¿QUÉ ES ECOEMBALAJES ESPAÑA?
WHAT EXACTLY IS ECOEMBALAJES
ESPAÑA?
ECOEMBALAJES ESPAÑA, S.A. (ECOEMBES) es una sociedad
sin ánimo de lucro, cuyo objeto social es el diseño y
organización de Sistemas encaminados a la recogida
selectiva y recuperación de residuos de envases y embalajes,
para su posterior tratamiento y valorización, en
cumplimiento de las normas legislativas estatales y
autonómicas que traspongan, implementen y/o desarrollen
la Directiva Europea 94/62/CE, sobre envases y residuos de
envases, y cualquier modificación de la misma, así como
otras normativas europeas que en el futuro se promulguen
en desarrollo o como complemento de la misma.
ECOEMBALAJES ESPAÑA, S.A. (ECOEMBES) is a non-profit
organization, whose corporate purpose is to devise and run
systems created specifically for selective collection and
recovery of packaging and packaging waste and for the
ulterior treatment and upgrading of said waste. This is
undertaken in accordance with the national and regional
legislation that implements and develops the European
Directive 94/62/CE, regarding packaging and packaging
waste, and any modifications to the Directive. Furthermore,
ECOEMBES shall continue to be governed by any future
European directives that may be passed for the purpose of
developing or complementing the aforementioned directive.
Por ello, como ente gestor de un Sistema Integrado de
gestión (SIG), ECOEMBES garantiza la recogida selectiva
periódica y recuperación de envases y residuos de envases
pertenecientes a las empresas adheridas, de acuerdo al
espíritu y finalidad de la ley.
ECOEMBES, as the managing entity of the Integrated
Management System (SIG) guarantees periodic selective
collection and recovery of the packaging and packaging
waste generated by member companies, in accordance with
the spirit and purpose of said Law.
Los envases de los productos de las empresas adheridas a
nuestro SIG, serán identificados mediante el símbolo “Punto
Verde” (Art. 7.3 de la ley 11/97), propiedad en exclusiva de
ECOEMBES para todo el territorio español.

La financiación del SIG se llevará a cabo mediante la
aportación, por parte de los envasadores adheridos, de una
cantidad por cada envase de producto puesto por primera
vez en el mercado nacional, con el ya mencionado distintivo
"Punto Verde".
Este coste del Punto Verde a sufragar por parte de los
agentes económicos legalmente obligados a ello deberá,
pues, ser una cuantía suficiente para costear el logro de los
objetivos de reducción, reciclaje y valorización previstos en
la Ley, calculándose en función del peso de cada tipo de
material componente del envase.
The SIG is financed by contributions it receives from member
companies. Each company pays an amount for the packaging
of each product it places on the Spanish market, with the
aforementioned Green Dot symbol.
The Green Dot contribution made by the economic agents
obliged to contribute must be sufficient to meet the costs of
achieving the objectives of reduction, recycling and
upgrading foreseen in the Law. The cost is calculated based
on the weight of each type of material composing the
packaging.

TO SPANISH CONSUMERS
Las empresas extranjeras que comercializan sus productos
envasados directamente a consumidor final en España,
(ventas a distancia /comercio electrónico), son responsables
de la correcta gestión de los residuos de los envases, de
acuerdo con lo previsto en la Ley de envases. Estas
empresas quedan por tanto sujetas a la obligación legal de
participar en un SIG como el gestionado por ECOEMBES o
establecer su propio sistema de depósito, devolución y
retorno.
Foreign companies selling their products directly to Spanish
consumers (remote sales/ electronic commerce) are
responsible for the proper management of the packaging
waste, according to the Packaging ordinance. Therefore these
companies are legally obliged to participate in a compliance
scheme like the SIG managed by ECOEMBES, or to establish
their own deposit and return system.

En principio, las empresas legalmente responsables de los
envases, de acuerdo a la Ley de envases, son los
envasadores y los comerciantes de productos envasados o,
cuando no sea posible identificar a los anteriores, los
responsables de la primera puesta en el mercado español de
los productos envasados, incluyendo a los importadores o
adquirentes españoles.
In principle, the companies legally responsible for packaging,
in accordance with the Packaging and Packaging Waste Act,
Law 11/97, are the packagers and sellers of packaged
products, or when it is impossible to identify them, the party
responsible for the first placement on the Spanish market of
the packaged products, including the Spanish importers or
acquirers.
No obstante en ciertos casos determinadas empresas
europeas vienen observando como sus productos son
comercializados en España por pequeños importadores que
incumplen la normativa de envases, mostrando desde hace
años su preocupación por las repercusiones que esto
pudiera acarrear hacia sus productos y empresas. Las
soluciones adoptadas a raíz de dicha preocupación, se han
dirigido hacia la aceptación de estas empresas extranjeras en
los SIG, quienes podrán contribuir voluntariamente en
nombre de sus clientes españoles.
However, certain foreign companies have noted that their
products are being commercialised in Spain by small-sized
companies who are in violation of packaging laws. In light of
this situation, for some years they have expressed their
concern regarding the repercussions it may have on their
products and businesses. The solutions adopted in response
to this concern are oriented towards the acceptance of these
companies from other countries into the SIGs, and to allow
them to voluntarily contribute on behalf of their Spanish
customers.
La empresa extranjera se hace entonces contractualmente
responsable frente a ECOEMBES de los productos envasados
que suministre a clientes españoles.
Thus, the foreign company assumes contractual liability, with
respect to ECOEMBES for the packaged products they supply
to Spanish clients.

CASOS EN LOS QUE LA EMPRESA EXTRANJERA NO DEBE
SOLICITAR LA ADHESIÓN A ECOEMBES:

Cuando existan filiales o entidades de su mismo grupo
en España que tengan la condición de envasador a los
efectos de la Ley de envases, es decir, cuando estas
filiales comercialicen los productos suministrados por la
empresa extranjera. En este caso la filial española sería
quien tuviera que adherirse a ECOEMBES.

Las empresas extranjeras no deben contribuir por
envases de marcas de distribución ni cualquier otra
marca de la que sean propietarios o licenciatarios sus
clientes españoles. En este caso dicha responsabilidad
recaerá necesariamente sobre el cliente español.
CASES IN WHICH THE FOREIGN COMPANY MUST NOT
APPLY FOR MEMBERSHIP:

When it has subsidiaries or entities of the same group
in Spain that could be defined by Law as packagers, this
is, when these subsidiaries commercialise the products
supplied by the foreign company. In this case the
Spanish subsidiary should join ECOEMBES.

Foreign companies cannot contribute for the packaging
of products with a store brand or any other type of
brand which is the property of, or licensed by their
Spanish clients. In this case, the aforementioned
responsibility will necessarily fall back on the Spanish
client.
MARCAS DE DISTRIBUCIÓN
STORE BRANDS
ECOEMBES permite que las empresas extranjeras se hagan
cargo voluntariamente de la contribución del Punto Verde en
lugar de los importadores/adquirentes, con el único fin de
evitar que sus productos puedan ser comercializados en
España sin cumplir la normativa de envases.
ECOEMBES allows foreign companies to voluntarily make the
Green Dot contribution on behalf of the Spanish importers/
acquirers. The sole aim of this is allow foreign companies to
prevent their products being commercialised in Spain
without complying with Spanish packaging law.
No obstante, cuando la marca con la que se comercializan
estos productos en España pertenece a la empresa española
(caso de las marcas de distribución), desaparece la razón para
permitir que la empresa extranjera realice la contribución del
Punto Verde. En este caso dicha responsabilidad recaerá
necesariamente sobre el propietario español de la marca.
Por tanto, en el caso de que una empresa española compre
productos con su propia marca a un proveedor extranjero,
será la empresa española la única responsable de incluir en
su declaración de envases dichos productos y pagar el
correspondiente Punto Verde a ECOEMBES. Como
responsable de la puesta en el mercado español, no podrá
trasladar dicha responsabilidad a ninguna empresa
extranjera, aunque ésta vaya identificada en el envase.
However, when the brand which the product is
commercialised under in Spain belongs to the Spanish
company (for example in the case of store brands), the
reason for allowing the foreign company to make the Green
Dot contribution disappears. In this case, the
aforementioned responsibility will necessarily fall back on
the Spanish owner of the brand.
Therefore, when a Spanish company buys products with its
own brand from a foreign supplier, the Spanish company is
solely responsible for including the said packaging in its
declaration and for contributing the corresponding Green
Dot cost to ECOEMBES. Consequently, being responsible for
commercialising in the Spanish market, it may not transfer
said responsibility to any foreign company, although the
foreign company is identified on the packaging.

APPLICATION FORM
A fin de iniciar los trámites de adhesión, la empresa
extranjera deberá cumplimentar y enviar a ECOEMBES la
ficha de identificación que se incluye en este dossier a la
dirección: [email protected]
In order to begin the membership process, the foreign
company will have to complete and submit the Application
Form enclosed to this dossier to ECOEMBES at the address:
[email protected]
Dicha Ficha de Identificación incluye un listado de sus
clientes españoles (Parte b)) en el que deberá detallar,
además del CIF y la Denominación de la Razón Social de su
cliente, las marcas comerciales de los productos vendidos a
cada uno de ellos y de cuyos envases se va a hacer
responsable. En caso de que la empresa venda sus
productos directamente a consumidores finales, también
podrá indicar dicha circunstancia en el listado.
This Application Form includes a list of all its Spanish clients
(Part b)). It must also include the CIF (Fiscal Code), the
Company Name and the commercial brands of the products
sold to each of the clients for whose packaging the foreign
company is going to be responsible. When the company sells
its products to final consumers directly, it can state said
circumstances in the list as well.
CONTRATO DE ADHESIÓN Y CUOTA DE ADHESION
MEMBERSHIP CONTRACT AND FEE
La adhesión a Ecoembalajes España, S.A. se formaliza
cumplimentando y firmando el CONTRATO DE ADHESIÓN. Una
vez recibida su Ficha de Identificación, se lo enviaremos por
duplicado por correo para su firma.
To join Ecoembalajes España, S.A., the MEMBERSHIP CONTRACT
must be completed and signed. Once we have received the
Application Form, we will send you two copies to be signed
by your company.
La cuota de adhesión es de 300 € para empresas cuya
facturación sea inferior a 6 MM € o de 600 € para el resto.
Esta cuota deberá ser abonada, en el momento en que
reciban la factura junto con los dos originales del Contrato.
The membership fee is set at 300 Euro for companies
invoicing less than 6 million Euro a year, or 600 Euro for all
others. The fee must be paid as soon as you receive the
invoice, together with the two Membership Contracts.

ANEXO VI AL CONTRATO DE ADHESIÓN PARA EMPRESAS EXTRANJERAS:
Las
empresas
extranjeras
tendrán
que
firmar
adicionalmente el Anexo VI, por el que manifiestan cumplir
los requisitos exigibles para su adhesión y se comprometen
a entregar todos los documentos adicionales propios de las
empresas extranjeras adheridas.
Desde el momento en que la empresa reciba la
documentación, dispondrá de un mes para remitir los
contratos firmados y cumplimentados junto al justificante
de ingreso de la cuota de adhesión a nuestras oficinas sitas
en la Castellana 83-85, 11ª planta. 28046 Madrid.
SWIFT: BSCHESMM
ANNEX VI TO THE MEMBERSHIP CONTRACT FOR FOREIGN COMPANIES:
Foreign companies must sign Annex VI, in which the foreign
company states that it complies with the membership
requirements and that it will submit all the additional
documentation necessary for a foreign member company.
The company will have a month to send the signed contracts
and the payment note concerning the membership fee,
starting from the date of the reception of the documents.
The company will send them to our offices located at

ANNUAL PACKAGING DECLARATION
DECLARACIÓN ANUAL DE ENVASES
Las empresas presentarán anualmente una DECLARACIÓN
ANUAL DE ENVASES de la cual resultará una contribución a
ECOEMBES según el número de envases y el tipo de
material. Dicha Declaración se confeccionará mediante un
programa Declaración de Envases que pondremos a su
disposición cada año. Las empresas que vayan a declarar
menos de 8 toneladas de material de envasado, se pueden
acoger a la DECLARACIÓN SIMPLIFICADA.
The companies will submit an ANNUAL PACKAGING DECLARATION
annually, from which will stem the contribution based on the
quantity of packaging and the types of packaging materials.
This Declaration shall be prepared using the computer
application that will be available every year. Companies may
choose to make a SIMPLIFIED DECLARATION providing they have
less than 8 tons of packaging material to be included in the
declaration.
La empresa extranjera declarará:

Obligatoriamente por los envases de los productos
que vende directamente a los consumidores en España
(ventas a distancia/comercio electrónico).

Compulsorily for the packaging of products that the
company sells directly to Spanish consumers (remote
sales/ electronic commerce).

Voluntariamente por los envases de los productos que
la empresa, cuando esté radicada en el Espacio
Económico Europeo, venda a distribuidores españoles,
exceptuando las marcas de distribución y cualquier
otra marca de la que sean propietarios o licenciatarios
los clientes españoles, y que deberán ser declarados
por estos últimos. En el caso de que algunos clientes
decidan hacer directamente la declaración a
ECOEMBES, el proveedor europeo no necesita declarar
esas cantidades.

Voluntarily for the packaging of the products that the
company, whenever it is located in the European
Economic Area, sells to its Spanish distributors; except
for distribution brands or any other brands that are
owned or licensed by the Spanish clients, which must
be declared by them. Should clients decide to file the
declaration directly with ECOEMBES, the European
supplier need not declare these amounts.
La Declaración, única, agrupará los datos de todos estos
clientes.
La empresa extranjera entregará las Declaraciones Anuales
de Envases que correspondan desde la fecha acordada con
sus clientes, y posteriormente una vez al año cada 28 de
Febrero de acuerdo a la Cláusula 7ª del Contrato de
Adhesión.
Con el objetivo de verificar que los clientes españoles están
efectivamente cumpliendo con sus obligaciones legales a
través de la empresa extranjera, así como para mantener el
control necesario sobre los envases de los cuáles son
responsables estos importadores españoles, la empresa
extranjera adherida a ECOEMBES debe entregar cada año,
junto a la Declaración Anual de Envases, el "ANEXO A LA
DECLARACIÓN PARA EMPRESAS EXTRANJERAS".
A través de dicho Anexo, la empresa extranjera deberá
identificar a estos clientes, asi como las marcas comerciales
de los productos declarados.
La primera Declaración de Envases se entregará un mes
después de recibir la documentación y software que
ECOEMBES enviará adjuntos a los Contratos de Adhesión ya
firmados por ambas partes.
The single Declaration will include the data of all these
clients.
The foreign company will only submit the Annual Packaging
Declarations from the date of its agreement with its Spanish
clients, and thereafter once per year, on 28 February in
accordance with Clause 7 of the Membership Contract.
In order to check that the Spanish clients are meeting their
legal obligations through the foreign company and in order
to maintain the necessary supervision of the packaging for
which the Spanish importers are responsible, the foreign
member companies of ECOEMBES must submit every year
"ANNEX TO THE DECLARATION FOR FOREIGN COMPANIES ", together
with the Annual Packaging Declaration.
By means of this Annex, the foreign company must identify
these clients, as well as the commercial brands of the
products whose packaging is liable to be declared.
The first Packaging Declaration will be submitted one month
after the reception of the documents and software that
ECOEMBES will send together to the Membership Contracts
signed by both parties.

TARIFAS PUNTO VERDE
GREEN DOT TARIFFS
Aquellas empresas que realizan una declaración ordinaria
presentarán anualmente información relativa a los envases
de los productos puestos en el mercado nacional de la cual
resultará una contribución a ECOEMBES según el número
de envases, peso de los mismos y el tipo de material en
base a las ventas reales del año anterior.
Those companies that submit an ordinary declaration will
reveal information about the products placed on the
national market. Through this information we will obtain
the contribution to pay to ECOEMBES according to the
packaging number, the weight of them and the material on
the basis of the real sales on the previous year.
En el caso de que la empresa sea de nueva creación, deberá
justificarlo y la declaración de envases se realizará sobre la
base de las previsiones de ventas para el año en curso.
In the case of a newly created company, this will have to
justify it and the Packaging Declaration will be completed on
the basis of the sales forecast for the year in course.
El Baremo de Costes del Punto Verde a aplicar, aprobado
por la Comisión Delegada de ECOEMBES, se establece:

DECLARACIÓN SIMPLIFICADA
SIMPLIFIED DECLARATION
ECOEMBES ofrece la posibilidad de hacer este tipo de
declaración a aquellas empresas que cumplan
simultáneamente dos requisitos:
 Que el peso total del material de envases a declarar, no
supere las 8 toneladas. Por tanto, una empresa que
desee declarar voluntariamente los envases comerciales
e industriales admitidos por ECOEMBES, podrá incluirlos
en esta Declaración siempre que no se supere la cifra
total de 8 toneladas entre todos los envases declarados.
 No presentar Planes Empresariales de Prevención a
través de ECOEMBES.
ECOEMBES offers the possibility of submitting this kind of
Declaration for those companies which simultaneously
fulfil the following requirements:
 Total weight of packaging material to be declared must
not exceed 8 metric tonnes. Therefore, a company which
wishes to voluntarily declare the commercial and
industrial packaging accepted by ECOEMBES may include
the same in this Declaration providing that the total
amount of packaging declared does not exceed that
amount.
 The member company does not submit any Prevention
Plan through ECOEMBES.
Las declaraciones se determinan en función de los envases
puestos en el mercado el año anterior. En el caso de que la
empresa sea de nueva creación, deberá justificarlo y la
declaración de envases se realizará sobre la base de las
previsiones de ventas para el año en curso.
Según las toneladas de envases puestas en el mercado se
facturará una cantidad fija en un único recibo domiciliado.
Los tramos son:

placed on the market in the previous year. In the case of a
newly created company, this will have to justify it and the
Packaging Declaration will be completed on the basis of
the sales forecast for the year in course.

one instalment. The weight brackets are:

PAGO DE LA DECLARACIÓN DE ENVASES
PAYMENT OF THE PACKAGING DECLARATION
A fin de llevar a cabo un importante ahorro en los gastos
administrativos y bancarios que se generan en cada uno de
los cuatro pagos de facturas trimestrales de la declaración
de envases, se ha establecido UN ÚNICO PAGO ANUAL (día
30 de junio de cada año) para las empresas extranjeras, en
el que se liquidará la regularización y el total de la deuda.

In order to make an important saving on the administrative
and banking expenses incurred in paying the four quarterly
invoices of the packaging declaration, A SINGLE ANNUAL
PAYMENT (June 30 of each year) has been established for
foreign companies, in which the regularisation and the total
Green Dot debt will be settled. This form of payment is
already contemplated for ordinary declarations under 400 €,
and for simplified declarations.

La empresa extranjera informará a los distribuidores
españoles sobre su adhesión a ECOEMBES y su voluntad de
contribuir por los productos envasados que les suministra,
para asegurar un correcto cumplimiento de la Ley.
The foreign company will inform Spanish distributors about
its membership in ECOEMBES and its commitment to
contributing for the packaged products it supplies them, in
order to ensure appropriate compliance with the packaging
law.
La empresa extranjera podrá enviar también a sus clientes
el documento estándar adjunto Información para
importadores / adquirentes intracomunitarios sobre la
adhesión voluntaria de los proveedores extranjeros a
ECOEMBES. Este documento ampliará su información
sobre su responsabilidad legal y la adhesión voluntaria del
proveedor extranjero.
Foreign companies may also send to its clients the standard
statement attached Information for importers / intracommunity purchasers regarding voluntary subscription of
foreign suppliers to ECOEMBES. This document will extend
the information on their legal responsibility for packaging
and the voluntary membership of the foreign supplier.
La declaración que haga la empresa extranjera para la
empresa española, sólo incluirá los productos que le
venda. Por lo tanto, la empresa española tendrá que
adherirse a ECOEMBES y hacer la declaración por otros
productos que importe o adquiera, por productos que
envase ella misma o por otros envases que ponga en el
mercado (por ejemplo, bolsas para el transporte de la
mercancía por sus clientes), y de los cuáles sea responsable
legalmente.
The declaration made by the foreign company for the
Spanish company will only include the products the former
sells to the latter. Therefore, the Spanish company will have
to join ECOEMBES and file a declaration for other products it
may import or acquire, for any products it may package
itself, or for other packaging it may place on the market (for
example, bags used by its customers to transport the
merchandise), for which it is legally responsible.

En cada transacción comercial que la empresa extranjera
lleve a cabo con sus clientes españoles, tendrán que
adjuntar a la factura que se emite, una carta o nota que
deberá conservar el cliente español, y que mencione lo
siguiente:
The invoices sent by the foreign company to the Spanish
clients who have authorized it to make the declarations shall
bear the following note:
"Todos los envases de los productos envasados objeto
de la factura que se adjunta, serán declarados por la
(EMPRESA EXTRANJERA) a ECOEMBES como si fueran
puestos en el mercado en el presente ejercicio".
Si también han sido entregados productos en envase
Industrial o Comercial, (que aunque no tienen obligación
legal de ser declarados a través de un SIG, pueden ser
declarados voluntariamente), y estos envases son incluidos
en la declaración, tendrá que indicar en la misma nota qué
envases de este tipo se declaran, más la siguiente nota:
"Todos los envases Comerciales y/o Industriales de los
productos que se citan a continuación, objeto de la
factura adjunta, serán declarados por la (EMPRESA
EXTRANJERA) a ECOEMBES como si fueran puestos en
el mercado en el presente ejercicio".
"All packaging of the packaged products which form the
object of the present invoice will be declared by the
(FOREIGN COMPANY) to ECOEMBES as if they have been
placed on the market during the current financial year".
If products have also been delivered in Industrial or
Commercial packaging (which is not legally required to be
declared through the compliance scheme, although it may
be so declared on a voluntary basis), and this packaging is
included in the declaration, the foreign company will have to
indicate in the note the packaging of this kind which is
declared, plus the following note:
"All Commercial and/or Industrial packaging of the
products indicated that form the object of the present
invoice shall be declared by the (FOREIGN COMPANY) to
ECOEMBES as if they have been placed on the market
during the current financial year".

Esta nota indica que los envases Comerciales e Industriales
de los productos indicados, han sido declarados

que citar dichos productos a continuación de esta nota.

De esta manera, sus clientes podrán -en caso de posibles
auditorias- presentar las notas adjuntas a las facturas de las
mercancías que reciben de suministradores extranjeros que
son miembros de Ecoembalajes España, S.A. y para quién la
contribución ya ha sido pagada.
In this manner, the clients may -in the event of a possible
audit- present the invoices for merchandise they have
received from their foreign suppliers who are members of
Ecoembalajes España, S.A., and for which the contributions
have already been paid.
En caso de que estos envases Comerciales no se declaren
voluntariamente a través de Ecoembalajes España, S.A., la
empresa extranjera deberá indicar asimismo en la
comunicación adjunta a la factura una leyenda que diga:

INFORMACION A LOS IMPORTADORES / ADQUIRENTES INTRACOMUNITARIOS
SOBRE LA ADHESIÓN VOLUNTARIA DE LOS PROVEEDORES EXTRANJEROS A ECOEMBES
Según la Ley de Envases 11/1997, las empresas son legalmente responsables de los productos envasados
que importan o adquieren en otros países miembro de la Unión Europea, y por tanto, correspondería a
dichos importadores o adquirentes adherirse a un Sistema Integrado de Gestión (SIG) de envases y residuos
de envases como el gestiona ECOEMBES, declarar los envases y realizar la correspondiente contribución de
PUNTO VERDE a fin de financiar la recogida selectiva de los residuos de envase para su valorización y
reciclaje.
No obstante, y bajo determinadas circunstancias, ECOEMBES admite la adhesión de empresas radicadas en
otros países del ámbito europeo. Las empresas extranjeras se adhieren VOLUNTARIAMENTE en nombre
de sus clientes españoles, por los cuáles realizarán una declaración anual de envases y pagarán la
correspondiente contribución. De esta forma, los importadores españoles cumplen indirectamente con sus
obligaciones de recuperación y reciclaje para esos envases.
La empresa extranjera se hace entonces contractualmente responsable frente a ECOEMBES de los
productos envasados que vende a clientes españoles, exceptuando las marcas de distribución y cualquier
otra marca de la que sean propietarios o licenciatarios los clientes españoles, y que deberán ser
declarados necesariamente por estos últimos.
La declaración que haga la empresa extranjera para la empresa española, sólo incluirá los productos que le
venda. Por lo tanto, la empresa española tendrá que adherirse a ECOEMBES y hacer la declaración por
otros productos que importe o adquiera (por ejemplo los de su propia marca), por productos que envase
ella misma o por otros envases que ponga en el mercado (por ejemplo, bolsas entregadas en comercios
utilizadas para el transporte de la mercancía por sus clientes), y de los cuáles sea responsable legalmente.
Para que la empresa española, legalmente responsable, pueda asegurarse de que la declaración y el pago
de la contribución están hechos por la empresa extranjera, encontrará una nota en todas las facturas que
reciba de empresa extranjera especificando que los productos objeto de la transacción están incluidos en su
declaración de envases a ECOEMBES.
RECUERDE

Es necesario que tanto proveedor como cliente acuerden claramente quien realizará la declaración y
contribución por los envases a fin de evitar tanto la duplicidad de contribución, como la
comercialización del producto sin contribuir al SIG.

En el caso de terminación del contrato de adhesión al SIG de la empresa extranjera, el cliente
español asumirá su obligación de declarar y contribuir por los productos envasados que adquiera a
dicho proveedor extranjero. Asimismo será responsable de cualquier deuda u obligación pendiente
que hubiera dejado éste al cancelar su adhesión voluntaria a ECOEMBES.

INFORMATION FOR IMPORTERS / INTRA-COMMUNITY PURCHASERS
REGARDING VOLUNTARY SUBSCRIPTION OF FOREIGN SUPPLIERS TO ECOEMBES
Pursuant to (Spanish) Packaging Law 11/1997, companies are legally responsible for packaged products
imported or acquired in other member countries of the European Union and, therefore, it is incumbent
upon said importers or buyers to subscribe to recovery scheme (SIG) for packaging and packaging waste
such as that managed by ECOEMBES, declaring packaging and paying the related GREEN DOT fee in
order to finance the selective collection of packaging waste for its recovery and recycling.
However, under certain circumstances, ECOEMBES allows for subscriptions by companies based in other
European countries. Foreign companies voluntarily subscribe on behalf of their Spanish clients, for
which they present an annual packaging declaration and pay the corresponding fee. In this way
Spanish importers comply indirectly with their recovery and recycling obligations for this packaging.
The foreign company is then contractually liable to ECOEMBES for the packaged products sold to
Spanish clients, except for distribution brands and any other brand of which Spanish clients are
owners
or
licensees,
which
must
necessarily
be
declared
by
them.
The declaration made by the foreign company for the Spanish company, will only include the products
sold to it. Therefore, the Spanish company will have to subscribe to ECOEMBES and file the declaration
for other products which it imports or acquires (those of its own brand, for example), for products it
packages itself or other packaging it puts on the market (for example, bags distributed at stores used
by their customers to transport the goods) and for which it is legally liable.
In order for the Spanish company legally responsible to be able to ensure that the declaration and
payment of the fee are made by the foreign company, it will find a note on all invoices received from
the foreign company specifying that the products involved in the transaction are included in its
ECOEMBES packaging declaration.
NOTE

It is necessary for both the supplier and client to clearly agree upon and establish who will
carry out the declaration and pay the fee for packaging, in order to avoid the redundant
payment of fees, as well as the commercialization of products without SIG contributions.

In cases in which foreign companies terminate their SIG subscription contracts, the Spanish
client shall assume its obligation to declare and pay for those packaged products which it
acquires from such foreign suppliers. In addition, it will be responsible for any outstanding
debts or obligations which foreign suppliers may have pending following their cancellation of
their voluntary subscription to ECOEMBES.

Se acepta el criterio de que el Punto Verde deberá estar
impreso como mínimo en el envase de la unidad mínima
de venta, esto es, en el envase que el consumidor puede
adquirir como producto en un lineal, por considerar que
es donde más visible está para el consumidor.
As a minimum requirement, the Green Dot will have to be
printed on the packaging of the minimum sales unit, that is,
on the packaging the consumer can acquire from a shelf;
given that this is where it is most visible to the consumer.
Ejemplo: Dentífrico: El Punto verde debe ir impreso como
mínimo en la caja de cartón (estuche), siendo el tubo
opcional. Si no tiene estuche, deberá ir en el tubo.
Example: Tooth paste: As a minimum requirement, the
Green Dot must be printed on the cardboard box, it being
optional to print the Green Dot on the toothpaste tube. If
there is no box, the logo has to appear on the tube.
Los elementos de venta que puedan ser fraccionados en
varias unidades de producto, pero que conceptualmente
sean la unidad mínima (ej. Pack de 4 yogures) irán todos

In the case of sales units that can be separated into a
number of product units, although they are conceptually
the minimum sale unit (example: 4 yogurt pack), it will be
necessary to identify all the individual product units with
the Green Dot. On the contrary, if it is impossible to
separate as a sale unit, (example: a box of containers of
different colored paints), the packager will be free to
choose whether to identify the containers individually or
not.
El símbolo ha de ser inmediatamente identificable por el
consumidor. Debe ser legible y visible tanto en los envases
como en los embalajes de los productos comercializados,
situados dentro del ámbito de aplicación de la Ley
11/1997, de 24 de Abril, de Envases y Residuos de
Envases.
The symbol shall be immediately identifiable by the
consumer. It shall be legible and visible on both the
containers and packaging of products placed on the market
within the scope of application of the Packaging and
Packaging Waste Law 11/97.
El símbolo no puede ser modificado. Ha de imprimirse en
su integridad, guardando sus proporciones y su unidad
cromática. No puede ser completado con mención o
elemento gráfico alguno, tampoco adicionarlo o alterarlo
sin el acuerdo formalizado por escrito de ECOEMBES.
The symbol shall not be modified. It shall be printed in its
entirety, maintaining its proportions and chromatic unity. It
shall not be completed with any statement or graphic
element whatsoever, nor be added to nor altered in any
way without the written agreement of ECOEMBES.
 NOTA MUY IMPORTANTE 
Según el Art. 14 de la Ley 11/97, a partir de un año desde
la fecha de entrada en vigor de esta norma, queda
prohibida la comercialización de envases etiquetados o
marcados con la leyenda de "No Retornable" u otras de
contenido similar.
 VERY IMPORTANT 
As established in Article 14 of the Law 11/97, one year
after the coming into effect of said norm, it is forbidden to
commercialize packaging labelled or marked with the
slogan "Not Returnable Empty" or any similar slogan.
So from 25 April, 1998 onwards, packaging with the slogans
