ABSTRACT
A decade after the deep restructuring of the Spanish railway conducted in 2005 and
after the deep crisis in 2008, the Spanish government has approved a new law in the
railway sector (Law 38/2015, of the Railway Sector).
The aim of this paper is to carry out a reflection on the experience in Spain and the
content of the reform. Some key research questions are as follows:
1. What are the legislative goals?
2. Who are the major players?
3. What is the mission assigned by Spanish government to the major players?
Specifically to public companies (ADIF and Renfe-Operator)
4. How is the control of government implemented? And what are the regulatory
bodies?

RESUMEN
Una década después del profundo proceso de reestructuración del ferrocarril español
realizado en 2005 y tras la profunda crisis sufrida en 2008, el gobierno español ha
aprobado una nueva ley del sector ferroviario (Ley 38/2015, del Sector Ferroviario).
El propósito de este trabajo es llevar a cabo una reflexión sobre la experiencia
acumulada en España y el contenido de la reforma. Las cuestiones clave de la
investigación son las siguientes:
1. ¿Cuáles son los objetivos de la reforma?
2. ¿Cuáles son los principales actores?
3. ¿Qué papel les asigna el gobierno español? Especialmente a las empresas
públicas (ADIF y Renfe operadora)
4. ¿Cómo se instrumenta el control del gobiern0? ¿Cuáles son los organismos
reguladores?
