La presente circular tienecomo fin hacer de su
conocimiento el objeto y alcance de La Ley de
reciente creación, misma que fue publicada en el
Diario Oficial de la Federación el pasado 7 de junio
de 2013 y que entró en vigor el pasado 7 de julio.
We hereby are pleased to inform you, the scope of The
Law, which was published on the Official Daily
Gazette of the Federation on June 7th, 2013 and entered
in force on past July 7th.
Objeto
Purpose
La Ley tiene como finla preservación y restauración
del medio ambiente, para garantizar el derecho
humano a un medio ambiente sano, pero sobre todo,
brindar a la ciudadanía el derecho a exigir la
responsabilidad generada por el daño ambiental,
estableciéndose claramente la diferencia entre la
responsabilidad
o
daño
ambiental
de
la
responsabilidad
civil
o
daño
patrimonial,
respectivamente, facultándose primordialmente al
ciudadano para reclamar ante un Juzgado Federal
dicha responsabilidad ambiental.
The Law aims to preserve and restore the
environment, in order to ensure a healthy environment
as a human right, but above all, to empower the
population with the right to file a claim regarding any
environmental liability generated by the damages
caused, it also states a clear difference between
environmental liability or environmental damages
from civil liability or civil damages, respectively,
granting the people the right to file a lawsuit claiming
the environmental damages before a Federal Court.

¿Quiénes son Responsables?
Who is Liable?
Toda persona física o moral que por su acción u
omisión sea responsable del daño ambiental
ocasionado, y en el caso de las morales, por dichas
acciones
u
omisiones
ejercidas
por
sus
representantes,
administradores,
gerentes,
directores y empleados, cuando actúen en ejercicio
de sus funciones, en representación o beneficio de la
moral.
Any person or company who by action or omission
causes any environmental damage, also the company’s
liability extends for actions or omissions made by its
representatives, officers, managers, directors or
employees, when the aforesaid are exercising their
corresponding functions, acting on behalf of or in
benefit of the corporation.

¿En qué consiste la responsabilidad?
What is environmental liability?

Reparacióndel daño, consistente en restituir a su
estado base el hábitat, ecosistema o recursos
naturales y sus condiciones químicas, físicas o
biológicas mediante la restauración, tratamiento,
o recuperación, la cual deberá ser en el lugar
donde fue producido el daño.

Damages repair, consistsof restoring to its base
state the habitat, ecosystem, or natural
resources as well as its chemical, physical or
biological conditions by means of a
restoration, treatment or recovery, this actions
have to take place on the locations where the
damage was caused.
Compensation,in case the restoration is
impossible, the person liable shall compensate
by means of an investment or actions that
generate an environmental improvement, this
improvement must be equivalent to the effect
caused by the damages and shall be performed
on the same damaged ecosystem or if this
otherwise, the compensation must be
performed on an alternative location,
ecologically and geographically linked to the
damaged area for the benefit of the affected
community.

Compensación, en caso de que sea imposible la
reparación, el responsable deberá compensar
mediante inversión o acciones que generen una
mejora ambiental, la cual será sustitutiva
equivalente a los efectos adversos ocasionados
por el daño y deberá hacerse en el mismo
ecosistema del daño ocasionado y en su defecto,
en un lugar alternativo, vinculado ecológica y
geográficamente al sitio dañado y en beneficio de
la comunidad afectada

incremente el daño ya ocasionado.

Sanctions
En caso de determinarse la responsabilidad, además
de la reparación o compensación del daño
ocasionado se fijara una sanción económica que en el
caso de personas morales se calculará mediante
montos tasados en Salarios Mínimos cuya
equivalencia al día de hoy oscila entre los $64,760.00
pesos hasta los $38’856,000.00pesos.
In case that a liability is ruled by a court against a
company, in addition to the restoration or
compensation for the damages caused, an economic
sanction will be determined, this can range from
$64,760.00 Mexican pesos up to $38’856,000.00 Mexican
pesos.
Es importante destacar que también los propietarios
que resulten afectados tendrán derecho en adición a
la responsabilidad ambiental a reclamar civilmente
daños y perjuicios que se le ocasione a su predio o
propiedad.
It is important to mention that the owners of the
affected areas are also entitled to claim, additionally,a
civil liability for damagescaused to their property.
La acción de responsabilidad ambiental podrá
ejercerse conindependencia de los procedimientos
administrativos, civiles y/o penales que se susciten.
The right to exercise any legal action for environmental
liability may be performedregardless of the existence
of administrative, civil or criminal trials.
Responsabilidad Solidaria con Contratistas:
Contractors Joint Liability
Es el caso que también serán responsables los que
utilicen o contraten con terceros para realizar dichas
conductas serán responsables solidarios, excepto que
derive de la prestación de un servicio profesional de
confinamiento de residuos peligrosos, siempre y
cuando la compañía este autorizada para tal efecto
Those who hire third parties to perform services will
be jointly liable of the environmental damages caused
by the contracted party; except for those resulting from
the provisions of a service agreement of hazardous
waste disposal, as long the contracting party is
authorized by SEMARNAT to do so.

La acción prescribe en doce años a partir de que fuera
producido el daño.

the environmental damage was caused.

Criminal Liability
Es importante señalar que en la Ley se contempla la
responsabilidad penal en materia ambiental, y nos
dirige a lo previsto por el Código Penal Federal
estableciéndosepenas que van desde uno a nueve
años de prisión.
It is important to mention that The Law also foresees
criminal liability and as established by the Federal
Criminal Code, which foresees imprisonment ranging
from one to nine years.

Relevant Considerations
1) Creación del Fondo de Responsabilidad
Ambiental: cuyo patrimonio se integrará entre otros
con las sanciones referidas y quetendrá como objeto
la reparación de los daños que sean ocasionados al
ambiente, en los casos que por razones de urgencia o
importancia determine la administración pública
federal que se deba intervenir para repararlos, así
como el pago de los estudios eljuez requiera realizar
durante el proceso jurisdiccional deresponsabilidad
ambiental.

aforementioned economic sanctions, among
