ACUERDO ENTRE EL GOBIERNO DE LA REPÚB LICA ARGENTINA Y EL GOBIERNO DE LA REP ÚBLICA SOCIALISTA DE VIETNAM SOBRE EL LIBRE EJERC ICIO DE ACT IVIDADES REMUNERADAS PARA FAMILI ARES A CARGO DEL PERSONAL DIPLO MÁTICO, CONSULAR, ADMINISTRATIVO Y TÉCN ICO DE MISIONES DIPLOMÁTICAS, OFIC INAS CONSULARES Y REPRESENTAC IONES PERMANENTES ANTE ORGANIZACIONES INTERNACIONALES J El Gobierno de la República Argentina y el Gobierno de la República Socialista de Vietnam, en ade lante denominados "las Partes"; Deseosos de perm itir el libre ejercicio de actividades remuneradas por parte de los fami liares a cargo de los miembros de las Misiones Diplomáticas, Oficinas Consulares y Representaciones Permanentes ante Organizaciones Internacionales de una de las Partes en el territorio de la otra Parte, Han acordado lo siguiente: Artículo 1 Los fam iliares a cargo del personal diplomático, consular, administrativo y técnico de las Misiones Diplomáticas, Oficinas Cons ulares o Representaciones Permanentes ante Organ izaciones Internacionales de una Parte en el territorio de la otra podrá n eje rcer actividades remuneradas en la Parte receptora una vez obten ida la autorización correspo ndiente de conformidad con las dispos iciones del presente Acuerdo. J Artículo 2 Para los fines del presente Acuerdo, por "familiares a cargo" se entiende: a) el cónyuge; b) los hijos solteros menores de 21 años a cargo de sus padres o menores de 25 que cursen estudios a tiempo completo en instituciones de educación superior de nivel terciario , y e) los hijos solteros que tengan alguna discapacidad física o mental y estén a cargo de sus padres. Siempre que dichas personas formen parte del grupo familiar del personal diplomático, consular, administrativo y técnico de Misiones Diplomáticas, Oficinas Consulares o Representaciones Permanentes ante Organizaciones Internacionales. Artículo 3 J No habrá restricciones respecto de la naturaleza o clase de actividad que podrá desempeñarse. Se entiende, sin embargo, que en el caso de las profes iones o actividades en que se requieran cualificaciones especiales, será necesario que los familiares a cargo cumplan con las normas que rigen el ejercicio de dichas profesiones o actividades en la Parte receptora . Asimismo, la autorización podrá ser denegada en aquellos casos en que, por razones de seguridad , solo puedan contratarse nacionales de la Parte receptora. Artículo 4 Las solicitudes de autorización para ejercer actividades remuneradas serán presentadas por la respectiva Misión Diplomática, Oficina Consular o Representación Permanente de la Parte acreditante mediante Nota Verbal a la autoridad competente del Ministerio de Relaciones Exteriores de la Parte receptora (en el caso de la República Argentina, la autoridad competente será la Dirección Nacional de Ceremonial , y en el caso de la República Socialista de Vietnam, la autoridad competente será el Departamento de Protocolo del Estado). Dicha solicitud deberá acreditar la relación de parentesco del beneficiario con el funcionario del cual es persona a cargo y proporcionar información detallada de la actividad remunerada que el beneficiario desee realizar (nombre del solicitante, nombre y domicilio del empleador y descripción de la actividad a realizar). Una vez que se haya verificado que la persona para la cual se solicita autorización se encuentra dentro de las categorias definidas en el presente Acuerdo, la autoridad competente del Estado receptor informará en forma inmediata y oficial a la Misión Diplomática , Oficina Consular o Representación 1 Permanente de la Parte acreditante que el familiar a cargo ha sido autorizado a trabajar con sujeción a las normas pertinentes de la Parte receptora. Artículo 5 Los familiares a cargo que gocen de inmunidad de jurisdicción en virtud de la Convención de Viena sobre Relaciones Diplomáticas del 18 de abril de 1961 y la Convención de Viena sobre Relaciones Consulares del 24 de abril de 1963, o en virtud de la Convención sobre los Privilegios e Inmunidades de las Naciones Unidas del 13 de febrero de 1946 o cualquier otro instrumento internacional que hayan obtenido empleo con arreglo al presente Acuerdo no gozarán de inmunidad civil ni administrativa respecto de las acciones deducidas en su contra en relación con las actividades remuneradas o los contratos directamente relacionados con el desempeño de tales actividades, y quedarán sujetos a la legislación y a los Tribunales de la Parte receptora en relación con dichas actividades. Artículo 6 J En caso de que un familiar a cargo goce de inmunidad de jurisdicción penal de conformidad con la Convención .de Viena sobre Relaciones Diplomáticas del 18 de abril de 1961 y la Convención de Viena sobre Relaciones Consulares del 24 de abril de 1963 y sea acusado de un delito cometido en relación con sus actividades remuneradas, la Parte acreditante estudiará muy seriamente toda petición escrita presentada por la Parte receptora para el levantamiento de dicha inmunidad. Lo expuesto se entenderá sin perjuicio del derecho de la Parte acreditante de determinar que el levantamiento de la inmunidad es contrario a sus intereses. En este caso, la Parte receptora podrá declarar al familiar a cargo persona non grata . Artículo 7 El familiar a cargo que realice actividades remuneradas en la Parte receptora estará sujeto a la legislación aplicable de dicha Parte en materia tributaria y de seguridad social en lo referente al ejercicio de dichas actividades. Artículo 8 El presente Acuerdo no implica el reconocimiento de titulos, diplomas o estudios entre las Partes. J Artículo 9 La autorización para ejercer actividades remuneradas en la Parte receptora finalizará, en principio, cuando: a) La persona en cuestión pierda su condición de familiar a cargo según la definición del presente Acuerdo; b) La persona en cuestión deje de residir en la Parte receptora como integrante del grupo familiar de un miembro de una Misión Diplomática, Oficina Consular o Representación Permanente; e) Finalice la asignación del miembro de la Misión Diplomática, Oficina Consu lar o Representación Permanente . d) Finalice el desempeño de la actividad remunerada. Artículo 10 Las Partes se comprometen a adoptar las medidas que estimen necesarias a efectos de la implementación del presente Acuerdo. Artícu lo 11 Cualqu ier controversia entre las Partes Contratantes relativa a la interpretación o aplicación del presente Acuerdo se resolverá a través de la vía diplomática . Artículo 12 El presente Acuerdo permanecerá en vigor por un plazo indefinido . Cualquiera de las Partes podrá denunciarlo mediante notificación escrita a la otra Parte , por medío de la vía diplomática, de su intención de denuncia rlo. La denuncia surtirá efectos transcurridos seis (6) meses a partir de la fecha de recepción de la notificación. Artícu lo 13 El presente Ac uerdo entrará en vigor en la fecha de recepción de la última notificación en la que las Partes se comuniquen el cumplimiento de los requisitos exigidos por sus respectivas legislaciones internas para su entrada en vigor. El presente Acue rdo podrá ser enmendado y/o complementado de común acuerdo entre las Partes, por escrito y a través de la vía diplomática. Hecho en Buenos Aires, el10 de mayo de 20 16, en dos originales en los idiomas español, vietnam ita e inglés , siendo todos los textos igualmente auténticos. En caso de divergencia en la interpretación, prevalecerá la versión en inglés. CQNG HOA XA HQI CHU NGHIAVIJ¡:T THAY ~T CHÍNH PHÚ NAM C(>NG HOA ÁC-HEN-TI-NA - Nuác 1 AGREEMENT BETWEEN THE GOVERNMENT OF THE ARGENTINE REPUBLlC ANO THE GOVERNMENT OF THE SOCIALlST REPUBLlC OF VIETNAM ON THE FREE EXERCISE OF REMUNERATEO ACTIVITIES BY OEPENOENT RELATIVES OF OIPLOMATIC, CONSULAR, AOMIN ISTRATIVE ANO TECHNICAL STAFF OF THEIR OIPLOMATIC MISSIONS , CONSULAR POSTS ANO PERMANENT REPRESENTATIVES TO INTERNATIONAL ORGANIZATIONS The Government of the Argentine Republic and the Government of the Socialist Republic ofVietnam, hereinafter referred to as "the Parties", Desirous of allowing the dependent relatives of members and Permanent Representatives Parties in the territory of the other free exercise of remunerated activities by of the Diplomatic Missions , Consular Posts to International Organizations of one of the Party, Have agreed as follows: Article 1 Dependent relatives of diplomatic, consular, administrative and technical staff of Diplomatic Missions , Consular Posts or Permanent Representatives to International Organizations of one Party in the territory of the other Party may exercise remunerated activities in that receiving Party, once the required authorization has been obtained, pursuant to the provisions of this Agreement. 1 Artiele 2 For the purpose of this Agreement, dependent relatives shall mean: a) a spouse , b) unmarried children under 21 years old dependent under the charge of their parents or under 25 years old full-time studying in tertiary-Ievel institutions of higher education , and e) unmarried children who are physically or mentally disabled and under the charge of their parents , Provided that those persons are forming part of the household of diplomatic, consular , administrative and technical staff of Diplomatic Missions, Consular Posts or Permanent Representatives to International Organizations. Artiele 3 J There shall be no restrictions as regards the nature or type of employment that may be engaged in. It is, however, understood that, in professions or activities requiring special qualifications, dependent relatives shall be required to comply with the rules governing the exercise of such professions or activities in the receiving Party. On the other hand, the authorization may be refused in cases in which , for reasons of security, only nationals of the receiving Party may be employed . Artiele 4 Requests for authorization to engage in remunerated activities shall be submitted, by the respective Diplomatic Mission , Consular Post or Permanent Representatives of the sending Party to the competent authority of the Ministry of Foreign Affairs of the receiving Party (for the Argentine Republic, the competent authority is the National Protocol Directorate, and for the Socialist Republic of Vietnam , the competent authority is the State Protocol Department) through a Verbal Note. The request shall certify the kinship between the beneficiary and the official of whom they are a dependant and the details of the remunerated activity in which the beneficiary wishes to engage (the name of the applicant , employer's name and address and job description). Upon verification that the person for whom authorization is requested is included in the categories defined in this Agreement, the competent authority of the receiving State shall immediately and officially inform the Diplomatic Mission, Consular Post or Permanent Representatives of the sending Party that the dependent relative has been authorized to work, subject to the relevant rules of the receiving Party. 1 Article 5 Dependent relatives enjoying immunity from jurisdiction under the "Vienna Convention on Diplomatic Relations" signed on 18 April 1961 and the "Vienna Convention on Consular Relations" signed on 24 April 1963 or under the "Convention on the Privileges and Immunities of the United Nations" signed on 13 February 1946 or any other international instrument, and who have obtained employment in accordance with this Agreement , shall not have the benefit of immunity from civil and administrative jurisdiction regarding actions against them arising out of remunerated activities or contracts directly related to the performance of such activities, and shall be subject to the legislation and courts of the receiving Party in connection with such activities. Article 6 In the case of dependent relatives having immunity from criminal jurisdiction in accordance with the "Vienna Convention on Diplomatic Relations" signed on 18 April 1961 and the "Vienna Convention on Consular Relations" signed on 24 Apri11963, and charged with a crime committed in relation to their remunerated activities, the sending Party shall give serious considerat ion to any written request submitted by the receiving Party for a waiver of immunity. The abovementio ned shall be construed without prejudice to the right of the sending Party to decide that a waiver of immunity is contrary to its interests. In this case, the receiving Party may declare the dependent relatives persona non grata. Article 7 A dependent relative who engages in remunerated activities in the receiving Party shall be subject to the applicable laws of that Party governing tax and social security matters in relation to the exercise thereof. Article 8 This Agreement shall not entail recognition of degrees, diplomas or studies between both Parties. Artic le 9 Any authorization to exercise remunerated activities in the receiving Party will, in principie, be terminated when: J (a) The individual concerned ceases to have the status of a dependent relative within the definition of this Agreement. 1 (b) The individual eoneerned eeases to reside in the reeeiving Party as part of the household of a member of a Diplomatie Mission, Consular Post or Permanent Representative . (e) The assignment of the member of a Diplomatie Mission, Consular Post or Permanent Representative is terminated. (d) The performance of the gainful oeeupation eeases. Artie le 10 The Parties undertake to adopt any measures they may deem neeessary for the implementation of this Agreement. Artiele 11 Any disputes between the Contraeting Parties concerning the interpretations or application of this Agreement shall be settled through diplomatic channels. Artie le 12 This Agreement will remain in force for an indefinite periodo Either Party may denounce this Agreement through written notification to the other Party, through diplomatic channels, of its intention to denounce it. The denouncement shall be effective six (06) months after the date of receipt of such notifieation. Artiele 13 This Agreement shall enter into force on the date of receipt of the last notification by which the Parties inform each other that the requirements of their respective domestic legal regulations for the entry into force have been complied with. This Agreement may be amended and/or supplemented in writing by mutual consent of the Parties through diplomatic ehannels.
