NO. 76934 2-18-14 RESOLUTION NO. 76934 A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN JOSE WITH ESTABLISHING THE A SISTER MUNICIPAL CITY AFFILIATION GOVERNMENT OF GUADALAJARA, JALISCO, MEXICO WHEREAS, the national Sister Cities program was established in 1956 and links U.S. cities with communities globally to foster citizen diplomacy and mutual understanding and cooperation: and WHEREAS, the City of San Jose ("City") currently has Sister City relationships with Okayama, Japan; San Jose, Costa Rica; Veracruz, Mexico; Tainan, Taiwan; Dublin, Ireland; Pune, India; and Ekaterinburg, Russia; and WHEREAS, San Jose shares strong economic and cultural ties with Guadalajara, the capital of the State of Jalisco and Mexico's second largest city, including a thriving information technology sector and arts scene; and WHEREAS, at the February 13, 2013, Rules and Open Government Committee meeting, the Committee directed the administration to send a letter of interest to the Municipal Government of Guadalajara, Jalisco. Mexico to begin a dialogue regarding the establishment of a formal Sister City affiliation; and WHEREAS, Officials of the Municipal Government of Guadalajara, Jalisco, Mexico responded favorably about establishing a new Sister City affiliation with the City, and issued a municipal decree on July 19, 2013, for the twinning of the City of Guadalajara, Jalisco, Mexico with the City of San Jose, California, United States of America; and T-27429\ RESO„76934 Council Agenda: 3-4-14 Item No.: 4.9 RD:EJM:LCP RES. An invitation is hereby extended to the government and the people of the City of Guadalajara, Jalisco, Mexico to participate with San Jose as its Sister City for the purpose of creating greater mutual understanding between the peoples of our two great cities and nations. 2. I would like to inform you that at the special session held on July 19,2013, the City Council issued the municipal decree D 33/0.1/13, initiative by Mayor Ramiro Hernandez Garcia, City of Guadalajara, Jalisco, and Councilman Juan Carlos Anguiano Orozco, for the twinning of our City of Guadalajara with the City of San Jose, California, United States of America, and concluded in the following points: MUNICIPAL ACT: FIRST. It approves the signature of twinning (or sisterhood) of Guadalajara, Jalisco, with the City of San Jose, California, United States of America. SECOND. It approves official visits by the Transitional Commission of the City of Guadalajara to the City of San Jose, California, United States of America to the signing of the twinning with the city within the framework of the "Week Jalisco" from August 1 to August 4, 2013. The Integrating Plural Transitional Commission will be: a) Mayor, Ramiro Hernandez Garcia; b) Chairman of the Committee to promote Economic Development and Tourism, Councilor, Juan Carlos Anguiano Orozco; c) An alderman of the Fraction Edilicia of the National Action Party, and d) A ruler of the Green Party of Mexico THIRD. It allows the realization of an invitation to entrepreneurs, universities, artistic agents, cultural leaders and traders in the Metropolitan Area of Guadalajara, who have an interest to participate and strengthen ties in each of the subject matters within the City of San Jose, California, USA. FOURTH. It authorizes Juan Carlos Anguiano Orozco, in coordination with municipal executive agencies, to make the call and register all interested parties. The notice must clearly state that the costs will be absorbed by each stakeholder, there will be an agenda of activities and institutional logistical support from the authorities to finalize bilateral work related meetings. FIFTH. The Ministry of Economic Development will be responsible for providing, soliciting and organizing the meetings with the City of San Jose and with counterparts interested in the exchange of business, academic, cultural, artistic and commercially. An initiative of decree was presented to the Commission Edilicia to Promote Economic Development and Tourism by Mayor Ramiro Hemandez Garcia and the Councilman Juan Carlos Anguiano Orozco, to twine the City of Guadalajara with the City of San Jose, California. It has been brought to Council for consideration with the following background: 1. The Chairman of the Committee to promote Economic Development and Tourism, was informed on July 2, 3013, that Council referred to the office of the commission the official doc# 1765/13 signed by the Secretary General, Tomas Vazquez Vigil, under Tumo # 135/13, the initiative by decree of the Mayor Ramiro Hemandez Garcia and Councilman Juan Carlos Anguiano Orozco, twinning the City of Guadalajara with the City of San Jose, California, United State of America. 2. In its explanatory memorandum, the initiative raises, among other things, diverse backgrounds of historical, economic and social character transcribed below: a. On April 30, 2013 we received a letter from Mayor Chuck Reed, Mayor of San Jose, California, U.S., a letter of intent addressed to the Mayor of Guadalajara expressing concern to advance a partnership between Guadalajara and the City of San Jose. b. In his letter, he states that out of the million inhabitants that reside in' San Jose, 200,000 residents are of Mexican origin. c. San Jose, California is a city called the Capital "Silicon Valley" by the generation, production and distribution of electronic technology; in fact it is the most important provider of the United States. d. To mark the Creative Digital City project, once launched in our city and considering that we are twinned with Dublin, we think it is feasible and necessary to sign a partnership with San Jose, California, and closing what is known as the diamond of Information Technology and Knowledge, TIC's acronym in Spanish, IT for acronym in English. e. It is important to highlight other points that make the twinning advisable, such as: 1. San Jose is a city of over 500,000 inhabitants and considered one of the safest in the U.S. 2. It is the home of large and important corporate digital businesses, such as Adobe, eBay, Xilinx, Cisco Systems, as well as the largest conglomerates in the industry as Vecton, Ericsson, Hewlett-Packard and IBM, to name a few. 3. San Jose has a large Mexican Cultural Heritage and Technological Industry, it has over 20 museums where you can see reflected the history and the process of the city such as the St. Joseph Basilica, the Cesar Chaves Plaza, the Mexican Heritage Plaza, and the HP Pavilion, among others. 4. San Jose has nine sister cities: Okayama, Japan; San Jose, Costa Rica; Veracruz, Mexico; Tainan, Taiwan; Dublin, Ireland; Pune, India; Oeiras, Portugal and Pekanbaru, Indonesia. 5. In turn, it has an educational system made up of several universities like the National Hispanic University, which it primarily focuses on Hispanics by offering advanced degrees, the Califomia State University and the University of Silicon Valley. f. We believe that the twirming cannot be exhausted by a formal act; the end purpose of strengthening ties with other entities is to strengthen industry, education, culture, the economy, the technological exchange and, of course, to leam from the successes and mistakes of other cities similar to ours. g. It is necessary to emphasize that if the twinning is adopted, the City of San Jose must also comply with the reporting requirements "Guidelines Sister Cities" of the organization to which he belongs, and particularly with an official relationship "... to develop long-term relationships, civic and person to person, to promote intemational cooperation and cultural understanding, and foster economic development." h. The initiative in study proposes the following points: DECREE IT APPROVES THE TWINNING OF THE CITY OF GUADALAJARA, JALISCO, WITH THE CITY OF SAN JOSE, CALIFORNIA, U.S.A. FIRST ARTICLE. It approves the twinning of the City of Guadalajara, Jahsco, with the City of San Jose, California, USA SECOND ARTICLE. It approves the integration of a Temporary Commission on plural terms of the Rules of Official Visits from the City of Guadalajara to visit the City of San Jose, California, USA to sign the twinning with that city within the framework of the "Week Jalisco" during August 2-4, 2013. The Integration of the temporary commission will be: a) Mayor, Ing. Ramiro Hem^dez Garcia; b) Chairman of the Committee Edilicia to Promote Economic Development and Tourism, Councilman, Juan Carlos Anguiano Orozco; c) A ruler from the Nation Action Party; d) A ruler ofthe Green Party of Mexico. THIRD ARTICLE. An open call is authorized to invite entrepreneurs, universities, artistic agents, cultural leaders and traders in the Metropolitan Area of Guadalajara, who have an interest to participate and strengthen ties in each of the subject matters within the City of San Jose, California, USA. That pursuant to the provisions of Article 115, Fraction 11 of the Political Constitution of the United States of Mexico, municipalities shall have authority to approve, in accordance with the municipal laws it must issue the legislatures of the states, sides of police and government, regulations, circulars and administrative rulings of general compliance within their respective jurisdictions, to organize local public administration, governing the materials, procedures, functions and utilities within its jurisdiction and ensure citizen and neighborhood participation; 2. That the Political Constitution of the State of Jalisco, in its article 77, provides that municipalities are empowered to issue and implement, in accordance with the normative foundations established by the laws, regulations, rules governing the provision of public services, provisions administrative and general observance circular within their respective jurisdictions; 3. Accordance with the provisions of Article 76, sections I and II of the Rules of the City of Guadalajara, members of city council and the committees have the faculty to submit and order municipal initiatives, of decree and agreement; 4. That pursuant to the provisions described above and as is clear from Articles 36 and 63 of the Rules of the City of Guadalajara, the Commission to Promote Economic Development and Tourism, is competent to rule on this case in particular; 5. Once the proposal in the initiative has been studied of the present dictum, the members of the Judging Commission expose that: a) Competence has been demonstrated by us, the authorities to intervene and rule in the matter that has been referred, so the same, has been manifested in the existence of power to introduce initiatives by the members of the City Council and Commissions. b) We who issued this dictum note that the initiative in question meets the requirements and formalities required by the applicable legal standard. 6. The initiative aims for the twinning signature of our City of Guadalajara with the City of San Jose, California, United States of America. 7. That according to what has been stated in article 130, fraction IV of the Rules of the City of Guadalajara the Mayor has the power to "issue the agreements, circulars and administrative provisions necessary in order to give effect to the foregoing powers and all others granted by the Constitution of the State of Jalisco and other laws applicable to municipalities." 10.The Regulation of Municipal Public Administration of Guadalajara in article 51 fraction V mentions that within the powers and duties of the Ministry of Economic Development is to propose strategies to attract investment and promote export of goods produced in the Municipality, likewise the aforementioned article states that for the release of its remit, the holder has the development directions of the Investment, Tourism, Development of Entrepreneurs, of Registration and Licensing, and International Relations and Sister Cities, whose powers are determined by the operating organization and procedures by its own Secretariat. 11.That, according to the eighth article of the Regulation of Relations between the City of Guadalajara and other cities under the Sister Cities Regimen, the Mayor is responsible for submitting the Application of Agreement of Sisterhood to the Chapter from the City of Guadalajai'a to other cities, and this committee is responsible for promoting international relations with other cities worldwide. 12.For the foregoing reasons, in accordance with the considerations above and pursuant to Articles 94, 95, 97 and 98 of the Rules of the City of Guadalajara, we submit to City Hall with the highest consideration the following: DECREE APPROVE THE SISTERHOOD SIGNATURE OF THE CITY OF GUADALAJARA, JALISCO, WITH THE CITY OF SAN JOSE, CALIFORNL\, U.S.A.
