Members of the Committee on Civil Rights and the Committee on Oversights and Investigations held an oversight hearing on Wed., Nov. 20th on recent allegations of racial profiling at Barneys and Macy’s. While the hearing drew a host of panelists, including the Reverend Al Sharpton of the National Action Network, there were some noticeable no-shows. Neither representatives from the stores in question, Macy’s and Barneys New York, nor the New York Police Department, who have pointed fingers at each other in the ensuing controversy, were present. Instead, the retailers sent written statements. “This is an important topic for our company, and we take any such accusations very seriously. The allegations are especially concerning given that our company has a long and valued tradition of welcoming persons of all races into our stores, providing employment and vendor opportunities that appropriately reflect the diverse multicultural market place in New York,” wrote Edward J. Goldberg, Macy’s Senior Vice President of External Affairs in a letter to Gary Altman, The practices of local department stores Barneys New York and Macy’s were the focus of a City Council hearing. Legislative Counsel to the City Council. “Macy’s will not tolerate discriminating practices, including racial profiling. We have extensive policies and procedures to prevent racial profiling,” he added, writing that some of those procedures were developed in conjunction with the Attorney General of New York. Altman was referring to an agreement that was made in 2005 between then-Attorney General Eliot Spitzer and Macy’s, in which the store agreed to appoint an internal security monitor to investigate security complaints about employees; train employees to avoid discrimination; pay $600,000 in damages; keep records of all detentions; and develop regulations on handcuffing. But now, Attorney General Eric Schneiderman has launched a new probe of the two stores. “So far, we have no evidence that Macy’s personnel were even involved in Mr. Brown’s detention; this was an operation of the New York City Police Department (NYPD),” wrote Goldberg, referring to accusations by television and film actor Robert Brown, who said that plainclothes officers stopped, questioned and detained him in a holding cell when he tried to purchase a watch for his mother’s college graduation. But others at the hearing put joint blame on the stores and the NYPD, and urged action. Pat Harris, a Bronxite who came to testify at the hearing, said that her Macy’s card was declined when she tried to buy a gift certificate for her niece. Harris was subsequently put on the phone with a store representative who made her answer personal questions in order to verify that the Macy’s card was actually hers. Harris went through a litany of questions only to be declined. Near the intersection of Palisade and Independence Avenues, they visit the Half Moon Overlook. It is where Adele’s husband took her wedding photo 40 years ago. The overlook is a quiet corner which offers sweeping vistas of the Hudson and Harlem Rivers; the Palisades; Inwood Hill Park; and in the distance, the George Washington Bridge. But on Sun., Dec. 1, the typically peaceful nook was instead filled in the early morning with jockeying camera crews, while the surrounding tree-lined streets were packed with fire trucks, police cars and emergency vehicles. Below the bluff, a Metro-North Railroad commuter train lay sprawled improbably on its side, resembling toys tossed aside by an errant toddler. One of the cars lay perilously close to the water’s edge. All seven of the commuter train’s cars and its locomotive had derailed at approximately 7:20 a.m., killing four passengers and injuring over seventy more. At least eleven were in critical condition. Three of the dead were found outside the train, and one was found inside, authorities said. By late Sunday afternoon, ladders used by rescue workers to extract survivors from the train were still leaning against derailed cars, and personnel in hazmat suits lingered. Victims of the crash had been taken to several area hospitals, including New-York Presbyterian’s Allen Hospital. Officers from the New York Police Department (NYPD) guarded the entrance to the hospital’s emergency ward to protect the privacy of the victims and their families. Other victims were also transferred to St. Barnabas Hospital, Jacobi Medical Center, and Montefiore Medical Center. John F. Kennedy High School was briefly used on Sunday afternoon as a gathering point for the families of the victims who wanted information on their loved ones. A worker for the Red Cross estimated that at most five people visited the site, none of whom were survivors of the derailment. The site was closed later in the afternoon. Since Sunday, members of the National Transportation Safety Board (NTSB) have remained on the scene to continue the investigation. More than 130 firefighters and responders helped extricate passengers and crew at the crash site, which was along a curve near the convergence of the Hudson and Harlem Rivers, just 100 yards north of the train station. They were among 50,266 finishers in the Nov. 3rd race, part of the largest field of runners in the event’s history. “We’re very grateful for these runners’ support of BronxWorks. Both their athletic and fundraising efforts are remarkable accomplishments,” commented Cathy Sharp, BronxWorks’ Director of Individual and Corporate Relations. She and fellow staffer Courtney Wong coordinated BronxWorks’ participation in the marathon. “Each runner on our team made a commitment to raise a specific amount from friends, colleagues and other contacts,” explained Sharp. “In this case, the goal for each runner was $3,000. We were very fortunate this year in that all eight who ran on behalf of BronxWorks surpassed this benchmark.” Many of the runners noted that the opportunity to help an organization like BronxWorks added to the fulfillment they experience testing their stamina by running the marathon. “It was a real privilege for me to raise money for such a great organization in my home borough,” said Emerita Torres, who said she usually is stationed in foreign countries with the Diplomatic Corps for up to two years at a time. “Thank you for giving me an opportunity to give back in a meaningful way.” Stephen Bonnett recalls he started running as a way to escape the stresses of teaching high school students. On a Friday in May of his first year of teaching, “I left my wallet and phone at home, and with only my keys on me, ran until I exhausted myself,” he said. “Once I returned home and mapped my route, I discovered that I’d gone over five miles. And I was hooked. Recently I’ve found a way to use the running I now have a passion for to actually help solve the problems that so often hold my students back.” Chris Bonastia, the Lehman College professor, is the most experienced runner of the three. He previously ran the Chicago Marathon last fall – and raised money for BronxWorks there. In 2010, he also ran the ING New York City Marathon on behalf of BronxWorks. The new funding contributed to BronxWorks from the marathon runners and their friends and family will support programs for children and youth in the South Bronx, Sharp said. They include after-school programs and summer day camps for low income families, programs designed to help teens to successfully make the transition from grade school or middle school to high school, and recreational and educational programs for children living in BronxWorks’ three transitional residences for homeless families. Story and photos by Robin Elisabeth Kilmer M ayor Bloomberg will enjoy one more ban before he leaves office. The mayor, and former smoker, signed landmark legislation on Tues., Nov. 19th that banned the sale of tobacco products to anyone under the age of 21. The law makes New York the first large city or state in the country to prohibit sales to young adults. The Bronx Free Press canvassed young New Yorkers about the ban. That many of those speaking up were smokers submitting to an interview in the frigid night air, midsmoke, spoke for itself. But Bibi Cartagena, 27, does not smoke, yet many of his peers do. He felt that stress is what causes many of them to smoke. “I know many of them are young parents, or juvenile delinquents, or a combination of the two,” he said, with a chuckle. Cartagena has never been inclined to smoke. “I never liked the smell. I’ve kissed people who smoke, and it tastes awful,” he said as he walked along on a cold Saturday night. Smoking can cause halitosis, swelling of the salivary glands, and can triple the risk of getting an infection after a dental procedure, she said. Jack Etheridge, 24, was visiting from Washington, D.C. He felt that it is plausible for other cities to follow suit if the New York City ban proves to be a success – if you could prove it. “How you would measure that would be an issue. You would have to have people answer honestly in medical surveys—and against their own interests.” There is also the matter of those under 21 simply turning to older peers—just like they acquire alcohol from of-age friends and relatives. “In a way, it makes it less safe because it’s less regulated,” said Etheridge. Masood Aliuddin, 31, agreed that access to cigarettes will not be a problem for young smokers. “They’ll have brothers or friends who will buy them.” This is how Aliuddin started smoking at age 16. “The cool kids were smoking and I fell into that aspect.” He was joined outside Yankee Tavern, near Yankee Stadium, for his cigarette break by Angelique Spencer, 32, who has been smoking for ten years. She doesn’t feel like the ban will stop the most dedicated smokers, but believe it would discourage at least some teens from smoking. “The first thing you do when you’re 18 is buy a lottery ticket and a pack of cigarettes just because you can,” she said. “With the ban, there will be a bigger chance they will not get them.” Brian Hostos, 30, agreed. “I’m all for it. Before 21, it’s too early for them (to start smoking). It’s their choice, but after a certain age,” he said, as he stepped out for a cigarette break. “If I had known then what I know now, I wouldn’t have started.” Hostos picked up the habit at 15. “I was hanging out with the wrong crowd, pretty much,” he said. He is trying to give it up. Bianca Díaz, 19, said she smokes about eight cigarettes per day. She started a year ago, when she was stressed out by working full-time and going to school. “People said it was a stress relief,” she said. Díaz, who works at The Court Diner near the Bronx County Courthouse, did not think the ban would be effective. “We do everything they tell us not to do,” she said. “What makes them think we’re going to quit just because they ban it?” Mi Gente: ¿Sólo si tienes 21? A paralegal for over 17 years until December 2010, she has since been dedicating her time to exploring the Bronx. Her energy and enthusiasm are indefatigable, and admirable. “I want to make my fellow residents aware and informed of how lovely our borough is, what it offers, and how to lend a helping hand in our environment.” Of this new time in her life, Martell says, “I have never felt so alive.” borough or even knowing where to begin in order to learn more about the Bronx. He explained that by junior high school he had developed a strong inclination to study the past, especially anything to do with his Latino roots. His mother had moved him and his brother from the Bronx to San Diego, California. It took a long time to adjust, as thoughts of the Bronx still lingered in his mind. “History was always my thing and one day in my junior high school, I found a copy of History in Asphalt written by John McNamara.” The book is a complete collection of the origins of street names in the Bronx. “This is three thousand miles away from the Bronx,” he recalled. “And [I] find this book at a school library in San Diego? I began to read the book and that’s when my strong affection for New York and Bronx history began.” It is quite amazing that this Bronx history book would surface in the West Coast. I couldn’t help wonder how many of our local schools have a copy. Through his work with BCHS, Hernández also leads some of the Bronx Walking Tours. “Foxhurst to Hunts Point” is scheduled for Sun., Dec. 8. “I do this because I love the Bronx, and by sharing its rich history, I want others to love it as well. I want people to appreciate where they come from and brag about the Bronx as being this special place. There are a lot of people who were born and raised in the Bronx that move away and always downplay their origins, [as] if they are ashamed. This is a major problem and as Bronx professionals, we need to change that perception and make Bronxites proud of their origins once again.” The East Bronx History Forum, a group of local history buffs and enthusiasts, meets once a month for Bronx history meetings. Every month there is a new speaker and topic. In November, Ángel Hernández, Educational Director of The Bronx County Historical Society (BCHS), presented “The Birth of the Bronx,” an hour-long presentation that was accompanied by slides. Hernández, 35, delivered a thorough chronological account of the development of the Bronx, and was amusing and passionate in his telling of tales of the borough and of New York. For more information, please visit He began the presentation in 1609 when Henry Hudson and his ship, the Half Moon, www.bronxhistoricalsociety.org. arrived in Spuyten Duyvil. I was fascinated to learn, for example, that in 1613, Juan Rodríguez, from Santo Domingo, settled in present-day New York. Rodríguez was a free black man traveling with Dutch traders, who would become the first non-native immigrant to settle on the island of Manhattan. This year marked the 400th anniversary of his arrival. A portion of Broadway, from 159th Street to 218th Street, was officially named “Juan Rodríguez Way”. For many moms, this is the case when they choose to “start over” with raising young children all over again, after having done so years, sometimes decades, ago. How can parents nurture both younger and older children as individuals, and also foster their relationship as siblings? Earlier this week, reality television star Evelyn Lozada announced she’s pregnant. According to several news sources, the 37-year-old star is thrilled to be a mom again, but no one seemed to be as excited as Lozada’s 20-year-old daughter, who was the first to broadcast the great news on Instagram. This seems to be case for many parents when they decide to have another child several years down the line. It could be the relationship with your first child’s father didn’t work out, like Lozada, or you were waiting to get a bit more settled before starting again. With a parenting age gap at home (we have both a newborn and a 12-year-old daughter), I thought I might share some of my own hard-earned thoughts on the matter. Here are my top tips for all moms preparing to have their next child in the midst of a gap. Hint: go with l-o-v-e. 1. Your oldest still needs a lot of love, and attention. Once you know a new bundle of joy is on its way, some might argue your older child probably needs just a little more consideration than ever. Just when she thought she’d claimed the lion’s share of your parental attention, here comes a tiny little creature whose needs will seem to constantly usurp her own, and whose every little movement will be fussed over endlessly. Be sure to engage your older child in dialogue about the changes to come and to express your abundant affection for her. Point out how she also used to love to hear you sing, or remind her about the time she took her first steps. Make your older child a part of the process, and the journey. Just be sure to take a lot of deep breaths. 2. Your new baby definitely needs a lot of love. That is not to say you should overlook preparing for and caring for your new baby. You might not think they remember, but research shows babies remember how they felt during those first crucial months. So do not hesitate to revel in preparing for the baby all over again, and deliberating over just the right onesies or stroller, etc. And once the baby has arrived, do not stop from holding him or her close. This is a new time for you as a mother, and for all of you as a family. Celebrate fully, and let your new baby know just how much she is loved. Lots of nuzzling is encouraged. 3. Journalist, model, teacher, poet ― Campanioni has all of these roles on his resumé, and recently added fiction writer to the mix. And his many trips to the Bronx played an oversize role in stirring his imagination. His debut novel Going Down has been garnering rave reviews, and was named as a “must-read” book by the New York Post in October. Born to a Cuban father and Polish mother, Campanioni works still as a model, but said he considers himself a writer first. “I’ve always had a love for language,” remarked Campanioni. “I use all of my different experiences to infuse my writing.” Campanioni completed his master’s degree at Fordham University this year, and currently teaches a fiction writing course at the City University of New York (CUNY). Going Down, based on Campanioni’s own experiences in the fashion industry, tells the story of Chris Selden ― a young man feeling somewhat adrift after college, who becomes a journalist at night and a fashion model during the day. “The fashion and newspaper worlds seem very different on the surface, but those two industries deal with fabrication in some degree,” said Campanioni. As the book’s main character begins to understand those two worlds, he starts to lose his sense of self. “I tried to explore the concept of media representation and the self-fragmentation that Headed up with Going Down “I’ve always had a love for language,” said author Chris Campanioni. Inspired by his Cuban heritage, Campanioni said his intention was to comment on the fashion world from a Latino perspective, since there is a perceived lack of Latino culture in the industry. “I was hoping to create a universal coming of age story,” said Campanioni, who wrote Going Down as a semi-autobiographical tale. After graduating from college, Campanioni acquired a day job as a model and actor, appearing in ads for Dentyne, Axe body spray and Tommy Hilfiger. At night, he worked as a sports copy editor and writer for The StarLedger in New Jersey. “With Going Down, the main character finds himself through his writing,” said Campanioni. “I’d like to think that comes across as organic in the book,” he added. “Because for me, personally, the journey of self-realization was motivated by a desire to write about it.” Though it might not be commonplace for professional journalists to stride a catwalk or model underwear as part of their day, for Campanioni it all made sense, as he always felt he would document his career experiences in a story somehow. “I think they went hand-in-hand for me, the novel and doing these other things,” he remarked. “But if I wrote a straight memoir, it wouldn’t be as interesting a story.” In preparing his novel, which took six years to complete, Campanioni’s life experiences gave him a unique perspective. Rather than writing about fashion or journalism as an outsider looking in, he could draw from a rich array of personal stories. The inquisitiveness and attention to detail he needed as a reporter has fueled Campanioni’s fiction writing. “As a journalist, you’re an observer,” he noted. “I wouldn’t be a fiction writer if I wasn’t a journalist first.” And while models are often viewed as onedimensional, Campanioni would look to turn that notion on its ear with his thriving literary career and current role as college instructor. He also received the 2013 Academy of American Poets Prize for his soon-to-bereleased work, In Conversation. Campanioni said he accomplishes much of his writing on his laptop while commuting on the subway. “I got a lot done on the 4 train heading to the Bronx to go to Fordham,” he quipped. The author is flattered about the accolades his book has attracted, especially praise for his use of different literary styles. “I think I really underestimated the level of attention that readers would pay to it,” he remarked. “People are saying I blend pop culture with avant-garde, and I take that as a huge compliment.” Chris Campanioni’s first novel, Going Down, is available now from Aignos Publishing. The forum, titled “Educate Don’t Incarcerate: Reversing the School to Prison Pipeline,” was organized by, among others, members of the Education from the Inside Out Coalition, Columbia’s Center for Institutional and Social Change, and John Jay College’s Prisoner Reentry Institute. All gathered to present the recommendations, which include improving access to higher education for older inmates and making college and career centers available to prisoners on Rikers Island. “We believe that without high school diplomas and without college, that people won’t have access to jobs that will sustain them and their families over the rest of their lives,” said NYREN member John Gordon. NYREN was founded in 2009 to strategize about increasing access to education for New Yorkers involved in the criminal justice system. It has grown into a coalition of 25 community-based organizations, government agencies, and higher education institutions. There is abundant information online, more informationsharing and new technology that provides near-instant data and references (just be sure to check in with your doctor on the important medical info). This was simply not the case years ago. Use it to your advantage – your whole family will reap the benefits. 9. Don’t let your oldest take care of the baby too much. Although your oldest might be old enough to help, find a way to have them help without also overdoing it. It is bound to cultivate resentment if you constantly rely on your older child to help out, and she might be inclined to blame the baby for her added responsibilities. Better to turn to a trusted family member or friend for structured babysitting time so as to free up an hour or two so that you can spend it – solo – with your older child. Even if you just curl up on the sofa in the next room and watch videos, it will be “your” time. 10. Be thankful. It is sometimes going to feel like you’re doing this for the very first time. Embrace that feeling and enjoy those first milestones with your new baby. Every child is different, and so is every mothering experience. Remember, go with love. Playing herself, Wilkins sat through a job interview during which her perfect grades were glossed over but her criminal history brought up again and again. Ninozca Núñez, who studies business and law at Bronx Community College, called the event “inspirational.” Though never incarcerated herself, Núñez said that hearing the speakers’ stories helped her better understand friends and classmates who had experienced the prison system. Organizers Yasmin Safdie and Tammy Arnstein explained that event was the first of its kind for NYREN. “The turnout was amazing and we had a lot of youth in the room who were directly impacted by the issue,” Safdie said. “Because it’s most important that they’re here, and speaking up, and giving policy recommendations.” Arnstein said the storytelling structure was used to focus on how people are personally transformed by education policies. “We wanted to show that policies do matter, but that there are human beings on the other side of them,” she said. Arnstein, who works as a researcher for Columbia Law School’s Center for Institutional and Social Change, said she was touched by each of the speakers’ stories and could feel the passion in the room. “I felt that I saw that in the audience as well,” she said. De Blasio campaigned with the promise of expanding alternatives to incarceration, especially for juvenile defenders. He also said that he would support legislation that requires private employers to consider job applicants’ full range of skills. (Many currently disqualify job candidates with criminal records outright). Talking Transition, the two-weeklong discussion space for the future of city politics, was installed by a group of foundations – not the mayor’s office. De Blasio, who has visited the tent, was not in attendance on Wednesday night. “Absolutely our next step is: how do we get these seven policy recommendations to the mayor,” Arnstein said. According to the Metropolitan Transportation Authority (MTA), engineers must drop to the maximum allowable capacity of 30 miles per hour, from 70 m.p.h., for trains going along the curve. Rates are often slower for local trains stopping at the Spuyten Duyvil station, though it was not a stop the derailed train was scheduled to make. A freight train carrying refuse had derailed in the same place on July 18th. “There is a problem. I don’t know if it’s this stretch of track of this specific area, but it’s something I’m going to be looking into,” said State Senator Jeff Klein at the site on Sunday. “We need some answers quickly.” Gov. Andrew Cuomo was on the scene shortly after the accident. “It was actually much worse than it looked,” he said on The Today Show. “As the cars were skidding across the ground, they were actually picking up a lot of debris, a lot of dirt and stones and tree limbs were going through the cars so it actually looked worse up close.” It was, he said, “your worst nightmare.” Law enforcement officers were told by the train’s engineer, 46-year-old William Rockefeller, a 15-year Metro-North Railroad veteran, that he hit brakes but they didn’t work. It has since been reported that Rockefeller may have fallen asleep. In a press briefing late Monday, NTSB member Earl Weener confirmed that the train was going 82 miles per hour around the curve, nearly three times the speed limit allowable at the curve. Rockefeller’s cell phone was taken for the investigation, and he has submitted to tests to determine if alcohol or drugs may have played a role. Weener said it was still too soon to determine if the cause of the accident was human error or mechanical error. The curve’s danger was documented over a century ago when two trains burst into flames on Jan. 13, 1882 after a local train headed south from Tarrytown crashed into the rear of a train stalled on the track when the brakes went out after taking the curve, reported Frank Leslie’s Illustrated Newspaper, which covered the wreck at the time. “The cause of the accident is unclear, but it seems there was an almost total absence of an attempt to flag the approaching train,” reported the Illustrated Newspaper then. Two luxury cars telescoped and burst into flames, killing between ten to twelve people. Cole Thompson, an Inwood resident and hobby historian who wrote about the 1882 crash for his blog, My Inwood, was walking his dog Sunday morning at Inwood Hill Park, situated directly across the accident’s site. “I saw many of my neighbors walking out of the park with tears in their eyes,” he said. Thompson heard helicopters overhead and went to observe. “When I saw the passenger cars toppled over by the bend, I immediately thought of the 1882 crash,” he said. “The location was the same. The hairpin turn where the railroad departs the Hudson River and cuts east has been a nightmare for engineers for well over a century.” Thompson said the 1882 train carried 500 passengers, and rescue efforts had been hampered by heavy snowfall. Out for his own walk in the park on Monday, José Espinal, said he was not surprised that an accident had happened at the curve across the river. “One day it was going to happen. You can hear the rails screaming all the time,” he said. Andrew Williams, also of Inwood, also surveyed the accident site from Inwood Hill Park on Monday, and watched as several of the cars were set upright. “I saw all the helicopters hovering over,” he recalled. “But I didn’t know what it was for. All the years I’ve been here I’ve never seen a train derailed.” “In the world of unexpected and random events, this scale is very different, but it’s a huge reminder of how uncontrollable life is,” observed KC Byrnes. She had come to the park’s riverfront to pray for the victims. Robert Jacobs, whose Spuyten Duyvil apartment overlooks the train tracks, said he always knows when the trains are coming by. “I’ve lived here for 20 years, and you can hear the sound as they come around the curve,” he said. The sound generally registers as a loud squeaking, he said. “It’s horrible, horrible that people lost their lives and others were hurt.” Standing on Palisade Avenue on Sunday, yards from the toppled train, Plot said she could think only of the victims. “Their lives are changed forever,” she said. Representatives from the Human Rights Commission reported that in the past decade, 150 complaints of racial discrimination from consumers had been filed against Macy’s. “If 150 people came to a hospital with the same symptoms, we’d call it an epidemic. We would work to fight the disease,” said Bertha Lewis, the President of the Black Institute, who also testified. The alleged working collaboration between the department stores and the NYPD only emphasized the need for more oversight, said Donna Lieberman, the Executive Director of the New York Civil Liberties Union. “If there was ever a reason the City Council was right in passing the Inspector General bill, this is it,” she said, referring to one of two bills in the Community Safety Act, which passed the City Council but was vetoed by Mayor Bloomberg. Some also leveled new allegations against the stores. “These retailers seem to have a back ops,” commented Kirsten John Foy, head of the Brooklyn Chapter of the National Action Network. Foy was referring to the stores’ alleged methods of tracking customers, and to Macy’s private holding cell within the store. “I don’t know if they’re per se illegal, but they’re per se offensive,” said Lieberman of the jails. The Macy’s holding cell was documented in a 2003 New York Times article, which also expounded on other security measures at Macy’s Herald Square store in Manhattan, which includes 100 security officers, four German shepherds, a control room, and hundreds of cameras. The measures are meant to staunch the loss of merchandise to shoplifters; in 2002, the store reportedly lost $15 million to theft. In order to compensate for the loss, civil recover statutes allow retailers to hold shoplifters liable for the cost of catching and detaining them and the property that was stolen—even if the items never left the store. Retailers are allowed to demand five times the value stolen, even if an alleged shoplifter never confessed, or was found guilty in court. “This is a business, just like Macy’s is a business,” charged Sanford Moore, a panelist on KISS-FM’s weekly talk show, “Week in Review.” Moore is involved in the Madison Avenue Project, which aims to end racial discrimination in America’s advertising industry. Among the suggestions made to address the issue were boycotting and divestiture. The City’s pension fund currently invests in Macy’s and Barneys. “Until we mess with how they eat and where they sleep, it’s going to be business as usual,” declared Moore. Reverend Al Sharpton, who also testified, suggested that the stores look to invest in a meaningful way in the community of consumers that has felt maligned. “I’m not talking about chicken dinners at our events,” he said. “I’m talking about real investment.” A bad bargain? Several New York City residents have alleged in recent weeks that they have been victims of bias-based profiling after making purchases, in separate incidents, at high-end retailers Barneys and Macy’s. • On February 28, 2013, 21-year-old Kayla Phillips alleges that she was stopped, frisked, searched and detained by four plainclothes NYPD officers three blocks from Barney’s Madison Avenue flagship store after validly purchasing a designer bag; • On April 24, 2013, 56-year-old Art Palmer alleges that four plainclothes NYPD officers stopped and questioned him three blocks away from Macy’s Herald Square, after he purchased a series of designer shirts and ties; • On April 29, 2013, 19-year-old Trayon Christian alleges that plainclothes NYPD detectives stopped him shortly after leaving Barney’s Madison Avenue flagship store after validly purchasing a designer belt; Christian also alleges that he was asked “how a young black man such as himself could afford such an expensive purchase,” and that he was detained for approximately one hour at a local precinct after showing his receipt, identification and debit card used to make the purchase; • In June, 2013, 29-year-old actor Rob Brown alleges that several plainclothes NYPD officers stopped, questioned and detained him in a holding cell after he validly purchased a designer watch; • Nafeesa Baptiste, former Sales Associate at Barneys, alleges that she, as a store employee, along with African American shoppers, were frequently followed around in the store, and that she was made to show receipts to security for expensive cash purchases made by African American customers.
