A revolutionary new concept is about to
make a high impact on the property market.
Now available for everyone, not just the
wealthy elite is the opportunity to invest
using your own pensions scheme. The
most exceptional benefits to be seen are
the huge savings you can make on purchasing your dream property abroad.
Self invested personal pensions SIPPs, are a
revolutionary new scheme which enables
investors to utilise their pensions, and,
doubly make and save money. SIPPS are
being fine-tuned and final amendments
made before the statute is due to be
passed on April 6th 2006, (known as A
Day). Although not all the regulations are
in place, it is possible to initiate a SIPP
immediately and reap the enormous benefits including overseas investments.
Pension contributions in the UK attract tax
relief. If you pay 78p in the pound the
government pays the balance of 22p.
High rate taxpayers, people who earn a
salary in excess of £37,000, receive an
extra 18p in the pound making the total
that they would receive 40p, or 40 per
cent tax relief, on any property purchased.
Although everyone will benefit, those in
the higher tax bracket will benefit most.
For example:
If you buy a property valued at £100.000
through your SIPP it will cost you £78.000
If you are a higher taxpayer it will only
cost you £60.000
Property lawyers have recently uncovered
a legal loophole, which enables people to
buy off plan before A Day using SIPP, on
the condition that the property is not
completed and will not have a habitation
certificate until after April 6th. In effect
you are not buying a building, as it will
not become as such until after the statute
date. Therefore using the name of your
SIPP it is possible to purchase a property
today. Buying off plan will enable you to
buy a property in the name of your SIPP
immediately.

Off plan purchases give the best opportunity to ensure your best return as they are
also a fraction of the completed cost.
Investors will benefit from full UK income
tax relief from the property purchase.
Thereafter they can collect rental income
tax free in the UK in the pension fund.
Any profits made from the sale of the
property are free from UK Capital Gains
Tax. Additionally the pension fund will be
able to borrow to invest so that buyers
will be able to have their dream holiday
homes, which would previously have been
put of their reach.
The current borrowing with a SIPP is 50%
of the value of the fund. If your SIPP
investment has a value of £52.000 this
means that you can borrow an additional
£26,000, making the total of £78,000.
Allowing for the minimum tax relief of 22
per cent, this would enable you to purchase a property to the value of 100,000.
The benefits are greater still for the higher income tax bracket. To purchase the
same £100,000 property, you only need to
pay in £40,000, top up with your borrowed 50% of £20,000 and receive the
benefit of 40% tax relief.
It is thought that there probably will be
heavy amendments prior to A Day as it
appears that at as it stands, the treasury
effectively will have to make huge tax
concessions.
For people looking to buy in Spain, the
good news is that when purchasing a
property abroad there is no UK Capital
Gains Tax payable on the sale of the property, providing it is owned and sold by the
SIPP. However, it should be noted that if
you decide to sell as an individual and not
through your SIPP then you would be
liable to pay Capital gains Tax.
SIPPs investment is a golden opportunity
with taxation savings and the potential for
overseas investment, but remember,
always be sure to get good professional
advice to optimise your benefits.

I would like to pay into a SIPP,
how do I go about it?
In any one year you can make contributions to the
equivalent of your annual earnings, up to a maximum
of £215.000.00. In your lifetime you are able to contribute up to £1.5 million.
Do I have to wait until next year to initiate a
SIPP?
No it is possible to commence contributions immediately, you do not have to wait until April 2006.
Who will administrate my SIPP ?
The company with whom you set up a SIPP will instruct
a manager who will act as a trustee of the pension. It is
his responsibility to ensure that the property and the
SIPP is run properly. He will however receive a fee from
the annual value of the fund which varies between
0.5%and 1%.
I would like to transfer my current personal pension into a SIPP, is it possible?
Yes it is possible. Speak to your SIPP provider who will
administer the transfer and subsequently manage your
fund.
If my wife and I both have a SIPP can we use the
two to purchase a property abroad?
Yes you certainly can, and receive two lots of tax relief.
It is also worth considering investing your SIPP in a
property investment fund, which could own several
properties and pay an annual dividend.
I have a property abroad, is it possible to transfer
that into a SIPP?
Yes it is possible, however the SIPP will have to buy your
property from you personally and this could mean that
Capital Gains Tax would be payable on any profit made.
Remember that legal and financial fees will have to be
borne by the SIPP.
Get independent financial advice, as it could still be a
very worthwhile proposition.
