy. In the first two­and­a­half years of implementation of all abortion services in Uruguay, MYSU has identified, through the ​
monitoring work​
of its National Observatory on Gender and Sexual and Reproductive Health, unprecedented percentages of professional gynecologists within our country’s public health system who are conscientious objectors (92% in Salto; 87% in Paysandú; 82% in Soriano and 43% in Río Negro –up to 100% in Young and Mercedes). The Court’s ruling only reinforces one of main barriers in ensuring effective abortions in Uruguay and directly affects women living in the most vulnerable of conditions. Where complex situations have already been identified at national level in terms of the functioning of the teams responsible for abortions, the ruling will contribute to the total collapse of these services, expelling women from the health system and exposing them once more to the risks of back­street abortions. Uruguay took over thirty years to democratically resolve the issue of back­street abortions. Today, medical, political, legislative and judiciary bodies are attempting to turn the clock back by continuing to impose their own beliefs and interests over the rights of women. The female body is and will continue to be the field of an ideological battle if the overwhelming majority of men present in the medical, political, legislative and judiciary powers continue to limit the exercise of our rights as citizens.
